"en": "<p data-HoCid=\"5761898\" data-originallang=\"en\">Madam Speaker, I rise today to speak to private member's Bill <a data-HoCid=\"8071171\" href=\"/bills/42-1/C-266/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-266</a>, an act to amend the Criminal Code, increasing parole ineligibility.</p>\n<p data-HoCid=\"5761899\" data-originallang=\"en\">The objective of the bill is to protect victims and alleviate their re-victimization by limiting the number of parole applications in which they may need to participate. The underlying assumption of Bill <a data-HoCid=\"8071171\" href=\"/bills/42-1/C-266/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-266</a> is that its proposed reforms would spare families from the heartache of reliving the loss of their loved one who may have been murdered in unspeakable circumstances.</p>\n<p data-HoCid=\"5761900\" data-originallang=\"en\">As currently drafted, Bill <a data-HoCid=\"8071171\" href=\"/bills/42-1/C-266/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-266</a> proposes to modify section 745 of the Criminal Code in order to effect two changes. First, it would make it mandatory for a judge to impose a parole ineligibility period of not less than 25 years for all offenders convicted of the following offences committed as part of the same event or series of events and in respect of the same victim: kidnapping and abduction-related offences; sexual offences; and murder, irrespective of whether it is in the first or second degree.</p>\n<p data-HoCid=\"5761901\" data-originallang=\"en\">Second, the bill would provide judicial discretion to set the period of parole ineligibility between 25 and 40 years for the same small subset of offenders who, given the severity of their crimes committed, are truly unlikely to obtain parole in any event.</p>\n<p data-HoCid=\"5761902\" data-originallang=\"fr\">It should be noted that Bill <a data-HoCid=\"8071171\" href=\"/bills/42-1/C-266/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-266</a> is similar to previous private members' bills, including Bills <a data-HoCid=\"6251824\" href=\"/bills/41-2/C-478/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-478</a> and <a data-HoCid=\"6496356\" href=\"/bills/41-2/C-587/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-587</a>. Bill C-478 got through second reading stage and was referred to the Standing Committee on Justice and Human Rights, but it did not get any further than that.</p>\n<p data-HoCid=\"5761903\" data-originallang=\"fr\">Unlike Bill C-266, former Bill C-478 did not require that the offences for which the offender was found guilty to be committed as part of the same criminal transaction.</p>\n<p data-HoCid=\"5761904\" data-originallang=\"en\">Former Bill <a data-HoCid=\"6251824\" href=\"/bills/41-2/C-478/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-478</a> was later reintroduced as Bill <a data-HoCid=\"6496356\" href=\"/bills/41-2/C-587/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-587</a> by the member for <a data-HoCid=\"214444\" href=\"/politicians/mel-arnold/\" title=\"Mel Arnold\">North Okanagan\u2014Shuswap</a> and essentially proposed the same legislative amendments as Bill <a data-HoCid=\"8071171\" href=\"/bills/42-1/C-266/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-266</a>, except for slight wording differences.</p>\n<p data-HoCid=\"5761905\" data-originallang=\"en\">Ultimately, former Bill <a data-HoCid=\"6496356\" href=\"/bills/41-2/C-587/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-587</a> was adopted by the justice committee, without amendment, and had commenced third reading debate in the House, but did not proceed further because of the dissolution of Parliament for the 2015 federal election.</p>\n<p data-HoCid=\"5761906\" data-originallang=\"en\">I want to take a moment to thank the member for <a data-HoCid=\"214380\" href=\"/politicians/james-bezan/\" title=\"James Bezan\">Selkirk\u2014Interlake\u2014Eastman</a> for the laudable objective of the bill. I think all of hon. members of the House can agree that alleviating the trauma, emotional suffering and re-victimization of families whose loved ones have been murdered is a worthwhile cause that merits our full consideration.</p>\n<p data-HoCid=\"5761907\" data-originallang=\"fr\">Victims have rights at every stage of the criminal justice process, including the right to information, protection, restitution, and participation. These rights, previously recognized by internal polices of the Parole Board of Canada and Correctional Service Canada, are now enshrined in the Canadian Victims Bill of Rights and give clear rights to all victims of crime. </p>\n<p data-HoCid=\"5761908\" data-originallang=\"en\">Once victims are registered with the Parole Board of Canada or the Correctional Service Canada, they can choose to receive information on the offender, including but not limited to: the sentence start date and length; and the offender's eligibility and review dates for unescorted temporary absences, parole or statutory release.</p>\n<p data-HoCid=\"5761909\" data-originallang=\"en\"> Upon further request, additional information could be provided to a victim, including: the date of any Parole Board of Canada hearing and the reason why an offender waived a hearing, if one was given; and whether the offender has appealed the decision of the Parole Board not to grant a release and the outcome of that appeal.</p>\n<p data-HoCid=\"5761910\" data-originallang=\"en\">Victims' participation rights include the following: attending the offender's parole hearing or listening to an audio recording of a parole hearing if the victim is unable to attend in person; presenting a written statement that outlines the continuing impact the offence has had on them and any risk or safety concerns the offender may pose and requesting that the Parole Board consider imposing special conditions on the offender's release; and obtaining a copy of the Parole Board's decision, including information on whether the offender has appealed the decision and the outcome of the appeal.</p>\n<p data-HoCid=\"5761911\" data-originallang=\"en\">I would like to pause here to highlight Bill <a data-HoCid=\"10078426\" href=\"/bills/42-1/C-83/\" title=\"An Act to amend the Corrections and Conditional Release Act and another Act\">C-83</a>, an act to amend the Corrections and Conditional Release Act and another act, which is proposing other legislative changes to better support victims of crime.</p>\n<p data-HoCid=\"5761912\" data-originallang=\"en\">Currently, victims who do not attend a parole hearing are entitled to listen to an audio recording of the hearing. However, if victims do attend, they lose their right to listen to a recording. Simply stated, parole hearings can be quite difficult for family members. Despite attending the hearing, they may not always remember everything that was said and may, for a variety of reasons, wish to listen to an audio recording at a later date. I am pleased to know that changes proposed in Bill <a data-HoCid=\"10078426\" href=\"/bills/42-1/C-83/\" title=\"An Act to amend the Corrections and Conditional Release Act and another Act\">C-83</a> would give all victims the right to listen to an audio recording, regardless of whether they attend the parole hearing.</p>\n<p data-HoCid=\"5761913\" data-originallang=\"en\"> The laws and policies that have been put forward were designed to be respectful of the privacy rights of victims who do not wish to be contacted or receive information about the offender who has harmed them. This recognizes the fact that victims are not a homogenous group; while some victims may choose not to attend or receive information about parole hearings in order to avoid emotional trauma, others will attend parole hearings as a means of furthering their healing and to feel empowered by having their voice heard.</p>\n<p data-HoCid=\"5761914\" data-originallang=\"en\"> In fact, on March 9, 2015, officials testifying on behalf of the Parole Board of Canada indicated during their testimony before the Standing Committee on Justice and Human Rights on former Bill <a data-HoCid=\"6496356\" href=\"/bills/41-2/C-587/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-587</a> that every victim is different and that the Parole Board of Canada also has victims who are interested in attending parole hearings. </p>\n<p data-HoCid=\"5761915\" data-originallang=\"en\">Therefore, we need to ask ourselves if the proposed amendments in Bill <a data-HoCid=\"8071171\" href=\"/bills/42-1/C-266/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-266 are </a> the most effective way of supporting the needs of victims affected by these brutal crimes.</p>\n<p data-HoCid=\"5761916\" data-originallang=\"en\"> I also wonder, despite the bill's laudable intentions, whether some victims might feel negatively impacted by legislative changes designed to reduce the number of parole hearings they may choose to attend.</p>\n<p data-HoCid=\"5761917\" data-originallang=\"en\"> I am certain all hon. members would agree that a thorough debate on the impacts of Bill <a data-HoCid=\"8071171\" href=\"/bills/42-1/C-266/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-266</a>'s proposed changes requires consideration of these questions. Also, I would be interested to hear the views of the member for <a data-HoCid=\"214380\" href=\"/politicians/james-bezan/\" title=\"James Bezan\">Selkirk\u2014Interlake\u2014Eastman</a> on these points.</p>\n<p data-HoCid=\"5761918\" data-originallang=\"en\"> It is clear that there are various ways of supporting victims. The changes proposed in Bill <a data-HoCid=\"8071171\" href=\"/bills/42-1/C-266/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-266</a> present one avenue for bettering the experience of victims at the very end of the spectrum of the criminal justice process. </p>\n<p data-HoCid=\"5761919\" data-originallang=\"en\">As parliamentarians, we should strive to achieve a fair, effective, just and compassionate criminal justice system for all involved. For these reasons, I will be closely monitoring the debate on Bill <a data-HoCid=\"8071171\" href=\"/bills/42-1/C-266/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-266</a> and look forward to hearing the views of other hon. members on its potential impacts.</p>",

Je pense que tous les d\u00e9put\u00e9s conviendront que l'att\u00e9nuation du traumatisme, de la souffrance affective et de la revictimisation des familles qui ont perdu un \u00eatre cher aux mains d'un meurtrier est une bonne cause, qui m\u00e9rite toute notre attention.</p>\n<p data-HoCid=\"5761907\" data-originallang=\"fr\">Les victimes ont des droits \u00e0 toutes les \u00e9tapes du processus p\u00e9nal, incluant les droits \u00e0 l\u2019information, \u00e0 la protection, \u00e0 la restitution et \u00e0 la participation. Ces droits, ant\u00e9rieurement reconnus par les politiques internes de la Commission des lib\u00e9rations conditionnelles du Canada et du Service correctionnel du Canada, sont maintenant consacr\u00e9s dans la Charte canadienne des droits des victimes et offrent des droits clairs \u00e0 toutes les victimes d\u2019actes criminels.</p>\n<p data-HoCid=\"5761908\" data-originallang=\"en\">Une fois qu'elles sont inscrites aupr\u00e8s de la Commission des lib\u00e9rations conditionnelles du Canada ou du Service correctionnel du Canada, les victimes peuvent demander de recevoir de l'information sur le d\u00e9linquant, dont: la date du d\u00e9but de la peine et sa dur\u00e9e; et les dates d\u2019admissibilit\u00e9 et d\u2019examen applicables aux permissions de sortir sans escorte, \u00e0 la lib\u00e9ration conditionnelle et \u00e0 la lib\u00e9ration d\u2019office.</p>\n<p data-HoCid=\"5761909\" data-originallang=\"en\">Sur demande, une victime peut obtenir des renseignements suppl\u00e9mentaires sur le d\u00e9linquant, dont: la date de toute audience devant la Commission des lib\u00e9rations conditionnelles du Canada et le motif pour lequel le d\u00e9linquant a renonc\u00e9 \u00e0 une audience, si celui-ci a \u00e9t\u00e9 fourni; la d\u00e9cision du d\u00e9linquant d'en appeler de la d\u00e9cision de la Commission de lui refuser la mise en libert\u00e9 et le r\u00e9sultat de cet appel.</p>\n<p data-HoCid=\"5761910\" data-originallang=\"en\"> Voici quels sont les droits de participation de la victime: assister \u00e0 l'audience de lib\u00e9ration conditionnelle du d\u00e9linquant ou \u00e9couter un enregistrement audio de l'audience si elle ne peut y assister en personne; pr\u00e9senter une d\u00e9claration \u00e9crite d\u00e9crivant les r\u00e9percussions que l'infraction continue d'avoir sur elle, les craintes qu'elle a pour sa s\u00e9curit\u00e9 advenant que le d\u00e9linquant soit mis en libert\u00e9 ainsi que les conditions sp\u00e9ciales que la Commission des lib\u00e9rations conditionnelles du Canada pourrait envisager d'imposer \u00e0 la mise en libert\u00e9 du d\u00e9linquant; et obtenir une copie de la d\u00e9cision de la Commission, y compris les d\u00e9tails sur un \u00e9ventuel appel de la d\u00e9cision par le d\u00e9linquant et l'issue de cet appel. </p>\n<p data-HoCid=\"5761911\" data-originallang=\"en\">J'aimerais prendre un moment pour parler du projet de loi <a data-HoCid=\"10078426\" href=\"/bills/42-1/C-83/\" title=\"An Act to amend the Corrections and Conditional Release Act and another Act\">C-83</a>, Loi modifiant la Loi sur le syst\u00e8me correctionnel et la mise en libert\u00e9 sous condition et une autre loi, dans lequel on propose d'autres modifications afin d'offrir un meilleur soutien aux victimes d'un crime. </p>\n<p data-HoCid=\"5761912\" data-originallang=\"en\">\u00c0 l'heure actuelle, les victimes qui n'assistent pas \u00e0 l'audience de lib\u00e9ration conditionnelle ont le droit d'en \u00e9couter un enregistrement audio. Par contre, si la victime assiste \u00e0 l'audience, elle perd ce droit. Une audience de lib\u00e9ration conditionnelle peut \u00eatre une exp\u00e9rience tr\u00e8s difficile pour les membres de la famille. Ces derniers ne se rappelleront pas n\u00e9cessairement tout ce qui a \u00e9t\u00e9 dit et ils pourraient, pour diverses raisons, vouloir \u00e9couter un enregistrement de l'audience plus tard. Les modifications propos\u00e9es dans le projet de loi <a data-HoCid=\"10078426\" href=\"/bills/42-1/C-83/\" title=\"An Act to amend the Corrections and Conditional Release Act and another Act\">C-83</a> donneraient \u00e0 toutes les victimes le droit d'\u00e9couter un enregistrement audio de l'audience, qu'elles y aient assist\u00e9 ou non. </p>\n<p data-HoCid=\"5761913\" data-originallang=\"en\">Les lois et politiques propos\u00e9es ont \u00e9t\u00e9 con\u00e7ues pour respecter le droit \u00e0 la vie priv\u00e9e des victimes qui ne souhaitent pas \u00eatre contact\u00e9es ou recevoir de l'information sur le d\u00e9linquant qui leur a fait du mal. On reconna\u00eet ainsi que les victimes ne sont pas un groupe homog\u00e8ne; si certaines d'entre elles choisissent de ne pas assister \u00e0 des audiences de lib\u00e9ration conditionnelle ou de ne pas recevoir d'information \u00e0 leur sujet afin d'\u00e9viter des chocs \u00e9motionnels, d'autres y assistent, en y voyant un moyen de gu\u00e9rir et de faire entendre leur voix.</p>\n<p data-HoCid=\"5761914\" data-originallang=\"en\"> D'ailleurs, le 9 mars 2015, des repr\u00e9sentants de la Commission des lib\u00e9rations conditionnelles du Canada ont affirm\u00e9 au Comit\u00e9 permanent de la justice et des droits de la personne, dans le cadre de l'\u00e9tude de l'ancien projet de loi <a data-HoCid=\"6496356\" href=\"/bills/41-2/C-587/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-587</a>, que chaque victime est diff\u00e9rente et que la Commission des lib\u00e9rations conditionnelles du Canada conna\u00eet des victimes qui souhaitent assister aux audiences. </p>\n<p data-HoCid=\"5761915\" data-originallang=\"en\">En cons\u00e9quence, nous devons nous demander si les modifications propos\u00e9es dans le projet de loi <a data-HoCid=\"8071171\" href=\"/bills/42-1/C-266/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-266 </a> sont le moyen le plus efficace de r\u00e9pondre aux besoins des victimes de ces crimes brutaux.</p>\n<p data-HoCid=\"5761916\" data-originallang=\"en\">Je me demande \u00e9galement si, en d\u00e9pit des intentions louables du projet de loi, certaines victimes pourraient \u00eatre affect\u00e9es par des changements l\u00e9gislatifs con\u00e7us pour r\u00e9duire le nombre d'audiences de lib\u00e9ration conditionnelle auxquelles elles voudraient assister.</p>\n<p data-HoCid=\"5761917\" data-originallang=\"en\">Je suis certaine que tous les d\u00e9put\u00e9s conviendront qu'un d\u00e9bat complet sur les cons\u00e9quences des changements propos\u00e9s dans le projet de loi <a data-HoCid=\"8071171\" href=\"/bills/42-1/C-266/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-266</a> implique l'examen de ces questions. Les changements propos\u00e9s dans le projet de loi <a data-HoCid=\"8071171\" href=\"/bills/42-1/C-266/\" title=\"An Act to amend the Criminal Code (increasing parole ineligibility)\">C-266</a> ne sont qu'un moyen parmi d'autres d'am\u00e9liorer l'exp\u00e9rience des victimes \u00e0 la toute fin du processus de justice p\u00e9nale. </p>\n<p data-HoCid=\"5761919\" data-originallang=\"en\">En tant que parlementaires, nous devons nous efforcer d'obtenir un syst\u00e8me de justice p\u00e9nale \u00e9quitable, efficace, juste et compatissant pour toutes les parties prenantes.
