        "en": "<p data-HoCid=\"2749782\" data-originallang=\"fr\">Mr. Speaker, the Conservative Minister of Immigration's Bill <a data-HoCid=\"5383493\" href=\"/bills/41-1/C-31/\" title=\"An Act to amend the Immigration and Refugee Protection Act, the Balanced Refugee Reform Act, the Marine Transportation Security Act and the Department of Citizenship and Immigration Act\">C-31</a> looks a lot more like a monopoly on the power to make decisions than a way to improve refugees' quality of life.</p>\n<p data-HoCid=\"2749783\" data-originallang=\"fr\">Once again, the Conservatives' thirst for power, their lack of rigour and their refusal to listen are taking a toll on justice, respect and equality. This bill is the latest in a long line of bills that most stakeholders consider irresponsible, even senseless. Opponents include the Canadian Council for Refugees, Amnesty International Canada, and the Canadian Association of Refugee Lawyers, to name but a few.</p>\n<p data-HoCid=\"2749784\" data-originallang=\"fr\">All of these opponents have indicated that this bill will make the system vulnerable to political considerations rather than ensure fair, independent and balanced decisions about who can be considered a refugee.</p>\n<p data-HoCid=\"2749785\" data-originallang=\"fr\">Bill <a data-HoCid=\"5383493\" href=\"/bills/41-1/C-31/\" title=\"An Act to amend the Immigration and Refugee Protection Act, the Balanced Refugee Reform Act, the Marine Transportation Security Act and the Department of Citizenship and Immigration Act\">C-31</a> makes us fear the worst for refugees who have become permanent residents. It is also discriminatory and, as the Canadian Council for Refugees pointed out, it creates a two-tier refugee protection system. According to the council, strict, tight deadlines will put victims of sexual trauma and members of the LGBT community at a major disadvantage. These people often need time to open up and tell their story. Two weeks is not enough. But for the Conservative government, ignoring the needs of the most vulnerable is nothing new.</p>\n<p data-HoCid=\"2749786\" data-originallang=\"fr\">To think that barely 18 months ago, the Conservative minister congratulated his opposition colleagues on reaching an agreement on some amendments that would make the refugee system, and I quote, \u201cfaster and fairer\u201d.</p>\n<p data-HoCid=\"2749787\" data-originallang=\"fr\">Now that the Conservatives have a majority, we can expect that measures that the Centre for Refugee Studies calls radical and draconian will be added to these fair amendments. While last year the minister agreed to a sensible compromise in a minority situation, he can now pass whatever legislation he pleases, no matter how undemocratic it is. This is serious and appalling.</p>\n<p data-HoCid=\"2749788\" data-originallang=\"fr\">No longer will it be left up to a panel of experts\u2014as it should\u2014to come up with a list of \u201csafe countries\u201d, from which the federal government does not think refugees usually come. In addition, no longer will it be possible for residents of those designated countries of origin to appeal their cases if their claims are rejected. This is a human rights violation. Unsuccessful claimants will have to wait one year before applying again on humanitarian grounds, during which time they can be sent back to their country, a country they tried to flee.</p>\n<p data-HoCid=\"2749789\" data-originallang=\"fr\">It is especially unfortunate that the government continues using terms like \u201cbogus claimants\u201d, terms that are extremely harmful.</p>\n<p data-HoCid=\"2749790\" data-originallang=\"fr\">While not every individual who files a refugee claim necessarily needs extreme protection, that does not make these refugee claimants \u201cpotential abusers\u201d. These people may have very good reasons for leaving their country.</p>\n<p data-HoCid=\"2749791\" data-originallang=\"fr\">Refugees are some of the most vulnerable members of society and are, therefore, easy targets for attack as non-citizens in a foreign country. Denigrating labels, especially those given by the government, have a serious negative impact on the public's perception of refugees and non-citizens in general.</p>\n<p data-HoCid=\"2749792\" data-originallang=\"fr\">Canada is a model for the rest of the world. It is known for welcoming people who are fleeing persecution. This important asset is going to be lost because of a new proposal by this government that emphasizes speed and categorization, at the expense of fairness, justice and protecting individuals.</p>\n<p data-HoCid=\"2749793\" data-originallang=\"fr\">In our opinion, the government is pushing its mandate far too far. In many ways, Bill <a data-HoCid=\"5383493\" href=\"/bills/41-1/C-31/\" title=\"An Act to amend the Immigration and Refugee Protection Act, the Balanced Refugee Reform Act, the Marine Transportation Security Act and the Department of Citizenship and Immigration Act\">C-31</a> represents the unprecedented dismantling of Canada's refugee system. If we just take the example of Australia, which had to go back to a system similar to our current system, it is clear that the approach outlined in Bill <a data-HoCid=\"5383493\" href=\"/bills/41-1/C-31/\" title=\"An Act to amend the Immigration and Refugee Protection Act, the Balanced Refugee Reform Act, the Marine Transportation Security Act and the Department of Citizenship and Immigration Act\">C-31</a> does not work. The Conservatives would save Canadians a lot of time and money if they stopped navel gazing and starting using facts, expert studies, statistics and concrete examples to support their bills.</p>\n<p data-HoCid=\"2749794\" data-originallang=\"fr\">On average, 25,000 refugees have obtained permanent resident status every year of the past five years. Last year, the number was 24,700. After a waiting period of three years, it takes an average of 18 to 22 months before the person can apply for citizenship, which takes an average of 19 months. </p>\n<p data-HoCid=\"2749795\" data-originallang=\"fr\">It takes at least five to six years for a person to become a citizen, if the process goes quickly. This bill threatens the thousands of refugees admitted every year, not to mention those who have not yet applied. </p>\n<p data-HoCid=\"2749796\" data-originallang=\"fr\">The minister wants to pass this vague bill in September, when the former Bill <a data-HoCid=\"4383517\" href=\"/bills/40-3/C-11/\" title=\"An Act to amend the Immigration and Refugee Protection Act and the Federal Courts Act\">C-11</a> has not even come into force. Why be in such a rush to pass, at all costs, a bungled bill that has such serious consequences for people's lives? What is more, clause 19 literally undermines Canada's commitment to refugees, makes a mockery of our commitment to the United Nations to grant permanent residence to refugees, and puts tens of thousands of refugees who have already been granted permanent resident status in Canada at risk of deportation.</p>\n<p data-HoCid=\"2749797\" data-originallang=\"fr\">Out of respect for Canada's commitment to the United Nations, refugees who have settled here permanently have and should always have the right to rebuild their lives, to work and to raise their families knowing that Canada is and will remain their permanent home. </p>\n<p data-HoCid=\"2749798\" data-originallang=\"fr\"> This is one of the most positive characteristics of our country. Canada's promotion of rapid and permanent resettlement is an enormous advantage, just as much for all Canadians as for all refugees. Instead of living in uncertainty, refugees become active and productive members of our society. The feeling of security that accompanies permanent residence cannot be overestimated and should be a formality. </p>\n<p data-HoCid=\"2749799\" data-originallang=\"fr\"> Canada's commitments to the UN are nevertheless clear: refugees who receive permanent resident status are entitled to rebuild their lives in the host country, to work and to have a family. They will not succeed in integrating into Canadian society if they are constantly under the threat of being sent back to the country they fled.</p>\n<p data-HoCid=\"2749800\" data-originallang=\"fr\"> Canada is a land of refuge and I am grateful, for if it had not been, I would not be here today. My parents came here in the wave of boat people after the Vietnam War, which enabled a number of new Canadians to take refuge here. In certain cases, this change might expose them to potentially violent reprisals if they go back to their country of origin.</p>\n<p data-HoCid=\"2749801\" data-originallang=\"fr\"> Determining refugee status is complex and difficult. It is not easy to decide whether a person needs protection or not. On the other hand, for refugees, the need for protection at all times is simple, but critical. For Canadians, the question is simple: are we going to make sure that refugees are not going back to persecution? It seems to me that the answer should be simple.</p>\n<p data-HoCid=\"2749802\" data-originallang=\"fr\"> In summary, what the Conservative government wants is the discretionary and automatic power to remove at any time a person who was granted refugee status in Canada and who then received permanent resident status. This is what I vehemently oppose, on behalf of all refugees, like my parents and my brothers, who flee their country, risking their lives, without identification and who hope, no matter what happens to them, to find a safe haven and live with dignity in a country to which they will contribute on a social, cultural or economic level. These people want to go on living with their heads held high, and they have human rights that must be respected. </p>\n<p data-HoCid=\"2749803\" data-originallang=\"fr\"> Bill <a data-HoCid=\"5383493\" href=\"/bills/41-1/C-31/\" title=\"An Act to amend the Immigration and Refugee Protection Act, the Balanced Refugee Reform Act, the Marine Transportation Security Act and the Department of Citizenship and Immigration Act\">C-31</a> does not target criminals or human traffickers or those who would take advantage of refugees. We worked on the old bill <a data-HoCid=\"4383517\" href=\"/bills/40-3/C-11/\" title=\"An Act to amend the Immigration and Refugee Protection Act and the Federal Courts Act\">C-11</a>; there are many points that need another look. I am therefore asking the Conservative government to go back to the drawing board with this bill.</p>",

Encore un projet de loi jug\u00e9 irresponsable, voire m\u00eame insens\u00e9, par la majorit\u00e9 des intervenants dans le domaine. Parmi les opposants, on compte entre autres le Conseil canadien pour les r\u00e9fugi\u00e9s, Amnistie internationale Canada, l'Association canadienne des avocats et avocates en droit des r\u00e9fugi\u00e9s, pour n'en nommer que quelques-uns.</p>\n<p data-HoCid=\"2749784\" data-originallang=\"fr\">Tous soulignent que ce projet de loi rend le syst\u00e8me vuln\u00e9rable \u00e0 des consid\u00e9rations politiques, plut\u00f4t que d'assurer une d\u00e9cision juste, ind\u00e9pendante et \u00e9quitable afin de d\u00e9cider qui est un r\u00e9fugi\u00e9.</p>\n<p data-HoCid=\"2749785\" data-originallang=\"fr\">En fait, le projet de loi <a data-HoCid=\"5383493\" href=\"/bills/41-1/C-31/\" title=\"An Act to amend the Immigration and Refugee Protection Act, the Balanced Refugee Reform Act, the Marine Transportation Security Act and the Department of Citizenship and Immigration Act\">C-31</a> fait non seulement craindre le pire pour les droits des r\u00e9fugi\u00e9s devenus r\u00e9sidents permanents au pays, mais il est \u00e9galement discriminatoire et, comme le souligne le Conseil canadien pour les r\u00e9fugi\u00e9s, il cr\u00e9e un syst\u00e8me de protection des r\u00e9fugi\u00e9s \u00e0 deux vitesses. Ignorer les int\u00e9r\u00eats des plus vuln\u00e9rables n'est rien de nouveau pour le gouvernement conservateur. </p>\n<p data-HoCid=\"2749786\" data-originallang=\"fr\">Dire qu'il y a 18 mois \u00e0 peine, le ministre conservateur avait f\u00e9licit\u00e9 ses coll\u00e8gues de l'opposition, avec lesquels il avait convenu d'amendements qui rendraient le syst\u00e8me de r\u00e9fugi\u00e9s, et je cite \u00ab plus rapide et plus \u00e9quitable \u00bb.</p>\n<p data-HoCid=\"2749787\" data-originallang=\"fr\">Maintenant, dans un contexte majoritaire, il est permis de croire que des mesures radicales ou draconiennes, selon le Centre d'\u00e9tudes sur les r\u00e9fugi\u00e9s, seront ajout\u00e9es \u00e0 ces amendements \u00e9quitables. Si l'an dernier le ministre avait accept\u00e9 des compromis sens\u00e9s en contexte minoritaire, il peut d\u00e9sormais adopter les lois qui lui plaisent, et ce, sans faire appel \u00e0 la d\u00e9mocratie. C'est grave et c'est m\u00e9prisant.</p>\n<p data-HoCid=\"2749788\" data-originallang=\"fr\">Plus question de laisser un comit\u00e9 d'experts dresser comme il se devrait la liste des \u00ab pays s\u00fbrs \u00bb, desquels le f\u00e9d\u00e9ral estime qu'il ne ressort pas habituellement de r\u00e9fugi\u00e9s. De plus, termin\u00e9e aussi la possibilit\u00e9 pour les r\u00e9sidents de ces pays d'origine d\u00e9sign\u00e9s de porter la d\u00e9cision en appel si leur demande est rejet\u00e9e. Cela va \u00e0 l'encontre des droits de la personne. Les demandeurs refus\u00e9s devront attendre un an avant de faire une nouvelle demande pour des motifs humanitaires, une p\u00e9riode au cours de laquelle ils pourraient \u00eatre renvoy\u00e9s dans leur pays, un pays duquel ils ont tent\u00e9 de fuir.</p>\n<p data-HoCid=\"2749789\" data-originallang=\"fr\">Il est d'autant plus regrettable que le gouvernement continue d'utiliser des termes tels que \u00ab faux demandeurs \u00bb, qui sont extr\u00eamement nuisibles.</p>\n<p data-HoCid=\"2749790\" data-originallang=\"fr\">Bien que toutes les personnes qui font une demande d'asile n'aient pas n\u00e9cessairement besoin d'une protection extr\u00eame, cela ne fait pas des demandeurs d'asile des \u00ab abuseurs potentiels \u00bb. Ces personnes peuvent avoir des raisons tr\u00e8s convaincantes de quitter leur pays.</p>\n<p data-HoCid=\"2749791\" data-originallang=\"fr\">Les r\u00e9fugi\u00e9s sont parmi les personnes les plus vuln\u00e9rables d'une soci\u00e9t\u00e9 et, en tant que non-citoyens dans un pays \u00e9tranger, ils sont des cibles faciles \u00e0 attaquer. Les \u00e9tiquettes d\u00e9nigrantes, surtout de la part du gouvernement, entravent profond\u00e9ment la perception du public envers les r\u00e9fugi\u00e9s et les non-citoyens en g\u00e9n\u00e9ral.</p>\n<p data-HoCid=\"2749792\" data-originallang=\"fr\">Le Canada est un mod\u00e8le pour les pays du monde entier. Il est connu pour son accueil des personnes fuyant la pers\u00e9cution. Cet atout important serait perdu \u00e0 cause d'une nouvelle proposition du gouvernement qui met l'accent sur la vitesse et les cat\u00e9gorisations au d\u00e9triment de l'\u00e9quit\u00e9, de la justice et de la protection de l'individu.</p>\n<p data-HoCid=\"2749793\" data-originallang=\"fr\">\u00c0 notre avis, le gouvernement pousse beaucoup trop loin son mandat. Le projet de loi <a data-HoCid=\"5383493\" href=\"/bills/41-1/C-31/\" title=\"An Act to amend the Immigration and Refugee Protection Act, the Balanced Refugee Reform Act, the Marine Transportation Security Act and the Department of Citizenship and Immigration Act\">C-31</a> repr\u00e9sente de plusieurs fa\u00e7ons le d\u00e9mant\u00e8lement sans pr\u00e9c\u00e9dent du syst\u00e8me de d\u00e9termination du statut de r\u00e9fugi\u00e9 du Canada. En ne prenant que l'exemple de l'Australie, qui a d\u00fb revenir \u00e0 un syst\u00e8me qui ressemble \u00e0 notre syst\u00e8me actuel, il est clair que l'approche mise de l'avant par le projet de loi <a data-HoCid=\"5383493\" href=\"/bills/41-1/C-31/\" title=\"An Act to amend the Immigration and Refugee Protection Act, the Balanced Refugee Reform Act, the Marine Transportation Security Act and the Department of Citizenship and Immigration Act\">C-31</a> ne fonctionne pas. Les conservateurs feraient \u00e9conomiser aux Canadiens beaucoup de temps et d'argent s'ils d\u00e9tournaient leur regard de leur nombril et appuyaient leurs projets de loi par des faits, par des \u00e9tudes d'experts, par des statistiques et par des exemples concrets d'ailleurs.</p>\n<p data-HoCid=\"2749794\" data-originallang=\"fr\">En moyenne, 25 000 r\u00e9fugi\u00e9s ont obtenu leur statut de r\u00e9sident permanent chaque ann\u00e9e depuis les cinq derni\u00e8res ann\u00e9es. L'an dernier, ils \u00e9taient 24 700. Le d\u00e9lai moyen est de 18 \u00e0 22 mois, apr\u00e8s une attente de trois ans, avant de pouvoir faire une demande de citoyennet\u00e9 qui chemine en moyenne pendant 19 mois.</p>\n<p data-HoCid=\"2749795\" data-originallang=\"fr\">Au minimum, de cinq \u00e0 six ann\u00e9es s'\u00e9coulent avant de devenir citoyen, si le processus se d\u00e9roule rapidement. C'est donc autant de milliers de r\u00e9fugi\u00e9s admis chaque ann\u00e9e qui seraient maintenant menac\u00e9s par le projet de loi, sans compter ceux qui n'auront pas encore fait leur demande.</p>\n<p data-HoCid=\"2749796\" data-originallang=\"fr\">Le ministre veut adopter ce projet de loi flou \u00e0 partir du mois de septembre, alors que l'ancien projet de loi <a data-HoCid=\"4383517\" href=\"/bills/40-3/C-11/\" title=\"An Act to amend the Immigration and Refugee Protection Act and the Federal Courts Act\">C-11</a> n'est m\u00eame pas encore en application. Pourquoi vouloir \u00e0 tout prix et \u00e0 toute vitesse b\u00e2cler un projet de loi ayant une port\u00e9e si lourde sur la vie des gens? De plus, l'article 19 sape litt\u00e9ralement l'engagement du Canada envers les r\u00e9fugi\u00e9s, ridiculise notre engagement envers les Nations Unies d'accorder la r\u00e9sidence permanente aux r\u00e9fugi\u00e9s et soumet des dizaines de milliers de r\u00e9fugi\u00e9s qui se sont d\u00e9j\u00e0 vu octroyer la r\u00e9sidente permanente au Canada au risque d'une d\u00e9portation.</p>\n<p data-HoCid=\"2749797\" data-originallang=\"fr\"> Par respect pour l'engagement du Canada envers les Nations Unies, les r\u00e9fugi\u00e9s qui sont r\u00e9install\u00e9s ici de fa\u00e7on permanente ont et devraient toujours avoir le droit de reb\u00e2tir leur vie, de travailler et d'\u00e9lever leur famille en ayant la certitude que le Canada est et demeurera leur foyer permanent.</p>\n<p data-HoCid=\"2749798\" data-originallang=\"fr\">Il s'agit de l'une des caract\u00e9ristiques les plus positives de notre pays. La promotion par le Canada de la r\u00e9installation rapide et permanente repr\u00e9sente un b\u00e9n\u00e9fice \u00e9norme, autant pour tous les Canadiens que pour les r\u00e9fugi\u00e9s. Au lieu de demeurer dans l'incertitude, les r\u00e9fugi\u00e9s deviennent des membres actifs et productifs dans notre soci\u00e9t\u00e9. Le sentiment de s\u00e9curit\u00e9 qui accompagne la r\u00e9sidence permanente ne peut pas \u00eatre surestim\u00e9 et devrait \u00eatre une formalit\u00e9. </p>\n<p data-HoCid=\"2749799\" data-originallang=\"fr\">Les engagements du Canada aupr\u00e8s de l'ONU sont pourtant clairs: un r\u00e9fugi\u00e9 dot\u00e9 d'un statut de r\u00e9sident permanent a le droit de refaire sa vie dans un pays d'accueil, d'y travailler et d'y fonder une famille. Ils ne parviendront pas \u00e0 s'int\u00e9grer \u00e0 la soci\u00e9t\u00e9 canadienne s'ils sont sous la menace continuelle d'\u00eatre retourn\u00e9s dans le pays qu'ils ont fui.</p>\n<p data-HoCid=\"2749800\" data-originallang=\"fr\">Le Canada est une terre d'accueil et je l'en remercie car s'il ne l'avait pas \u00e9t\u00e9, je n'aurais pas \u00e9t\u00e9 l\u00e0 aujourd'hui. Mes parents sont arriv\u00e9s avec la vague des <em>boat people</em> apr\u00e8s la guerre du Vietnam, qui a permis \u00e0 plusieurs nouveaux Canadiens de se r\u00e9fugier ici. Dans certains cas, ce changement pourrait les exposer \u00e0 de possibles repr\u00e9sailles violentes \u00e0 leur retour dans leur pays d'origine. </p>\n<p data-HoCid=\"2749801\" data-originallang=\"fr\">La d\u00e9termination du statut de r\u00e9fugi\u00e9 est un processus complexe et difficile. D\u00e9cider si une personne a besoin ou non d'une protection n'est pas \u00e9vident. Par contre, pour les r\u00e9fugi\u00e9s, le besoin d'\u00eatre prot\u00e9g\u00e9s en tout temps est simple, mais crucial. Pour la population canadienne, le d\u00e9fi est simple: allons-nous faire en sorte, oui ou non, que les r\u00e9fugi\u00e9s ne soient pas retourn\u00e9s vers la pers\u00e9cution? Il me semble que la r\u00e9ponse devrait \u00eatre simple.</p>\n<p data-HoCid=\"2749802\" data-originallang=\"fr\">En r\u00e9sum\u00e9, ce que le gouvernement conservateur souhaite, c'est un pouvoir discr\u00e9tionnaire et automatique lui permettant d'expulser en tout temps une personne re\u00e7ue au Canada \u00e0 titre de r\u00e9fugi\u00e9 et qui a ensuite obtenu sa r\u00e9sidence permanente. C'est ce \u00e0 quoi je m'oppose farouchement au nom de tous les r\u00e9fugi\u00e9s, comme mes parents et mes fr\u00e8res, qui fuient leur pays au p\u00e9ril de leur propre vie sans papiers et qui esp\u00e8rent, peu importe ce qui va leur arriver, trouver une terre d'accueil et vivre dignement dans un pays auquel ils apporteront leur contribution, que ce soit sur le plan social, culturel ou \u00e9conomique. Ces gens veulent continuer \u00e0 vivre la t\u00eate haute et ils ont des droits humains qu'on doit respecter. </p>\n<p data-HoCid=\"2749803\" data-originallang=\"fr\">Le projet de loi <a data-HoCid=\"5383493\" href=\"/bills/41-1/C-31/\" title=\"An Act to amend the Immigration and Refugee Protection Act, the Balanced Refugee Reform Act, the Marine Transportation Security Act and the Department of Citizenship and Immigration Act\">C-31</a> ne s'attaque pas du tout aux criminels et aux passeurs, ni aux gens qui veulent profiter des personnes r\u00e9fugi\u00e9es. On a d\u00e9j\u00e0 travaill\u00e9 \u00e0 l'ancien projet de loi <a data-HoCid=\"4383517\" href=\"/bills/40-3/C-11/\" title=\"An Act to amend the Immigration and Refugee Protection Act and the Federal Courts Act\">C-11</a>; il y a beaucoup de choses \u00e0 revoir.
