"en": "<p data-HoCid=\"2995118\" data-originallang=\"fr\">Mr. Speaker, today, I would like to participate in the debate on this bill.</p>\n<p data-HoCid=\"2995119\" data-originallang=\"fr\">Clearly, this bill would benefit greatly from additional debate in committee. It is very important that all the points that are raised there be debated.</p>\n<p data-HoCid=\"2995120\" data-originallang=\"fr\">Once again, the Conservatives are trying to pass a bill that will take discretionary power away from judges. We have to ask ourselves why that is. What is the reasoning behind this? What impact will it have?</p>\n<p data-HoCid=\"2995121\" data-originallang=\"fr\">In court, during the testimony and sentencing, judges are in the best position to understand and to determine the proper sentence for the offence committed. Why is this not being taken into consideration? This bill takes away judges' discretion, and I am very concerned about that.</p>\n<p data-HoCid=\"2995122\" data-originallang=\"fr\">Canada's legal system allows a judge to clearly understand the testimony, the evidence and the circumstances. The burden is on him to impose a fair and equitable sentence. We in the House of Commons must not think that we know all the facts and that we are always right, when all of this should be assessed on a case-by-case basis. </p>\n<p data-HoCid=\"2995123\" data-originallang=\"fr\">We do not know the circumstances of the crime or the offender's ability to pay the fines. We thus do not know what sentence would be fair and equitable. Let us not forget that the purpose of a sentence should be rehabilitation; it should not encourage the offender to reoffend.</p>\n<p data-HoCid=\"2995124\" data-originallang=\"fr\">I will come back to that in a moment, but I would first like to share with the House what the Quebec justice minister has to say about fines on his website:</p>\n<blockquote><p data-HoCid=\"2995125\" data-originallang=\"fr\"> A fine is a sum of money that must be paid to the State by an offender within a time frame determined by the judge. </p>\n</blockquote><p data-HoCid=\"2995126\" data-originallang=\"fr\">He then adds the following, and this is the part that seems important to me:</p>\n<blockquote><p data-HoCid=\"2995127\" data-originallang=\"fr\"> Before imposing a fine, the judge must be satisfied that the individual has the means to pay it. </p>\n</blockquote><p data-HoCid=\"2995128\" data-originallang=\"fr\">This is not the first time in Canada's legal history or in our legal system that we have heard this said. In a legal system such as ours, the sentence must fit the crime. In the past, there were debtors' prisons, prisons for people who did not pay their debts. We can impose all the fines that we want on a homeless offender who does not have any money, but that will not change the fact that he does not have any and that he will never be able to afford to pay those fines.</p>\n<p data-HoCid=\"2995129\" data-originallang=\"fr\">We should not take away from a judge the power to waive a surcharge when he is fully aware that the offender does not have the means to pay that surcharge. The judge knows that because he is the judge of the facts and he is well informed.</p>\n<p data-HoCid=\"2995130\" data-originallang=\"fr\">Yet, that is what the bill will do. The judge will be fully aware that a fine will never be paid, but he will still have to impose it. It makes no sense. It is absolutely illogical that a judge who knows the facts should have to do that. </p>\n<p data-HoCid=\"2995131\" data-originallang=\"fr\">There a reason why we have our modern legal system. The trial judge looks at the facts and he is the one who has the responsibility of imposing a sentence, based on the offence and on the offender's ability to serve that sentence. </p>\n<p data-HoCid=\"2995132\" data-originallang=\"fr\">The sentence should also be an incentive to rehabilitate. I find it hard to believe that imposing a series of fines can lead to rehabilitation.</p>\n<p data-HoCid=\"2995133\" data-originallang=\"fr\">There is one thing we often hear and cannot ignore: jails are a place where offenders increase their ability to break the law, to remain offenders. Jails are crime schools. We should not feed jails like that. If we create this situation and the offender cannot pay his fine, what are we going to do? Are we just going to ignore the fact that a fine was imposed? No, we cannot do that. The fine exists and the offender must pay it. If he is unable to do so, he will be fined again and this will generate yet another legal process. We are imposing a burden that cannot be supported. It is important to understand that.</p>\n<p data-HoCid=\"2995134\" data-originallang=\"fr\">The current act already provides for a 15% surcharge on any fine imposed on the offender. If no fine is imposed, the surcharge is $50. That surcharge must be imposed because that is what the law says. Now, we want to increase the burden twofold, from 15% to 30% when a fine is imposed, and from $50 to $100 for offences punishable by summary conviction, when no fine is imposed.</p>\n<p data-HoCid=\"2995135\" data-originallang=\"fr\">Under the current act, the judge has a discretionary power. Section 737(5) of the Criminal Code reads as follows: </p>\n<blockquote><p data-HoCid=\"2995136\" data-originallang=\"fr\"> When the offender establishes to the satisfaction of the court that undue hardship to the offender or the dependants of the offender would result from payment of the victim surcharge, the court may, on application of the offender, make an order exempting the offender from the application of subsection (1). </p>\n</blockquote><p data-HoCid=\"2995137\" data-originallang=\"fr\">As we can see, the lawmakers who wrote this legislation were wise enough to understand that, sometimes, one is not in a position to pay a surcharge. They even went a little further and said that the court must take into consideration the offender's ability to pay the surcharge. They also thought about a dependent: would imposing a surcharge harm this dependent? A dependent is usually a child, but it could be anyone.</p>\n<p data-HoCid=\"2995138\" data-originallang=\"fr\"> I would point out that in international law and Canadian law, the needs of the child must always be given priority when a bill is drafted. And whenever judges have to interpret legislation, they have a duty, an obligation, to consider the impact it may have on a child. Looking at the bill that is before us, it may be that a judge will have no choice but to impose a surcharge, knowing not only that the burden is too heavy for the offender, but also that it might cause hardship for a dependent child of the offender. What this means is that it would be contrary not only to a number of Canadian laws, but also to international obligations. </p>\n<p data-HoCid=\"2995139\" data-originallang=\"fr\"> It is incomprehensible that we could enact bills in Canada that might impose an unreasonable burden on a child who, clearly, does not have the means to pay a victim surcharge levied against the child's parents. We have to avoid, at all costs, imposing that kind of burden on a child who is an innocent party in the situation. And yet what we are doing is creating a situation that could cause hardship for a child. Frankly, and I will say it again, we would benefit from a longer and more thorough discussion in committee. That is why I will probably vote to send the bill to committee, but that does not mean it would not benefit from being amended.</p>\n<p data-HoCid=\"2995140\" data-originallang=\"fr\"> I also want to note that the popular encyclopedia Wikipedia, which I often find to be an inspiring source, talks about surcharges and fines. This is what it says:</p>\n<blockquote><p data-HoCid=\"2995141\" data-originallang=\"en\"> Fines are counter-productive if the offender commits more offences to get the money to pay the fine. </p>\n</blockquote><p data-HoCid=\"2995142\" data-originallang=\"fr\"> What that means is that there is little point in imposing fines when the person is not able to pay them, because that could actually encourage recidivism. A person who is not able to pay their fines has to get the money somewhere, or they will be charged with another offence. And again, that encourages recidivism. We are potentially creating a vicious circle. I hope that everyone will think carefully about this and there will be a good debate in committee. </p>\n<p data-HoCid=\"0\" data-originallang=\"fr\"></p>",

Quel en sera l'impact?</p>\n<p data-HoCid=\"2995121\" data-originallang=\"fr\"> Au tribunal, lors du t\u00e9moignage et lors de la sentence, les juges sont les personnes les mieux plac\u00e9es pour comprendre et d\u00e9terminer une sentence ad\u00e9quate pour l'infraction qui a \u00e9t\u00e9 commise. Pourquoi n'aurait-on pas cela en t\u00eate? Ce projet de loi enl\u00e8ve cette discr\u00e9tion, et cela m'inqui\u00e8te \u00e9norm\u00e9ment.</p>\n<p data-HoCid=\"2995122\" data-originallang=\"fr\">Le syst\u00e8me judiciaire du Canada permet \u00e0 un juge de bien comprendre les t\u00e9moignages, la preuve et les circonstances. C'est \u00e0 lui qu'incombe le fardeau d'\u00e9tablir une sentence juste et \u00e9quitable. On ne doit pas croire, ici \u00e0 la Chambre des communes, que nous, nous connaissons tous les faits et que nous avons toujours raison, alors que tout cela doit \u00eatre bas\u00e9 sur le cas par cas. </p>\n<p data-HoCid=\"2995123\" data-originallang=\"fr\">On ne conna\u00eet ni les circonstances des infractions ni la capacit\u00e9 du contrevenant de payer les amendes. On ne sait donc pas ce que serait une sentence juste et \u00e9quitable. N'oublions pas qu'une sentence devrait avoir pour objectif la r\u00e9habilitation; elle ne devrait pas inciter le contrevenant \u00e0 la r\u00e9cidive. </p>\n<p data-HoCid=\"2995124\" data-originallang=\"fr\">Je reviendrai l\u00e0-dessus dans un moment, mais j'aimerais d'abord faire part \u00e0 la Chambre de ce que dit le ministre de la Justice du Qu\u00e9bec d'une amende sur son site Web:</p>\n<blockquote><p data-HoCid=\"2995125\" data-originallang=\"fr\"> L\u2019amende est la somme d'argent qui doit \u00eatre vers\u00e9e \u00e0 l'\u00c9tat par le contrevenant, dans un d\u00e9lai d\u00e9termin\u00e9 par le juge. </p>\n</blockquote><p data-HoCid=\"2995126\" data-originallang=\"fr\">Il ajoute, et c'est ce qui me semble important:</p>\n<blockquote><p data-HoCid=\"2995127\" data-originallang=\"fr\"> Avant d'imposer une amende, le juge doit \u00eatre convaincu que la personne a la capacit\u00e9 de la payer. </p>\n</blockquote><p data-HoCid=\"2995128\" data-originallang=\"fr\">Ce n'est pas la premi\u00e8re fois qu'on voit cette phrase dans l'histoire juridique du Canada et dans notre syst\u00e8me juridique. Dans un syst\u00e8me judiciaire comme le n\u00f4tre, la sentence doit \u00eatre \u00e0 la mesure de l'infraction commise. Dans le pass\u00e9, il y avait ce qu'on appelait en anglais des <em>debtors' prisons</em>, des prisons pour les gens qui ne payaient pas leurs dettes. On peut imposer toutes les amendes qu'on veut \u00e0 un itin\u00e9rant qui n'a pas d'argent, cela ne changera pas le fait qu'il n'en a pas et qu'il ne sera jamais en mesure de les payer. </p>\n<p data-HoCid=\"2995129\" data-originallang=\"fr\">On ne doit pas retirer au juge la capacit\u00e9 de lever une suramende quand il est tout \u00e0 fait conscient que le contrevenant devant lui n'a pas les moyens de la payer. Il le sait parce qu'il est le juge des faits et qu'il est tout \u00e0 fait inform\u00e9.</p>\n<p data-HoCid=\"2995130\" data-originallang=\"fr\">Or ce projet de loi va cr\u00e9er cette situation. Le juge qui, en toute connaissance de cause, sait tr\u00e8s bien qu'une amende ne sera jamais pay\u00e9e devra l'imposer quand m\u00eame. C'est un non-sens. Il est absolument illogique qu'un juge qui conna\u00eet les faits doive faire cela. </p>\n<p data-HoCid=\"2995131\" data-originallang=\"fr\">Ce n'est pas pour rien qu'on a le syst\u00e8me juridique qu'on a aujourd'hui. Le juge de premi\u00e8re instance est le juge des faits, et c'est \u00e0 lui que revient l'obligation d'imposer une sentence en fonction de l'infraction et \u00e0 la mesure de la capacit\u00e9 du contrevenant de soutenir la sentence.</p>\n<p data-HoCid=\"2995132\" data-originallang=\"fr\"> Cette sentence doit aussi \u00eatre un incitatif \u00e0 la r\u00e9habilitation. J'ai du mal \u00e0 croire que le fait d'imposer amende sur amende puisse mener \u00e0 la r\u00e9habilitation.</p>\n<p data-HoCid=\"2995133\" data-originallang=\"fr\">Il y a une chose que l'on n'oublie pas, et on l'entend souvent: les prisons sont un endroit o\u00f9 les contrevenants renforcent leur capacit\u00e9 de briser la loi, d'\u00eatre des contrevenants futurs. C'est l'\u00e9cole de la r\u00e9cidive. On ne doit pas alimenter les prisons \u00e0 ce point-l\u00e0. Si on cr\u00e9e une telle situation et qu'une personne ne puisse pas payer son amende, que fait-on? Va-t-on juste faire abstraction du fait que l'amende a \u00e9t\u00e9 impos\u00e9e? Non, on ne peut pas faire cela. L'amende existe et le contrevenant doit la payer. S'il est incapable de la payer, il aura encore une autre contravention, ce sera encore un autre processus juridique. C'est imposer un fardeau qui ne peut pas \u00eatre soutenu. C'est important qu'on le comprenne.</p>\n<p data-HoCid=\"2995134\" data-originallang=\"fr\">La loi actuelle pr\u00e9voit d\u00e9j\u00e0 une suramende de 15 % de toute amende impos\u00e9e au contrevenant. Lorsque aucune amende n'est impos\u00e9e, la suramende impos\u00e9e est de 50 $. \u00c0 priori, la suramende doit \u00eatre impos\u00e9e. C'est ainsi que la loi a \u00e9t\u00e9 \u00e9crite. Aujourd'hui, on veut doubler le fardeau et le faire passer de 15 % \u00e0 30 % dans le cas o\u00f9 une amende est impos\u00e9e, et le faire passer de 50 $ \u00e0 100 $ pour les infractions punissables sur d\u00e9claration de culpabilit\u00e9 par proc\u00e9dure sommaire quand une suramende n'est pas impos\u00e9e. </p>\n<p data-HoCid=\"2995135\" data-originallang=\"fr\">\u00c0 l'heure actuelle, la loi pr\u00e9voit la discr\u00e9tion du juge. Le paragraphe 737(5) du Code criminel dit ceci: </p>\n<blockquote><p data-HoCid=\"2995136\" data-originallang=\"fr\"> Le tribunal peut ordonner qu\u2019aucune suramende compensatoire ne soit inflig\u00e9e aux termes du paragraphe (1), si le contrevenant en fait la demande et lui d\u00e9montre que cela lui causerait \u2014 ou causerait aux personnes \u00e0 sa charge \u2014 un pr\u00e9judice injustifi\u00e9. </p>\n</blockquote><p data-HoCid=\"2995137\" data-originallang=\"fr\">On constate que les gens qui ont cr\u00e9\u00e9 cette loi \u00e9taient assez sages pour comprendre que, parfois, on n'est pas en mesure de payer une suramende. En outre, on est m\u00eame all\u00e9 un peu plus loin et on a dit qu'il faut tenir compte de la capacit\u00e9 de la personne qui a commis l'infraction de payer la suramende. On a aussi pens\u00e9 \u00e0 la personne \u00e0 sa charge: cela pourrait-il causer un pr\u00e9judice \u00e0 cette personne \u00e0 charge? Normalement, on parle de ses enfants, mais, finalement, \u00e7a peut \u00eatre n'importe quelle personne \u00e0 sa charge.</p>\n<p data-HoCid=\"2995138\" data-originallang=\"fr\">Je souligne qu'en mati\u00e8re de droit international et de droit canadien, on doit toujours tenir compte en priorit\u00e9 des besoins de l'enfant chaque fois qu'on cr\u00e9e un projet de loi. Et chaque fois qu'un juge doit interpr\u00e9ter la loi, il a le devoir, l'obligation de penser \u00e0 l'incidence que cela peut avoir sur un enfant. Il se peut que, compte tenu du projet de loi dont nous sommes saisis, le juge n'ait pas le choix d'imposer une suramende en sachant non seulement que le fardeau est trop lourd pour le contrevenant, mais aussi que cela pourrait causer un pr\u00e9judice \u00e0 l'enfant \u00e0 sa charge. Finalement, on contreviendrait ainsi non seulement \u00e0 plusieurs lois canadiennes, mais \u00e0 des obligations internationales. </p>\n<p data-HoCid=\"2995139\" data-originallang=\"fr\">C'est incompr\u00e9hensible que, au Canada, on puisse adopter des projets de lois qui pourraient imposer un fardeau d\u00e9raisonnable \u00e0 un enfant qui n'a pas les moyens \u2014 c'est clair \u2014 de payer l'amende compensatoire qui a \u00e9t\u00e9 impos\u00e9e \u00e0 ses parents. On doit \u00e9viter \u00e0 tout prix d'imposer un tel fardeau \u00e0 un enfant qui est un innocent dans cette histoire. N\u00e9anmoins, on est en train de cr\u00e9er une situation qui pourrait \u00eatre pr\u00e9judiciable \u00e0 un enfant. Franchement, je le dis encore une fois, on gagnerait \u00e0 prolonger le d\u00e9bat en comit\u00e9 et \u00e0 l'approfondir. C'est pourquoi je vais probablement voter en faveur du renvoi de ce projet de loi au comit\u00e9, mais ce n'est pas pour dire que des amendements ne lui seraient pas b\u00e9n\u00e9fiques.</p>\n<p data-HoCid=\"2995140\" data-originallang=\"fr\">Je veux aussi faire remarquer que, dans l'encyclop\u00e9die populaire Wikipedia, qui est souvent pour moi une source inspirante, on parle des suramendes et des amendes. Voici ce qu'on y dit:</p>\n<blockquote><p data-HoCid=\"2995141\" data-originallang=\"en\"> Il est contre-productif d'imposer une amende \u00e0 quelqu'un qui va devoir commettre de nouvelles infractions pour la payer. </p>\n</blockquote><p data-HoCid=\"2995142\" data-originallang=\"fr\">Cela signifie que ce n'est pas tr\u00e8s utile d'imposer des amendes quand la personne n'a pas la capacit\u00e9 de les payer, parce que cela pourrait justement favoriser la r\u00e9cidive. La personne qui n'est pas capable de payer ses amendes doit chercher l'argent quelque part, sinon elle fait encore l'objet d'une autre contravention. Et, encore une fois, cela favorise la r\u00e9cidive. On est en train de cr\u00e9er potentiellement un cercle vicieux.
