"en": "<p data-HoCid=\"3351435\" data-originallang=\"en\">Mr. Speaker, I would like to enumerate some of the goals of the justice system, because it is important that we place legislation dealing with criminal offences and so on within the context of the principles that guide the justice system. We could say that the point of the justice system is, first, to reinforce acceptable norms of behaviour; second, to protect society from those who have proven that their actions can cause harm; and third, to ensure that only the guilty pay for their crimes and that the innocent are not convicted. These seem to be, in general, the overriding goals of our justice system, a system that has evolved slowly but surely over centuries.</p>\n<p data-HoCid=\"3351436\" data-originallang=\"en\"> It turns out that because the justice system is focusing on these three principles, often the interests of victims are ignored, albeit unintentionally. Bill <a data-HoCid=\"6077022\" href=\"/bills/41-1/C-489/\" title=\"An Act to amend the Criminal Code and the Corrections and Conditional Release Act (restrictions on offenders)\">C-489</a> would attempt to provide some assistance to victims.</p>\n<p data-HoCid=\"3351437\" data-originallang=\"en\"> Bill <a data-HoCid=\"6077022\" href=\"/bills/41-1/C-489/\" title=\"An Act to amend the Criminal Code and the Corrections and Conditional Release Act (restrictions on offenders)\">C-489</a> would deal mostly with sexual offences, though not exclusively, as I understand it. Sexual offences create a unique kind of vulnerability among the victims. They are a unique kind of violation compared to, for example, car theft or house break-ins when individuals are not at home. Both of those crimes create a terrible sense of vulnerability as well, but we are talking here of sexual offences and the particular sense of vulnerability they create.</p>\n<p data-HoCid=\"3351438\" data-originallang=\"en\"> I agree with the hon. member that the interests of victims of sexual crimes have often been overlooked in our criminal justice system. Liberals support the intent of Bill <a data-HoCid=\"6077022\" href=\"/bills/41-1/C-489/\" title=\"An Act to amend the Criminal Code and the Corrections and Conditional Release Act (restrictions on offenders)\">C-489</a>. We are not certain that the bill would bring about meaningful progress in all cases for victims or prospective victims of sexual crimes. I say \u201cprospective\u201d victims, because the bill would also deal with recognizance orders, where an individual has not committed a criminal act but poses a threat to another person. </p>\n<p data-HoCid=\"3351439\" data-originallang=\"en\">We support sending the bill to committee to ascertain its merits in attaining a goal that, obviously, we all share in this House.</p>\n<p data-HoCid=\"3351440\" data-originallang=\"en\">I understand that the bill is motivated by the MP for <a data-HoCid=\"170478\" href=\"/politicians/mark-warawa/\" title=\"Mark Warawa\">Langley</a>'s particular experience with some victims in his riding. In fact, the member stated:</p>\n<blockquote><p data-HoCid=\"3351441\" data-originallang=\"en\"> [A] sex offender...was permitted to serve House arrest right next door to his young victim. In another case, the sex offender served House arrest across the street from the victim. In both cases, the young victims lived in fear and were re-victimized every time they saw their attacker. </p>\n</blockquote><p data-HoCid=\"3351442\" data-originallang=\"en\">Obviously, that situation, which the hon. member for <a data-HoCid=\"170478\" href=\"/politicians/mark-warawa/\" title=\"Mark Warawa\">Langley</a> described, leaves all members in disbelief and with a view that something should be done.</p>\n<p data-HoCid=\"3351443\" data-originallang=\"en\">Bill <a data-HoCid=\"6077022\" href=\"/bills/41-1/C-489/\" title=\"An Act to amend the Criminal Code and the Corrections and Conditional Release Act (restrictions on offenders)\">C-489</a> would introduce two prohibitions through amendments to two laws. Number one, it would amend the Criminal Code, and number two, it would amend the Corrections and Conditional Release Act.</p>\n<p data-HoCid=\"3351444\" data-originallang=\"en\">In terms of Criminal Code changes, as I understand it, the bill would deal with subsection 161(1) of the Criminal Code, which allows conditions to be placed on offenders who receive conditional discharges for sexual offences. This discharge is sometimes granted in cases where the offence carries no minimum sentence and a maximum possible sentence of less than 14 years. In this case, as I understand it, the accused would not have a criminal record if all of the conditions imposed as part of the conditional discharge were respected.</p>\n<p data-HoCid=\"3351445\" data-originallang=\"en\">Bill <a data-HoCid=\"6077022\" href=\"/bills/41-1/C-489/\" title=\"An Act to amend the Criminal Code and the Corrections and Conditional Release Act (restrictions on offenders)\">C-489</a> seeks to add to the list of conditions that may be imposed by a judge. This is a very specific list, and as I understand it, the judge cannot impose conditions beyond this list. It is important that a specific point be made in adding this condition, because it is not something the judge could impose if he or she saw fit. We are talking about the condition that an offender must be no closer than two kilometres from the house where he or she knows or ought to know that the victim is alone. Similarly, another condition would be that the offender would not be allowed to be in a private vehicle with any person under the age of 16 without his or her guardians' consent.</p>\n<p data-HoCid=\"3351446\" data-originallang=\"en\">It is important to note that the list of possible conditions in this instance is finite. There is no flexibility here for the judge to impose other conditions beyond those listed. Therefore, this is the only place where adding conditions might make sense, since it gives the sentencing judge the ability to prohibit the offender from living near the victim. As I said, it is important to specify the condition, because there is no latitude for the judge to impose it.</p>\n<p data-HoCid=\"3351447\" data-originallang=\"en\">In the bill there is also a restriction on contacting victims. I am not sure if it pertains to those who have committed sexual offences. The bill extends the list of conditions the court must, or shall, prescribe for offenders on probation.</p>\n<p data-HoCid=\"3351448\" data-originallang=\"en\"> At the moment, section 732.1 of the code has two sets of conditions. One set is conditions the judge shall impose. The second set is conditions the judge may impose.</p>\n<p data-HoCid=\"3351449\" data-originallang=\"en\">In this case, the bill would add a new \u201cshall\u201d condition. The court would have to impose this condition on an offender, for example, who is on probation or is under a conditional sentence. If it chose not to impose the condition, the court would have to explain, in writing, why it was not choosing to add this condition.</p>\n<p data-HoCid=\"3351450\" data-originallang=\"en\">We understand the intent of this part of the bill. What I would say is that, at the moment, the list of possible conditions for probation orders and conditional sentences both include \u201csuch other reasonable conditions as the court considers desirable.\u201d In other words, in this case, the judge has the latitude to impose conditions that are not specifically prescribed on a list. Presumably, the court could already order offenders not to have contact with their victims or not to visit certain places, if it saw fit to do so.</p>\n<p data-HoCid=\"3351451\" data-originallang=\"en\">The point I am trying to make is that unlike the first amendment, about staying within two kilometres of where the victim would be residing, in this case, we have to ask ourselves if this particular amendment to the Criminal Code is necessary, given that the court already has the latitude to impose this condition.</p>\n<p data-HoCid=\"3351452\" data-originallang=\"en\">I congratulate the hon. member for bringing this bill forward. I know that he is attempting to address a very serious flaw in our criminal justice system. I look forward to discussing and studying the bill at committee so that we can see and understand the extent to which the bill achieves its stated goals.</p>",

Les lib\u00e9raux adh\u00e8rent \u00e0 l'esprit du projet de loi <a data-HoCid=\"6077022\" href=\"/bills/41-1/C-489/\" title=\"An Act to amend the Criminal Code and the Corrections and Conditional Release Act (restrictions on offenders)\">C-489</a>. Mais nous ne sommes pas certains que ce projet de loi constituerait dans tous les cas un progr\u00e8s pour les victimes ou les victimes potentielles de crimes sexuels. Voici d'ailleurs ce que le d\u00e9put\u00e9 a d\u00e9clar\u00e9: </p>\n<blockquote><p data-HoCid=\"3351441\" data-originallang=\"en\"> [...] un d\u00e9linquant sexuel a \u00e9t\u00e9 autoris\u00e9 \u00e0 purger sa peine \u00e0 domicile, juste \u00e0 c\u00f4t\u00e9 de la r\u00e9sidence de sa jeune victime. Un autre d\u00e9linquant sexuel a purg\u00e9 sa peine dans sa maison, qui \u00e9tait situ\u00e9e en face du domicile de sa jeune victime. Dans les deux cas, les pauvres victimes vivaient dans la peur et \u00e9taient victimis\u00e9es de nouveau chaque fois qu'elles voyaient leur agresseur. </p>\n</blockquote><p data-HoCid=\"3351442\" data-originallang=\"en\">\u00c9videmment, tous les d\u00e9put\u00e9s sont estomaqu\u00e9s lorsqu'ils entendent le d\u00e9put\u00e9 de <a data-HoCid=\"170478\" href=\"/politicians/mark-warawa/\" title=\"Mark Warawa\">Langley</a> leur d\u00e9crire de pareilles situations et ils sont d'avis qu'il faut y rem\u00e9dier.</p>\n<p data-HoCid=\"3351443\" data-originallang=\"en\">Le projet de loi <a data-HoCid=\"6077022\" href=\"/bills/41-1/C-489/\" title=\"An Act to amend the Criminal Code and the Corrections and Conditional Release Act (restrictions on offenders)\">C-489</a> comprend deux mesures d'interdiction qui seraient int\u00e9gr\u00e9es \u00e0 deux lois. Il modifierait premi\u00e8rement le Code criminel et, deuxi\u00e8mement, la Loi sur le syst\u00e8me correctionnel et la mise en libert\u00e9 sous condition.</p>\n<p data-HoCid=\"3351444\" data-originallang=\"en\">En ce qui concerne les modifications au Code criminel, d'apr\u00e8s ce que je comprends, elles porteront notamment sur le paragraphe 161(1), qui permet l'imposition de conditions lors de la lib\u00e9ration sous condition de d\u00e9linquants coupables d'infractions sexuelles. Dans ce cas, si je comprends bien, l'accus\u00e9 n'aurait pas de casier judiciaire si toutes les conditions impos\u00e9es dans le cadre de la mise en libert\u00e9 sous condition sont respect\u00e9es. </p>\n<p data-HoCid=\"3351445\" data-originallang=\"en\">Le projet de loi <a data-HoCid=\"6077022\" href=\"/bills/41-1/C-489/\" title=\"An Act to amend the Criminal Code and the Corrections and Conditional Release Act (restrictions on offenders)\">C-489</a> vise \u00e0 allonger la liste des conditions que le juge peut imposer. Cette liste est tr\u00e8s pr\u00e9cise et, si je ne m'abuse, le juge ne peut pas s'en \u00e9carter. Une observation doit \u00eatre faite au sujet de la condition qui y est ajout\u00e9e, car ce n'est pas quelque chose que le juge pourra imposer \u00e0 sa guise. Il s'agit de l'interdiction, pour un d\u00e9linquant, de se trouver \u00e0 moins de deux kilom\u00e8tres de la maison o\u00f9 il sait ou devrait savoir que la victime se trouve seule. Le d\u00e9linquant ne pourra pas non plus se trouver dans un v\u00e9hicule personnel avec une personne de moins de 16 ans sans le consentement de la personne qui en a la garde. </p>\n<p data-HoCid=\"3351446\" data-originallang=\"en\">Il importe de souligner que dans ce cas, la liste des conditions possibles est limit\u00e9e. Ainsi, le juge ne peut imposer d'autres conditions que celles figurant dans la liste. Par cons\u00e9quent, ce n'est qu'\u00e0 cet endroit qu'il serait logique d'ajouter des conditions, car cela donnerait au juge qui prononce la peine la capacit\u00e9 d'interdire au d\u00e9linquant d'habiter pr\u00e8s de sa victime. Comme je l'ai mentionn\u00e9, il est important de pr\u00e9ciser cette condition, car le juge ne peut l'imposer de son propre chef.</p>\n<p data-HoCid=\"3351447\" data-originallang=\"en\">Le projet de loi interdit \u00e9galement au d\u00e9linquant de communiquer avec les victimes. Je ne saurais toutefois dire si cette interdiction s'applique aux d\u00e9linquants qui ont commis des infractions d'ordre sexuel. Le projet de loi vient allonger la liste des conditions que le tribunal doit imposer aux d\u00e9linquants vis\u00e9s par une ordonnance de probation.</p>\n<p data-HoCid=\"3351448\" data-originallang=\"en\">\u00c0 l'heure actuelle, l'article 732.1 du Code pr\u00e9voit deux types de conditions. D'une part, des conditions obligatoires, que le juge doit imposer, et, d'autre part, des conditions facultatives, que le juge peut imposer.</p>\n<p data-HoCid=\"3351449\" data-originallang=\"en\">En l'occurrence, le projet de loi ajouterait une nouvelle condition obligatoire. Le tribunal devrait donc imposer cette condition \u00e0 tout d\u00e9linquant qui, par exemple, est en probation ou a re\u00e7u une peine avec sursis. Si le tribunal d\u00e9cide de ne pas imposer cette condition, il devra justifier sa d\u00e9cision par \u00e9crit.</p>\n<p data-HoCid=\"3351450\" data-originallang=\"en\">Nous comprenons le but de cette partie du projet de loi. J'aimerais mentionner que, \u00e0 l'heure actuelle, la liste des conditions tant en ce qui concerne les ordonnances de probation que les ordonnances de sursis pr\u00e9voit l'imposition de \u00ab telles autres conditions raisonnables que le tribunal consid\u00e8re souhaitables \u00bb. Autrement dit, dans ces cas, le juge peut imposer des conditions qui ne sont pas express\u00e9ment \u00e9nonc\u00e9es dans une liste. On peut donc supposer que le tribunal, s'il le juge n\u00e9cessaire, pourrait d\u00e9j\u00e0 ordonner au d\u00e9linquant de ne pas communiquer avec ses victimes ou de ne pas se rendre \u00e0 certains endroits.</p>\n<p data-HoCid=\"3351451\" data-originallang=\"en\">Ce que j'essaie de dire, c'est que contrairement \u00e0 la premi\u00e8re modification, qui consiste \u00e0 interdire au d\u00e9linquant de se trouver \u00e0 moins de deux kilom\u00e8tres d'une maison d'habitation o\u00f9 se trouve la victime, dans le cas qui nous occupe, nous devons nous demander si cette modification au Code criminel est n\u00e9cessaire, \u00e9tant donn\u00e9 que le tribunal peut d\u00e9j\u00e0 imposer cette condition.</p>\n<p data-HoCid=\"3351452\" data-originallang=\"en\">Je f\u00e9licite le d\u00e9put\u00e9 d'avoir pr\u00e9sent\u00e9 cette mesure l\u00e9gislative. Je sais qu'il essaie de combler une grave lacune de notre syst\u00e8me de justice p\u00e9nale. Il me tarde de discuter de cette mesure l\u00e9gislative et de l'\u00e9tudier en comit\u00e9, pour d\u00e9terminer dans quelle mesure elle permettrait d'atteindre les objectifs \u00e9nonc\u00e9s.</p>"
