"en": "<p data-HoCid=\"5884362\" data-originallang=\"en\">Mr. Speaker, I am pleased to participate in this third reading debate on Bill <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a>, a piece of legislation that has been described as the culmination of over 10 years of parliamentary work on the important issue of organ trafficking.</p>\n<p data-HoCid=\"5884363\" data-originallang=\"en\"> It is worth recalling that four bills dealing with this issue were introduced in Parliament prior to Bill <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a>, some of which were sponsored by the member for <a data-HoCid=\"214176\" href=\"/politicians/borys-wrzesnewskyj/\" title=\"Borys Wrzesnewskyj\">Etobicoke Centre</a> and by the former minister of justice, Irwin Cotler. </p>\n<p data-HoCid=\"5884364\" data-originallang=\"en\">This goes to show that combatting the scourge of organ trafficking and protecting vulnerable people from whom organs are being forcibly removed are serious concerns that we all share. That applies to my constituents in Parkdale\u2014High Park and Canadians around the country who are rightfully concerned about protecting those who are vulnerable to predatory organ harvesting activities in Asia and around the world.</p>\n<p data-HoCid=\"5884365\" data-originallang=\"en\">There is no question that there exists a serious organ shortage, both in Canada and abroad. The organ shortage affects family members and neighbours, and it understandably leaves many feeling vulnerable about their health. However, Bill <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a> provides an important reminder to Canadians that capitalizing on the vulnerability of organ donors abroad is not an acceptable response to this issue. That is why our government is proud to support this important bill, with targeted amendments that make it better achieve its objectives.</p>\n<p data-HoCid=\"5884366\" data-originallang=\"fr\"> Bill <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a> proposes to strengthen Canada\u2019s response to organ trafficking by creating four new Criminal Code offences related to this conduct, extending extraterritorial jurisdiction over these new offences and amending the Immigration and Refugee Protection Act to add a new ground of inadmissibility to Canada for having engaged in conduct that would be an offence under the bill.</p>\n<p data-HoCid=\"5884367\" data-originallang=\"fr\">More specifically, Bill <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a> proposes to criminalize all persons involved in the removal of an organ for transplant knowing that, or being reckless as to whether, the organ was removed without the informed consent of the donor or a substitute decision-maker. </p>\n<p data-HoCid=\"5884368\" data-originallang=\"en\">Organ trafficking involves a range of conduct committed by various players. Accordingly, the proposed offences seeking to address this conduct would capture brokers who connect prospective organ recipients with prospective organ donors, medical professionals who extract organs illegally for transplantation, and persons who purchase organs for their own use, as well as those who assist them.</p>\n<p data-HoCid=\"5884369\" data-originallang=\"en\">The bill also proposes to criminalize the commodification of human organs more specifically by enacting a new financial transaction offence. This offence would prohibit participating in, or facilitating the obtaining of, an organ for transplant knowing that, or being reckless as to whether, it was obtained for consideration, whether the donor consented or not to the organ removal.</p>\n<p data-HoCid=\"5884370\" data-originallang=\"fr\">With respect to the meaning and scope of the term \u201cfor consideration\u201d, according to the study of the bill by the House of Commons Standing Committee on Foreign Affairs and International Development, this term targets the purchasing of human organs.</p>\n<p data-HoCid=\"5884371\" data-originallang=\"en\">The bill would also extend extraterritorial application to these offences, which means that Canadian citizens or permanent residents who go abroad to purchase an organ for transplant, also known as \u201ctransplant tourism\u201d, or commit any of the new offences abroad, could then be prosecuted in Canada.</p>\n<p data-HoCid=\"5884372\" data-originallang=\"en\">As illegal organ trafficking is an international issue that mostly targets impoverished individuals in foreign countries, the extraterritorial application of these offences will help protect vulnerable people abroad, including those who may be induced to sell their own organs out of financial desperation. </p>\n<p data-HoCid=\"5884373\" data-originallang=\"en\">Consistent with the objectives of the bill, these new provisions would help deter Canadians and permanent residents from contributing to organ trafficking by fuelling the demand through transplant tourism.</p>\n<p data-HoCid=\"5884374\" data-originallang=\"fr\">As mentioned during second reading debate, the extraterritorial application of the new organ trafficking offences is necessary given the fact that much of the conduct targeted by the bill occurs abroad.</p>\n<p data-HoCid=\"5884375\" data-originallang=\"en\">Bill <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a> also proposes to add a new ground of inadmissibility to section 35 of the Immigration and Refugee Protection Act, for having engaged in conduct that would constitute an offence under the bill. As a result, a permanent resident or foreign national could be found inadmissible to Canada for having engaged in one of the new organ trafficking offences. This amendment sends a clear signal that purchasing any organs, including from vulnerable people abroad, is serious criminal conduct here in Canada.</p>\n<p data-HoCid=\"5884376\" data-originallang=\"en\">I would like to address some of the amendments that were made to the bill during the committee stage.</p>\n<p data-HoCid=\"5884377\" data-originallang=\"en\">On February 27 of this year, the House committee adopted an amendment to clarify that a substitute decision-maker can provide consent on behalf of an organ donor to provide greater precision around some of the criminal law language used in the bill.</p>\n<p data-HoCid=\"5884378\" data-originallang=\"en\">The committee also removed two amendments that had been passed in the Senate on October 23, 2018. It removed the proposed definition of \u201cinformed consent\u201d, as well as the duty for physicians to report all organ transplants to an authority designated by order of the Governor in Council.</p>\n<p data-HoCid=\"5884379\" data-originallang=\"fr\"> As previously highlighted during second reading debate, the proposed definition of \u201cinformed consent\u201d presented challenges. The term \u201cinformed consent\u201d has clear meaning in provincial and territorial health law. This is one of the reasons why it was not defined in the Criminal Code as part of the medical assistance in dying reforms in 2016. Therefore, in order to avoid statutory interpretation issues and ensure clarity and consistency in the Criminal Code, the definition was removed.</p>\n<p data-HoCid=\"5884380\" data-originallang=\"fr\">The proposed duty to report for physicians also raised concerns. As recalled before the House committee, doctor-patient confidentiality is sacrosanct. It is a fundamental principle that allows people to feel safe about disclosing any health issues they may be facing to their doctor. It encourages people to safeguard their own health and seek treatment, where necessary, in order to get better. It is important to protect this relationship between patients and their physicians.</p>\n<p data-HoCid=\"5884381\" data-originallang=\"fr\"> Furthermore, the duty to report for physicians applied to all transplants. For these reasons, among others, the duty to report for physicians was also removed.</p>\n<p data-HoCid=\"5884382\" data-originallang=\"en\">I pause to note that since the committee's important study of this bill, the Government of Nova Scotia has passed legislation that presumes consent for organ donation while retaining the ability for individuals to opt out of the organ donation regime. I want to clarify that I respect the choices individual provinces and territories make to try to protect the health and safety of Canadians, and that nothing in Bill <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a> is intended to interfere with provincial efforts in this important regard. We look forward to seeing the results of this legislation for the people of the province of Nova Scotia.</p>\n<p data-HoCid=\"5884383\" data-originallang=\"en\">As members know, this piece of legislation is the result of successive efforts made by parliamentarians in both Houses to address what is truly a horrendous crime that continues to exploit vulnerable individuals right around the planet. The provisions contained in Bill <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a> will allow Canada to demonstrate leadership in the fight against organ trafficking and in the protection of international human rights.</p>\n<p data-HoCid=\"5884384\" data-originallang=\"en\"> I would urge all members of this House to support Bill <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a> in order to ensure that its proposed legislative measures become law.</p>",

Cela dit, le projet de loi <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a> est aussi l\u00e0 pour rappeler aux Canadiens qu'il est inacceptable de profiter de la vuln\u00e9rabilit\u00e9 des donneurs d'organes \u00e0 l'\u00e9tranger pour rem\u00e9dier \u00e0 la situation. C'est pourquoi le gouvernement aura le plaisir d'appuyer ce projet de loi aussit\u00f4t qu'il aura fait l'objet d'amendements cibl\u00e9s lui permettant d'atteindre plus efficacement ses objectifs.</p>\n<p data-HoCid=\"5884366\" data-originallang=\"fr\">Le projet de loi <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a> propose de renforcer la r\u00e9ponse du Canada \u00e0 l'\u00e9gard du trafic d'organes humains en cr\u00e9ant quatre nouvelles infractions relatives \u00e0 cette conduite dans le Code criminel, en \u00e9tendant la comp\u00e9tence extraterritoriale \u00e0 ces nouvelles infractions, ainsi qu'en modifiant la Loi sur l'immigration et la protection des r\u00e9fugi\u00e9s afin d'y ajouter un nouveau motif d'interdiction de territoire consistant \u00e0 avoir eu un comportement qui constituerait une infraction aux termes du projet de loi.</p>\n<p data-HoCid=\"5884367\" data-originallang=\"fr\">Plus pr\u00e9cis\u00e9ment, le projet de loi <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a> propose de criminaliser la conduite de quiconque prend part au pr\u00e9l\u00e8vement d'un organe \u00e0 des fins de greffe en sachant que l'organe a \u00e9t\u00e9 pr\u00e9lev\u00e9 sans le consentement \u00e9clair\u00e9 du donneur ou du d\u00e9cideur substitut ou en ne se souciant pas de savoir si un tel consentement a \u00e9t\u00e9 donn\u00e9.</p>\n<p data-HoCid=\"5884368\" data-originallang=\"en\">Le trafic d'organes implique plusieurs comportements commis par divers acteurs. Dans cette optique, les infractions propos\u00e9es viseraient les interm\u00e9diaires qui mettent en contact les receveurs et les donneurs d'organes potentiels, les professionnels de la sant\u00e9 qui pr\u00e9l\u00e8vent ill\u00e9galement des organes destin\u00e9s \u00e0 une transplantation et les personnes qui ach\u00e8tent des organes pour eux-m\u00eames, ainsi que ceux qui les aident dans leurs d\u00e9marches.</p>\n<p data-HoCid=\"5884369\" data-originallang=\"en\">Le projet de loi propose \u00e9galement de criminaliser la marchandisation des organes humains, plus pr\u00e9cis\u00e9ment en \u00e9rigeant en infraction une nouvelle op\u00e9ration financi\u00e8re. Il sera interdit de participer \u00e0 l\u2019obtention de l\u2019organe ou de la faciliter, sachant que l\u2019organe a \u00e9t\u00e9 obtenu pour contrepartie ou ne se souciant pas de savoir qu\u2019il a \u00e9t\u00e9 obtenu pour contrepartie, que le donneur ait consenti ou non au pr\u00e9l\u00e8vement.</p>\n<p data-HoCid=\"5884370\" data-originallang=\"fr\">En ce qui concerne le sens et la port\u00e9e de l'expression \u00ab pour contrepartie \u00bb, selon l'\u00e9tude du projet de loi par le Comit\u00e9 permanent des affaires \u00e9trang\u00e8res et du d\u00e9veloppement international, cette expression cible l'achat d'organes humains.</p>\n<p data-HoCid=\"5884371\" data-originallang=\"en\">Le projet de loi permettra aux infractions de s'appliquer \u00e0 l'ext\u00e9rieur du Canada, ce qui signifie que les citoyens canadiens et les r\u00e9sidents permanents qui se rendent \u00e0 l'\u00e9tranger pour acheter un organe en vue d'une transplantation \u2014 une pratique qui porte aussi le nom de \u00ab tourisme de transplantation \u00bb \u2014 ou qui commettent une des nouvelles infractions \u00e0 l'\u00e9tranger pourraient \u00eatre poursuivis au Canada.</p>\n<p data-HoCid=\"5884372\" data-originallang=\"en\">\u00c9tant donn\u00e9 que le trafic d'organes est un probl\u00e8me international qui cible principalement les pauvres dans les pays \u00e9trangers, l'application extraterritoriale des infractions contribuera \u00e0 prot\u00e9ger les personnes vuln\u00e9rables \u00e0 l'\u00e9tranger, notamment celles qui pourraient \u00eatre amen\u00e9es \u00e0 vendre leurs organes en raison de leurs difficult\u00e9s financi\u00e8res.</p>\n<p data-HoCid=\"5884373\" data-originallang=\"en\">Conform\u00e9ment aux objectifs du projet de loi, les nouvelles dispositions dissuaderont les Canadiens et les r\u00e9sidents permanents de contribuer au trafic d'organes en alimentant la demande au moyen du tourisme de transplantation.</p>\n<p data-HoCid=\"5884374\" data-originallang=\"fr\">Tel que mentionn\u00e9 dans le cadre du d\u00e9bat en deuxi\u00e8me lecture, l'application extraterritoriale des infractions de trafic d'organes est n\u00e9cessaire \u00e9tant donn\u00e9 que la conduite vis\u00e9e par le projet de loi est commise \u00e0 l'\u00e9tranger la plupart du temps.</p>\n<p data-HoCid=\"5884375\" data-originallang=\"en\">Le projet de loi <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a> propose \u00e9galement d'ajouter un nouveau motif d'interdiction de territoire \u00e0 l'article 35 de la Loi sur l'immigration et la protection des r\u00e9fugi\u00e9s, soit la commission d'actes qui constitueraient une infraction en vertu du projet de loi. Par cons\u00e9quent, un r\u00e9sident permanent ou un ressortissant \u00e9tranger qui aurait commis l'une des nouvelles infractions li\u00e9es au trafic d'organes pourrait se voir interdire l'entr\u00e9e sur le territoire canadien. Cette modification indique clairement que l'achat d'organes, notamment ceux de personnes vuln\u00e9rables vivant \u00e0 l'\u00e9tranger, constitue un acte criminel grave au Canada. </p>\n<p data-HoCid=\"5884376\" data-originallang=\"en\">Je voudrais parler de certains des amendements apport\u00e9s au projet de loi \u00e0 l'\u00e9tape de l'\u00e9tude en comit\u00e9.</p>\n<p data-HoCid=\"5884377\" data-originallang=\"en\">Le 27 f\u00e9vrier dernier, le comit\u00e9 de la Chambre a adopt\u00e9 un amendement visant \u00e0 pr\u00e9ciser qu'un mandataire peut donner son consentement au nom d'un donneur d'organes, et cela visait \u00e0 clarifier certains termes du droit p\u00e9nal utilis\u00e9s dans le projet de loi.</p>\n<p data-HoCid=\"5884378\" data-originallang=\"en\">Le comit\u00e9 a aussi retir\u00e9 deux amendements qui avaient \u00e9t\u00e9 adopt\u00e9s le 23 octobre 2018 au S\u00e9nat. Ont ainsi \u00e9t\u00e9 supprim\u00e9es la proposition de d\u00e9finition de \u00ab consentement \u00e9clair\u00e9 \u00bb ainsi que l'obligation, pour les m\u00e9decins, de signaler toutes les transplantations d'organes \u00e0 une autorit\u00e9 d\u00e9sign\u00e9e par d\u00e9cret du gouverneur en conseil.</p>\n<p data-HoCid=\"5884379\" data-originallang=\"fr\">Comme cela a \u00e9t\u00e9 mentionn\u00e9 dans le cadre du d\u00e9bat de deuxi\u00e8me lecture, la d\u00e9finition propos\u00e9e de \u00ab consentement \u00e9clair\u00e9 \u00bb pr\u00e9sentait des probl\u00e8mes. L'expression \u00ab consentement \u00e9clair\u00e9 \u00bb est clairement d\u00e9finie dans les lois provinciales et territoriales en mati\u00e8re de sant\u00e9. C'est l'une des raisons pour lesquelles elle n'a pas \u00e9t\u00e9 d\u00e9finie dans le Code criminel aux fins des dispositions sur l'aide m\u00e9dicale \u00e0 mourir, en 2016. Par cons\u00e9quent, afin d'\u00e9viter des probl\u00e8mes d'interpr\u00e9tation l\u00e9gislative et d'assurer la clart\u00e9 et l'uniformit\u00e9 dans le Code criminel, la d\u00e9finition a \u00e9t\u00e9 retir\u00e9e de ce projet de loi. </p>\n<p data-HoCid=\"5884380\" data-originallang=\"fr\">L'obligation propos\u00e9e d'imposer aux m\u00e9decins de faire rapport soulevait aussi des pr\u00e9occupations. Comme cela a \u00e9t\u00e9 soulign\u00e9 devant le comit\u00e9 de la Chambre, le secret professionnel entre un m\u00e9decin et son patient est sacro-saint. C'est un principe fondamental qui permet aux gens de se sentir en s\u00e9curit\u00e9 lorsqu'ils divulguent \u00e0 leur m\u00e9decin tout probl\u00e8me de sant\u00e9 auquel ils font face. Ce principe encourage les gens \u00e0 sauvegarder leur propre sant\u00e9 et \u00e0 se faire soigner, lorsque c'est n\u00e9cessaire, afin de pouvoir aller mieux. Il est important de prot\u00e9ger cette relation entre les patients et leurs m\u00e9decins.</p>\n<p data-HoCid=\"5884381\" data-originallang=\"fr\">De plus, l'obligation pour les m\u00e9decins de faire rapport s'appliquait \u00e0 toutes les transplantations. Pour ces raisons, parmi d'autres, l'obligation pour les m\u00e9decins de faire rapport a aussi \u00e9t\u00e9 supprim\u00e9e.</p>\n<p data-HoCid=\"5884382\" data-originallang=\"en\">Je m'interromps pour souligner que, depuis l'\u00e9tude importante de ce projet de loi qu'a effectu\u00e9e le comit\u00e9, l'Assembl\u00e9e l\u00e9gislative de la Nouvelle-\u00c9cosse a adopt\u00e9 une loi selon laquelle les gens sont pr\u00e9sum\u00e9s avoir donn\u00e9 leur consentement au don d'organes, tout en permettant \u00e0 chacun individuellement de retirer ce consentement. Je tiens \u00e0 pr\u00e9ciser que je respecte les choix que font les provinces et les territoires pour essayer de prot\u00e9ger la sant\u00e9 et la s\u00e9curit\u00e9 des Canadiens. Le projet de loi <a data-HoCid=\"9206308\" href=\"/bills/42-1/S-240/\" title=\"An Act to amend the Criminal Code and the Immigration and Refugee Protection Act (trafficking in human organs)\">S-240</a> ne vise aucunement \u00e0 s'ing\u00e9rer dans le travail fait par les provinces et les territoires relativement \u00e0 ce dossier tr\u00e8s important. Nous sommes impatients de voir les r\u00e9sultats de cette mesure l\u00e9gislative pour les gens de la Nouvelle-\u00c9cosse.</p>\n<p data-HoCid=\"5884383\" data-originallang=\"en\"> Comme le savent les d\u00e9put\u00e9s, ce projet de loi est le r\u00e9sultat d'efforts successifs de la part des parlementaires des deux Chambres pour r\u00e9agir \u00e0 ce qui est v\u00e9ritablement un crime \u00e9pouvantable qui continue d'\u00eatre commis aux d\u00e9pens de personnes vuln\u00e9rables un partout sur la plan\u00e8te.
