"en": "<p data-HoCid=\"2733038\" data-originallang=\"en\">Mr. Speaker, it is an honour to participate in the debate on the Senate's message to this House of Commons on Bill <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a>, the safe streets and communities act.</p>\n<p data-HoCid=\"2733039\" data-originallang=\"en\"> Bill <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a> is a comprehensive crime bill that addresses a number of issues: supporting the victims of terrorism; strengthening sentences for child sexual offences, serious drug offences and violent and serious offences vis-\u00e0-vis the use of conditional sentences; enhancing post-sentencing measures to enhance offender accountability and management; strengthening the youth criminal justice system's ability to deal with serious repeat and violent offenders; and enhancing the ability of the immigration system to protect vulnerable foreign workers against abuse and exploitation, including through the use of human trafficking.</p>\n<p data-HoCid=\"2733040\" data-originallang=\"en\">While I will focus my remarks on the provisions of Bill <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a> that deal with serious drug offences, I want to clearly state to all members of this House my unequivocal support for Bill <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a> in its entirety and also for the amendments as proposed by our colleagues in the upper chamber, the Senate.</p>\n<p data-HoCid=\"2733041\" data-originallang=\"en\">This part of the bill has been before us or before the Senate on several distinct occasions. I would remind all members of the House that the portion of Bill <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a>, which proposes various mandatory minimum sentences, falls within the ambit of Canada's national anti-drug strategy. That strategy proposes a two-track approach: one that would be tough on drug crime and the other that would focus on the victims of drug crime.</p>\n<p data-HoCid=\"2733042\" data-originallang=\"en\">The national anti-drug strategy includes three action plans: first, preventing illicit drug use; second, treating those with illicit drug dependencies; and finally, combatting the production and distribution of illicit drugs.</p>\n<p data-HoCid=\"2733043\" data-originallang=\"en\">The action plan to combat the production and distribution of illicit drugs contains a number of elements, including ensuring that strong and adequate penalties are in place for serious drug crimes. It is within this context that the bill must be viewed if one is to view it fairly.</p>\n<p data-HoCid=\"2733044\" data-originallang=\"en\">Moreover, the bill follows through on one of the key elements of the priority of the government to tackle crime, which this government has repeatedly identified as one of its key commitments.</p>\n<p data-HoCid=\"2733045\" data-originallang=\"en\">There is wide and vast support for the bill from a great number of ordinary Canadians, Canadians who are concerned about drug abuse, Canadians who are concerned that marijuana grow operations and methamphetamine production and trafficking are out of control, and Canadians who are very concerned that these activities pose a serious threat to their own safety and the safety of the communities in which they live.</p>\n<p data-HoCid=\"2733046\" data-originallang=\"en\">The legislation also has the wide support of police officer organizations in Canada, including the Canadian Association of Chiefs of Police, the Canadian Police Association and the Canadian Association of Police Boards.</p>\n<p data-HoCid=\"2733047\" data-originallang=\"en\">We have responsibilities as legislators to ensure that our criminal law stays on top of serious developments in our society. Over the last decade, domestic operations related to the production and distribution of marijuana and synthetic drugs have dramatically increased, resulting in very serious problems in several regions of Canada.</p>\n<p data-HoCid=\"2733048\" data-originallang=\"en\"> I live in and represent Edmonton and Edmonton is certainly one of the regions in Canada that has seen an epidemic growth in organized crime and the violence that is associated with it. In fact, anecdotally, last year there were 44 homicides in Canada and, sadly, Edmonton led Canada in that statistic.</p>\n<p data-HoCid=\"2733049\" data-originallang=\"en\">In some cases, these problems have overwhelmed the capacity of law enforcement agencies to deal with these phenomena. These legal operations pose serious health and public safety hazards to those in or around the grow operations. They produce environmental hazards, post-cleanup problems and endanger the lives and health of the communities at large.</p>\n<p data-HoCid=\"2733050\" data-originallang=\"en\">Moreover, organized crime groups and criminal gangs are resorting to increased violence to establish their dominance over the drug trade in various metropolitan regions of the country. Sadly, but unavoidably, innocent persons are being hurt. </p>\n<p data-HoCid=\"2733051\" data-originallang=\"en\">Now that is not to say that all drug offenders are necessarily dangerous or that all forms of drug trades are violent. Bill <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a> recognizes this and that is why what is being proposed in the bill is a focused and targeted approach, a surgical approach so to speak.</p>\n<p data-HoCid=\"2733052\" data-originallang=\"en\">As has been stated before, the new penalties would not apply to possession offences nor will they apply to offences involving certain types of drugs. The bill focuses on the more serious drug offences involving the most serious drugs. Overall, the proposals represent a tailored approach to mandatory minimum penalties for serious drug offences. </p>\n<p data-HoCid=\"2733053\" data-originallang=\"en\">I would remind all members of the House how this part of the proposed Bill <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a> would operate. For schedule I drugs, such as heroin, cocaine or methamphetamine, the bill proposes a one year minimum for the majority of the serious drug offences in the presence of certain aggravating factors. Some of those aggravating factors are as follows: the offence is committed for the benefit of, at the direction of, or in association with organized crime; the offence involved violence or the threat of violence, or weapons or the threat of the use of weapons; or, the offence is committed by someone who was convicted in the previous 10 years of a designated drug offence. </p>\n<p data-HoCid=\"2733054\" data-originallang=\"en\">I think we would all agree that in the presence of those aggravating factors a minimum mandatory sentence ought to apply. Moreover, if youth are present or the offence occurs in a prison, the minimum is increased to two years.</p>\n<p data-HoCid=\"2733055\" data-originallang=\"en\">In the case of importing, exporting and possession for the purposes of exporting, the minimum penalty will be one year if certain aggravating factors, such as the offence was committed for the purposes of trafficking, and for two years if the offence involves more than one kilogram of a schedule I drug.</p>\n<p data-HoCid=\"2733056\" data-originallang=\"en\">A minimum of two years is provided for the production offence involving a schedule I drug. The minimum sentence for the production of a schedule I drug increases to three years where aggravating factors relating to health and safety are present. These factors are the following: the person used real property that belonged to a third party to commit the offence; the production constituted a potential security, health or safety hazard to children who were in the location where the offence was committed or in the immediate area; the production constituted a potential public safety hazard in a residential area; the person placed or set a trap.</p>\n<p data-HoCid=\"2733057\" data-originallang=\"en\">We hear all too often of rental properties that are turned into grow operations with significant damage having been done to the real property of the landlords. It is that type of aggravating factor with respect to damage to real property belonging to a third person that this portion of Bill <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a> captures and, I would suggest to members of the House, appropriately so.</p>\n<p data-HoCid=\"2733058\" data-originallang=\"en\">For schedule II drugs, such as marijuana, cannabis resin and others, the proposed mandatory minimum penalty for trafficking and possession for the purposes of trafficking is one year where certain aggravating factors such as violence, recidivism or organized crime are present. The minimum penalty is increased to two years if other aggravating factors, such as trafficking to youth, are involved.</p>\n<p data-HoCid=\"2733059\" data-originallang=\"en\">In the case of importing, exporting or possession for the purpose of exporting, the minimum penalty is one year imprisonment when certain aggravating factors are present such as the offence was committed for the purpose of trafficking.</p>\n<p data-HoCid=\"2733060\" data-originallang=\"en\">A lot has been said in the media and by the opposition about the offence of marijuana production. Some of it has been factual but a lot of it has been misconstrued hyperbole. Therefore, it is important for members to know what is actually in the bill. The bill proposes mandatory penalties based on the number of plants involved: for the production of 6 to 200 plants and if the plants are cultivated for the purposes of trafficking, the minimum mandatory sentence is six months; for the production of between 201 and 500 plants, the minimum mandatory is one year; for the production of more than 500 plants, the mandatory minimum is two years; and for the production of cannabis resin for the purpose of trafficking, the mandatory minimum is one year.</p>\n<p data-HoCid=\"2733061\" data-originallang=\"en\">The minimum sentences for the production of schedule II drugs increases by 50% where any of the aggravating factors relating to health and safety, which I just enumerated, such as using the real property of a third person to facilitate the grow op, are present. </p>\n<p data-HoCid=\"2733062\" data-originallang=\"en\">I would like to remind members of the House that this part of Bill <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a> is not just about minimum penalties. The maximum penalty for producing marijuana would be doubled from 7 to 14 years' imprisonment. The amphetamine class of drugs, as well as the date rape drugs, GHB and Rohypnol, would be transferred from schedule III to schedule I of the Controlled Drugs and Substances Act, thereby allowing the courts to impose higher maximum penalties for offences involving those drugs. We know from media reports that the so-called date rape drugs are becoming a scourge and epidemic among young people, often with catastrophic and fatal consequences. </p>\n<p data-HoCid=\"2733063\" data-originallang=\"en\">It is important that I remind members of the House that the proposed legislation would allow a trial judge the discretion of imposing a penalty other than the mandatory minimum on an offender who is referred to a drug treatment court where the offender successfully completes the court-ordered program. Moreover, we know that drug treatment courts are not in all centres in Canada and if there is no drug treatment court, the court sentencing the offender can still refer the offender for treatment for his or her drug addiction. Also, if the offender successfully completes the program, the court would not be required to impose the mandatory minimum penalty for the drug offence.</p>\n<p data-HoCid=\"2733064\" data-originallang=\"en\">I have had the pleasure to visit the Edmonton drug treatment court on three or four occasions. It does absolutely remarkable work. It attempts to help individuals break the cycle of getting involved in criminal activity to feed their drug addiction. It is a carrot and stick program, in that the person will not be sentenced to prison and could be discharged for the offence if he or she successfully completes a rehabilitation program and complies with all the terms and conditions of release, including abstaining from all drugs and alcohol, and attending Alcoholics Anonymous, Narcotics Anonymous or whatever program the person is directed to attend.</p>\n<p data-HoCid=\"2733065\" data-originallang=\"en\">The drug treatment court has been very successful in helping people break the cycle of committing crimes to feed their addiction and starting all over again. I cannot emphasize enough to members of the House the importance of that piece of the puzzle. The courts would have the ability not to impose a mandatory minimum sentence when the individual successfully completes a program as directed by the drug treatment court.</p>\n<p data-HoCid=\"2733066\" data-originallang=\"en\">The proposed reforms in Bill <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a> have been carefully studied in both chambers and committees of both houses. I sit on the justice committee. I sat on the justice committee in the last Parliament. This bill is comprised of nine separate but related pieces of legislation, all of which have been studied significantly not only in this Parliament but in the last Parliament as well. This is the type of legislation Canadians have been demanding. Canadians are demanding safety and security in their homes and communities.</p>\n<p data-HoCid=\"2733067\" data-originallang=\"en\">Bill <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a> has been carefully studied in both chambers. Witnesses who have appeared before the House of Commons Standing Committee on Justice and Human Rights and the Senate Standing Committee on Legal and Constitutional Affairs have welcomed these proposals. They have welcomed them because they send drug traffickers and organized crime a clear message that if they commit serious crimes and cause harm to our society, they will be spending time in jail. </p>\n<p data-HoCid=\"2733068\" data-originallang=\"en\">There are provisions that deal with serious drug crimes, as well as provisions that deal with amendments to the Youth Criminal Justice Act, ending House arrest for property and other serious crimes and changes to our pardon system. All of these separate but combined pieces of legislation have been demanded not only by police and chiefs of police but also by our constituents, such as the citizens I represent in northwest Edmonton who, sadly, have witnessed a record number of murders, 44 in 2011, and all of the other crimes that are tied into organized crime in the city. </p>\n<p data-HoCid=\"2733069\" data-originallang=\"en\">This type of legislation is desperately needed. It was promised and it is being delivered. I encourage all members to vote in favour of Bill <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a>, as amended.</p>",

Les cultures ill\u00e9gales posent de graves probl\u00e8mes de sant\u00e9 et de s\u00e9curit\u00e9 publiques aux personnes qui vivent sur place ou \u00e0 proximit\u00e9. Elles posent des risques pour l'environnement, entra\u00eene des probl\u00e8mes de d\u00e9contamination et mettent en danger la sant\u00e9 et la vie de la population. </p>\n<p data-HoCid=\"2733050\" data-originallang=\"en\">En outre, les groupes criminalis\u00e9s ont recours \u00e0 la violence pour \u00e9tablir leur mainmise sur le commerce de la drogue dans diverses r\u00e9gions m\u00e9tropolitaines au pays, et il est malheureusement in\u00e9vitable qu'ils fassent d'innocentes victimes. </p>\n<p data-HoCid=\"2733051\" data-originallang=\"en\"> Cela ne signifie pas que tous les auteurs d'infractions li\u00e9es aux drogues sont n\u00e9cessairement dangereux ou que toutes les formes de trafic de drogues s'accompagnent de violence. Le projet de loi <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a> en tient compte. C'est pour cette raison que l'approche qui y est propos\u00e9e est une approche cibl\u00e9e.</p>\n<p data-HoCid=\"2733052\" data-originallang=\"en\">Comme cela a d\u00e9j\u00e0 \u00e9t\u00e9 mentionn\u00e9, les nouvelles peines ne s'appliqueraient pas aux infractions li\u00e9es \u00e0 la possession, ni aux infractions li\u00e9es \u00e0 certains types de drogues. Le projet de loi cible les infractions les plus graves li\u00e9es aux drogues les plus dures. De mani\u00e8re g\u00e9n\u00e9rale, les propositions repr\u00e9sentent une approche sur mesure pour l'imposition de peines minimales obligatoires pour les infractions graves li\u00e9es aux drogues.</p>\n<p data-HoCid=\"2733053\" data-originallang=\"en\">Je tiens \u00e0 rappeler \u00e0 tous les d\u00e9put\u00e9s de la Chambre la fa\u00e7on dont cette partie du projet de loi <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a> sera appliqu\u00e9e. Pour les drogues \u00e9num\u00e9r\u00e9es \u00e0 l'annexe 1, comme l'h\u00e9ro\u00efne, la coca\u00efne et la m\u00e9thamph\u00e9tamine, le projet de loi propose une peine minimale d'un an d'emprisonnement pour la majorit\u00e9 des infractions graves li\u00e9es aux drogues quand il y a certaines circonstances aggravantes. Certaines de ces circonstances aggravantes sont les suivantes: la personne a commis l'infraction au profit ou sous la direction d'une organisation criminelle ou en association avec elle; la personne a eu recours ou a menac\u00e9 de recourir \u00e0 la violence, ou a utilis\u00e9 ou menac\u00e9 d'utiliser une arme; ou encore, la personne a d\u00e9j\u00e0 \u00e9t\u00e9 reconnue coupable d'une infraction d\u00e9sign\u00e9e li\u00e9e \u00e0 la drogue au cours des dix derni\u00e8res ann\u00e9es.</p>\n<p data-HoCid=\"2733054\" data-originallang=\"en\">Je crois que nous convenons tous qu'une peine minimale obligatoire doit \u00eatre impos\u00e9e lorsqu'il y a des circonstances aggravantes. De plus, si l'infraction est commise en pr\u00e9sence de personnes mineures ou dans une prison, la peine minimale passe \u00e0 deux ans d'emprisonnement. </p>\n<p data-HoCid=\"2733055\" data-originallang=\"en\"> Dans les cas d'importation, d'exportation et de possession dans le but d'en faire l'exportation, la peine minimale est d'un an en pr\u00e9sence de circonstances aggravantes, par exemple si l'infraction est commise \u00e0 des fins de trafic. La peine passe \u00e0 deux ans si l'infraction concerne plus d'un kilogramme d'une substance inscrite \u00e0 l'annexe 1.</p>\n<p data-HoCid=\"2733056\" data-originallang=\"en\">La peine minimale applicable \u00e0 une infraction li\u00e9e \u00e0 la production d'une substance inscrite \u00e0 l'annexe I est de deux ans. Elle passe \u00e0 trois ans s'il y a des circonstances aggravantes li\u00e9es \u00e0 la sant\u00e9 et \u00e0 la s\u00e9curit\u00e9. Ces circonstances sont les suivantes: la personne s'est servie d'un immeuble appartenant \u00e0 un tiers pour commettre l'infraction, la production constitue un danger potentiel pour la s\u00e9curit\u00e9 ou la sant\u00e9 d'enfants se trouvant \u00e0 l'endroit ou dans les environs de l'endroit o\u00f9 l'infraction a \u00e9t\u00e9 commise; la production constitue un danger potentiel pour la s\u00e9curit\u00e9 du public dans un secteur r\u00e9sidentiel; ou encore, la personne a tendu un pi\u00e8ge.</p>\n<p data-HoCid=\"2733057\" data-originallang=\"en\">Nous entendons trop souvent parler d'habitations locatives qui ont \u00e9t\u00e9 transform\u00e9es en installations de culture causant d'importants dommages aux biens immeubles des propri\u00e9taires. Aux termes de cette partie du projet de loi <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a>, voil\u00e0 le genre de circonstance aggravante qu'il faut consid\u00e9rer dans le cas de dommages aux biens immeubles appartenant \u00e0 un tiers, et ce, \u00e0 juste titre. </p>\n<p data-HoCid=\"2733058\" data-originallang=\"en\">Dans le cas des drogues inscrites \u00e0 l'annexe II, dont la marihuana et la r\u00e9sine de cannabis, la peine minimale obligatoire propos\u00e9e pour le trafic et la possession \u00e0 des fins de trafic est d'un an en pr\u00e9sence de certaines circonstances aggravantes telles que la violence, la r\u00e9cidive ou la participation au crime organis\u00e9. En pr\u00e9sence de facteurs aggravants tels que la vente \u00e0 des jeunes, la peine minimale est port\u00e9e \u00e0 deux ans.</p>\n<p data-HoCid=\"2733059\" data-originallang=\"en\">En ce qui concerne l'importation, l'exportation et la possession dans le but de faire l'exportation, la peine minimale est d'un an d'emprisonnement en pr\u00e9sence de certaines circonstances aggravantes, notamment si l'infraction a \u00e9t\u00e9 commise \u00e0 des fins de trafic.</p>\n<p data-HoCid=\"2733060\" data-originallang=\"en\">Les journalistes et les d\u00e9put\u00e9s de l'opposition ont beaucoup parl\u00e9 de la production de la marijuana. Dans certains cas, il s'agissait de faits, mais souvent il s'agissait d'une interpr\u00e9tation exag\u00e9r\u00e9e de la r\u00e9alit\u00e9. Par cons\u00e9quent, il importe que les d\u00e9put\u00e9s comprennent ce que l'on trouve r\u00e9ellement dans le projet de loi. Le projet de loi propose des peines obligatoires en fonction du nombre de plants en cause: en cas de production de 6 \u00e0 200 plants \u00e0 des fins de trafic, la peine minimale obligatoire est de six mois. Pour la production de 201 \u00e0 500 plants, la peine minimale obligatoire est d'un an. Pour la production de plus de 500 plants, elle est de deux ans; et pour la production de r\u00e9sine de cannabis \u00e0 des fins de trafic, elle est d'un an. </p>\n<p data-HoCid=\"2733061\" data-originallang=\"en\">Au minimum, la peine pour la production de drogues vis\u00e9es \u00e0 l'annexe II augmenterait de 50 p. 100 en pr\u00e9sence de circonstances aggravantes li\u00e9es \u00e0 la sant\u00e9 et \u00e0 la s\u00e9curit\u00e9 comme celles que je viens de mentionner, notamment l'utilisation de biens immeubles appartenant \u00e0 un tiers pour exploiter une installation de culture.</p>\n<p data-HoCid=\"2733062\" data-originallang=\"en\">J'aimerais rappeler aux d\u00e9put\u00e9s que cette partie du projet de loi <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a> ne porte pas seulement sur les peines minimales obligatoires. La peine d'emprisonnement maximale associ\u00e9e \u00e0 la production de marijuana doublerait, passant de 7 \u00e0 14 ans. Les drogues de la cat\u00e9gorie des amph\u00e9tamines et les \u00ab drogues du viol \u00bb, comme le GHB et le Rohypnol, passeraient de l'annexe III \u00e0 l'annexe I de la Loi r\u00e9glementant certaines drogues et autres substances, ce qui permettrait aux tribunaux d'imposer des peines maximales plus lourdes pour des infractions mettant en cause ces drogues. D'apr\u00e8s les reportages m\u00e9diatiques, l'utilisation des drogues du viol est un v\u00e9ritable fl\u00e9au, qui prend des proportions \u00e9pid\u00e9miques chez les jeunes. Ces drogues ont souvent des cons\u00e9quences catastrophiques, voire mortelles.</p>\n<p data-HoCid=\"2733063\" data-originallang=\"en\">J'estime important de rappeler aux d\u00e9put\u00e9s que le projet de loi propos\u00e9 laisserait au juge pr\u00e9sidant un proc\u00e8s la discr\u00e9tion d'imposer une peine autre que la peine minimale obligatoire lorsque le contrevenant est renvoy\u00e9 \u00e0 un tribunal de traitement de la toxicomanie et le termine avec succ\u00e8s. S'il n'y a pas de tribunal de traitement de la toxicomanie dans la r\u00e9gion du contrevenant \u2014 et nous sommes conscients qu'il n'y en a pas partout \u2014, le tribunal qui d\u00e9termine la peine peut quand m\u00eame ordonner au contrevenant de suivre un traitement pour ses probl\u00e8mes de toxicomanie. Dans ce cas aussi, si cette personne termine le programme avec succ\u00e8s, la cour ne sera pas tenue d'imposer la peine minimale obligatoire pour l'infraction li\u00e9e \u00e0 la drogue.</p>\n<p data-HoCid=\"2733064\" data-originallang=\"en\">J'ai eu le plaisir de visiter le tribunal de traitement de la toxicomanie d'Edmonton \u00e0 trois ou quatre reprises. Le travail qui y est accompli est remarquable. On s'efforce d'aider les participants \u00e0 rompre le cycle qui les am\u00e8ne \u00e0 commettre des crimes pour assouvir leur besoin de drogues. Le programme est fond\u00e9 sur des incitatifs: le participant ne purgera pas de peine d'emprisonnement et pourrait \u00eatre absous de l'infraction s'il termine le programme de r\u00e9adaptation avec succ\u00e8s et respecte toutes les conditions de sa remise en libert\u00e9, ce qui pourrait signifier, par exemple, de ne consommer ni drogues ni alcool et d'assister \u00e0 des rencontres des Alcooliques anonymes, des Narcotiques anonymes ou de tout autre groupe auquel on lui a ordonn\u00e9 de participer.</p>\n<p data-HoCid=\"2733065\" data-originallang=\"en\">Le tribunal de traitement de la toxicomanie obtient d'excellents r\u00e9sultats: il aide les participants \u00e0 rompre le cycle qui les am\u00e8ne \u00e0 commettre des crimes pour assouvir leur besoin de drogues, et les aide \u00e0 repartir \u00e0 neuf. Je ne saurais trop insister sur ce facteur important: les tribunaux pourraient ne pas imposer la peine minimale obligatoire quand le contrevenant termine avec succ\u00e8s un programme de traitement, conform\u00e9ment aux directives du tribunal de traitement de la toxicomanie</p>\n<p data-HoCid=\"2733066\" data-originallang=\"en\"> Les r\u00e9formes propos\u00e9es dans le projet de loi <a data-HoCid=\"5120829\" href=\"/bills/41-1/C-10/\" title=\"An Act to enact the Justice for Victims of Terrorism Act and to amend the State Immunity Act, the Criminal Code, the Controlled Drugs and Substances Act, the Corrections and Conditional Release Act, the Youth Criminal Justice Act, the Immigration and Refugee Protection Act and other Acts\">C-10</a> ont \u00e9t\u00e9 soigneusement \u00e9tudi\u00e9es dans les deux Chambres et aux comit\u00e9s des deux Chambres. Les t\u00e9moins qui ont comparu devant le Comit\u00e9 permanent de la justice et des droits de la personne de la Chambre des communes et le Comit\u00e9 s\u00e9natorial permanent des affaires juridiques et constitutionnelles ont accueilli favorablement ces propositions parce qu'elles envoient un message clair aux trafiquants de drogue et aux membres du crime organis\u00e9, \u00e0 savoir que, s'ils commettent des crimes graves et causent du tort \u00e0 notre soci\u00e9t\u00e9, ils seront emprisonn\u00e9s. </p>\n<p data-HoCid=\"2733068\" data-originallang=\"en\">Il y a des dispositions qui portent sur les infractions graves li\u00e9es aux drogues, ainsi que d'autres qui portent sur les modifications \u00e0 la Loi sur le syst\u00e8me de justice p\u00e9nale pour les adolescents. Il y en a \u00e9galement qui visent \u00e0 mettre fin \u00e0 la d\u00e9tention \u00e0 domicile des contrevenants ayant commis des crimes contre les biens ou d'autres crimes graves ou \u00e0 apporter des changements au syst\u00e8me de r\u00e9habilitation. Toutes ces mesures l\u00e9gislatives regroup\u00e9es dans un seul projet de loi ont \u00e9t\u00e9 r\u00e9clam\u00e9es non seulement par les policiers et les chefs de police, mais aussi par nos \u00e9lecteurs, comme les citoyens que je repr\u00e9sente dans le Nord-Ouest d'Edmonton, qui ont malheureusement \u00e9t\u00e9 t\u00e9moins de 44 meurtres en 2011, un nombre sans pr\u00e9c\u00e9dent, ainsi que de beaucoup d'autres crimes li\u00e9s au crime organis\u00e9.</p>\n<p data-HoCid=\"2733069\" data-originallang=\"en\">On a d\u00e9sesp\u00e9r\u00e9ment besoin de ce type de mesure l\u00e9gislative.
