        "en": "<p data-HoCid=\"9015350\" data-originallang=\"en\"> I am now prepared to rule on the question of privilege raised on November 17 by the member for <a data-HoCid=\"318013\" href=\"/politicians/kelly-mccauley/\" title=\"Kelly McCauley\">Edmonton West</a> regarding information the Parliamentary Budget Officer requested from the government.</p>\n<p data-HoCid=\"9015351\" data-originallang=\"en\"> The member alleged that a contempt of the House was committed when the government refused to provide in a timely manner information about measures in the 2025 budget, particularly the comprehensive expenditure review. He stated that this refusal was contrary to subsection 79.4(1) of the Parliament of Canada Act and that it compromised the House's ability to hold an informed debate on the budget speech.</p>\n<p data-HoCid=\"9015352\" data-originallang=\"en\">The member pointed out that the Parliamentary Budget Officer had informed the House of this refusal by notifying the Speaker, as provided by section 79.42 of the act. In the member's view, the Parliamentary Budget Officer has a legislative mandate from Parliament to play an essential role in providing objective, non-partisan analysis on behalf of the House. He argued that refusing to provide the information the Parliamentary Budget Officer requested is analogous to ignoring a committee's request for documents.</p>\n<p data-HoCid=\"9015353\" data-originallang=\"en\">The member asked the Chair to find a prima facie question of privilege so the House can discuss the means by which it might defend its authority and the rights of its officers.</p>\n<p data-HoCid=\"9015354\" data-originallang=\"fr\"> In response, the <a data-HoCid=\"319413\" href=\"/politicians/kevin-lamoureux/\" title=\"Kevin Lamoureux\">Parliamentary Secretary to the Leader of the Government in the House of Commons</a> stated that the government is working in good faith to provide the information requested. He explained that the government had requested a delay so that it could meet its obligations to the employees affected by the coming reductions. In his opinion, this slight delay did not interfere with members\u2019 rights, as the budget debate concerned a general approval of the budgetary policy, not detailed measures requiring analysis by the Parliamentary Budget Officer.</p>\n<p data-HoCid=\"9015355\" data-originallang=\"fr\">The member for Saint-Jean echoed the statements of the member for Edmonton West. In her view, the Parliamentary Budget Officer was impeded in his work. Violating a legal obligation to provide a document is an important reason for raising a question of privilege, since such a breach undermines the authority and dignity of the House.</p>\n<p data-HoCid=\"9015356\" data-originallang=\"en\">Let us take a few moments to consider the wording of section 79.42 of the Parliament of Canada Act, because it is central to the matter before us. It provides that:</p>\n<blockquote><p data-HoCid=\"9015357\" data-originallang=\"en\"> If the Parliamentary Budget Officer is of the opinion that he or she has not been provided with free or timely access to information requested under subsection 79.4(1), he or she may so notify the Speaker of the Senate and the Speaker of the House of Commons or any appropriate committee of the Senate, of the House of Commons or of both Houses of Parliament. </p>\n</blockquote><p data-HoCid=\"9015358\" data-originallang=\"en\">Pursuant to this section, the Parliamentary Budget Officer sent a letter to the Speaker, dated November 13, stating that the government would not meet a deadline of November 19, 2025, for providing information about the 2025 budget. A copy of a letter of the comptroller general of Canada confirming that the government would endeavour to provide the information in early December was also obtained. These documents were tabled in the House on Monday, November 17, 2025.</p>\n<p data-HoCid=\"9015359\" data-originallang=\"fr\"> By advising the Speaker of the government's refusal, the Parliamentary Budget Officer made use of the appropriate recourse under the act. Moreover, it appears that one of the purposes of section 79.42, which was put forward during clause-by-clause consideration of Bill <a data-HoCid=\"8874160\" href=\"/bills/42-1/C-44/\" title=\"An Act to implement certain provisions of the budget tabled in Parliament on March 22, 2017 and other measures\">C-44</a>, Budget Implementation Act, 2017, No. 1, was to give the Parliamentary Budget Officer a parliamentary recourse mechanism in order to eliminate the need for court action. The committee evidence of May 29, 2017, also reveals that this section was designed to enable the House to subsequently demand the information itself, if it considered that appropriate. </p>\n<p data-HoCid=\"9015360\" data-originallang=\"fr\">It is true that the Parliamentary Budget Officer helps members better understand and debate financial matters. In the Parliament of Canada Act, Parliament gave the Parliamentary Budget Officer the ability to gain access to any government information that falls within their mandate. However, Parliament did not delegate its constitutional powers relating to the production of papers, under which the question of privilege could be brought forward.</p>\n<p data-HoCid=\"9015361\" data-originallang=\"fr\">When the House is seized of a matter such as the one raised by the Parliamentary Budget Officer, it is up to the House, not the Chair, to decide what response is required and whether to use its powers, which the House has not yet done.</p>\n<p data-HoCid=\"9015362\" data-originallang=\"en\">At this time, the House has not adopted any order for the production of documents. Members have multiple ways of bringing matters such as the one raised by the member for <a data-HoCid=\"318013\" href=\"/politicians/kelly-mccauley/\" title=\"Kelly McCauley\">Edmonton West</a> before the House and having them debated. </p>\n<p data-HoCid=\"9015363\" data-originallang=\"en\">The dispute between the Parliamentary Budget Officer and the government is unfortunate. The Parliamentary Budget Officer's legislative mandate is to support parliamentarians in order to raise the quality of debate and promote greater budget transparency and accountability. The act is clear: The Parliamentary Budget Officer has the right of access to any information that is required for the performance of their mandate. However, it is up to the House to decide how it wishes to respond to this situation. It would therefore be premature for the Chair to make a finding of privilege.</p>\n<p data-HoCid=\"9015364\" data-originallang=\"en\"> I thank all members for their attention. </p>",

Il a expliqu\u00e9 que le gouvernement avait demand\u00e9 un d\u00e9lai afin de respecter ses obligations envers les employ\u00e9s concern\u00e9s par les r\u00e9ductions \u00e0 venir. Selon elle, le directeur parlementaire du budget a \u00e9t\u00e9 entrav\u00e9 dans son travail. Le non-respect d'une obligation l\u00e9gale de lui remettre un document repr\u00e9sente un motif important pour invoquer le privil\u00e8ge puisqu'un tel manquement porterait atteinte \u00e0 l'autorit\u00e9 et \u00e0 la dignit\u00e9 de la Chambre.</p>\n<p data-HoCid=\"9015356\" data-originallang=\"en\">Prenons quelques instants pour lire l'article 79.42 de la Loi sur le Parlement du Canada, puisqu'il s'agit d'un \u00e9l\u00e9ment central de cette affaire. Il stipule:</p>\n<blockquote><p data-HoCid=\"9015357\" data-originallang=\"en\"> S'il est d'avis que son droit de prendre connaissance, gratuitement et en temps opportun, des renseignements demand\u00e9s au titre du paragraphe 79.4(1) n'a pas \u00e9t\u00e9 respect\u00e9, le directeur parlementaire du budget peut porter ce fait \u00e0 la connaissance du pr\u00e9sident du S\u00e9nat et de celui de la Chambre des communes ou de tout comit\u00e9 parlementaire comp\u00e9tent. </p>\n</blockquote><p data-HoCid=\"9015358\" data-originallang=\"en\">En vertu de cet article, une lettre dat\u00e9e du 13 novembre 2025 a \u00e9t\u00e9 transmise au Pr\u00e9sident par le directeur parlementaire du budget pour l'informer que le gouvernement n'allait pas respecter un d\u00e9lai fix\u00e9 au 19 novembre 2025 pour l'obtention de renseignements relatifs au budget 2025. Une copie d'une lettre de la contr\u00f4leure g\u00e9n\u00e9rale du Canada qui confirmait que le gouvernement s'efforcerait de transmettre lesdits renseignements au d\u00e9but de d\u00e9cembre a aussi \u00e9t\u00e9 obtenue. Ces documents ont \u00e9t\u00e9 d\u00e9pos\u00e9s en Chambre le lundi 17 novembre 2025.</p>\n<p data-HoCid=\"9015359\" data-originallang=\"fr\"> En avisant le Pr\u00e9sident du refus du gouvernement, le directeur parlementaire du budget a suivi le recours appropri\u00e9 pr\u00e9vu par la Loi. Il semble d'ailleurs qu'un des objectifs de l'article 79.42 propos\u00e9 pendant l'\u00e9tude article par article du projet de loi <a data-HoCid=\"8874160\" href=\"/bills/42-1/C-44/\" title=\"An Act to implement certain provisions of the budget tabled in Parliament on March 22, 2017 and other measures\">C\u201144</a>, Loi n<sup>o</sup> 1 d'ex\u00e9cution du budget de 2017, \u00e9tait d'offrir au directeur parlementaire du budget un m\u00e9canisme de recours parlementaire pour \u00e9viter de devoir s'adresser aux tribunaux. Les t\u00e9moignages du comit\u00e9 du 29 mai 2017 r\u00e9v\u00e8lent aussi qu'il visait \u00e0 permettre \u00e0 la Chambre d'ensuite, si elle le juge opportun, demander elle-m\u00eame l'information.</p>\n<p data-HoCid=\"9015360\" data-originallang=\"fr\">Il est vrai que le directeur parlementaire du budget aide les d\u00e9put\u00e9s \u00e0 mieux comprendre et d\u00e9battre de questions financi\u00e8res. Le Parlement, par le biais de la Loi sur le Parlement du Canada, a octroy\u00e9 au directeur parlementaire du budget la possibilit\u00e9 de prendre connaissance de tout renseignement gouvernemental relevant de son mandat. En revanche, il n'a pas d\u00e9l\u00e9gu\u00e9 ses pouvoirs constitutionnels en mati\u00e8re de production de documents, en vertu desquels la question de privil\u00e8ge pourrait \u00eatre invoqu\u00e9e.</p>\n<p data-HoCid=\"9015361\" data-originallang=\"fr\">Lorsque la Chambre est saisie d'une affaire comme celle communiqu\u00e9e par le directeur parlementaire du budget, il revient ensuite \u00e0 la Chambre, et non \u00e0 la pr\u00e9sidence, de d\u00e9terminer des suivis n\u00e9cessaires et la possible utilisation de ces pouvoirs, ce que la Chambre n'a pas encore fait.</p>\n<p data-HoCid=\"9015362\" data-originallang=\"en\">\u00c0 l'heure actuelle, aucun ordre de production de documents de la Chambre n'a \u00e9t\u00e9 adopt\u00e9. Il existe plusieurs mani\u00e8res pour les d\u00e9put\u00e9s de saisir la Chambre des questions telles que celle soulev\u00e9e par le d\u00e9put\u00e9 d'<a data-HoCid=\"318013\" href=\"/politicians/kelly-mccauley/\" title=\"Kelly McCauley\">Edmonton West</a>, puis d'en faire un objet de d\u00e9bat.</p>\n<p data-HoCid=\"9015363\" data-originallang=\"en\">Le diff\u00e9rend entre le directeur parlementaire du budget et le gouvernement est regrettable. Son mandat l\u00e9gislatif vise \u00e0 appuyer les parlementaires, afin d'am\u00e9liorer la qualit\u00e9 de leurs d\u00e9bats et de promouvoir une plus grande transparence et responsabilit\u00e9 en mati\u00e8re budg\u00e9taire. La Loi est claire, il a le droit de prendre connaissance de tout renseignement n\u00e9cessaire \u00e0 l'exercice de son mandat. Il appartient \u00e0 la Chambre de d\u00e9cider comment elle veut donner suite \u00e0 cet enjeu. Il serait toutefois pr\u00e9matur\u00e9 pour la pr\u00e9sidence de conclure qu'il y a mati\u00e8re \u00e0 privil\u00e8ge. </p>\n<p data-HoCid=\"9015364\" data-originallang=\"en\">Je remercie tous les d\u00e9put\u00e9s de leur attention.</p>"
