        "en": "<p class=\"procedural\" data-HoCid=\"5147056\"> moved that Bill <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45, An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts</a>, be read the third time and passed. </p>\n<p data-HoCid=\"5147057\" data-originallang=\"en\">Mr. Speaker, it is my pleasure to rise to speak to Bill <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a>.</p>\n<p data-HoCid=\"5147058\" data-originallang=\"en\">On October 13, I introduced two pieces of important legislation in the House of Commons. First, Bill <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a> proposes a framework for legalizing, strictly regulating, and restricting access to cannabis in Canada. The second complementary piece of legislation, Bill <a data-HoCid=\"8886286\" href=\"/bills/42-1/C-46/\" title=\"An Act to amend the Criminal Code (offences relating to conveyances) and  to make consequential amendments to other Acts\">C-46</a>, proposes new and stronger laws to more seriously tackle alcohol and drug-impaired driving, including cannabis. I am proud to note that Bill C-46 has been passed by the House and is being studied in the other place. </p>\n<p data-HoCid=\"5147059\" data-originallang=\"en\">I am pleased to speak again today about Bill <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a> and discuss some of the amendments that were carried during the Standing Committee on Health's extensive study of the bill. I would like to thank all committee members for their considerable amount of work on this file. The committee reviewed 115 briefs and heard from nearly 100 different witnesses, who provided their invaluable perspectives on a wide array of issues, ranging from law enforcement to public health.</p>\n<p data-HoCid=\"5147060\" data-originallang=\"en\"> Groups represented at committee included the Canadian Association of Chiefs of Police, the Criminal Lawyers' Association, the M\u00e9tis National Council, the Canadian Medical Association, the Canadian Public Health Association, and the Federation of Canadian Municipalities. Officials from Colorado and Washington state also provided testimony on their states' experience in the legalization of cannabis. </p>\n<p data-HoCid=\"5147061\" data-originallang=\"en\">After hearing from the witnesses, several amendments were proposed at clause-by-clause consideration of the bill. I will speak to some of these worthwhile amendments in a moment, but first I would like to remind members what Bill <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a> is all about. </p>\n<p data-HoCid=\"5147062\" data-originallang=\"en\">Bill <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a> would create a legal framework whereby adults would be able to access legal cannabis through an appropriate retail framework sourced from a well-regulated industry or grown in limited amounts at home. Under the proposed legislation, the federal, provincial, and territorial governments will all share in responsibility for overseeing the new system. The federal government will oversee the production and manufacturing components of the cannabis framework and set industry-wide rules and standards.</p>\n<p data-HoCid=\"5147063\" data-originallang=\"en\">To that end, our fall economic statement of 2017 has earmarked $526 million of funding to license, inspect, and enforce all aspects of the proposed cannabis act. Provincial and territorial governments will in turn be responsible for the distribution and sale components of the framework.</p>\n<p data-HoCid=\"5147064\" data-originallang=\"en\"> Beyond the legislative framework outlining the rules for production, retail sale, distribution, and possession, cannabis will remain a strictly prohibited substance. </p>\n<p data-HoCid=\"5147065\" data-originallang=\"en\"> Division 1 of part 1 of the proposed act clearly sets out that many of the offences that currently apply to cannabis under the Controlled Drugs and Substances Act will continue to exist under the proposed cannabis act. This is very much in keeping with the recommendations contained in the final report of the task force on cannabis legalization and regulation.</p>\n<p data-HoCid=\"5147066\" data-originallang=\"en\"> In its report, the task force recommended that criminal offences should be maintained for illicit production, trafficking, possession for the purposes of trafficking, possession for the purposes of export, and import/export.</p>\n<p data-HoCid=\"5147067\" data-originallang=\"en\">I will now speak to the amendments adopted by the committee. Let me begin by saying that our government supports all the amendments adopted by the Standing Committee on Health. At this time, I would like to speak about five specific amendments that were adopted during clause-by-clause consideration of Bill <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a>.</p>\n<p data-HoCid=\"5147068\" data-originallang=\"en\">First, the height restriction for cannabis plants permitted to be grown at home was eliminated. The 100-centimetre height restriction was intended to balance the interest to allow personal cultivation while safeguarding against the known risks associated with large plants, including the risk of diversion outside of the licit regime. The height restriction, indeed the proposal to allow even limited personal cultivation, attracted significant commentary both before the health committee and in the general public.</p>\n<p data-HoCid=\"5147069\" data-originallang=\"en\"> We understand the complexities leading to the task force's recommendation of a 100-centimetre height limit and accept the health committee's conclusion after it listened to several witnesses about the problems that such a limit might realistically create.</p>\n<p data-HoCid=\"5147070\" data-originallang=\"en\">Our government agrees that this issue is best addressed outside of the criminal law. Should they wish, provinces and territories. relying on their own legislative powers. could address plant heights and if legislative authority exists or is extended to municipalities, they could do so as well.</p>\n<p data-HoCid=\"5147071\" data-originallang=\"en\">Second, the addition of the good Samaritan provision will exempt individuals from criminal charges for simple possession if they call medical services or law enforcement following a life threatening medical emergency involving a psychoactive substance. Evidence demonstrates that individuals experiencing or witnessing an overdose or an acute medical condition are often afraid to call emergency assistance due to the fear of prosecution. A good Samaritan clause in the proposed cannabis act will help to ensure that individuals contact and co-operate with emergency services in the context of a medical emergency, knowing that they will not face prosecution for minor possession offences.</p>\n<p data-HoCid=\"5147072\" data-originallang=\"en\">Third, the amendments to the Non-smokers' Health Act, provides flexibility to prohibit the smoking or vaping of tobacco or cannabis in specific outdoor areas or spaces by regulation in federal workplaces to protect people from exposure to tobacco or cannabis smoke. This aligns with the recommendation by the Canadian Cancer Society.</p>\n<p data-HoCid=\"5147073\" data-originallang=\"en\">Fourth, courts will have the discretion of imposing a fine of up to $200 for an accused convicted of a ticketable offence rather than imposing a fixed fine in the amount of $200. This will ensure that the courts can consider a range of factors in setting the fine, including the ability of the accused to pay the fine.</p>\n<p data-HoCid=\"5147074\" data-originallang=\"en\">Finally, an amendment was adopted to require a review of the proposed cannabis act three years after its coming into force and to table a report in Parliament on the results of this review.</p>\n<p data-HoCid=\"5147075\" data-originallang=\"en\">Given the transformative nature of the proposed legislation, it is important that our government clearly communicates to Parliament and to the Canadian public the impact the legislation will have on achieving our objectives of protecting youth and reducing the role of organized crime. This will enable us as parliamentarians to determine whether future changes to the legislation are necessary to help ensure the protection of public health and safety.</p>\n<p data-HoCid=\"5147076\" data-originallang=\"en\">I will now speak to the significant discussion that has occurred in relation to the treatment of young persons under the proposed cannabis act.</p>\n<p data-HoCid=\"5147077\" data-originallang=\"en\"> On the one hand, the Standing Committee on Health heard from witnesses, including criminal defence lawyers and the Canadian Nurses Association, who argued that youth possession of cannabis should not be subject to criminal penalties, because making it a criminal offence for a youth to possess five grams of cannabis would not deter them from possessing. It would only serve to perpetuate the disproportionate enforcement of laws on young, marginalized, and racialized members of our society.</p>\n<p data-HoCid=\"5147078\" data-originallang=\"en\">On the other hand, others, including opposition members, have called for a zero tolerance in relation to the possession of cannabis by youth. Our government is mindful of the concerns raised in relation to the exemption of young persons from criminal prosecution for possession or sharing of up to five grams of cannabis and the suggestion that this decision is sending the wrong message to youth.</p>\n<p data-HoCid=\"5147079\" data-originallang=\"en\">As I discussed at my appearance before the committee, our government has drafted Bill <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a> to specifically ensure that there are no legal means for a young person to purchase or acquire cannabis. Young persons should not have access to any amount of cannabis.</p>\n<p data-HoCid=\"5147080\" data-originallang=\"en\"> At the same time, criminalizing youth for possessing or sharing very small amounts of cannabis recognizes the negative impacts that exposure to the criminal justice system can have on our young people, particularly marginalized young persons.</p>\n<p data-HoCid=\"5147081\" data-originallang=\"en\">Our focus aligns with what the majority of respondents conveyed to the task force; that criminal sanctions should be focused on adults who provide cannabis to youth, not on the youth themselves. This does not mean that our government sees youth possession or consumption of cannabis as acceptable. Our government has given much thought as to how we will keep cannabis out of the hands of youth and discourage them from using cannabis at all.</p>\n<p data-HoCid=\"5147082\" data-originallang=\"en\">Our government has been encouraging the provinces and territories to create administrative offences that would prohibit youth from possessing any amounts of cannabis without exposing them to the criminal justice system. Police would be given authority to seize cannabis from youth with small amounts. Provinces and territories use this measured approach for alcohol and tobacco possession by young persons, and it has proven to be successful. We were pleased to hear that Ontario, Quebec, and Alberta have already announced their plans to create just such prohibitions, and we expect other jurisdictions to follow suit. </p>\n<p data-HoCid=\"5147083\" data-originallang=\"en\">This approach is complemented by the other significant protections for youth in Bill <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a>. The proposed act creates new offences for those adults who either sell or distribute cannabis to youth, or who use a young person to commit a cannabis-related offence. It protects young people from promotional enticements to use cannabis, prohibits cannabis product packaging or labelling that are appealing to youth, and prohibits the sale of cannabis through self-service displays or vending machines.</p>\n<p data-HoCid=\"5147084\" data-originallang=\"en\">In addition to these legislative mechanisms, I would also like to remind members that our government will be undertaking a broad public education campaign to inform Canadians of all ages about the proposed legislation, including penalties for providing cannabis to youth and the risks involved with consuming cannabis. This public education campaign will focus on helping young Canadians make the best choices about their future and to understand the risks and consequences of using cannabis. This public education and awareness campaign has already begun, and it will continue to be an ongoing priority. To that end, last month our government announced $36.4 million over five years in funding for public education and awareness. This is in addition to the $9.6 million over five years toward a comprehensive public education and awareness campaign, and surveillance activities that we announced in budget 2017. </p>\n<p data-HoCid=\"5147085\" data-originallang=\"en\">I will now turn to the implementation and timing of Bill <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a>. Much has been conveyed about the timing of the implementation of the proposed cannabis act, with the suggestion being made that provinces and territories will not be ready, or that law enforcement will not be ready. Several witnesses at committee, however, rightfully pointed out that we need to act now. The Canadian Public Health Association responded to claims that we are not ready for legalization by advising the committee of the following:</p>\n<blockquote><p data-HoCid=\"5147086\" data-originallang=\"en\"> Unfortunately, we don't have the luxury of time, as Canadians are already consuming cannabis at record levels. The individual and societal harms associated with cannabis use are already being felt every day. The proposed legislation and eventual regulation is our best attempt to minimize those harms and protect the well-being of all Canadians. </p>\n</blockquote><p data-HoCid=\"5147087\" data-originallang=\"en\">Witnesses at committee further pointed out that there is always a perception that more time is needed, but that any delays would contribute to confusion among the population. </p>\n<p data-HoCid=\"5147088\" data-originallang=\"en\">Our government agrees that we need to act now, and we have been working closely with provinces and territories on many fronts, including through a federal-provincial-territorial senior officials working group. The working group has been kept apprised of developments on this file over the last year through meetings via teleconference every three weeks, as well as in-person meetings. Most recently, a meeting took place here in Ottawa on October 17 and 18. </p>\n<p data-HoCid=\"5147089\" data-originallang=\"en\"> Since the introduction of Bill <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a>, several federal-provincial-territorial issue-specific working groups have also been established to collaborate more closely on a range of complex issues, including drug-impaired driving, ticketable offences, taxation, and public education. </p>\n<p data-HoCid=\"5147090\" data-originallang=\"en\">Our government recognizes that providing support to provinces and territories for this work is critical. That is why we have committed, for instance, up to $81 million specifically to the provinces and territories to train front-line officers to recognize the signs and symptoms of impaired driving, build law enforcement capacity across the country, and provide access to drug screening devices. </p>\n<p data-HoCid=\"5147091\" data-originallang=\"en\">Our government is encouraged by the tremendous amount of work that has already been carried out in the provinces and territories. Many jurisdictions committed to and have completed public consultations on how cannabis legalization should be implemented. </p>\n<p data-HoCid=\"5147092\" data-originallang=\"en\">Ontario, Quebec, New Brunswick, and Alberta have released proposed legislation and frameworks describing how they will approach recreational cannabis, and Manitoba has enacted the Cannabis Harm Prevention Act. Clearly, many provinces are moving forward in anticipation of the July 2018 time frame.</p>\n<p data-HoCid=\"5147093\" data-originallang=\"en\">Recognizing that some provinces and territories may not have systems in place by the summer of 2018, our government is proposing to facilitate interim access to a regulated quality controlled supply from a federally licensed producer via online ordering, with secure home delivery through mail or courier. </p>\n<p data-HoCid=\"5147094\" data-originallang=\"en\">Our government's intention is to offset the broader costs associated with implementing this new system by collecting licensing and other fees, as well as through revenues generated through taxation, as is the case with the tobacco and alcohol industry. Discussions with provinces and territories around the proposed taxation plan have already begun and will continue. As part of our consultations on this matter, we welcome the feedback of all Canadians to ensure that we achieve the goal of keeping prices low enough to put criminals out of business while helping to offset the costs of education, administration, and enforcement.</p>\n<p data-HoCid=\"5147095\" data-originallang=\"en\">In conclusion, I would like to reiterate that Canada's current approach to cannabis continues to contribute to the profits of organized crime, risks to public health and safety, and exposes thousands of Canadians to criminal records for minor cannabis offences each year. Most Canadians no longer believe that simple possession of small amounts of cannabis should be subjected to harsh criminal sanctions. I would like to conclude by encouraging all members of this House to support Bill <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a>, as amended by the Standing Committee on Health.</p>",

Je profite de l'occasion pour remercier les membres du Comit\u00e9 du travail consid\u00e9rable qu'ils ont effectu\u00e9 dans ce dossier. Je parlerai dans un instant de certains de ces amendements fort valables mais, auparavant, je tiens \u00e0 rappeler aux d\u00e9put\u00e9s l'objectif principal que vise le projet de loi <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a>. </p>\n<p data-HoCid=\"5147062\" data-originallang=\"en\">Le projet de loi <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a> vise \u00e0 cr\u00e9er un cadre juridique qui permettra aux adultes de se procurer l\u00e9galement du cannabis par une vente au d\u00e9tail encadr\u00e9e et provenant d'une industrie bien r\u00e9glement\u00e9e ou de le cultiver en quantit\u00e9 limit\u00e9e \u00e0 la maison. En vertu du projet de loi, les gouvernements f\u00e9d\u00e9ral, provinciaux et territoriaux se partageraient la responsabilit\u00e9 de superviser le nouveau syst\u00e8me. Pour leur part, les gouvernements provinciaux et territoriaux seraient responsables des volets distribution et vente du cadre.</p>\n<p data-HoCid=\"5147064\" data-originallang=\"en\">Au-del\u00e0 du cadre l\u00e9gislatif \u00e9non\u00e7ant les r\u00e8gles r\u00e9gissant la production, la vente au d\u00e9tail, la distribution et la possession de cannabis, celui-ci demeurera une substance strictement interdite.</p>\n<p data-HoCid=\"5147065\" data-originallang=\"en\">La section 1 de la partie 1 du projet de loi indique clairement que bien des infractions qui s'appliquent actuellement au cannabis selon la Loi r\u00e9glementant certaines drogues et autres substances seront maintenues dans la Loi sur le cannabis. Cette approche est tout \u00e0 fait conforme aux recommandations contenues dans le rapport final du Groupe de travail sur la l\u00e9galisation et la r\u00e9glementation du cannabis.</p>\n<p data-HoCid=\"5147066\" data-originallang=\"en\">Dans son rapport, le Groupe de travail recommandait de maintenir les infractions p\u00e9nales pour la production illicite, le trafic, la possession en vue de trafic et la possession aux fins d'exportation, ainsi que l'importation et l'exportation de cannabis.</p>\n<p data-HoCid=\"5147067\" data-originallang=\"en\">Je vais maintenant parler des amendements adopt\u00e9s par le comit\u00e9. Pour l'instant, j'aimerais parler de cinq amendements bien pr\u00e9cis qui ont \u00e9t\u00e9 adopt\u00e9s lors de l'\u00e9tude article par article du projet de loi <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a>.</p>\n<p data-HoCid=\"5147068\" data-originallang=\"en\">Premi\u00e8rement, les restrictions concernant la hauteur des plants de cannabis qui peuvent \u00eatre cultiv\u00e9s \u00e0 domicile ont \u00e9t\u00e9 supprim\u00e9es. Cette restriction, limitant \u00e0 100 centim\u00e8tres la hauteur des plants, a \u00e9t\u00e9 propos\u00e9e pour parvenir \u00e0 un certain compromis: permettre la culture \u00e0 des fins personnelles tout en garantissant une protection contre les risques connus li\u00e9s aux gros plants, notamment le risque de d\u00e9tournement de cannabis \u00e0 l'ext\u00e9rieur du r\u00e9gime l\u00e9gal. La disposition sur la hauteur maximale des plants, en fait la proposition de restreindre la culture \u00e0 des fins personnelles, a suscit\u00e9 de nombreux commentaires, tant au comit\u00e9 de la sant\u00e9 que dans l'ensemble de la population. </p>\n<p data-HoCid=\"5147069\" data-originallang=\"en\">Nous comprenons le processus complexe qui a men\u00e9 \u00e0 la recommandation du Groupe de travail visant \u00e0 limiter \u00e0 100 centim\u00e8tres la hauteur des plants de cannabis, et nous acceptons la conclusion formul\u00e9e par le comit\u00e9 de la sant\u00e9 \u00e0 la suite des nombreux t\u00e9moignages au sujet des probl\u00e8mes qu'une telle limite pourrait vraisemblablement engendrer. </p>\n<p data-HoCid=\"5147070\" data-originallang=\"en\">Le gouvernement convient qu'il vaut mieux s'attaquer \u00e0 ce probl\u00e8me en dehors du droit p\u00e9nal. S'ils le d\u00e9sirent, les provinces et les territoires pourront se servir de leurs propres pouvoirs l\u00e9gislatifs pour r\u00e9glementer la hauteur des plants, et si ces m\u00eames pouvoirs sont conf\u00e9r\u00e9s aux municipalit\u00e9s, ces derni\u00e8res pourront faire de m\u00eame. </p>\n<p data-HoCid=\"5147071\" data-originallang=\"en\">Deuxi\u00e8mement, l'ajout de la disposition du bon samaritain exempt de toute accusation criminelle pour possession simple les personnes qui font appel aux services m\u00e9dicaux ou aux forces de l'ordre \u00e0 la suite d'une urgence m\u00e9dicale potentiellement mortelle mettant en cause une substance psychotrope. Il est d\u00e9montr\u00e9 que les personnes victimes ou t\u00e9moins d'une surdose de drogue ou d'un probl\u00e8me m\u00e9dical grave ont souvent peur d'appeler les services d'urgence parce qu'elles craignent d'\u00eatre poursuivies. L'ajout d'une disposition du bon samaritain dans le projet de loi sur le cannabis contribuerait \u00e0 faire en sorte que les gens communiquent et collaborent avec les services d'urgence lors d'une urgence m\u00e9dicale \u00e9tant donn\u00e9 qu'ils savent qu'ils ne seront pas accus\u00e9s d'une infraction mineure de possession.</p>\n<p data-HoCid=\"5147072\" data-originallang=\"en\">Troisi\u00e8mement, les modifications propos\u00e9es \u00e0 la Loi sur la sant\u00e9 des non-fumeurs pr\u00e9voient une certaine souplesse pour interdire l'usage du tabac ou du cannabis dans des espaces ext\u00e9rieurs pr\u00e9cis, ou dans des espaces r\u00e9glement\u00e9s dans les milieux de travail f\u00e9d\u00e9raux, ce qui prot\u00e9gerait les gens contre la fum\u00e9e du tabac ou du cannabis. Cette mesure s'harmonise avec la recommandation formul\u00e9e par la Soci\u00e9t\u00e9 canadienne du cancer. </p>\n<p data-HoCid=\"5147073\" data-originallang=\"en\">Quatri\u00e8mement, plut\u00f4t que d'imposer une amende au montant fixe de 200 $ pour un d\u00e9lit pouvant faire l'objet d'une contravention, les tribunaux se verront accorder le pouvoir discr\u00e9tionnaire d'imposer une amende pouvant atteindre 200 $, en tenant compte de divers facteurs, comme la capacit\u00e9 de l'accus\u00e9 \u00e0 payer l'amende, par exemple. </p>\n<p data-HoCid=\"5147074\" data-originallang=\"en\">Enfin, un amendement a \u00e9t\u00e9 adopt\u00e9 afin d'exiger la tenue d'un examen de la loi sur le cannabis trois ans apr\u00e8s son entr\u00e9e en vigueur et le d\u00e9p\u00f4t d'un rapport au Parlement sur les r\u00e9sultats de l'examen. </p>\n<p data-HoCid=\"5147075\" data-originallang=\"en\">\u00c9tant donn\u00e9 l'ampleur des changements pr\u00e9vus dans le projet de loi, il est important que l'actuel gouvernement communique clairement au Parlement et aux Canadiens l'incidence qu'aura la loi sur notre capacit\u00e9 \u00e0 r\u00e9aliser nos objectifs, soit prot\u00e9ger les jeunes et r\u00e9duire l'emprise du crime organis\u00e9. L'examen permettra aux parlementaires de d\u00e9terminer s'il faudra modifier la loi pour assurer la protection de la sant\u00e9 et la s\u00e9curit\u00e9 du public. </p>\n<p data-HoCid=\"5147076\" data-originallang=\"en\">Je vais maintenant parler de l'importante discussion qui a eu lieu sur le traitement r\u00e9serv\u00e9 aux jeunes au titre de la Loi sur le cannabis.</p>\n<p data-HoCid=\"5147077\" data-originallang=\"en\">Le Comit\u00e9 permanent de la sant\u00e9 a entendu des t\u00e9moins, y compris des avocats de la d\u00e9fense et des repr\u00e9sentantes de l'Association des infirmi\u00e8res et infirmiers du Canada, qui ont fait valoir que la possession de cannabis par des jeunes ne devrait pas entra\u00eener des peines criminelles, puisque criminaliser la possession de cinq grammes de cannabis ne dissuadera pas les jeunes d'en poss\u00e9der. Cela ne fera que perp\u00e9tuer l'application excessive de la loi pour les jeunes membres de la soci\u00e9t\u00e9 qui sont marginalis\u00e9s et qui appartiennent \u00e0 une minorit\u00e9 raciale.</p>\n<p data-HoCid=\"5147078\" data-originallang=\"en\">En revanche, d'autres personnes, dont des d\u00e9put\u00e9s de l'opposition, pr\u00e9conisent la tol\u00e9rance z\u00e9ro pour ce qui est de la possession de cannabis par les jeunes. Le gouvernement tient compte des pr\u00e9occupations li\u00e9es au fait d'exempter les jeunes qui ont en leur possession ou qui partagent un maximum de cinq grammes de poursuites criminelles et du fait que cette d\u00e9cision pourrait leur lancer un mauvais message.</p>\n<p data-HoCid=\"5147079\" data-originallang=\"en\">Comme je l'ai dit lorsque j'ai t\u00e9moign\u00e9 devant le comit\u00e9, le gouvernement a r\u00e9dig\u00e9 le projet de loi <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a> de fa\u00e7on \u00e0 ce que les jeunes ne disposent d'aucun moyen l\u00e9gal pour acheter ou faire l'acquisition de cannabis. Les jeunes ne doivent pas du tout avoir acc\u00e8s au cannabis.</p>\n<p data-HoCid=\"5147080\" data-originallang=\"en\">Cependant, faire en sorte que les jeunes soient passibles de poursuites p\u00e9nales pour avoir poss\u00e9d\u00e9 ou partag\u00e9 une tr\u00e8s petite quantit\u00e9 de cannabis pourrait avoir sur eux des r\u00e9percussions n\u00e9gatives en les exposant, tout particuli\u00e8rement les jeunes marginalis\u00e9s, au syst\u00e8me de justice p\u00e9nale.</p>\n<p data-HoCid=\"5147081\" data-originallang=\"en\">Nous nous sommes attach\u00e9s au message transmis au groupe de travail par la majorit\u00e9 des r\u00e9pondants, \u00e0 savoir que les sanctions p\u00e9nales doivent viser les adultes qui procurent du cannabis aux jeunes, et non ces derniers. Cela ne veut pas dire que le gouvernement consid\u00e8re comme acceptables que les jeunes soient en possession de cannabis ou en consomment. Le gouvernement a beaucoup r\u00e9fl\u00e9chi sur les moyens de garder le cannabis hors de port\u00e9e des jeunes et de d\u00e9courager ces derniers d\u2019en consommer.</p>\n<p data-HoCid=\"5147082\" data-originallang=\"en\">Le gouvernement a encourag\u00e9 les provinces et les territoires \u00e0 cr\u00e9er des infractions administratives visant \u00e0 emp\u00eacher les jeunes de poss\u00e9der quelque quantit\u00e9 de cannabis que ce soit, sans toutefois les exposer au syst\u00e8me de justice p\u00e9nale. La police aurait ainsi le pouvoir de saisir le cannabis dont un jeune dispose. Les provinces et les territoires utilisent cette approche mesur\u00e9e pour l\u2019alcool et le tabac dont disposent les jeunes, approche qui s\u2019est av\u00e9r\u00e9e efficace. Nous nous f\u00e9licitons que l\u2019Ontario, le Qu\u00e9bec et l\u2019Alberta aient d\u00e9j\u00e0 annonc\u00e9 leur plan relatif \u00e0 une telle interdiction et nous esp\u00e9rons que d\u2019autres provinces et territoires leur embo\u00eeteront le pas.</p>\n<p data-HoCid=\"5147083\" data-originallang=\"en\">Cette approche est assortie d\u2019autres protections importantes des jeunes pr\u00e9vus dans le projet de loi <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a>, qui cr\u00e9e de nouvelles infractions pour les adultes qui, soit vendent ou distribuent du cannabis aux jeunes, soit se servent d\u2019un jeune pour commettre une infraction li\u00e9e au cannabis. Le projet de loi prot\u00e8ge les jeunes du mat\u00e9riel promotionnel qui pourrait les inciter \u00e0 consommer. Il interdit l\u2019emballage ou l\u2019\u00e9tiquetage attirant pour les jeunes, ainsi que la vente de cannabis en libre-service ou dans des distributrices automatiques.</p>\n<p data-HoCid=\"5147084\" data-originallang=\"en\">Je rappelle aux d\u00e9put\u00e9s que, outre ces m\u00e9canismes l\u00e9gislatifs, le gouvernement entreprendra une vaste campagne d'\u00e9ducation du public afin de renseigner les Canadiens de tous \u00e2ges au sujet de la loi propos\u00e9e, y compris des sanctions pr\u00e9vues pour la distribution de cannabis \u00e0 un jeune et des risques associ\u00e9s \u00e0 la consommation de cannabis. La campagne, qui est d\u00e9j\u00e0 amorc\u00e9e et qui demeurera une priorit\u00e9 constante, vise avant tout \u00e0 aider les jeunes Canadiens \u00e0 faire le meilleur choix possible pour leur avenir et \u00e0 comprendre les risques et les cons\u00e9quences li\u00e9s \u00e0 la consommation de cannabis. Le gouvernement a annonc\u00e9 le mois dernier un financement de 36,4 millions de dollars r\u00e9partis sur cinq ans pour cette campagne. Ce montant s'ajoute aux 9,6 millions de dollars r\u00e9partis sur cinq ans annonc\u00e9s dans le budget de 2017 pour une campagne compl\u00e8te de sensibilisation et d'\u00e9ducation du public, ainsi que pour des activit\u00e9s de surveillance.</p>\n<p data-HoCid=\"5147085\" data-originallang=\"en\">Parlons maintenant de la mise en oeuvre du projet de loi <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a> et de l'\u00e9ch\u00e9ancier qui s'y rattache, un sujet qui a fait beaucoup parler. Certains laissent entendre que les provinces et les territoires ne seront pas pr\u00eats ou que les forces de l'ordre ne seront pas pr\u00eates. Or, plusieurs t\u00e9moins qui ont comparu devant le comit\u00e9 ont fait remarquer, avec raison, qu'il faut agir maintenant. En r\u00e9action aux affirmations voulant que nous ne soyons pas pr\u00eats pour la l\u00e9galisation, l'Association canadienne de sant\u00e9 publique a conseill\u00e9 au comit\u00e9 ceci:</p>\n<blockquote><p data-HoCid=\"5147086\" data-originallang=\"en\"> Malheureusement, le temps est un luxe que nous ne pouvons nous offrir, car les Canadiens consomment d\u00e9j\u00e0 des quantit\u00e9s records de marijuana. Les dommages pour les personnes et la soci\u00e9t\u00e9 caus\u00e9s par la consommation de cannabis se font d\u00e9j\u00e0 ressentir chaque jour. La loi propos\u00e9e et la r\u00e9glementation qui suivra sont le meilleur moyen de r\u00e9duire ces dommages et d'assurer le bien-\u00eatre de tous les Canadiens. </p>\n</blockquote><p data-HoCid=\"5147087\" data-originallang=\"en\">Les t\u00e9moins re\u00e7us par le comit\u00e9 ont \u00e9galement soulign\u00e9 qu'il y a toujours le sentiment qu'il faudrait pr\u00e9voir plus de temps, mais que tout d\u00e9lai contribue \u00e0 semer la confusion au sein de la population. </p>\n<p data-HoCid=\"5147088\" data-originallang=\"en\">Le gouvernement convient qu'il faut agir maintenant et nous collaborons avec les provinces et les territoires sur de nombreux fronts, notamment au moyen d'un groupe de travail f\u00e9d\u00e9ral-provincial-territorial form\u00e9 de hauts fonctionnaires. Ce groupe de travail demeure inform\u00e9 des d\u00e9veloppements dans ce dossier depuis un an au moyen de t\u00e9l\u00e9conf\u00e9rences tenues toutes les trois semaines et de r\u00e9unions en personne. Une r\u00e9union s'est d'ailleurs d\u00e9roul\u00e9e \u00e0 Ottawa les 17 et 18 octobre, tout r\u00e9cemment. </p>\n<p data-HoCid=\"5147089\" data-originallang=\"en\"> Depuis la pr\u00e9sentation du projet de loi <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a>, plusieurs groupes de travail f\u00e9d\u00e9raux-provinciaux-territoriaux assign\u00e9s \u00e0 des questions pr\u00e9cises ont \u00e9t\u00e9 mis sur pied afin d'accro\u00eetre la collaboration sur diff\u00e9rentes questions complexes, comme la conduite avec facult\u00e9s affaiblies par la drogue, les infractions passibles d'une amende, la taxation et la sensibilisation. </p>\n<p data-HoCid=\"5147090\" data-originallang=\"en\">Le gouvernement reconna\u00eet qu'il sera crucial de soutenir les provinces et territoires dans leurs efforts. C'est pourquoi, entre autres, nous avons engag\u00e9 jusqu'\u00e0 81 millions de dollars pour aider les provinces et les territoires \u00e0 former les intervenants de premi\u00e8re ligne \u00e0 reconna\u00eetre les signes et les sympt\u00f4mes de la conduite avec facult\u00e9s affaiblies, pour consolider la capacit\u00e9 des forces de l'ordre partout au pays et pour donner acc\u00e8s \u00e0 des appareils de d\u00e9tection des drogues. </p>\n<p data-HoCid=\"5147091\" data-originallang=\"en\">Le gouvernement est satisfait de voir tout le travail d\u00e9j\u00e0 accompli par les provinces et les territoires. Plusieurs d'entre eux ont d\u00e9j\u00e0 men\u00e9 les consultations publiques qu'ils avaient promises concernant la fa\u00e7on de mettre en oeuvre la l\u00e9galisation du cannabis. </p>\n<p data-HoCid=\"5147092\" data-originallang=\"en\">L'Ontario, le Qu\u00e9bec, le Nouveau-Brunswick et l'Alberta ont \u00e9labor\u00e9 des projets de loi et des cadres d\u00e9crivant comment ils entendent r\u00e9gir le cannabis consomm\u00e9 \u00e0 des fins r\u00e9cr\u00e9atives, tandis que le Manitoba a d\u00e9j\u00e0 adopt\u00e9 la Loi sur la r\u00e9duction des m\u00e9faits du cannabis. Bref, de nombreuses provinces font le n\u00e9cessaire pour \u00eatre pr\u00eates en juillet 2018.</p>\n<p data-HoCid=\"5147093\" data-originallang=\"en\">Comme il sait que certains territoires ou provinces pourraient ne pas s'\u00eatre encore dot\u00e9s de r\u00e8gles qui leur sont propres d'ici l'\u00e9t\u00e9 2018, le gouvernement permettra temporairement aux Canadiens de se procurer en ligne du cannabis dont la qualit\u00e9 aura \u00e9t\u00e9 contr\u00f4l\u00e9e et r\u00e9glement\u00e9e et qui aura \u00e9t\u00e9 cultiv\u00e9 par un producteur homologu\u00e9 par le f\u00e9d\u00e9ral, et de se le faire livrer \u00e0 domicile par la poste ou par messagerie.</p>\n<p data-HoCid=\"5147094\" data-originallang=\"en\">Pour att\u00e9nuer les co\u00fbts g\u00e9n\u00e9raux associ\u00e9s \u00e0 la mise en oeuvre des nouvelles r\u00e8gles, le gouvernement mise sur les droits des licences et les autres frais connexes de m\u00eame que sur les recettes fiscales, comme pour le tabac et l'alcool. Les discussions avec les provinces et les territoires concernant le plan fiscal propos\u00e9 ont d\u00e9j\u00e0 commenc\u00e9, et elles vont se poursuivre. Les Canadiens sont invit\u00e9s \u00e0 prendre part \u00e0 nos consultations, et nous prendrons connaissance de leurs commentaires avec beaucoup d'int\u00e9r\u00eat, car nous tenons \u00e0 ce que le prix du cannabis soit assez bas pour faire plier boutique aux criminels tout en contribuant \u00e0 att\u00e9nuer les co\u00fbts associ\u00e9s \u00e0 la sensibilisation, \u00e0 l'administration et \u00e0 l'application de la loi.</p>\n<p data-HoCid=\"5147095\" data-originallang=\"en\">Je terminerai en rappelant que l'approche actuelle du Canada concernant le cannabis continue de faire la joie du crime organis\u00e9, alimente les risques pour la sant\u00e9 et la s\u00e9curit\u00e9 et fait que, chaque ann\u00e9e, des milliers de Canadiens risquent de se retrouver avec un casier judiciaire parce qu'ils ont commis une infraction somme toute mineure. La plupart des Canadiens croient que la simple possession de petites quantit\u00e9s de cannabis ne devrait plus \u00eatre assortie de lourdes peines criminelles. Pour conclure, j'invite tous les d\u00e9put\u00e9s \u00e0 appuyer la version du projet de loi <a data-HoCid=\"8886269\" href=\"/bills/42-1/C-45/\" title=\"An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts\">C-45</a> modifi\u00e9e par le Comit\u00e9 permanent de la sant\u00e9.</p>"
