"en": "<p data-HoCid=\"5829930\" data-originallang=\"en\">Madam Speaker, in response to both the member for <a data-HoCid=\"213892\" href=\"/politicians/michael-cooper/\" title=\"Michael Cooper\">St. Albert\u2014Edmonton</a> and the member for <a data-HoCid=\"214564\" href=\"/politicians/charlie-angus/\" title=\"Charlie Angus\">Timmins\u2014James Bay</a>, the important point that needs to be clear on the record for Canadians is that it was stated that the <a data-HoCid=\"214296\" href=\"/politicians/justin-trudeau/\" title=\"Justin Trudeau\">Prime Minister</a> refused to accept the position of the <a data-HoCid=\"214558\" href=\"/politicians/jody-wilson-raybould/\" title=\"Jody Wilson-Raybould\">former attorney general</a>. That is categorically not the case. The evidence has shown that the Prime Minister indicated that the decision was for the former attorney general to take, and she confirmed that in her own testimony. That is an important point.</p>\n<p data-HoCid=\"5829931\" data-originallang=\"en\">The member for <a data-HoCid=\"214564\" href=\"/politicians/charlie-angus/\" title=\"Charlie Angus\">Timmins\u2014James Bay</a> said that it is a matter of law. I want to clarify for the record that directives have been done in terms of classes of litigation. Directives have occurred recently for HIV non-disclosure and also for indigenous litigation. Those directives were issued even once litigation was under way.</p>\n<p data-HoCid=\"5829932\" data-originallang=\"en\">What I would reiterate for people to understand, including the member opposite, is that decisions are made about prosecutions on an ongoing basis until a sentence is determined. That happens all the time in the to-and-fro of a courtroom process. By way of example, there is the issue of the way a criminal trial unfolds. If it is meant to be a five-day trial and pursuing one type of sentence, as the evidence unfolds on the stand, decisions are made, agreements are struck to change penalties that are being sought, etc. This is a well-known feature of Canadian criminal law and has been for literally centuries. It is something that is well entrenched in terms of how prosecutions are handled.</p>\n<p data-HoCid=\"5829933\" data-originallang=\"en\">I hope that helps to address the concerns of the member for <a data-HoCid=\"214564\" href=\"/politicians/charlie-angus/\" title=\"Charlie Angus\">Timmins\u2014James Bay</a> in terms of the notion of what directives are and when they are applied.</p>",

R\u00e9cemment, on a \u00e9mis des directives pour les litiges relatifs \u00e0 la non-divulgation du VIH et aux Autochtones. Ces directives ont \u00e9t\u00e9 \u00e9mises m\u00eame quand les litiges \u00e9taient en cours.</p>\n<p data-HoCid=\"5829932\" data-originallang=\"en\">Je tiens \u00e0 r\u00e9p\u00e9ter ce qui suit pour que tout le monde, y compris le d\u00e9put\u00e9 d'en face, comprenne. Des d\u00e9cisions sont prises continuellement relativement aux poursuites jusqu'\u00e0 la d\u00e9termination de la peine. Cela se produit tout le temps dans le cadre du processus judiciaire. Prenons par exemple le d\u00e9roulement des proc\u00e8s criminels. S'il s'agit d'un proc\u00e8s de cinq jours, et que l'on cherche \u00e0 imposer une certaine peine, au fur et \u00e0 mesure que les faits se pr\u00e9cisent, il arrive que des d\u00e9cisions soient prises et des ententes conclues pour demander d'autres sanctions, etc. C'est une particularit\u00e9 bien connue du droit p\u00e9nal canadien et elle existe depuis des si\u00e8cles.
