        "en": "<p data-HoCid=\"4027843\" data-originallang=\"en\">Mr. Speaker, before I begin, I would like to note that I will be sharing my time with the member for <a data-HoCid=\"170552\" href=\"/politicians/maurice-vellacott/\" title=\"Maurice Vellacott\">Saskatoon\u2014Wanuskewin</a>.</p>\n<p data-HoCid=\"4027844\" data-originallang=\"en\">When we come to this place, we all come with certain reasons behind what we want to accomplish. One, of course, is to improve the lives of Canadians. Another is sometimes to fix things that we believe are terribly wrong with our systems. For me, this legislation fits in the latter category of fixing something that we believe is terribly wrong.</p>\n<p data-HoCid=\"4027845\" data-originallang=\"en\">Many people have been fortunate, in their careers and their lives, and they have never been touched by this particular issue. They have been spared the heartbreaking view of what happens to these young children when they are violated. In my career, I spent many years working in a rural emergency department. When I rise both to speak to this bill and to vote, it will be with the victims that I will be making that vote. I will give just a few small examples before I actually talk about the technical aspects of this bill.</p>\n<p data-HoCid=\"4027846\" data-originallang=\"en\">I remember very clearly the 14-month-old who came in with incredibly bruised genitalia and a fractured femur. I remember three little girls. I remember the day their dad died in an accident. Two years later their mother remarried someone who then began to abuse those little girls. I remember a rape kit we had to pull out of the cupboards for a 12-year-old, barely pubescent young girl who had gone out and had a few drinks for the first time in her life. She had overdone it, and had then been brutally raped.</p>\n<p data-HoCid=\"4027847\" data-originallang=\"en\">I remember a nurse who worked the night shift. One day she went home and her daughter revealed that the step-dad had been climbing into the beds at night, and the absolute trauma and the guilt that this nurse experienced as she dealt with the fact that she had married someone who was abusing her most precious possessions.</p>\n<p data-HoCid=\"4027848\" data-originallang=\"en\">These are just some examples of what I experienced in my career. However, I was only representing a small area of this country, a small area of the province in terms of providing services. We have to recognize that these things are being repeated across the country many times over. Some are being reported; some are not.</p>\n<p data-HoCid=\"4027849\" data-originallang=\"en\">I have witnessed young girls going into the criminal system to share their testimony and not meeting that burden of guilt that was required, and seeing the person who had violated them go free.</p>\n<p data-HoCid=\"4027850\" data-originallang=\"en\">I hope this is a personal issue that everyone can stand up and support. </p>\n<p data-HoCid=\"4027851\" data-originallang=\"en\">I need to talk about the specifics of this bill. It set out to recognize the devastating impacts such crimes have on the lives of the victims. It ensures that justice is not only done for each victim, but also for each crime by requiring sexual offenders to serve sentences that are proportional to the degree of harm inflicted on each victim.</p>\n<p data-HoCid=\"4027852\" data-originallang=\"en\">What is it going to do? It is going to increase penalties for sexual offences committed against children. This includes increasing existing maximum and mandatory minimum terms of imprisonment for certain offences, as well as ending sentence discounts for child pornography offences where there are multiple child victims. Bill <a data-HoCid=\"6434291\" href=\"/bills/41-2/C-26/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act and the Sex Offender Information Registration Act, to enact the High Risk Child Sex Offender Database Act and to make consequential amendments to other Acts\">C-26</a> also increases the penalties for breach of a number of supervision orders. These amendments are necessary to protect the community from offenders who deliberately persist in reoffending, and this despite having been given the privilege of being conditionally released in the community.</p>\n<p data-HoCid=\"4027853\" data-originallang=\"en\"> Such amendments are not only integral to the protection of our communities, but necessary to incapacitate repeat sex child offenders who choose recidivism over rehabilitation, and continue unlawful conduct over peaceful reintegration into the community.</p>\n<p data-HoCid=\"4027854\" data-originallang=\"en\">Again, there is not one of us who as members of Parliament have not had concerned citizens phoning our offices when there is a repeat child offender released into their communities. In many cases I have seen them go on to repeat their crimes. We are all absolutely horrified that the system that we had in place did not actually address those issues.</p>\n<p data-HoCid=\"4027855\" data-originallang=\"en\">These proposed amendments would ensure consistency in punishment for breaches of prohibition orders imposed on child sexual offenders, section 161, breaches of probation orders, section 733.1, and breaches of peace bonds, section 811, imposed on individuals feared to be at risk of committing a sexual offence against a child.</p>\n<p data-HoCid=\"4027856\" data-originallang=\"en\">In all these cases, offenders would be liable to a maximum of four years imprisonment on indictment and 18 months imprisonment on summary conviction.</p>\n<p data-HoCid=\"4027857\" data-originallang=\"en\"> The bill would provide the same penalty for a breach of the new prohibition order, section 162.2, created by Bill <a data-HoCid=\"6301394\" href=\"/bills/41-2/C-13/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act, the Competition Act and the Mutual Legal Assistance in Criminal Matters Act\">C-13, the Protecting Canadians from Online Crime Act</a>, which can be imposed for the new offence of the non-consensual distribution of intimate images. Bill C-13 came into force on March 10, 2015.</p>\n<p data-HoCid=\"4027858\" data-originallang=\"en\">Furthermore, Bill <a data-HoCid=\"6434291\" href=\"/bills/41-2/C-26/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act and the Sex Offender Information Registration Act, to enact the High Risk Child Sex Offender Database Act and to make consequential amendments to other Acts\">C-26</a> would make it an aggravating factor on sentencing for an offender to commit an offence while on parole, statutory release, or an unescorted temporary absence or while being subject to a conditional sentence order.</p>\n<p data-HoCid=\"4027859\" data-originallang=\"en\">The proposed amendments would also ensure that the relevant evidence was available in prosecuting child predators in the case of child pornography. </p>\n<p data-HoCid=\"4027860\" data-originallang=\"en\">As a general rule, the spouse of a person accused of most offences cannot testify for the prosecution, even if the person wants to. The exceptions to this rule permit spousal testimony for most child sexual offences and the offence of violence against young persons, but it is important to note that it does not include child pornography offences.</p>\n<p data-HoCid=\"4027861\" data-originallang=\"en\">In the case of child pornography, evidence of the accused's spouse is often required to prove the guilt of the accused. For example, the spouse's denial of responsibility for child pornography or a shared home computer may be necessary to prove the accused's guilt beyond a reasonable doubt.</p>\n<p data-HoCid=\"4027862\" data-originallang=\"en\">Bill <a data-HoCid=\"6434291\" href=\"/bills/41-2/C-26/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act and the Sex Offender Information Registration Act, to enact the High Risk Child Sex Offender Database Act and to make consequential amendments to other Acts\">C-26</a> proposes to amend the Canada Evidence Act to add child pornography to the list of exceptions and to therefore make the spouse competent and compellable to testify for the prosecution.</p>\n<p data-HoCid=\"4027863\" data-originallang=\"en\">Bill <a data-HoCid=\"6434291\" href=\"/bills/41-2/C-26/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act and the Sex Offender Information Registration Act, to enact the High Risk Child Sex Offender Database Act and to make consequential amendments to other Acts\">C-26</a>'s proposed reforms also seek to build on existing measures to better protect children in Canada and abroad against sexual abuse by convicted child sex offenders. The bill proposes to establish a new, publicly accessible national database of high-risk offenders convicted of child sexual offences.</p>\n<p data-HoCid=\"4027864\" data-originallang=\"en\">Currently, all provinces and territories have the power to advise the public about the release of high-risk offenders. These notifications are made at the discretion of the police, and they contain characteristics about the offender and the nature of the offences committed.</p>\n<p data-HoCid=\"4027865\" data-originallang=\"en\">However, such notifications are limited to the jurisdiction and province where they are made. The bill seeks to expand access to all of those local notifications on a national scale. We do not have any boundaries in terms of where people go in Canada. The establishment of such a database would be a great example of a coordinated effort to protect the community against convicted high-risk sex offenders, because it would consolidate existing notifications in one publicly accessible spot. </p>\n<p data-HoCid=\"4027866\" data-originallang=\"en\">As I mentioned earlier, a complete and comprehensive response to child sexual exploitation also requires a coordinated effort that encompasses programs, services, and partnerships among key stakeholders, including federal, provincial, and territorial governments, law enforcement agencies, and civil society. In this respect, since 2010, the government has allocated $10.25 million for new or enhanced child advocacy centres to address the needs of child and youth victims of crime.</p>\n<p data-HoCid=\"4027867\" data-originallang=\"en\">We obviously have existing criminal prohibitions against child sexual abuse. However, the fact that it has been growing in the last few years at an extraordinary rate, as indicated earlier by my hon. colleague opposite, and the fact that children account for 55% of all victims of police-reported sexual offences, even though they account for only 20% of the Canadian population, is a stark reminder that more must be done.</p>\n<p data-HoCid=\"4027868\" data-originallang=\"en\">We must stop such heinous crimes. As such, I urge all members of the House to unanimously support the passage of Bill <a data-HoCid=\"6434291\" href=\"/bills/41-2/C-26/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act and the Sex Offender Information Registration Act, to enact the High Risk Child Sex Offender Database Act and to make consequential amendments to other Acts\">C-26</a>.</p>",

Certains veulent aussi r\u00e9gler les choses qui, \u00e0 leur avis, ne fonctionnent pas du tout dans nos syst\u00e8mes. \u00c0 mon avis, cette mesure l\u00e9gislative rel\u00e8ve de cette deuxi\u00e8me cat\u00e9gorie: elle permettra de combler des lacunes inacceptables.</p>\n<p data-HoCid=\"4027845\" data-originallang=\"en\">Nombreuses sont les personnes qui ont eu de la chance dans leur carri\u00e8re et dans leur vie personnelle et qui n'ont jamais \u00e9t\u00e9 concern\u00e9es par ce probl\u00e8me. Elles n'ont pas eu le coeur bris\u00e9 en observant ce qui arrive aux jeunes enfants qui subissent de tels abus. J'ai pass\u00e9 de nombreuses ann\u00e9es de ma carri\u00e8re \u00e0 travailler aux urgences d'une communaut\u00e9 rurale. C'est pour les victimes que je parle de ce projet de loi et que je voterai en faveur de celui-ci. J'aimerais donner quelques petits exemples avant de m'attarder aux aspects techniques du projet de loi.</p>\n<p data-HoCid=\"4027846\" data-originallang=\"en\">Je me souviens tr\u00e8s bien d'une adolescente de 14 ans dont les organes g\u00e9nitaux avaient \u00e9t\u00e9 atrocement mutil\u00e9s et qui avait subi une fracture du f\u00e9mur. Je me souviens de trois fillettes. Je me rappelle le jour o\u00f9 leur p\u00e8re est d\u00e9c\u00e9d\u00e9 dans un accident. Deux ans plus tard, leur m\u00e8re s'est remari\u00e9e avec un homme qui s'\u00e9tait alors mis \u00e0 agresser les fillettes. Je me souviens que nous avions d\u00fb utiliser la trousse de pr\u00e9l\u00e8vement en cas de viol sur une jeune fille de 12 ans, \u00e0 peine pub\u00e8re, qui \u00e9tait sortie et qui avait pris quelques verres pour la premi\u00e8re fois de sa vie. Elle avait bu un peu trop, puis avait \u00e9t\u00e9 brutalement viol\u00e9e.</p>\n<p data-HoCid=\"4027847\" data-originallang=\"en\">Je me souviens d'une infirmi\u00e8re qui travaillait de nuit. Un jour, \u00e0 son arriv\u00e9e \u00e0 la maison, sa fille lui avait confi\u00e9 que son beau-p\u00e8re allait la retrouver dans son lit la nuit. Cette infirmi\u00e8re a alors subi un grand traumatisme, et elle s'est sentie coupable parce qu'elle avait \u00e9pous\u00e9 un homme qui maltraitait son tr\u00e9sor le plus pr\u00e9cieux.</p>\n<p data-HoCid=\"4027848\" data-originallang=\"en\">Voil\u00e0 seulement quelques exemples de ce que j'ai v\u00e9cu au cours de ma carri\u00e8re. Toutefois, je ne repr\u00e9sentais qu'une petite r\u00e9gion du pays, un petit secteur de la province, sur le plan de la prestation de services. Nous devons reconna\u00eetre que ces horreurs se r\u00e9p\u00e8tent sans cesse partout au pays. Certains cas sont signal\u00e9s, alors que d'autres ne le sont pas.</p>\n<p data-HoCid=\"4027849\" data-originallang=\"en\">J'ai vu des jeunes filles s'adresser aux tribunaux p\u00e9naux sans que leur t\u00e9moignage suffise \u00e0 faire condamner leur agresseur, qui a ainsi pu conserver sa libert\u00e9.</p>\n<p data-HoCid=\"4027850\" data-originallang=\"en\">J'esp\u00e8re qu'il s'agit d'un dossier qui nous touche de pr\u00e8s et que tout le monde peut appuyer.</p>\n<p data-HoCid=\"4027851\" data-originallang=\"en\">Analysons le projet de loi dans le d\u00e9tail. Il vise \u00e0 reconna\u00eetre les effets d\u00e9vastateurs des crimes de cet ordre sur la vie des victimes. Il garantit que justice sera rendue non seulement \u00e0 chaque victime, mais aussi par rapport \u00e0 chaque infraction criminelle en imposant que l'agresseur sexuel purge une peine proportionnelle au pr\u00e9judice subi par sa victime.</p>\n<p data-HoCid=\"4027852\" data-originallang=\"en\">Qu'accomplira le projet de loi? Il alourdira les peines associ\u00e9es aux infractions sexuelles contre des enfants, notamment en augmentant les peines minimales obligatoires et les peines maximales pr\u00e9vues pour certaines infractions ainsi qu'en interdisant l'imposition de peines au rabais \u00e0 l'\u00e9gard des infractions de pornographie juv\u00e9nile impliquant plus d'une victime. Le projet de loi <a data-HoCid=\"6434291\" href=\"/bills/41-2/C-26/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act and the Sex Offender Information Registration Act, to enact the High Risk Child Sex Offender Database Act and to make consequential amendments to other Acts\">C-26</a> aggravera par ailleurs les sanctions associ\u00e9es au non-respect de diverses ordonnances de surveillance. Il faut absolument apporter ces modifications pour prot\u00e9ger les Canadiens contre les d\u00e9linquants qui s'ent\u00eatent \u00e0 r\u00e9cidiver m\u00eame apr\u00e8s avoir joui du privil\u00e8ge d'une lib\u00e9ration conditionnelle dans la collectivit\u00e9.</p>\n<p data-HoCid=\"4027853\" data-originallang=\"en\">Ces amendements sont \u00e0 la fois essentiels \u00e0 la protection des collectivit\u00e9s et n\u00e9cessaires \u00e0 la neutralisation des agresseurs sexuels d'enfant endurcis qui optent pour la r\u00e9cidive plut\u00f4t que pour la r\u00e9adaptation, pour la poursuite de leurs agissements criminels plut\u00f4t que pour une r\u00e9insertion sociale paisible.</p>\n<p data-HoCid=\"4027854\" data-originallang=\"en\">Tous les d\u00e9put\u00e9s parmi nous ont d\u00e9j\u00e0 re\u00e7u des appels de citoyens inquiets parce qu'un agresseur d'enfants r\u00e9cidiviste a \u00e9t\u00e9 lib\u00e9r\u00e9 dans leur circonscription. Dans bien des cas, ces agresseurs ont r\u00e9cidiv\u00e9. Nous sommes tous profond\u00e9ment horrifi\u00e9s que le syst\u00e8me n'ait pas su r\u00e9gler cette question.</p>\n<p data-HoCid=\"4027855\" data-originallang=\"en\">Les modifications propos\u00e9es uniformiseraient les sanctions impos\u00e9es aux agresseurs sexuels d'enfants qui ne respectent pas une ordonnance d'interdiction, \u00e0 l'article 161, ou une ordonnance de probation, \u00e0 l'article 733.1, et aux individus susceptibles de commettre une infraction d'ordre sexuel contre un enfant qui ne respectent pas un engagement de ne pas troubler l'ordre public, \u00e0 l'article 811.</p>\n<p data-HoCid=\"4027856\" data-originallang=\"en\">Dans tous les cas, les d\u00e9linquants seraient passibles d'une peine maximale d'emprisonnement de quatre ans sur d\u00e9claration de culpabilit\u00e9 par mise en accusation et d'une peine d'emprisonnement de 18 mois sur d\u00e9claration de culpabilit\u00e9 par proc\u00e9dure sommaire.</p>\n<p data-HoCid=\"4027857\" data-originallang=\"en\">Le projet de loi imposerait la m\u00eame peine en cas de non-respect de l'ordonnance d'interdiction \u2014 article 162.2 \u2014 instaur\u00e9e par le projet de loi <a data-HoCid=\"6301394\" href=\"/bills/41-2/C-13/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act, the Competition Act and the Mutual Legal Assistance in Criminal Matters Act\">C-13, Loi sur la protection des Canadiens contre la cybercriminalit\u00e9</a>, qui peut \u00eatre impos\u00e9e aux personnes reconnues coupables de la nouvelle infraction de distribution non consensuelle d'images intimes. Le projet de loi C-13 est entr\u00e9 en vigueur le 10 mars 2015.</p>\n<p data-HoCid=\"4027858\" data-originallang=\"en\">De plus, en vertu du projet de loi <a data-HoCid=\"6434291\" href=\"/bills/41-2/C-26/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act and the Sex Offender Information Registration Act, to enact the High Risk Child Sex Offender Database Act and to make consequential amendments to other Acts\">C-26</a>, les tribunaux devraient consid\u00e9rer comme une circonstance aggravante pour la d\u00e9termination de la peine le fait que le d\u00e9linquant ait commis une infraction alors qu'il b\u00e9n\u00e9ficiait d\u2019une lib\u00e9ration conditionnelle ou d\u2019office ou d\u2019une permission de sortir sans escorte ou qu'il faisait l\u2019objet d\u2019une ordonnance de sursis. </p>\n<p data-HoCid=\"4027859\" data-originallang=\"en\">Les modifications propos\u00e9es feraient aussi en sorte que le tribunal puisse tenir compte de tous les t\u00e9moignages pertinents dans les affaires de pornographie juv\u00e9nile.</p>\n<p data-HoCid=\"4027860\" data-originallang=\"en\">R\u00e8gle g\u00e9n\u00e9rale, le conjoint d'une personne accus\u00e9e de la plupart des infractions ne peut pas t\u00e9moigner pour la poursuite, et ce, m\u00eame s'il le souhaite. Les exceptions \u00e0 cette r\u00e8gle permettent le t\u00e9moignage des conjoints pour la plupart des infractions d'ordre sexuel contre des enfants et des infractions de violence faite aux jeunes, mais il est important de signaler qu'elles n'incluent pas les infractions de pornographie juv\u00e9nile.</p>\n<p data-HoCid=\"4027861\" data-originallang=\"en\">Pour ce qui est de la pornographie juv\u00e9nile, les preuves fournies par le conjoint de la personne accus\u00e9e sont souvent n\u00e9cessaires pour prouver la culpabilit\u00e9 de l'accus\u00e9. Par exemple, le d\u00e9ni de responsabilit\u00e9 du conjoint \u00e0 l'\u00e9gard de la pornographie juv\u00e9nile qui se trouve sur un ordinateur personnel partag\u00e9 pourrait \u00eatre n\u00e9cessaire pour prouver la culpabilit\u00e9 de l'accus\u00e9 hors de tout doute raisonnable. </p>\n<p data-HoCid=\"4027862\" data-originallang=\"en\">Le projet de loi <a data-HoCid=\"6434291\" href=\"/bills/41-2/C-26/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act and the Sex Offender Information Registration Act, to enact the High Risk Child Sex Offender Database Act and to make consequential amendments to other Acts\">C-26</a> propose de modifier la Loi sur la preuve du Canada afin d'ajouter la pornographie juv\u00e9nile \u00e0 la liste des exceptions et, par cons\u00e9quent, habiliter et contraindre le conjoint \u00e0 t\u00e9moigner pour la poursuite.</p>\n<p data-HoCid=\"4027863\" data-originallang=\"en\">Les r\u00e9formes propos\u00e9es dans le projet de loi <a data-HoCid=\"6434291\" href=\"/bills/41-2/C-26/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act and the Sex Offender Information Registration Act, to enact the High Risk Child Sex Offender Database Act and to make consequential amendments to other Acts\">C-26</a> s'appuient sur des mesures existantes pour mieux prot\u00e9ger les enfants contre l'exploitation sexuelle, au Canada et \u00e0 l'\u00e9tranger, par des d\u00e9linquants sexuels reconnus coupables. Ainsi, depuis 2010, le gouvernement a affect\u00e9 10,25 millions de dollars \u00e0 la cr\u00e9ation de centres d'appui aux enfants et \u00e0 l'am\u00e9lioration des centres existants, dans le but de r\u00e9pondre aux besoins des enfants et des adolescents victimes de crime.</p>\n<p data-HoCid=\"4027867\" data-originallang=\"en\">\u00c9videmment, il existe d\u00e9j\u00e0 des dispositions dans nos lois qui interdisent d'infliger des s\u00e9vices sexuels \u00e0 des enfants. Cependant, \u00e9tant donn\u00e9 que le nombre de ces actes a augment\u00e9 \u00e0 un rythme effarant au cours des derni\u00e8res ann\u00e9es, comme l'a indiqu\u00e9 tout \u00e0 l'heure mon coll\u00e8gue d'en face, et puisque 55 % des infractions sexuelles signal\u00e9es \u00e0 la police ont comme victimes des enfants, alors que ceux-ci ne constituent que 20 % de la population canadienne, les faits nous rappellent cruellement qu'il reste encore beaucoup \u00e0 faire.</p>\n<p data-HoCid=\"4027868\" data-originallang=\"en\">Nous devons mettre fin \u00e0 ces crimes haineux. C'est pourquoi j'exhorte les d\u00e9put\u00e9s \u00e0 appuyer unanimement le projet de loi <a data-HoCid=\"6434291\" href=\"/bills/41-2/C-26/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act and the Sex Offender Information Registration Act, to enact the High Risk Child Sex Offender Database Act and to make consequential amendments to other Acts\">C-26</a>.</p>"
