        "en": "<p data-HoCid=\"4863517\" data-originallang=\"fr\"> The Chair would like to take a moment to provide some information to the House regarding the management of private members' business. </p>\n<p data-HoCid=\"4863518\" data-originallang=\"fr\">As members know, after the order of precedence is replenished, the Chair reviews the new items so as to alert the House to bills which at first glance appear to infringe on the financial prerogative of the crown. This allows members the opportunity to intervene in a timely fashion to present their views about the need for those bills to be accompanied by a royal recommendation.</p>\n<p data-HoCid=\"4863519\" data-originallang=\"en\">Accordingly, following the April 10, 2017 replenishment of the order of precedence with 15 new items, I wish to inform the House that there are two bills that give the Chair some concern as to the spending provisions they contemplate. They are Bill <a data-HoCid=\"8344494\" href=\"/bills/42-1/C-315/\" title=\"An Act to amend the Parks Canada Agency Act (Conservation of National Historic Sites Account)\">C-315, an act to amend the Parks Canada Agency Act (Conservation of National Historic Sites Account)</a>, standing in the name of the member for <a data-HoCid=\"214426\" href=\"/politicians/gord-brown/\" title=\"Gord Brown\">Leeds\u2014Grenville\u2014Thousand Islands and Rideau Lakes</a>, and Bill <a data-HoCid=\"8828970\" href=\"/bills/42-1/C-343/\" title=\"An Act to establish the Office of the Federal Ombudsman for Victims of Criminal Acts and to amend certain Acts\">C-343, an act to establish the Office of the Federal Ombudsman for Victims of Criminal Acts and to amend certain acts</a>, standing in the name of the member for <a data-HoCid=\"213937\" href=\"/politicians/sylvie-boucher/\" title=\"Sylvie Boucher\">Beauport\u2014C\u00f4te-de-Beaupr\u00e9\u2014\u00cele d'Orl\u00e9ans\u2014Charlevoix</a>.</p>\n<p data-HoCid=\"4863520\" data-originallang=\"en\">Additionally, on an exceptional basis, I would like to raise concerns regarding Bill <a data-HoCid=\"8063336\" href=\"/bills/42-1/S-205/\" title=\"An Act to amend the Canada Border Services Agency Act (Inspector General of the Canada Border Services Agency) and to make consequential amendments to other Acts\">S-205, an act to amend the Canada Border Services Agency Act (Inspector General of the Canada Border Services Agency) and to make consequential amendments to other acts</a>, and Bill <a data-HoCid=\"8450590\" href=\"/bills/42-1/S-229/\" title=\"An Act respecting underground infrastructure safety\">S-229, an act respecting underground infrastructure safety</a>. Both bills have been sent to the House of Commons for consideration. The Chair expects that in due course they will be given first reading in the House, as is usually the case with bills sent to the House by the other place. </p>\n<p data-HoCid=\"4863521\" data-originallang=\"fr\">As members know, certain constitutional and procedural principles inform the Chair with respect to bills containing spending provisions that would require a royal recommendation, which are also known as \u201cmoney bills\u201d.</p>\n<p data-HoCid=\"4863522\" data-originallang=\"fr\">A fundamental requirement for bills of this nature is that they must originate in the House of Commons. Standing Order 80(1) embodies this important principle, stating:</p>\n<blockquote><p data-HoCid=\"4863523\" data-originallang=\"fr\"> All aids and supplies granted to the Sovereign by the Parliament of Canada are the sole gift of the House of Commons, and all bills for granting such aids and supplies ought to begin with the House, as it is the undoubted right of the House to direct, limit, and appoint in all such bills, the ends, purposes, considerations, conditions, limitations and qualifications of such grants, which are not alterable by the Senate. </p>\n</blockquote><p data-HoCid=\"4863524\" data-originallang=\"fr\">This stipulation explicitly prohibits \u201cmoney bills\u201d from originating in the Senate. In the past, if a bill requiring a royal recommendation was passed by the Senate and sent to the House, the Chair has seen fit to interrupt all further consideration of the bill. </p>\n<p data-HoCid=\"4863525\" data-originallang=\"en\">The Chair has specific concerns about the unusual manner in which Bill <a data-HoCid=\"8063336\" href=\"/bills/42-1/S-205/\" title=\"An Act to amend the Canada Border Services Agency Act (Inspector General of the Canada Border Services Agency) and to make consequential amendments to other Acts\">S-205</a> and Bill <a data-HoCid=\"8450590\" href=\"/bills/42-1/S-229/\" title=\"An Act respecting underground infrastructure safety\">S-229</a> are structured. Essentially, they appear to contain spending provisions that would require a royal recommendation, but they both conclude with coming into force provisions that suggest otherwise. </p>\n<p data-HoCid=\"4863526\" data-originallang=\"en\">Receiving such bills from the Senate is exceptional and rare. Indeed it may well be the first time the House is seized with such legislative measures. Parenthetically, Bill <a data-HoCid=\"8828970\" href=\"/bills/42-1/C-343/\" title=\"An Act to establish the Office of the Federal Ombudsman for Victims of Criminal Acts and to amend certain Acts\">C-343</a>, which I referenced earlier, contains a similar provision. </p>\n<p data-HoCid=\"4863527\" data-originallang=\"en\">If, following an anticipated first reading of Bill <a data-HoCid=\"8063336\" href=\"/bills/42-1/S-205/\" title=\"An Act to amend the Canada Border Services Agency Act (Inspector General of the Canada Border Services Agency) and to make consequential amendments to other Acts\">S-205</a> and Bill <a data-HoCid=\"8450590\" href=\"/bills/42-1/S-229/\" title=\"An Act respecting underground infrastructure safety\">S-229</a>, the Chair determines that the bills are contrary to our usual rules and practices regarding money bills, I would be obligated to disallow them to be further considered in the House. Specifically, it would be incumbent on me to order them removed from the Order Paper and any consideration of them ended. This is distinct from the process for bills first introduced in the House that require a royal recommendation, which are allowed to continue to the end of third reading before the Chair interrupts their consideration. Such would be the case for Bill <a data-HoCid=\"8344494\" href=\"/bills/42-1/C-315/\" title=\"An Act to amend the Parks Canada Agency Act (Conservation of National Historic Sites Account)\">C-315 </a> and Bill <a data-HoCid=\"8828970\" href=\"/bills/42-1/C-343/\" title=\"An Act to establish the Office of the Federal Ombudsman for Victims of Criminal Acts and to amend certain Acts\">C-343</a>, should the Chair conclude that they do indeed require a royal recommendation.</p>\n<p data-HoCid=\"4863528\" data-originallang=\"fr\"> In view of these considerations, I would encourage hon. members who would like to make arguments regarding the concerns about these bills that I have raised today, or any of the other bills now on the order of precedence, to do so at the earliest opportunity.</p>\n<p data-HoCid=\"4863529\" data-originallang=\"fr\">I thank hon. members for their attention. </p>",

Les deux projets de loi sont parvenus \u00e0 la Chambre des communes pour \u00e9tude. La pr\u00e9sidence s\u2019attend \u00e0 ce que, en temps et lieu, la Chambre des communes proc\u00e8de \u00e0 la premi\u00e8re lecture de ces projets de loi, comme c\u2019est habituellement le cas avec les projets de loi que la Chambre re\u00e7oit de l\u2019autre endroit.</p>\n<p data-HoCid=\"4863521\" data-originallang=\"fr\">Comme le savent les d\u00e9put\u00e9s, la pr\u00e9sidence doit appliquer certains principes constitutionnels et proc\u00e9duraux aux projets de loi dits \u00ab de finances \u00bb qui, parce qu'ils pr\u00e9voient des d\u00e9penses, n\u00e9cessitent une recommandation royale.</p>\n<p data-HoCid=\"4863522\" data-originallang=\"fr\">Une des r\u00e8gles fondamentales r\u00e9gissant les projets de loi de ce genre est qu'ils doivent provenir de la Chambre des communes. Le paragraphe 80(1) du R\u00e8glement \u00e9nonce ce principe important de la mani\u00e8re suivante:</p>\n<blockquote><p data-HoCid=\"4863523\" data-originallang=\"fr\"> Il appartient \u00e0 la Chambre des communes seule d'attribuer des subsides et cr\u00e9dits parlementaires au Souverain. Les projets de loi portant ouverture de ces subsides et cr\u00e9dits doivent prendre naissance \u00e0 la Chambre des communes, qui a indiscutablement le droit d'y d\u00e9terminer et d\u00e9signer les objets, destinations, motifs, conditions, limitations et emplois de ces allocations l\u00e9gislatives, sans que le S\u00e9nat puisse y apporter des modifications. </p>\n</blockquote><p data-HoCid=\"4863524\" data-originallang=\"fr\">Cette disposition interdit express\u00e9ment que les projets de loi de finances prennent naissance au S\u00e9nat. Par le pass\u00e9, quand le S\u00e9nat a adopt\u00e9 un projet de loi n\u00e9cessitant une recommandation royale et l'a fait parvenir \u00e0 la Chambre, la pr\u00e9sidence a jug\u00e9 indiqu\u00e9 de mettre fin \u00e0 l'examen de ce projet de loi.</p>\n<p data-HoCid=\"4863525\" data-originallang=\"en\">Les r\u00e9serves de la pr\u00e9sidence portent en particulier sur la mani\u00e8re inhabituelle dont les projets de loi <a data-HoCid=\"8063336\" href=\"/bills/42-1/S-205/\" title=\"An Act to amend the Canada Border Services Agency Act (Inspector General of the Canada Border Services Agency) and to make consequential amendments to other Acts\">S-205</a> et <a data-HoCid=\"8450590\" href=\"/bills/42-1/S-229/\" title=\"An Act respecting underground infrastructure safety\">S-229</a> sont construits. Pr\u00e9cis\u00e9ment, je n\u2019aurais d\u2019autre choix que d\u2019ordonner que ces projets de loi soient ray\u00e9s du Feuilleton et qu\u2019il soit mis fin \u00e0 leur examen. Cette fa\u00e7on de faire ne s\u2019applique pas aux projets de loi ayant pris naissance \u00e0 la Chambre et n\u00e9cessitant une recommandation royale. Ceux-ci peuvent se rendre jusqu\u2019\u00e0 la fin de la troisi\u00e8me lecture avant que la pr\u00e9sidence soit tenue de mettre fin \u00e0 leur examen. C\u2019est ce qui se produirait dans le cas des projets de loi <a data-HoCid=\"8344494\" href=\"/bills/42-1/C-315/\" title=\"An Act to amend the Parks Canada Agency Act (Conservation of National Historic Sites Account)\">C-315</a> et <a data-HoCid=\"8828970\" href=\"/bills/42-1/C-343/\" title=\"An Act to establish the Office of the Federal Ombudsman for Victims of Criminal Acts and to amend certain Acts\">C-343</a> si la pr\u00e9sidence devait conclure qu\u2019ils n\u00e9cessitent bel et bien une recommandation royale.</p>\n<p data-HoCid=\"4863528\" data-originallang=\"fr\">Compte tenu de ce qui pr\u00e9c\u00e8de, j'invite les honorables d\u00e9put\u00e9s qui voudraient formuler des observations au sujet des projets de loi que j'ai mentionn\u00e9s aujourd'hui ou de tout autre projet de loi figurant dans l'ordre de priorit\u00e9 \u00e0 le faire d\u00e8s que possible. </p>\n<p data-HoCid=\"4863529\" data-originallang=\"fr\">Je remercie les honorables d\u00e9put\u00e9s de leur attention.</p>"
