        "en": "<p data-HoCid=\"6348822\" data-originallang=\"en\">Madam Speaker, I am very pleased to speak today as the Parliamentary Secretary to the Minister of Justice in support of moving Bill <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> to the next stage of review.</p>\n<p data-HoCid=\"6348823\" data-originallang=\"en\">I wanted to start by recognizing the work of my colleagues on the Standing Committee on Justice and Human Rights in conducting the clause-by-clause study of Bill C-3 in an expeditious and efficient manner so this important bill can continue to move forward. The version we have before the House today reflects a number of amendments that were adopted by the justice committee, and I will speak to those amendments in due course.</p>\n<p data-HoCid=\"6348824\" data-originallang=\"en\">At the outset, I would like to acknowledge the important work that was done on a previous iteration of this bill during the 42nd Parliament by Ms. Rona Ambrose, the then interim leader of the Conservative Party of Canada. She presented this bill as a private member's bill, which gathered support of all members of Parliament and proceeded expeditiously through the House of Commons at that time. </p>\n<p data-HoCid=\"6348825\" data-originallang=\"en\">It is unfortunate that it was not able to be passed in the 42nd Parliament and, as a result, has ended up before this current Parliament. In light of our belief in and support of this bill, we committed to tabling this legislation as government legislation, which is what we have done. We have seen it through now to this third reading debate.</p>\n<p data-HoCid=\"6348826\" data-originallang=\"fr\">The end goal of Bill <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> is to bolster public confidence, particularly among survivors of sexual assault, that our criminal justice system will treat all individuals fairly. This fundamental objective was unanimously agreed to at second reading by the members, with a number of them speaking about painful personal experiences or their work with survivors of sexual assault.</p>\n<p data-HoCid=\"6348827\" data-originallang=\"fr\">These important statements bear witness to the fact that the sexual assault of women remains a scourge that is an affront to our society's reputation. It is a thorny and pervasive problem that every member of society must take seriously and that requires us to commit to making changes.</p>\n<p data-HoCid=\"6348828\" data-originallang=\"en\">The bill, importantly, is not a panacea to this complex problem. However, Bill <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> represents a small but important step toward transforming our justice system into one in which survivors of sexual assault are treated with dignity and respect at all stages of the justice system process.</p>\n<p data-HoCid=\"6348829\" data-originallang=\"en\">I strongly believe that as parliamentarians it behooves us to take whatever steps we can to move toward a fairer, more just and more accessible criminal justice system. If passed, the bill will enhance public confidence. It will demonstrate to survivors of sexual assault and to all Canadians Parliament's commitment to ensure they are treated fairly and with dignity and respect, and that the proceeding will be decided in accordance with the legal framework provided by Parliament, not influenced by misguided or outdated myths or stereotypes.</p>\n<p data-HoCid=\"6348830\" data-originallang=\"en\">To this end, Bill <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> proposes three key measures relating to judicial education and one relating to the Criminal Code of Canada. Let me outline these provisions.</p>\n<p data-HoCid=\"6348831\" data-originallang=\"en\">First, the Judges Act would be amended to require that to be eligible to be appointed to a provincial superior court, candidates must commit to participate, following their appointment, in education on matters relating to sexual assault law and social context. It is important, and I want to open a parenthesis here, that we are dealing as a federal Parliament with judges that are within federal jurisdiction. The bill does not purport to direct, indicate or outline aspects of judges who are nominated by provincial attorneys general and provincial governments in provincial courts. </p>\n<p data-HoCid=\"6348832\" data-originallang=\"en\">This remains an important point. The notion of sexual assault law and awareness of social context is important for all judges. However, we are committed to leading by example on this important legislation and also continuing to work at federal, provincial and territorial tables to ensure the concept of the importance of this kind of sensitization is imparted upon judges at all levels within Canada and by all provinces.</p>\n<p data-HoCid=\"6348833\" data-originallang=\"en\">The second point is that Bill <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> would amend the Judges Act to provide that sexual assault and social context training established by the Canadian Judicial Council be developed after consultation with survivors, the groups that support them or with other groups and individuals who the council considers appropriate.</p>\n<p data-HoCid=\"6348834\" data-originallang=\"en\">The third key element in Bill <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a>, touching on judicial education, is the provision that would seek to have the Canadian Judicial Council provide an annual report to the <a data-HoCid=\"245291\" href=\"/politicians/david-lametti/\" title=\"David Lametti\">Minister of Justice</a>, for tabling in Parliament, containing details relating to the judicial education offered. This is intended to enhance accountability in the education of sitting judges on these matters and act as an incentive to encourage their participation.</p>\n<p data-HoCid=\"6348835\" data-originallang=\"en\">The final element in Bill <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> is an amendment to the Criminal Code of Canada that would require judges to provide reasons in writing or on the record of proceedings for their decision in sexual assault matters. This provision would help to prevent the misapplication of sexual assault law. It would also help to improve the transparency of sexual assault decisions, because recorded and written decisions can be reviewed. We heard about this extensively during the course of the two iterations of the bill and in the various committee studies. Not only must justice be done but it must be seen to be done, and a record of the proceedings and reasons provided help ensure this critical objective is obtained.</p>\n<p data-HoCid=\"6348836\" data-originallang=\"fr\">Taken together, these amendments would increase the confidence of the public and survivors in our criminal justice system's ability to handle sexual assault matters in a fair and respectful manner, by treating the victims with dignity and, above all, by respecting the law that has been carefully designed to that end.</p>\n<p data-HoCid=\"6348837\" data-originallang=\"fr\">Just as importantly, the bill will send Canadians, especially survivors of sexual assault, the message that Parliament is committed and ready to take action so that all Canadians, especially the most vulnerable, can have confidence in our justice system.</p>\n<p data-HoCid=\"6348838\" data-originallang=\"en\">With this outline in mind, I would like to now turn to the amendments adopted at committee, which I am very happy to say our government is pleased to support.</p>\n<p data-HoCid=\"6348839\" data-originallang=\"en\">The first key amendment made by the committee was to include the terms \u201csystemic racism\u201d and \u201csystemic discrimination\u201d within the idea of social context. Colleagues will recall that in 2017, in its consideration of Bill <a data-HoCid=\"8783394\" href=\"/bills/42-1/C-337/\" title=\"An Act to amend the Judges Act and the Criminal Code (sexual assault)\">C-337</a>, the private member's bill by Ms. Rona Ambrose which I mentioned at the outset, our government proposed an amendment in the House of Commons to include social context education within the scope of that bill in the 42nd Parliament. That amendment ended up being passed unanimously by the House of Commons.</p>\n<p data-HoCid=\"6348840\" data-originallang=\"en\">Adding social context to the judicial education provisions of the old Bill C-337 was considered essential to ensuring that important institutions like the judiciary be able to respond to the realities, needs and concerns of all Canadians. This was intended as explicit recognition that knowledge of substantive law was insufficient on its own. Individuals aspiring to appointment to Canada's superior courts must also be willing to undergo continued education following their appointment to ensure they are sensitive to and informed about the evolving nature of Canadian society, particularly marginalized and vulnerable groups. The language that was chosen was very deliberately drafted to be as encompassing as possible without going down a path of enumerating certain concepts, classes, groups or demographics, which could open up parliamentarians to the possibility of having unwittingly or, indeed, inadvertently excluded some persons or groups.</p>\n<p data-HoCid=\"6348841\" data-originallang=\"en\">This is not an idle concern. As I noted earlier, it is imperative that all Canadians see themselves in the institutions that are created to serve them and support our democracy. It is our role as parliamentarians to ensure this when considering legislation. I also fully expect that this issue will receive careful consideration in the Senate. I look forward to hearing the views of all Canadians and stakeholders to ensure we meet the expectations of Canadians and get this accurate.</p>\n<p data-HoCid=\"6348842\" data-originallang=\"en\">It is important to outline for the members of the House that Canada's superior court judiciary was one of the first in the world to insist on the importance of integrating awareness of social context into all its substantive programming. Going back to 2018, the Canadian Judicial Council explicitly mandated that the professional development of judges include awareness of the social context in which they performed their functions.</p>\n<p data-HoCid=\"6348843\" data-originallang=\"en\"> I will quote from the Canadian Judicial Council's professional development policies and guidelines, which can be found on the council's website. The document states:</p>\n<blockquote><p data-HoCid=\"6348844\" data-originallang=\"en\"> Judges must ensure that personal or societal biases, myths and stereotypes do not influence judicial decision-making. This requires awareness and knowledge of the realities of individuals who appear in court, including an understanding of circumstances related to gender, race, ethnicity, religion, culture, sexual orientation, differing mental or physical abilities, age, socio-economic background, children and family violence. </p>\n</blockquote><p data-HoCid=\"6348845\" data-originallang=\"en\">This being said, the bill is a nuanced bill and an important one. We need to be careful in our approach. I say this because judicial independence is constitutionally protected. If I am allowed to digress a moment, this is an area in which I spent a large amount of my practice litigating in the 15 years I spent as a constitutional lawyer prior to entering Parliament.</p>\n<p data-HoCid=\"6348846\" data-originallang=\"en\">Judicial independence is sacrosanct in any westernized democracy. It contains tenets that are obvious but often go unstated. We cannot influence the financial security of members of the bench. We cannot influence their tenure or seek to remove them of their tenure as a way of exercising influence. We also cannot, as a third hallmark of judicial independence, affect their administrative independence. A tangible example would be the government inserting itself in electing which judges hear what types of cases. That would clearly be offside our notion of democracy, but also offside the charter and the Constitution Act, 1867. </p>\n<p data-HoCid=\"6348847\" data-originallang=\"en\">The administrative component of judicial independence requires judicial control over the training and education of judges. This ensures that judges in our country are not, and are not perceived to be, subject to arbitrary interference or influence in their decision-making. This is a critical concept, and that is why it is entrenched in the Constitution.</p>\n<p data-HoCid=\"6348848\" data-originallang=\"en\"> Bill <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> and its predecessor, Bill <a data-HoCid=\"10620333\" href=\"/bills/43-1/C-5/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-5</a>, were carefully drafted to ensure ultimate judicial control over judicial education.</p>\n<p data-HoCid=\"6348849\" data-originallang=\"en\">I will turn to the amendment that was proposed, expressing Parliament's view that systemic racism and systemic discrimination are included within the idea of social context does not upset this very careful balance. The judiciary would still retain the direction and delivery of judicial education in a manner that fully respects judicial independence. At the same time, Parliament is able to fulfill Canadians' expectations that it has a role in addressing issues of pressing public importance. The issues of systemic racism and systemic discrimination are long standing, particularly with respect to our justice system. However, it goes without saying that public awareness of these concepts has clearly come to the fore during this pandemic.</p>\n<p data-HoCid=\"6348850\" data-originallang=\"en\"> I want to outline two specific instances and thank two specific members who participated in those committee proceedings: the member for <a data-HoCid=\"252608\" href=\"/politicians/greg-fergus/\" title=\"Greg Fergus\">Hull\u2014Aylmer</a> and the member for <a data-HoCid=\"253036\" href=\"/politicians/jaime-battiste/\" title=\"Jaime Battiste\">Sydney\u2014Victoria</a>. They talked eloquently about the pernicious aspects of systemic racism and systemic discrimination vis-\u00e0-vis Black people and indigenous people in Canada. I salute them for their work in with respect to the Black caucus and the indigenous caucus, but also for their contributions at the committee by suggesting amendments that are very targeted but very necessary in expanding out the idea of what social context includes.</p>\n<p data-HoCid=\"6348851\" data-originallang=\"en\">I will now turn to the next set of amendments that were proposed by members of the third party, the Bloc Qu\u00e9b\u00e9cois. Members will note that some of the provisions have been slightly altered. For example, the word \u201cshall\u201d has been changed to \u201cshould\u201d in certain contexts. Minor changes have also been made in relation to other provisions. These amendments were intended to address the possible perception that Parliament, in potentially enacting Bill <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a>, could be purporting to direct the judiciary in respect of judicial education. While this perception, in my view, is improbable, our government is prepared to support these amendments out of an abundance of caution.</p>\n<p data-HoCid=\"6348852\" data-originallang=\"en\"> At this point, I want to briefly bring the attention of members to the government motion to amend Bill <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> at the report stage to correct an unintended inconsistency between the English and the French versions of the amendments proposed by the Bloc members. These amendments are clearly necessary and uncontroversial, and I would expect all hon. members to vote to support them to ensure the amendments intended by the committee are reflected in both our official languages. </p>\n<p data-HoCid=\"6348853\" data-originallang=\"en\">Again, the principle of judicial independence cannot be overstated. As I have emphasized, Parliament's efforts to bolster public confidence in our justice system cannot at the same time undermine this constitutionally protected principle. I fully expect that our esteemed colleagues in the Senate will likewise give this issue their careful attention, and I look forward to that for two reasons: first, because a vigorous public debate is essential to a healthy democracy; and, second, because in this instance such a debate will, in and of itself, serve to reassure the public of the strength of judicial independence in the country and the regard that our Parliament has for this important constitutional principle.</p>\n<p data-HoCid=\"6348854\" data-originallang=\"en\">We are very fortunate in Canada to have one of the most, if not the most, robustly independent and highly regarded judiciaries in the world. This is in no small part due to the availability of the excellent publicly funded but judicially controlled continuing education to which the superior court judiciary has access.</p>\n<p data-HoCid=\"6348855\" data-originallang=\"en\"> Members heard me refer to some of the contours of what that education looked like as of 2018. This is a step in the same vein and direction to ensuring that education continues to be robust and indeed among the best standards, literally on the planet, for the judiciary in a westernized democracy.</p>\n<p data-HoCid=\"6348856\" data-originallang=\"en\">I also applaud those parliamentarians before us who had the foresight to embed the availability of funding for judicial education in the Judges Act, and the Canadian Judicial Council for its leadership in recognizing that professional development and lifelong learning are critical to ensuring a judiciary that is well-educated, professional and, indeed critically, independent.</p>\n<p data-HoCid=\"6348857\" data-originallang=\"en\">The commitment of the Canadian Judicial Council to excellent continuing education is manifested in its professional development policies and guidelines, which I know explicitly recognize that the public rightfully expects judges to be competent and knowledgeable in the law. Bill <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> seeks only to support and build on this notion and thereby move toward a better, more humane and more inclusive justice system. </p>\n<p data-HoCid=\"6348858\" data-originallang=\"en\">I am going to conclude my remarks where I started: by acknowledging the challenges faced by survivors of sexual assault. Those challenges go well beyond the scope of the bill. We must recognize that in order to effect meaningful and substantial changes to the manner in which survivors of sexual assault are treated in our criminal justice system, every actor in the justice system, and every level of government, must take responsibility. That is what I referred to regarding the passage of the bill in the context of working with federal, provincial and territorial partners, and ensuring that the actions we may take through the bill, with respect to judges appointed to Superior Courts, are replicated in actions we may see, and hope to see, in provincial appointments to the bench.</p>\n<p data-HoCid=\"6348859\" data-originallang=\"en\">It also goes without saying that the bill would not have had its genesis without the leadership of Ms. Rona Ambrose. It is important to note that when a member of the official opposition presents a bill that the government gets behind, it truly demonstrates the non-partisan nature of what we are speaking about when we speak about sexual assault law, the importance of ensuring public confidence in our judiciary, social context, and confronting systemic racism and systemic discrimination. These concepts should never be partisan. I am thankful that in the context of the bill in its current iteration, partisanship has not entered into the discussion. This is representative of how important these concepts are for all of us as parliamentarians. I would urge all members to take the small but important next step to vote to move the bill into the next phase so that it can be addressed by the Senate. On that note, I conclude my remarks.</p>",

Cependant, le projet de loi <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> repr\u00e9sente un pas, petit mais important, vers la transformation du syst\u00e8me de justice canadien en un syst\u00e8me au sein duquel les victimes d'agression sexuelle sont trait\u00e9es avec dignit\u00e9 et respect \u00e0 toutes les \u00e9tapes des proc\u00e9dures judiciaires. </p>\n<p data-HoCid=\"6348829\" data-originallang=\"en\">J'ai la ferme conviction que, \u00e0 titre de parlementaires, nous avons le devoir de prendre toutes les mesures possibles pour rendre le syst\u00e8me de justice p\u00e9nale plus \u00e9quitable, plus juste et plus accessible. La notion du droit relatif aux agressions sexuelles et de la sensibilisation au contexte social est importante pour tous les juges. Toutefois, nous sommes r\u00e9solus \u00e0 donner l'exemple en ce qui concerne cette mesure l\u00e9gislative importante et \u00e0 continuer \u00e0 travailler \u00e0 l'\u00e9chelle f\u00e9d\u00e9rale, provinciale et territoriale pour faire comprendre aux juges de toutes les juridictions au Canada et dans toutes les provinces l'importance de ce type de sensibilisation.</p>\n<p data-HoCid=\"6348833\" data-originallang=\"en\">Deuxi\u00e8mement, le projet de loi <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> modifierait la Loi sur les juges afin d'exiger que le Conseil canadien de la magistrature \u00e9labore la formation sur le droit relatif aux agressions sexuelles et au contexte social en consultation avec des personnes ayant surv\u00e9cu \u00e0 une agression sexuelle, les groupes qui les appuient et d'autres groupes et personnes que le Conseil estime indiqu\u00e9s.</p>\n<p data-HoCid=\"6348834\" data-originallang=\"en\">Le troisi\u00e8me \u00e9l\u00e9ment cl\u00e9 du projet de loi <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a>, \u00e0 propos de la participation des juges \u00e0 des s\u00e9ances de formation, est l'obligation pour le Conseil canadien de la magistrature de fournir au <a data-HoCid=\"245291\" href=\"/politicians/david-lametti/\" title=\"David Lametti\">ministre de la Justice</a>, pour qu'il le d\u00e9pose au Parlement, un rapport annuel donnant des pr\u00e9cisions sur la formation suivie par les juges. Cette obligation vise \u00e0 mieux rendre compte de la sensibilisation des juges en exercice \u00e0 ces questions et \u00e0 encourager leur participation.</p>\n<p data-HoCid=\"6348835\" data-originallang=\"en\">Enfin, le dernier \u00e9l\u00e9ment cl\u00e9 du projet de loi <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> est une modification au Code criminel du Canada afin d'obliger les juges \u00e0 motiver leurs d\u00e9cisions lors des proc\u00e8s pour agressions sexuelles, que ce soit par \u00e9crit ou dans le compte rendu des d\u00e9lib\u00e9rations. Cette modification contribuerait \u00e0 pr\u00e9venir une mauvaise application des dispositions juridiques li\u00e9es aux agressions sexuelles. Elle rendrait en outre plus transparentes les d\u00e9cisions dans les affaires d'agression sexuelle, car il est toujours plus facile de passer une chose en revue quand elle a \u00e9t\u00e9 \u00e9crite et consign\u00e9e. Nous l'avons entendu en long et en large lors des d\u00e9bats sur les deux versions pr\u00e9c\u00e9dentes du projet de loi et lors des diverses \u00e9tudes en comit\u00e9. Il ne faut pas seulement qu'il y ait justice, mais aussi qu'il y ait apparence de justice, et le fait de consigner les justifications des d\u00e9cisions par \u00e9crit ou dans le compte rendu des d\u00e9lib\u00e9rations contribuerait \u00e0 r\u00e9aliser cet objectif primordial.</p>\n<p data-HoCid=\"6348836\" data-originallang=\"fr\">Ensemble, ces modifications viseraient \u00e0 accro\u00eetre la confiance du public et des survivants en la capacit\u00e9 de notre syst\u00e8me de justice p\u00e9nale d'instruire les affaires d'agression sexuelle de mani\u00e8re \u00e9quitable et respectueuse, en traitant les victimes avec dignit\u00e9 et, surtout, en respectant la loi qui a \u00e9t\u00e9 soigneusement \u00e9labor\u00e9e \u00e0 cette fin.</p>\n<p data-HoCid=\"6348837\" data-originallang=\"fr\"> De mani\u00e8re tout aussi importante, le projet de loi enverra \u00e0 tous les Canadiens, et particuli\u00e8rement aux personnes ayant surv\u00e9cu \u00e0 une agression sexuelle, le message selon lequel le Parlement est d\u00e9termin\u00e9 et pr\u00eat \u00e0 agir pour que l'ensemble de la population canadienne, surtout les personnes les plus vuln\u00e9rables, puisse avoir confiance en notre syst\u00e8me de justice.</p>\n<p data-HoCid=\"6348838\" data-originallang=\"en\">Ceci \u00e9tant dit, j'aimerais maintenant aborder les amendements qui ont \u00e9t\u00e9 adopt\u00e9s par le comit\u00e9, et qui, je suis tr\u00e8s heureux de le dire, sont appuy\u00e9s par le gouvernement.</p>\n<p data-HoCid=\"6348839\" data-originallang=\"en\">Le premier amendement cl\u00e9 que le comit\u00e9 a apport\u00e9 est d'inclure les termes \u00ab racisme syst\u00e9mique \u00bb et \u00ab discrimination syst\u00e9mique \u00bb dans le concept du contexte social. La Chambre se rappellera s\u00fbrement qu'en 2017, lors des d\u00e9bats sur le projet de loi <a data-HoCid=\"8783394\" href=\"/bills/42-1/C-337/\" title=\"An Act to amend the Judges Act and the Criminal Code (sexual assault)\">C-337</a>, c'est-\u00e0-dire le projet de loi \u00e9manant de la d\u00e9put\u00e9e Rona Ambrose, comme je l'ai indiqu\u00e9 d'entr\u00e9e de jeu, le gouvernement avait propos\u00e9 un amendement pour inclure la sensibilisation au contexte social dans la port\u00e9e du projet de loi \u00e0 l'\u00e9tude durant la 42<sup>e</sup> l\u00e9gislature. Cet amendement avait finalement \u00e9t\u00e9 adopt\u00e9 \u00e0 l'unanimit\u00e9 par la Chambre.</p>\n<p data-HoCid=\"6348840\" data-originallang=\"en\">L'inclusion du contexte social dans les dispositions sur la formation des juges de l'ancien projet de loi C-337 \u00e9tait jug\u00e9e essentielle pour garantir que des institutions importantes comme la magistrature sont en mesure de r\u00e9pondre aux r\u00e9alit\u00e9s, aux besoins et aux inqui\u00e9tudes de tous les Canadiens. Cette initiative visait \u00e0 reconna\u00eetre explicitement que la connaissance du droit substantiel est insuffisante en soi. En effet, les candidats potentiels aux cours sup\u00e9rieures doivent \u00eatre pr\u00eats \u00e0 suivre une formation continue apr\u00e8s leur nomination afin de s'assurer qu'ils sont conscients et inform\u00e9s de la nature \u00e9volutive de la soci\u00e9t\u00e9 canadienne, plus particuli\u00e8rement des groupes marginalis\u00e9s et vuln\u00e9rables. On a tr\u00e8s d\u00e9lib\u00e9r\u00e9ment choisi un libell\u00e9 qui est le plus inclusif possible, sans pour autant \u00e9num\u00e9rer des concepts, des cat\u00e9gories et des groupes, notamment des groupes d\u00e9mographiques, \u00e9liminant ainsi le risque que les parlementaires excluent involontairement ou par inadvertance certaines personnes ou certains groupes.</p>\n<p data-HoCid=\"6348841\" data-originallang=\"en\">Il ne s'agit pas l\u00e0 d'une pr\u00e9occupation sans fondement. Comme je l'ai mentionn\u00e9 plus t\u00f4t, il est imp\u00e9ratif que tous les Canadiens se retrouvent dans les institutions cr\u00e9\u00e9es pour les servir et appuyer notre d\u00e9mocratie. Les parlementaires doivent veiller \u00e0 ce que ce soit le cas quand ils examinent des mesures l\u00e9gislatives. Par ailleurs, je m'attends pleinement \u00e0 ce que cette question soit \u00e9tudi\u00e9e attentivement par le S\u00e9nat. Je suis impatient d'entendre les opinions de tous les Canadiens et intervenants pour faire en sorte de r\u00e9pondre aux attentes des Canadiens et de bien faire les choses.</p>\n<p data-HoCid=\"6348842\" data-originallang=\"en\">Il convient de souligner pour la gouverne des d\u00e9put\u00e9s que la magistrature des cours sup\u00e9rieures du Canada est l'une des premi\u00e8res au monde \u00e0 insister sur l'importance d'int\u00e9grer la sensibilisation au contexte social \u00e0 tous ses programmes de formation pour les juges. En 2018, le Conseil canadien de la magistrature a explicitement ordonn\u00e9 que le perfectionnement professionnel des juges comprenne la sensibilisation au contexte social dans lequel ils exercent leurs fonctions. </p>\n<p data-HoCid=\"6348843\" data-originallang=\"en\">J'aimerais citer un passage des politiques et lignes directrices sur le perfectionnement professionnel du Conseil canadien de la magistrature, qui peuvent \u00eatre consult\u00e9es sur le site Web du Conseil. Le document dit ceci:</p>\n<blockquote><p data-HoCid=\"6348844\" data-originallang=\"en\"> Les juges doivent veiller \u00e0 ce que les pr\u00e9jug\u00e9s personnels ou soci\u00e9taux, les mythes et les st\u00e9r\u00e9otypes n\u2019influencent pas la prise de d\u00e9cisions judiciaires. Pour cela, il est n\u00e9cessaire de conna\u00eetre les r\u00e9alit\u00e9s des personnes qui comparaissent devant le tribunal et d\u2019y \u00eatre sensibilis\u00e9, notamment de comprendre les circonstances li\u00e9es au genre, \u00e0 la race, \u00e0 l\u2019origine ethnique, \u00e0 la religion, \u00e0 la culture, \u00e0 l\u2019orientation sexuelle, aux capacit\u00e9s mentales ou physiques diff\u00e9rentes, \u00e0 l\u2019\u00e2ge, aux ant\u00e9c\u00e9dents socio\u00e9conomiques, aux enfants et \u00e0 la violence familiale. </p>\n</blockquote><p data-HoCid=\"6348845\" data-originallang=\"en\">Cela dit, l'important projet de loi dont il est question comprend des nuances. Nous devons nous y prendre comme il faut. Je dis cela parce que l'ind\u00e9pendance judiciaire est prot\u00e9g\u00e9e par la Constitution. Si je peux me permettre une petite parenth\u00e8se, avant d'\u00eatre \u00e9lu au Parlement, j'ai pass\u00e9 une grande partie de mes 15 ans de pratique en tant qu'avocat de droit constitutionnel \u00e0 plaider dans ce domaine. </p>\n<p data-HoCid=\"6348846\" data-originallang=\"en\">L'ind\u00e9pendance des juges est sacr\u00e9e dans toutes les d\u00e9mocraties occidentales. Elle repose sur des principes \u00e9vidents, mais qu'on passe souvent sous silence. On ne peut influencer la s\u00e9curit\u00e9 financi\u00e8re des membres de la magistrature. On ne peut influencer leur mandat ou chercher \u00e0 les faire d\u00e9mettre de leurs fonctions dans le but d'exercer une forme d'influence. Enfin, on ne peut toucher \u00e0 l'ind\u00e9pendance administrative des juges. Par exemple, le gouvernement ne peut s'ing\u00e9rer dans le processus qui consiste \u00e0 d\u00e9terminer quel juge entend quel type d'affaires. Cela contreviendrait clairement \u00e0 la notion que nous avons de la d\u00e9mocratie, sans parler de la Charte et de la Loi constitutionnelle de 1867.</p>\n<p data-HoCid=\"6348847\" data-originallang=\"en\">Le volet administratif de l'ind\u00e9pendance des juges pr\u00e9voit que c'est l'appareil judiciaire qui contr\u00f4le la formation et l'\u00e9ducation des juges. Cela permet de s'assurer que le processus d\u00e9cisionnel des juges de notre pays n'est pas \u2014 et n'est pas consid\u00e9r\u00e9 \u00eatre \u2014 l'objet d'ing\u00e9rence ou d'influence arbitraires. Il s'agit l\u00e0 d'un concept fondamental, et c'est pourquoi il est inscrit dans la Constitution. </p>\n<p data-HoCid=\"6348848\" data-originallang=\"en\">Le projet de loi <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> et son pr\u00e9d\u00e9cesseur, le projet de loi <a data-HoCid=\"10620333\" href=\"/bills/43-1/C-5/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-5</a>, ont \u00e9t\u00e9 soigneusement r\u00e9dig\u00e9s afin que, au bout du compte, ce soit l'appareil judiciaire qui contr\u00f4le la formation des juges. </p>\n<p data-HoCid=\"6348849\" data-originallang=\"en\">Je vais parler maintenant de l'amendement propos\u00e9. Il refl\u00e8te l'avis du Parlement selon lequel le racisme et la discrimination syst\u00e9miques devraient \u00eatre compris dans la notion de contexte social, sans toutefois perturber le d\u00e9licat \u00e9quilibre qui doit \u00eatre maintenu. L'appareil judiciaire s'occuperait quand m\u00eame de concevoir et d'offrir la formation d'une mani\u00e8re qui respecte pleinement l'ind\u00e9pendance de la magistrature. Le Parlement peut cependant r\u00e9pondre aux attentes des Canadiens en s'effor\u00e7ant de r\u00e9soudre des probl\u00e8mes urgents d'int\u00e9r\u00eat public. Les probl\u00e8mes de racisme et de discrimination syst\u00e9miques subsistent depuis longtemps, notamment au sein du syst\u00e8me de justice. Cependant, il va sans dire que la sensibilisation du public \u00e0 ces concepts est une question qui a \u00e9t\u00e9 particuli\u00e8rement mise en \u00e9vidence pendant cette pand\u00e9mie.</p>\n<p data-HoCid=\"6348850\" data-originallang=\"en\">Je tiens \u00e0 souligner deux exemples particuliers et \u00e0 remercier deux d\u00e9put\u00e9s qui ont particip\u00e9 aux d\u00e9lib\u00e9rations du comit\u00e9, soit le d\u00e9put\u00e9 de <a data-HoCid=\"252608\" href=\"/politicians/greg-fergus/\" title=\"Greg Fergus\">Hull\u2014Aylmer</a> et le d\u00e9put\u00e9 de <a data-HoCid=\"253036\" href=\"/politicians/jaime-battiste/\" title=\"Jaime Battiste\">Sydney\u2014Victoria</a>. Ils ont parl\u00e9 avec \u00e9loquence des aspects pernicieux du racisme et de la discrimination syst\u00e9miques envers les Noirs et les Autochtones du Canada. Je les f\u00e9licite du travail qu'ils ont r\u00e9alis\u00e9 dans le cadre du caucus des parlementaires noirs et du caucus des parlementaires autochtones, mais aussi d'avoir contribu\u00e9 \u00e0 l'\u00e9tude du comit\u00e9 en proposant des amendements tr\u00e8s cibl\u00e9s mais absolument n\u00e9cessaires afin de pr\u00e9ciser la notion de contexte social.</p>\n<p data-HoCid=\"6348851\" data-originallang=\"en\">Je passe maintenant \u00e0 une autre s\u00e9rie d'amendements propos\u00e9s par les d\u00e9put\u00e9s du troisi\u00e8me parti, le Bloc qu\u00e9b\u00e9cois. Les d\u00e9put\u00e9s remarqueront des changements mineurs, par exemple le remplacement du mot \u00ab doit \u00bb par \u00ab devrait \u00bb dans certains contextes. On a aussi apport\u00e9 de l\u00e9g\u00e8res modifications \u00e0 d'autres dispositions. Ces amendements visent \u00e0 \u00e9viter une interpr\u00e9tation selon laquelle en adoptant le projet de loi <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a>, le Parlement donnerait des ordres au pouvoir judiciaire au sujet de la formation des juges. Bien qu'une telle perception me semble improbable, le gouvernement est pr\u00eat \u00e0 accepter ces amendements par souci de prudence.</p>\n<p data-HoCid=\"6348852\" data-originallang=\"en\"> Je souhaite aussi attirer l'attention des d\u00e9put\u00e9s sur la motion du gouvernement qui vise \u00e0 amender le projet de loi <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> \u00e0 l'\u00e9tape du rapport afin de corriger des diff\u00e9rences entre les versions anglaise et fran\u00e7aise des amendements propos\u00e9s par les d\u00e9put\u00e9s du Bloc. De toute \u00e9vidence, ces amendements sont n\u00e9cessaires et ne pr\u00eatent pas \u00e0 controverse. J'esp\u00e8re donc que tous les d\u00e9put\u00e9s les appuieront afin que les amendements souhait\u00e9s par le comit\u00e9 soient faits dans les deux langues officielles. </p>\n<p data-HoCid=\"6348853\" data-originallang=\"en\">Encore une fois, on ne saurait trop insister sur l'importance du principe de l'ind\u00e9pendance judiciaire. Comme je l'ai soulign\u00e9, les efforts du Parlement pour renforcer la confiance du public dans le syst\u00e8me de justice ne doivent pas en m\u00eame temps miner ce principe qui est prot\u00e9g\u00e9 par la Constitution. Je suis certain que nos estim\u00e9s coll\u00e8gues du S\u00e9nat accorderont \u00e0 cette question toute l'attention qu'elle m\u00e9rite, ce que j'attends avec impatience, pour deux raisons: premi\u00e8rement, parce qu'un vigoureux d\u00e9bat public est essentiel \u00e0 une d\u00e9mocratie saine; deuxi\u00e8mement, parce que dans ce cas-ci, le d\u00e9bat en soi servira \u00e0 rassurer le public quant \u00e0 la force de l'ind\u00e9pendance judiciaire au Canada et \u00e0 la consid\u00e9ration du Parlement pour cet important principe constitutionnel.</p>\n<p data-HoCid=\"6348854\" data-originallang=\"en\">Nous sommes tr\u00e8s chanceux au Canada d'avoir l'un des syst\u00e8mes judiciaires les plus vigoureusement ind\u00e9pendants et les plus respect\u00e9s au monde, sinon le plus ind\u00e9pendant et le plus respect\u00e9, et ce, en grande partie gr\u00e2ce \u00e0 l'acc\u00e8s, pour la magistrature des cours sup\u00e9rieures, \u00e0 une excellente formation continue financ\u00e9e par l'\u00c9tat, mais relevant du judiciaire.</p>\n<p data-HoCid=\"6348855\" data-originallang=\"en\">Les d\u00e9put\u00e9s m'ont entendu parler de certains aspects de cette formation continue depuis 2018. Il s'agit d'un autre pas dans la m\u00eame direction, pour veiller \u00e0 ce que la formation continue d'\u00eatre rigoureuse et de r\u00e9pondre aux meilleures normes dans le monde pour la magistrature d'une d\u00e9mocratie occidentalis\u00e9e.</p>\n<p data-HoCid=\"6348856\" data-originallang=\"en\">J\u2019applaudis \u00e9galement les parlementaires qui ont eu la pr\u00e9voyance d\u2019inscrire dans la Loi sur les juges la disponibilit\u00e9 de fonds pour la formation des juges, et le Conseil canadien de la magistrature pour le leadership dont il a fait preuve en reconnaissant que le perfectionnement professionnel et l\u2019\u00e9ducation permanente sont essentiels pour assurer une magistrature bien form\u00e9e, professionnelle et, bien entendu, ind\u00e9pendante.</p>\n<p data-HoCid=\"6348857\" data-originallang=\"en\">L\u2019engagement du Conseil canadien de la magistrature en faveur d\u2019une excellente formation continue s\u2019exprime dans ses politiques et lignes directrices en mati\u00e8re de perfectionnement professionnel, qui, je le sais, reconnaissent explicitement que le public s\u2019attend \u00e0 juste titre \u00e0 ce que les juges soient comp\u00e9tents et qu'ils connaissent bien la loi. Le projet de loi <a data-HoCid=\"10867694\" href=\"/bills/43-2/C-3/\" title=\"An Act to amend the Judges Act and the Criminal Code\">C-3</a> ne vise qu\u2019\u00e0 appuyer et consolider cette notion et \u00e0 progresser ainsi vers un meilleur syst\u00e8me de justice, plus humain et plus inclusif.</p>\n<p data-HoCid=\"6348858\" data-originallang=\"en\">Je vais conclure mes propos de la m\u00eame fa\u00e7on que j\u2019ai commenc\u00e9, en reconnaissant les d\u00e9fis que doivent relever les personnes ayant surv\u00e9cu \u00e0 une agression sexuelle. Ces d\u00e9fis vont bien au-del\u00e0 de la port\u00e9e du projet de loi. Nous devons reconna\u00eetre que pour apporter des changements significatifs et profonds au traitement r\u00e9serv\u00e9 \u00e0 ces personnes dans notre syst\u00e8me de justice p\u00e9nale, chaque acteur du syst\u00e8me de justice et chaque ordre de gouvernement doit assumer ses responsabilit\u00e9s. C\u2019est ce \u00e0 quoi j\u2019ai fait allusion concernant l\u2019adoption du projet de loi, la collaboration avec les partenaires f\u00e9d\u00e9raux, provinciaux et territoriaux, pour veiller \u00e0 ce que les mesures que nous pourrions prendre par l\u2019entremise du projet de loi en ce qui concerne les juges nomm\u00e9s aux cours sup\u00e9rieures soient reproduites dans les mesures que nous pouvons et esp\u00e9rons voir dans les nominations provinciales \u00e0 la magistrature.</p>\n<p data-HoCid=\"6348859\" data-originallang=\"en\">Il va \u00e9galement de soi que le projet de loi n\u2019aurait pas vu le jour sans le leadership de Mme Rona Ambrose. Chaque fois qu\u2019un d\u00e9put\u00e9 de l\u2019opposition officielle pr\u00e9sente un projet de loi appuy\u00e9 par le gouvernement, nous pouvons prendre conscience de la nature non partisane de nos discussions sur le droit relatif aux agressions sexuelles, l\u2019importance de maintenir la confiance du public envers notre syst\u00e8me judiciaire, le contexte social et la lutte contre le racisme et la discrimination syst\u00e9miques. Ces concepts ne devraient jamais tomber dans la partisanerie. Je suis reconnaissant que, dans le contexte de la version actuelle du projet de loi, la discussion ne soit pas tomb\u00e9e dans la partisanerie. Cela montre bien l\u2019importance de ces concepts pour nous tous \u00e0 titre de parlementaires. J\u2019invite tous les d\u00e9put\u00e9s \u00e0 passer \u00e0 l\u2019\u00e9tape suivante, petite mais importante, en votant pour faire passer le projet de loi \u00e0 la prochaine \u00e9tape: l\u2019examen par le S\u00e9nat.
