I also want to thank my colleague, the Liberal member of Parliament for <a data-HoCid=\"170396\" href=\"/politicians/sean-casey/\" title=\"Sean Casey\">Charlottetown</a>, who did an extensive amount of work on this, as well as the member of Parliament for <a data-HoCid=\"170158\" href=\"/politicians/wayne-easter/\" title=\"Wayne Easter\">Malpeque</a> and the member of Parliament for <a data-HoCid=\"170211\" href=\"/politicians/irwin-cotler/\" title=\"Irwin Cotler\">Mount Royal</a>.</p>\n<p data-HoCid=\"3749105\" data-originallang=\"en\">The enactment would amend the Criminal Code to provide most notably for a new offence of non-consensual distribution of intimate images. As well, there would complementary amendments to authorize the removal of such images from the Internet and the recovery of the expenses incurred to obtain the removal of images, the forfeiture of property used in the commission of the offence, a recognizance order to be issued to prevent the distribution of such images, and restriction of the use of a computer or the Internet by a convicted offender. </p>\n<p data-HoCid=\"3749106\" data-originallang=\"en\">We are talking about the power to make preservation demands and orders to compel the preservation of electronic evidence, new production orders to compel the production of data relating to the transmission of communications and the location of transactions, individuals or things.</p>\n<p data-HoCid=\"3749107\" data-originallang=\"en\"> A warrant that would extend the current investigative power for data associated with telephones to transmission data relating to all means of telecommunications, or warrants that would be associated with telephones and the like, as I mentioned, a streamlined process of obtaining warrants and orders related to an authorization to intercept private communications by ensuring that those warrants and orders could be issued by a judge who would issue the authorization and by specifying that all documents relating to a request for a related warrant or order would be automatically subject to the same rules respecting confidentiality as the request for authorization.</p>\n<p data-HoCid=\"3749108\" data-originallang=\"en\">Last, it would also amend the Competition Act to make applicable for the purpose of enforcing certain provisions of the act the new provisions being added to the Criminal Code respecting demands and orders for the preservation of computer data and orders for the production of documents related to the transmission or communications of financial data.</p>\n<p data-HoCid=\"3749109\" data-originallang=\"en\">It would also amend the Mutual Legal Assistance in Criminal Matters Act to make some of the new investigative powers being added to the Criminal Code available to Canadian authorities executing incoming requests for assistance and to allow the Commissioner of Competition to execute search warrants under the Mutual Legal Assistance in Criminal Matters Act that I spoke of earlier.</p>\n<p data-HoCid=\"3749110\" data-originallang=\"en\">There are some messages that we would like to put out there regarding this. This has been a long time coming. It was first introduced in the House on November 20, 2013. Cyberbullying is a scourge upon our society, as we all know, and has been evidenced certainly in the last two or three years. This is a problem not just in Canada but around the world. The party is supportive, in principle, of legislative measures that would provide law enforcement with additional tools to combat cyberbullying.</p>\n<p data-HoCid=\"3749111\" data-originallang=\"en\">This is an area where the Criminal Code urgently needs to be updated to reflect the realities of modern technologies.</p>\n<p data-HoCid=\"3749112\" data-originallang=\"en\">We believe, however, that legislative measures alone are insufficient to combat cyberbullying and we urge the government to commit to a broader, more holistic strategy to deal with cyberbullying that would also include public awareness resources for both parents and kids to allow them to see the signs of cyberbullying which they probably would not recognize under normal circumstances.</p>\n<p data-HoCid=\"3749113\" data-originallang=\"en\">We introduced cyberbullying legislation last session that would have modified some Criminal Code offences to cover modern technology, as is done in <a data-HoCid=\"6301394\" href=\"/bills/41-2/C-13/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act, the Competition Act and the Mutual Legal Assistance in Criminal Matters Act\">C-13</a>, which the Conservatives and the NDP voted down. The Liberals introduced legislation that would have addressed new technologies back in 2005. </p>\n<p data-HoCid=\"3749114\" data-originallang=\"en\">The Conservative government is only figuring out now that police forces need these tools to keep up with technologies that are increasingly a part of today's crime.</p>\n<p data-HoCid=\"3749115\" data-originallang=\"en\">We believe that a balance must be struck between civil liberties and public safety, particularly when it comes to warrants that may be intrusive and overboard. We do not support the measures that were in Bill <a data-HoCid=\"5375610\" href=\"/bills/41-1/C-30/\" title=\"An Act to enact the Investigating and Preventing Criminal Electronic Communications Act and to amend the Criminal Code and other Acts\">C-30</a>, which even the government had to withdraw because of the outrage some time ago.</p>\n<p data-HoCid=\"3749116\" data-originallang=\"en\">Some of the bill would duplicate the rejected Bill <a data-HoCid=\"5375610\" href=\"/bills/41-1/C-30/\" title=\"An Act to enact the Investigating and Preventing Criminal Electronic Communications Act and to amend the Criminal Code and other Acts\">C-30</a>, such as word for word reproductions of the changes, subsection 487.3(1) of the Criminal Code and all but one word changes to subsection 492.1 and subsection 492 regarding warrants.</p>\n<p data-HoCid=\"3749117\" data-originallang=\"en\">We are very concerned about efforts to reintroduce lawful access, which the Conservatives promised was dead at the time. That is not necessarily the case now.</p>\n<p data-HoCid=\"3749118\" data-originallang=\"en\">Though the title is the protecting Canadians from online crime act, nobody is actually protected under this act. In typical fashion, this is all about punishment rather than prevention. Complex problems like cyberbullying require more than blunt editions to the Criminal Code. This omnibus bill touches everything from terrorism to telemarketing, cable stealing to hate speech, and is an affront to both democracy and the legislative process in the omnibus form that has been in going on in for quite some time.</p>\n<p data-HoCid=\"3749119\" data-originallang=\"en\"> We have seen that through the budget bills and a lot of the legislation that has passed through the House, so we can only assume that this type of pattern will continue with this legislation. Therefore, we support the motion to have the bill split and the provisions relating to cyberbullying be contained in a stand-alone bill at committee.</p>\n<p data-HoCid=\"3749120\" data-originallang=\"en\">We are proposing two amendments.</p>\n<p data-HoCid=\"3749121\" data-originallang=\"en\"> The first is an amendment that would provide for a statutory review of elements of the bill, including the voluntary disclosure provisions. The sunset clause is a part of a law statute and we can repeal the law part over a specified time period.</p>\n<p data-HoCid=\"3749122\" data-originallang=\"en\"> The second is an amendment that would require an actual basis a report by telecoms detailing the volume of information being disclosed without a warrant. </p>\n<p data-HoCid=\"3749123\" data-originallang=\"en\">As we mentioned earlier, we talked about the splitting of this bill, and we certainly feel this is a way to go. This would be the most responsible thing to do in light of the omnibus nature of this legislation. I believe that by doing this, we would be taking a principled and responsible approach. </p>\n<p data-HoCid=\"3749124\" data-originallang=\"en\">Again, I go back to our original message of cyberbullying, which is a scourge on our society. What we can do in the House is reflect by looking at stand-alone legislation dealing with that. Basically, by making this a stand-alone provision, it would go a long way in enhancing the debate. Given the fact that we have had so much debate in the past, so much opposition and that there has been so much talk in the public realm about this legislation, this is something we can support.</p>",

Comme je l'ai dit, il s'agit de simplifier l'obtention de mandats et d'ordonnances li\u00e9s \u00e0 l'autorisation d'intercepter des communications priv\u00e9es, car il est pr\u00e9cis\u00e9 que ces mandats et ordonnances pourraient \u00eatre d\u00e9livr\u00e9s par le juge ayant accord\u00e9 l'autorisation d'interception, et que tous les documents li\u00e9s \u00e0 la demande de mandat ou d'ordonnance en question seraient automatiquement assujettis aux m\u00eames r\u00e8gles en mati\u00e8re de confidentialit\u00e9 que l'autorisation d'interception.</p>\n<p data-HoCid=\"3749108\" data-originallang=\"en\">Enfin, le projet de loi modifierait la Loi sur la concurrence afin de rendre applicables, pour assurer le contr\u00f4le d\u2019application de certaines dispositions de cette loi, les nouvelles dispositions du Code criminel concernant les ordres et ordonnances de pr\u00e9servation de donn\u00e9es informatiques et les ordonnances de communication \u00e0 l\u2019\u00e9gard de documents li\u00e9s \u00e0 la transmission ou \u00e0 la communication de donn\u00e9es financi\u00e8res.</p>\n<p data-HoCid=\"3749109\" data-originallang=\"en\">Il modifierait aussi la Loi sur l\u2019entraide juridique en mati\u00e8re criminelle afin que certains des nouveaux pouvoirs d\u2019enqu\u00eate pr\u00e9vus au Code criminel puissent \u00eatre utilis\u00e9s par les autorit\u00e9s canadiennes qui re\u00e7oivent des demandes d\u2019assistance et afin que le commissaire de la concurrence puisse ex\u00e9cuter des mandats de perquisition d\u00e9livr\u00e9s en vertu de la Loi sur l\u2019entraide juridique en mati\u00e8re criminelle, un sujet dont j'ai parl\u00e9 tout \u00e0 l'heure.</p>\n<p data-HoCid=\"3749110\" data-originallang=\"en\">Nous aimerions communiquer certains messages au sujet de ce projet de loi. Nous attendions ces dispositions l\u00e9gislatives depuis longtemps. Le projet de loi a \u00e9t\u00e9 pr\u00e9sent\u00e9 \u00e0 la Chambre le 20 novembre 2013. La cyberintimidation est un fl\u00e9au pour notre soci\u00e9t\u00e9, comme nous avons pu le constater tout particuli\u00e8rement au cours de deux ou trois derni\u00e8res ann\u00e9es. Ce probl\u00e8me ne touche pas que le Canada: il s\u00e9vit dans le monde entier. Le Parti lib\u00e9ral appuie en principe les mesures l\u00e9gislatives qui permettraient aux forces de l'ordre d'obtenir des outils suppl\u00e9mentaires pour lutter contre la cyberintimidation.</p>\n<p data-HoCid=\"3749111\" data-originallang=\"en\">Il faut de toute urgence mettre \u00e0 jour le Code criminel pour qu'il tienne compte des technologies modernes dans ce domaine particulier.</p>\n<p data-HoCid=\"3749112\" data-originallang=\"en\">Toutefois, nous croyons que, seules, les mesures l\u00e9gislatives sont insuffisantes pour lutter contre la cyberintimidation. C'est pourquoi nous exhortons le gouvernement \u00e0 adopter une strat\u00e9gie plus vaste et plus holistique de lutte contre la cyberintimidation. Cette strat\u00e9gie pr\u00e9voirait des ressources afin de sensibiliser les parents et les enfants pour qu'ils puissent d\u00e9tecter les indices de la cyberintimidation qu'ils ne pourraient probablement pas reconna\u00eetre en temps normal.</p>\n<p data-HoCid=\"3749113\" data-originallang=\"en\">Au cours de la derni\u00e8re session, nous avons pr\u00e9sent\u00e9 un projet de loi sur la cyberintimidation qui aurait eu pour effet de modifier certaines infractions pr\u00e9vues au Code criminel afin de tenir compte de la technologie moderne, comme le fait le projet de loi <a data-HoCid=\"6301394\" href=\"/bills/41-2/C-13/\" title=\"An Act to amend the Criminal Code, the Canada Evidence Act, the Competition Act and the Mutual Legal Assistance in Criminal Matters Act\">C-13</a>. Toutefois, les conservateurs et les n\u00e9o-d\u00e9mocrates ont vot\u00e9 contre cette mesure l\u00e9gislative. En 2005, les lib\u00e9raux ont pr\u00e9sent\u00e9 un projet de loi qui aurait permis de prendre en compte les nouvelles technologies.</p>\n<p data-HoCid=\"3749114\" data-originallang=\"en\">Le gouvernement conservateur vient tout juste de se rendre compte que les services de police ont besoin de ces outils pour rester bien au fait des technologies auxquelles les criminels ont de plus en plus recours.</p>\n<p data-HoCid=\"3749115\" data-originallang=\"en\">Nous croyons qu'il faut \u00e9tablir un \u00e9quilibre entre les libert\u00e9s civiles et la s\u00e9curit\u00e9 publique, en particulier dans le cas de mandats qui risquent d'empi\u00e9ter sur la vie priv\u00e9e et de d\u00e9passer les bornes. Nous n'\u00e9tions pas en faveur des mesures contenues dans le projet de loi <a data-HoCid=\"5375610\" href=\"/bills/41-1/C-30/\" title=\"An Act to enact the Investigating and Preventing Criminal Electronic Communications Act and to amend the Criminal Code and other Acts\">C-30</a>. Fid\u00e8les \u00e0 leurs habitudes, les conservateurs pr\u00e9f\u00e8rent encore cette fois-ci les sanctions \u00e0 la pr\u00e9vention. Les probl\u00e8mes complexes comme la cyberintimidation n\u00e9cessitent bien plus que des modifications grossi\u00e8res au Code criminel. Ce projet de loi omnibus, qui touche autant le terrorisme que le t\u00e9l\u00e9marketing, le vol de signaux de c\u00e2blodistribution et les propos haineux, constitue une atteinte autant \u00e0 la d\u00e9mocratie qu'au processus l\u00e9gislatif l\u00e9gitime et de longue date que sont les mesures omnibus.</p>\n<p data-HoCid=\"3749119\" data-originallang=\"en\">J'en veux pour preuve les projets de loi budg\u00e9taires ainsi que bon nombre des mesures l\u00e9gislatives adopt\u00e9es par la Chambre. On peut ais\u00e9ment supposer qu'il en sera ainsi encore cette fois. Nous allons donc appuyer la motion portant que le projet de loi soit scind\u00e9 et que les dispositions qui traitent de la cyberintimidation fassent l'objet d'un projet de loi \u00e0 part enti\u00e8re.</p>\n<p data-HoCid=\"3749120\" data-originallang=\"en\">Nous proposons deux amendements.</p>\n<p data-HoCid=\"3749121\" data-originallang=\"en\">Le premier inscrirait dans la loi que les divers \u00e9l\u00e9ments du projet de loi, y compris les dispositions sur la divulgation volontaire, devront faire l'objet d'un examen obligatoire. La disposition de caducit\u00e9 fait partie du texte, et nous pouvons abroger une partie de la loi apr\u00e8s une p\u00e9riode pr\u00e9\u00e9tablie. </p>\n<p data-HoCid=\"3749122\" data-originallang=\"en\">Le second amendement obligerait les entreprises de t\u00e9l\u00e9communications \u00e0 faire rapport dans le d\u00e9tail du nombre de donn\u00e9es divulgu\u00e9es sans mandat.</p>\n<p data-HoCid=\"3749123\" data-originallang=\"en\">Comme nous le disions plus t\u00f4t, il a \u00e9t\u00e9 question de scinder ce projet de loi, et nous croyons de notre c\u00f4t\u00e9 que c'est la chose \u00e0 faire. Ce serait en tout cas la chose responsable \u00e0 faire, vu la nature omnibus de cette mesure l\u00e9gislative. Je crois \u00e9galement que, ce faisant, nous respecterions nos principes et agirions de mani\u00e8re responsable.</p>\n<p data-HoCid=\"3749124\" data-originallang=\"en\">Je reviens un instant au fl\u00e9au social qu'est la cyberintimidation. La Chambre pourrait tr\u00e8s bien \u00e9tudier une mesure l\u00e9gislative distincte qui porterait uniquement sur ce probl\u00e8me. En fait, le d\u00e9bat n'en serait que rehauss\u00e9. Dans la mesure o\u00f9 nous avons abondamment d\u00e9battu de cette mesure l\u00e9gislative jusqu'ici, qu'elle a soulev\u00e9 un v\u00e9ritable toll\u00e9 et qu'il en a \u00e9t\u00e9 tr\u00e8s souvent question dans la sph\u00e8re publique, nous voterions en faveur d'une telle proposition.</p>"
