        "en": "<p data-HoCid=\"2370113\" data-originallang=\"fr\">Mr. Speaker, at this stage, I will say that we plan on voting in favour of sending this bill to committee to be studied. It must at least be substantially amended, if not replaced by the bill that all legislators in this House wanted and that was much more simple than the one we have in front of us today.</p>\n<p data-HoCid=\"2370114\" data-originallang=\"fr\">The speaker before me mentioned some incidents in Toronto that have made people think. Two members from two different parties introduced much simpler bills to clarify things.</p>\n<p data-HoCid=\"2370115\" data-originallang=\"fr\">I will sum up the situation. A store owner who sees a shoplifter who has previously stolen from him return to his shop and act the same way, realizes that he will once again be robbed. He does not have time to call the police, who would not arrive in time. Therefore, he decides to arrest the individual himself and detain him until the police arrive. That is something that makes sense. I will talk about two cases I pleaded that show that this is useful, especially in a country as vast as ours, where sometimes the police are far away and may take 45 minutes to an hour to come arrest someone who is committing an offence on or in relation to property.</p>\n<p data-HoCid=\"2370116\" data-originallang=\"fr\">We should have been satisfied with these private members' bills. What is strange in this case is that the department is telling us that it is introducing this bill to clarify things, but the language it uses is far from clear. In a few moments I will read some excerpts. I think it will take a lot of thinking and explanations before we can truly understand the provisions of the bill.</p>\n<p data-HoCid=\"2370117\" data-originallang=\"fr\">I am told that people love to hear my speeches in the House. It feels as though we are talking to an empty room or to a completely disinterested group of people. Our debates are televised and some people are disappointed if I do not use examples from past cases of mine to illustrate my point. I will talk about two cases, if I have the time.</p>\n<p data-HoCid=\"2370118\" data-originallang=\"fr\">I would like to clarify our position from the outset. We recognize that this amendment to section 494 is exactly what members want right now. Subsection 494(2) of the Criminal Code states the following:</p>\n<blockquote><p data-HoCid=\"2370119\" data-originallang=\"fr\"> Any one who is </p>\n<p data-HoCid=\"2370120\" data-originallang=\"fr\"> (a) the owner or a person in lawful possession of property, or </p>\n<p data-HoCid=\"2370121\" data-originallang=\"fr\"> (b) a person authorized by the owner or by a person in lawful possession of property, </p>\n<p data-HoCid=\"2370122\" data-originallang=\"fr\"> may arrest without warrant a person whom he finds committing a criminal offence on or in relation to that property. </p>\n</blockquote><p data-HoCid=\"2370123\" data-originallang=\"fr\">It is important to take note of what is not said in this subsection. It says \u201cfinds committing\u201d. But if the following day the owner sees the person who committed the offence to his property\u2014such as breaking his car windows, for example\u2014it is too late to make a citizen's arrest.</p>\n<p data-HoCid=\"2370124\" data-originallang=\"fr\">That is what happened to Mr. Chen, as was mentioned by the previous speaker. And it happens quite often. We agree with the amendment proposed in Bill <a data-HoCid=\"4963242\" href=\"/bills/40-3/C-60/\" title=\"An Act to amend the Criminal Code (citizen's arrest and the defences of property and persons)\">C-60</a>, which would change subsection 494(2) to the following:</p>\n<blockquote><p data-HoCid=\"2370125\" data-originallang=\"fr\"> The owner or a person in lawful possession of property, or a person authorized by the owner or by a person in lawful possession of property, may arrest a person without a warrant if they find them committing a criminal offence on or in relation to that property and </p>\n<p data-HoCid=\"2370126\" data-originallang=\"fr\"> (a) they make the arrest at that time; </p>\n</blockquote><p data-HoCid=\"2370127\" data-originallang=\"fr\">Up until that point, there are only slight changes to the current law, but then the following is added:</p>\n<blockquote><p data-HoCid=\"2370128\" data-originallang=\"fr\"> (b) they make the arrest within a reasonable time after the offence is committed and they believe on reasonable grounds that it is not feasible in the circumstances for a peace officer to make the arrest. </p>\n</blockquote><p data-HoCid=\"2370129\" data-originallang=\"fr\">This amendment, which is similar to two private members' bills previously introduced, would resolve the problem that we are all now aware of and provide the solution that we all want.</p>\n<p data-HoCid=\"2370130\" data-originallang=\"fr\"> This government has a bad habit. Whenever it sees that the House is likely to reach unanimous consent on a given measure, it always has to add something. We in the Bloc Qu\u00e9b\u00e9cois are particularly concerned about the changes it is making to the principle of self-defence. </p>\n<p data-HoCid=\"2370131\" data-originallang=\"fr\">For instance, here are two situations that could become legal and\u2014even worse\u2014become widespread, if the bill passes in its entirety. After a dispute over a fence degenerates, one neighbour utters death threats against the other neighbour and his family. Incidentally, people do not usually really mean them when they utter death threats. They usually amount to nothing more than excessive language, not all that different from what is often heard here in this House, for example. The two are more or less on the same level.</p>\n<p data-HoCid=\"2370132\" data-originallang=\"fr\">One thing is certain: the neighbour who hears those threats should not feel truly threatened. However, say he does feel threatened and fears for his life, and wanting to defend his family, he will say, he goes after his neighbour and kills him, justifying his action by saying that the police could not guarantee his safety and that of his family in the long term. In such a case, no one would ever know if the deceased neighbour ever really intended to carry out his threats. Thus, if potentially deadly force is to be used, we want to ensure that the danger is real, that there is no other option besides violence to respond to those threats.</p>\n<p data-HoCid=\"2370133\" data-originallang=\"fr\">In the other scenario, imagine a young person shoplifting in a convenience store. The store clerk, outraged by this recurring act in his store that is eating up his profits, pulls a shotgun on the shoplifter, but it fires accidentally. At present, that is a criminal offence, because it deals with property and because it involves someone who is not a peace officer. He would be using force that is disproportionate to the crime committed and that caused someone's death.</p>\n<p data-HoCid=\"2370134\" data-originallang=\"fr\">This is why we want to carefully study the provisions of this bill that have to do with self-defence.</p>\n<p data-HoCid=\"2370135\" data-originallang=\"fr\">I have practised criminal law since 1966 and have always found the current provisions to be logical and rather self-explanatory and not requiring any radical changes. For example, without going into all the details, the current provisions on self-defence against unprovoked assault start out as follows: </p>\n<blockquote><p data-HoCid=\"2370136\" data-originallang=\"fr\"> (1) Every one who is unlawfully assaulted without having provoked the assault is justified in repelling force by force if the force he uses is not intended to cause death or grievous bodily harm and is no more than is necessary to enable him to defend himself. </p>\n<p data-HoCid=\"2370137\" data-originallang=\"fr\"> (2) Every one who is unlawfully assaulted and who causes death or grievous bodily harm in repelling the assault is justified if </p>\n<p data-HoCid=\"2370138\" data-originallang=\"fr\"> (a) he causes it under reasonable apprehension of death or grievous bodily harm from the violence with which the assault was originally made or with which the assailant pursues his purposes; and </p>\n<p data-HoCid=\"2370139\" data-originallang=\"fr\"> (b) he believes, on reasonable grounds, that he cannot otherwise preserve himself from death or grievous bodily harm. </p>\n</blockquote><p data-HoCid=\"2370140\" data-originallang=\"fr\"> No matter their education, jurors who carefully read this section, or if it is read by the judge\u2014perhaps judges provide a copy of the Criminal Code section\u2014are perfectly capable of understanding it. Now here is what they want to replace it with. Why? I do not know.</p>\n<p data-HoCid=\"2370141\" data-originallang=\"fr\">This is the proposed wording:</p>\n<blockquote><p data-HoCid=\"2370142\" data-originallang=\"fr\"> A person is not guilty of an offence if </p>\n<p data-HoCid=\"2370143\" data-originallang=\"fr\"> (a) they believe on reasonable grounds that force is being used against them or another person or that a threat of force is being made against them or another person; </p>\n<p data-HoCid=\"2370144\" data-originallang=\"fr\"> (b) the act that constitutes the offence is committed for the purpose of defending or protecting themselves or the other person from that use or threat of force;... </p>\n</blockquote><p data-HoCid=\"2370145\" data-originallang=\"fr\">I am not exaggerating when I say that I am certain that anyone hearing this for the first time will not understand the underlying principle. However, if they referred to the text I read earlier, the current Criminal Code section, they would have a much better understanding.</p>\n<p data-HoCid=\"2370146\" data-originallang=\"fr\">I do not understand when the government says that it wants to clarify an act, but then it uses such esoteric language to replace Criminal Code provisions that have stood the test of time.</p>\n<p data-HoCid=\"2370147\" data-originallang=\"fr\">As a lawyer, I have been involved in various cases. I remember a client who was accused of manslaughter. In fact, he might have been accused of murder, but the Crown was prepared to convict for manslaughter of a boat thief.</p>\n<p data-HoCid=\"2370148\" data-originallang=\"fr\">The defendant was living on an island east of Laval and he had several neighbours. Thieves would arrive by water. One night, the defendant, who was having prostate problems, got up and turned on the lights. He heard a noise, looked outside and saw people fleeing in a canoe. He realized that they were thieves. He finished what he was doing and went back to bed. Later, he heard the sound of boats knocking together even though the river was calm at that hour. He kept the light off and looked outside. What did he see? He saw two people in a canoe pulling his neighbour's motor boat behind them. He yelled out to them and told them to let go of the boat immediately, that they had been caught red-handed. The people kept paddling as though nothing were wrong and headed toward a nearby island to hide. The man found the shameless thieves and told them he had guns. He warned them to give up the boat or he would shoot.</p>\n<p data-HoCid=\"2370149\" data-originallang=\"fr\">At this point his wife was awake and he asked her to call the police. He could still see the two men paddling. Since he is a hunter, he has at least two guns: a rifle he uses for big game hunting and a .22 calibre gun.</p>\n<p data-HoCid=\"2370150\" data-originallang=\"fr\">He decided against using the moose hunting rifle because the shot could be fatal and the .22 calibre gun would make enough noise just to scare them. The man warned the thieves that he was aiming his gun at them, ready to shoot, but they kept on paddling. He decided to shoot in front of the canoe to scare them, but they kept on paddling. He warned them he was going to shoot again and he ordered them to let go of the boat. The thieves continued to paddle. The man took another shot in front of the canoe\u2014or so he thought. Then one of the perpetrators seemed to be hiding in the canoe and the other raised his paddle and said they were surrendering. They came back toward him. The police were called to the scene.</p>\n<p data-HoCid=\"2370151\" data-originallang=\"fr\">One of the two thieves got out of the canoe, but the other one seemed to remain hidden inside. The man warned the thieves that he was armed and that they should not do anything foolish because the police were on their way. Finally, when the police arrived, the man handed over the rifle, trembling, and said that there was another person hiding in the canoe. The police went to look in the canoe and saw that the other person was dead.</p>\n<p data-HoCid=\"2370152\" data-originallang=\"fr\">Normally, a .22 calibre bullet fired at that range should not do that, but a .22 calibre bullet is still a bullet even though it is small and slow. In this case, the bullet entered the thief's side, passed between two of his ribs, through one of his lungs\u2014where there was not much to stop it\u2014and lodged at the base of his heart, which is what caused his death. </p>\n<p data-HoCid=\"2370153\" data-originallang=\"fr\">A police officer would have had the right to do what this man did, although admittedly a police officer would not have done it. Nevertheless, under the Criminal Code, a police officer has the right to behave like this. He used the only force available to make the arrest and it was deadly force. Individuals do not have the right to use deadly force simply to protect their property.</p>\n<p data-HoCid=\"2370154\" data-originallang=\"fr\">I told myself that the jurors would understand his position, so we decided to bring the case before a jury. We had an expert shooter come in, who told me to ask the police officers whether they had touched the weapon or made any changes to it. I asked him why and he said that he would tell me later. The police officers said that they had kept the weapon as they had found it. The expert shooter noticed that the sight was not calibrated for the range in question. He said that if the man in question had not wanted to hit the thieves, he should have aimed above their heads. Although a bullet travels several feet per second, a canoe also travels a certain distance in several seconds. </p>\n<p data-HoCid=\"2370155\" data-originallang=\"fr\">I thought that the judge would have to often reiterate that the force must be reasonable and proportional to the situation. If shouting was not enough to convince boat thieves who are on the water to stop, how else could they be stopped other than with a shot? The man had weapons at his disposal and he chose the less dangerous one. He aimed ahead of the boat so that the thieves would see the flash. His arguments convinced the jury and he was acquitted even though the judge told me that she would have found him guilty. She did not sentence him to time in prison since she understood his reasoning. This earned me some nice comments from the presiding juror, who knew Mr. Roy, Mr. Mulroney's former chief of staff. Mr. Roy was actually her nephew, and she told him that the lawyer was extraordinary. However, that has nothing to do with the application of the law, except that a law that is difficult to understand could lead to a sympathy verdict. This bill is ten times harder to understand.</p>\n<p data-HoCid=\"2370156\" data-originallang=\"fr\">I think that I have time to talk about another case, but it is about the ordinary arrest of an ordinary citizen after the fact. It is similar to the case of Mr. Chen, except that a security guard was involved. It is 17 years since I last practised criminal law. At the time, it was not popular for men to shave their heads, except maybe a few troublemakers. The individual in my case had no hair, no eyebrows, nothing. He had what is called alopecia universalis. He told me that he had no hair anywhere\u2014yes, even where you are thinking. It is odd to see someone without any hair or eyebrows. This person told me that a few thousand people in Montreal have this condition, including the drummer of for the band Corbeau. He said that people always mistook him for someone else.</p>\n<p data-HoCid=\"2370157\" data-originallang=\"fr\">He had just moved and went into Steinberg's grocery to buy some bread and coffee for breakfast. When he got to the cash, he was arrested by the security guard who said that he had stolen something the day before. He responded that he had not been in the store the day before and that it was likely someone who looked like him. He said that he was often mistaken for the drummer from Corbeau, who had the same condition.</p>\n<p data-HoCid=\"2370158\" data-originallang=\"fr\">We explained his conditions and the effects of it, but when I tried his case, the security guard at the door of the court had the same condition. So we did not need an acquittal, but we filed a lawsuit. Steinberg went bankrupt and the security guard committed suicide. He had made a mistake by arresting him the following day. He did not have the right to arrest him because he had not caught him in the act.</p>",

Il d\u00e9cide donc de l'arr\u00eater lui-m\u00eame et de le d\u00e9tenir jusqu'\u00e0 ce que la police arrive. C'est quelque chose qui a du sens. Je vais parler de deux causes que j'ai plaid\u00e9es d\u00e9montrant que cela est utile, surtout dans un pays immense comme le n\u00f4tre, o\u00f9 parfois, la police est tr\u00e8s loin et peut mettre jusqu'\u00e0 trois quarts d'heure ou une heure pour venir arr\u00eater une personne en train de commettre une infraction sur des biens.</p>\n<p data-HoCid=\"2370116\" data-originallang=\"fr\">On aurait d\u00fb se contenter de ces projets de loi \u00e9manant de d\u00e9put\u00e9s. Ce qui est \u00e9trange dans ce cas-ci, c'est que le minist\u00e8re nous dit qu'il pr\u00e9sente ce projet de loi pour clarifier la situation. Le langage qu'il utilise est loin de le faire. Je vais en lire tout \u00e0 l'heure certains extraits. Je suis convaincu qu'il faut r\u00e9fl\u00e9chir longuement et qu'on nous donne beaucoup d'explications avant de comprendre exactement les dispositions du projet de loi.</p>\n<p data-HoCid=\"2370117\" data-originallang=\"fr\">On m'a dit que des gens aiment bien \u00e9couter mes pr\u00e9sentations \u00e0 la Chambre. On a l'impression de plaider devant une salle vide ou compl\u00e8tement d\u00e9sint\u00e9ress\u00e9e. Nos d\u00e9lib\u00e9rations sont diffus\u00e9es \u00e0 la t\u00e9l\u00e9vision et certains sont d\u00e9\u00e7us quand je ne parle pas de certains des proc\u00e8s que j'ai plaid\u00e9s pour illustrer les questions \u00e0 l'\u00e9tude. Je vais leur parler de deux proc\u00e8s, si j'en ai le temps.</p>\n<p data-HoCid=\"2370118\" data-originallang=\"fr\">Je voudrais d'abord clarifier notre position d\u00e8s le d\u00e9part. Nous reconnaissons que l'amendement \u00e0 l'article 494 est exactement ce que l'ensemble des d\u00e9put\u00e9s de la Chambre veulent maintenant. Le paragraphe 494(2) du Code criminel dit ceci: </p>\n<blockquote><p data-HoCid=\"2370119\" data-originallang=\"fr\"> Quiconque est, selon le cas: </p>\n<p data-HoCid=\"2370120\" data-originallang=\"fr\"> a) le propri\u00e9taire ou une personne en possession l\u00e9gitime d\u2019un bien; </p>\n<p data-HoCid=\"2370121\" data-originallang=\"fr\"> b) une personne autoris\u00e9e par le propri\u00e9taire ou par une personne en possession l\u00e9gitime d\u2019un bien, </p>\n<p data-HoCid=\"2370122\" data-originallang=\"fr\"> peut arr\u00eater sans mandat une personne qu\u2019il trouve en train de commettre une infraction criminelle sur ou concernant ce bien. </p>\n</blockquote><p data-HoCid=\"2370123\" data-originallang=\"fr\">Ce qui est important de noter, c'est ce que le paragraphe ne dit pas. On y lit les mots \u00ab en train de commettre \u00bb, mais si le lendemain, on revoit la personne qui a commis l'infraction sur notre bien, qui a bris\u00e9 les vitres de notre voiture ou n'importe quoi d'autre, il est trop tard pour l'arr\u00eater comme citoyen.</p>\n<p data-HoCid=\"2370124\" data-originallang=\"fr\">C'est ce qui est arriv\u00e9 \u00e0 M. Chen, dont parlait l'orateur pr\u00e9c\u00e9dent, et c'est ce qui arrive assez souvent. Nous sommes d'accord sur l'amendement propos\u00e9 dans le projet de loi <a data-HoCid=\"4963242\" href=\"/bills/40-3/C-60/\" title=\"An Act to amend the Criminal Code (citizen's arrest and the defences of property and persons)\">C-60</a>, o\u00f9 le nouveau paragraphe 494(2) se lirait ainsi: </p>\n<blockquote><p data-HoCid=\"2370125\" data-originallang=\"fr\"> Le propri\u00e9taire d\u2019un bien ou la personne en ayant la possession l\u00e9gitime, ainsi que toute personne qu\u2019il autorise, peut arr\u00eater sans mandat une personne qu\u2019il trouve en train de commettre une infraction criminelle sur le bien ou concernant celui-ci dans les cas suivants: </p>\n<p data-HoCid=\"2370126\" data-originallang=\"fr\"> a) il proc\u00e8de \u00e0 l\u2019arrestation \u00e0 ce moment-l\u00e0; </p>\n</blockquote><p data-HoCid=\"2370127\" data-originallang=\"fr\">Jusqu'ici, on reprend en termes un peu diff\u00e9rents la loi actuelle, mais on ajoute ceci:</p>\n<blockquote><p data-HoCid=\"2370128\" data-originallang=\"fr\"> b) il proc\u00e8de \u00e0 l\u2019arrestation dans un d\u00e9lai raisonnable apr\u00e8s la perp\u00e9tration de l\u2019infraction et il croit, pour des motifs raisonnables, que l\u2019arrestation par un agent de la paix n\u2019est pas possible dans les circonstances. </p>\n</blockquote><p data-HoCid=\"2370129\" data-originallang=\"fr\">Cet amendement, qui ressemble aux deux projets de loi d'initiative parlementaire qui ont \u00e9t\u00e9 pr\u00e9sent\u00e9s r\u00e9glerait le probl\u00e8me auquel nous avons tous \u00e9t\u00e9 sensibilis\u00e9s et apporterait la solution que nous d\u00e9sirons tous, de fa\u00e7on unanime. </p>\n<p data-HoCid=\"2370130\" data-originallang=\"fr\">Or ce gouvernement a une mauvaise habitude. Quand il voit qu'il aura l'accord unanime de la Chambre des communes sur une mesure, il tient absolument \u00e0 ajouter des choses. Au Bloc qu\u00e9b\u00e9cois, nous sommes particuli\u00e8rement inquiets des changements qu'il apporte au principe de la l\u00e9gitime d\u00e9fense. </p>\n<p data-HoCid=\"2370131\" data-originallang=\"fr\">Par exemple, voici deux situations qui pourraient devenir l\u00e9gales et \u2014 pire, m\u00eame \u2014 se r\u00e9pandre, si le projet de loi \u00e9tait adopt\u00e9 dans son ensemble. Apr\u00e8s une chicane de cl\u00f4ture qui d\u00e9g\u00e9n\u00e8re, un voisin prof\u00e8re des menaces de mort contre un autre et toute sa famille. Soit dit en passant, la plupart du temps, les gens ne sont pas vraiment s\u00e9rieux quand ils prof\u00e8rent des menaces de mort. Ce sont des exc\u00e8s de langage \u00e0 peu pr\u00e8s du m\u00eame type que ceux que nous utilisons couramment ici, en cette Chambre. Ils se situent \u00e0 peu pr\u00e8s au m\u00eame niveau. </p>\n<p data-HoCid=\"2370132\" data-originallang=\"fr\">Il est certain qu'il ne faudrait pas que le voisin qui entend ces menaces se sente trop menac\u00e9. Donc, ce voisin menac\u00e9, craignant pour sa vie, dira-t-il, et voulant d\u00e9fendre les siens, se rue sur l'injurieux, le tue et justifie son geste en disant que la police ne pouvait pas garantir sa s\u00e9curit\u00e9 ni celle de sa famille, \u00e0 long terme. Dans un tel cas, on ne saura m\u00eame pas si le voisin d\u00e9c\u00e9d\u00e9 avait r\u00e9ellement l'intention de mettre ses menaces \u00e0 ex\u00e9cution. Donc, si on utilise une force susceptible de causer la mort, on veut s'assurer que le danger est r\u00e9el, qu'il n'y a pas d'autres possibilit\u00e9s que la violence pour riposter \u00e0 ces menaces.</p>\n<p data-HoCid=\"2370133\" data-originallang=\"fr\">Dans l'autre sc\u00e9nario, un jeune commet un vol \u00e0 l'\u00e9talage au d\u00e9panneur. Le caissier, ulc\u00e9r\u00e9 de cet acte r\u00e9p\u00e9titif dans son commerce qui menace ses finances, le met en joue avec un fusil de chasse, mais le coup part accidentellement. Actuellement, c'est ill\u00e9gal parce qu'il s'agit d'un bien, il s'agit de quelqu'un qui n'est pas un agent de la paix. Il utilise une force qui est hors de proportion par rapport au crime commis et il en r\u00e9sulte la mort. </p>\n<p data-HoCid=\"2370134\" data-originallang=\"fr\">C'est pourquoi nous voulons \u00e9tudier avec beaucoup d'attention les dispositions du projet de loi qui ont trait \u00e0 la l\u00e9gitime d\u00e9fense. </p>\n<p data-HoCid=\"2370135\" data-originallang=\"fr\">Ayant pratiqu\u00e9 le droit criminel depuis 1966, j'ai toujours trouv\u00e9 que ces dispositions actuelles \u00e9taient logiques et relativement bien expliqu\u00e9es, ne n\u00e9cessitant pas, d'ailleurs, de changement radical. Par exemple, actuellement, en ce qui a trait \u00e0 la l\u00e9gitime d\u00e9fense \u2014 je n'irai pas dans tous les d\u00e9tails \u2014, on commence par dire ceci: </p>\n<blockquote><p data-HoCid=\"2370136\" data-originallang=\"fr\"> (1) Toute personne ill\u00e9galement attaqu\u00e9e sans provocation de sa part est fond\u00e9e \u00e0 employer la force qui est n\u00e9cessaire pour repousser l\u2019attaque si, en ce faisant, elle n\u2019a pas l\u2019intention de causer la mort ni des l\u00e9sions corporelles graves. </p>\n<p data-HoCid=\"2370137\" data-originallang=\"fr\"> (2) Quiconque est ill\u00e9galement attaqu\u00e9 et cause la mort ou une l\u00e9sion corporelle grave en repoussant l\u2019attaque est justifi\u00e9 si: </p>\n<p data-HoCid=\"2370138\" data-originallang=\"fr\"> a) d\u2019une part, il la cause parce qu\u2019il a des motifs raisonnables pour appr\u00e9hender que la mort ou quelque l\u00e9sion corporelle grave ne r\u00e9sulte de la violence avec laquelle l\u2019attaque a en premier lieu \u00e9t\u00e9 faite, ou avec laquelle l\u2019assaillant poursuit son dessein; </p>\n<p data-HoCid=\"2370139\" data-originallang=\"fr\"> b) d\u2019autre part, il croit, pour des motifs raisonnables, qu\u2019il ne peut pas autrement se soustraire \u00e0 la mort ou \u00e0 des l\u00e9sions corporelles graves. </p>\n</blockquote><p data-HoCid=\"2370140\" data-originallang=\"fr\">Quiconque fait partie d'un jury et lit cela avec attention, quelle que soit sa formation, ou si cela est lu par un juge \u2014 peut-\u00eatre des juges donnent-ils une copie de l'article du Code criminel \u2014, est parfaitement capable de comprendre. Or voici par quoi on veut le remplacer. Pourquoi? Je ne le sais pas. </p>\n<p data-HoCid=\"2370141\" data-originallang=\"fr\">On propose ceci:</p>\n<blockquote><p data-HoCid=\"2370142\" data-originallang=\"fr\"> Ne peut \u00eatre d\u00e9clar\u00e9e coupable d\u2019une infraction la personne qui, \u00e0 la fois: </p>\n<p data-HoCid=\"2370143\" data-originallang=\"fr\"> a) croit, pour des motifs raisonnables, que la force est employ\u00e9e contre elle ou une autre personne ou qu\u2019on menace de l\u2019employer contre elle ou une autre personne; </p>\n<p data-HoCid=\"2370144\" data-originallang=\"fr\"> b) commet l\u2019acte constituant l\u2019infraction dans le but de se d\u00e9fendre ou de se prot\u00e9ger \u2014 ou de d\u00e9fendre ou de prot\u00e9ger une autre personne \u2014 contre l\u2019emploi ou la menace d\u2019emploi de la force; [...] </p>\n</blockquote><p data-HoCid=\"2370145\" data-originallang=\"fr\">Je n'exag\u00e8re pas lorsque je dis que je suis certain que ceux qui entendent \u00e7a pour la premi\u00e8re fois ne comprennent pas quel est au juste le principe. Par contre, s'ils se r\u00e9f\u00e9raient \u00e0 l'article que je lisais tout \u00e0 l'heure, soit l'article en force actuellement, ils comprendraient beaucoup mieux.</p>\n<p data-HoCid=\"2370146\" data-originallang=\"fr\">Je ne comprends pas que l'on dise vouloir clarifier une loi, mais que l'on utilise un langage aussi \u00e9sot\u00e9rique pour remplacer des dispositions du Code criminel qui ont fait leurs preuves depuis pr\u00e8s d'un si\u00e8cle.</p>\n<p data-HoCid=\"2370147\" data-originallang=\"fr\">Personnellement, en tant qu'avocat, j'ai eu \u00e0 vivre certaines circonstances. Je me souviens d'un client qui \u00e9tait accus\u00e9 d'homicide involontaire coupable. En fait, il \u00e9tait peut-\u00eatre accus\u00e9 de meurtre, mais la Couronne \u00e9tait pr\u00eate \u00e0 r\u00e9gler pour homicide involontaire coupable d'un voleur de bateau. </p>\n<p data-HoCid=\"2370148\" data-originallang=\"fr\">L'accus\u00e9 habitait sur une \u00eele situ\u00e9e \u00e0 l'est de Laval et avait plusieurs voisins. Plusieurs voleurs arrivaient par l'eau. Une nuit, pour des raisons li\u00e9es \u00e0 des probl\u00e8mes de prostate, il se l\u00e8ve et allume les lumi\u00e8res. Il entend du bruit, regarde \u00e0 l'ext\u00e9rieur et voit des gens qui s'enfuient \u00e0 bord d'un canot. Il r\u00e9alise que ce sont des voleurs. Il fait ses besoins et retourne se coucher. Plus tard, il entend des bruits de bateaux qui s'entrechoquent, bien que la rivi\u00e8re soit tr\u00e8s calme \u00e0 cette heure. Il n'ouvre pas lumi\u00e8re et regarde dehors. Que voit-il? Il voit deux personnes \u00e0 bord d'un canot qui tire le bateau \u00e0 moteur de son voisin. Il leur crie de l\u00e2cher le bateau imm\u00e9diatement, qu'ils sont pris sur le fait. Les gens continuent de ramer comme si de rien n'\u00e9tait et se dirigent vers une \u00eele \u00e0 proximit\u00e9 o\u00f9 ils vont pouvoir se cacher. L'homme trouve les voleurs effront\u00e9s et leur dit qu'il a des armes. Il les avertit de l\u00e2cher le bateau, sans quoi il devra se servir d'une de ses armes.</p>\n<p data-HoCid=\"2370149\" data-originallang=\"fr\">\u00c9videmment, sa femme est maintenant r\u00e9veill\u00e9e et il lui demande d'appeler tout de suite les policiers. Il voit toujours les deux hommes ramer. Comme il est chasseur, il poss\u00e8de au moins deux armes, dont une carabine utilis\u00e9e lors de la chasse au gros gibier et une arme de calibre 22.</p>\n<p data-HoCid=\"2370150\" data-originallang=\"fr\">Il d\u00e9cide de ne pas utiliser l'arme qui sert \u00e0 la chasse \u00e0 l'orignal, car le coup pourrait \u00eatre mortel. Toutefois, l'arme de calibre 22 fera juste assez de bruit pour les effrayer. L'homme pr\u00e9vient les voleurs qu'il les tient en joue et qu'il va tirer, mais ceux-ci continuent toujours \u00e0 ramer. Il d\u00e9cide de tirer devant le canot, juste pour leur faire peur, mais les voleurs continuent \u00e0 ramer. Il les avertit qu'il va tirer de nouveau et leur ordonne de l\u00e2cher le bateau. Les voleurs continuent \u00e0 ramer. L'homme tire un autre coup devant le canot \u2014 enfin, c'est ce qu'il croit. \u00c0 cet instant, un des deux malfaiteurs semble se cacher dans le canot et l'autre l\u00e8ve sa rame et lui indique qu'ils se rendent. Les gens reviennent vers lui. La police est appel\u00e9e sur les lieux. </p>\n<p data-HoCid=\"2370151\" data-originallang=\"fr\">Un des deux voleurs d\u00e9barque du canot, mais l'autre semble rester cach\u00e9 \u00e0 l'int\u00e9rieur. Il les avertit qu'il est arm\u00e9 et qu'ils sont aussi bien de ne pas faire de folies, parce que les policiers s'en viennent. Finalement, lorsque les policiers arrivent, l'homme leur remet la carabine d'une main tremblante et leur explique qu'il y a une autre personne qui se cache dans le bateau. Les policiers vont voir dans le canot et s'aper\u00e7oivent que l'autre personne est morte.</p>\n<p data-HoCid=\"2370152\" data-originallang=\"fr\">Normalement, une balle de calibre 22 tir\u00e9e \u00e0 cette distance ne devrait pas faire \u00e7a, mais une balle de 22, \u00e7a reste un projectile, m\u00eame s'il est lent et n'est pas important. Dans ce cas, le projectile est entr\u00e9 par le c\u00f4t\u00e9, est pass\u00e9 entre deux c\u00f4tes, a travers\u00e9 le poumon \u2014 o\u00f9 il n'y a pas grand-chose pour l'arr\u00eater \u2014 et a \u00e9t\u00e9 se loger au bas du coeur, ce qui a caus\u00e9 la mort.</p>\n<p data-HoCid=\"2370153\" data-originallang=\"fr\">Je constate que ce qu'il a fait, un policier aurait eu droit de le faire, quoique je sais qu'un policier ne l'aurait pas fait. Cependant, en vertu du Code criminel, un policier a le droit de le faire. Il a utilis\u00e9 la seule force pour effectuer l'arrestation, et c'\u00e9tait une force susceptible de causer la mort. Un particulier n'a pas le droit d'utiliser une force susceptible de causer la mort uniquement pour une infraction sur un bien.</p>\n<p data-HoCid=\"2370154\" data-originallang=\"fr\"> Je me suis dit que les jur\u00e9s allaient comprendre son attitude. On d\u00e9cide alors d'aller devant un jury et on fait venir un tireur expert, qui me dit de demander aux policiers s'ils ont touch\u00e9 \u00e0 cette arme, s'ils l'ont modifi\u00e9e. Je lui demande pourquoi, et il me r\u00e9pond qu'il me le dira plus tard. Les policiers me disent qu'ils ont gard\u00e9 l'arme telle quelle. Le tireur expert s'aper\u00e7oit que la mire n'est pas plac\u00e9e pour la distance en cause. Il dit que si l'homme en question n'avait pas voulu attraper les voleurs, il aurait d\u00fb viser dessus. La balle a beau parcourir plusieurs pieds par seconde, il reste qu'en quelques secondes, un canot parcourt une certaine distance. </p>\n<p data-HoCid=\"2370155\" data-originallang=\"fr\">Je me suis dit que le juge allait devoir r\u00e9p\u00e9ter tr\u00e8s souvent qu'il faut que la force soit raisonnable et proportionnelle \u00e0 la situation. Comment peut-on arr\u00eater des voleurs de bateau sur l'eau \u00e0 moins de leur lancer un projectile, si notre voix ne les a pas convaincus d'arr\u00eater? Il a des armes \u00e0 sa disposition et il choisit la moins dangereuse. Il vise en avant du bateau de fa\u00e7on \u00e0 ce que les voleurs voient l'\u00e9clat produit. Ses arguments ont convaincu le jury, qui l'a acquitt\u00e9, m\u00eame si la juge m'a signal\u00e9 qu'elle l'aurait trouv\u00e9 coupable. Elle ne lui a pas impos\u00e9 une peine d'emprisonnement, car elle comprenait son raisonnement. \u00c7a m'a valu de belles remarques de la pr\u00e9sidente du jury qui connaissait M. Roy, l'ancien chef de cabinet de M. Mulroney, qui \u00e9tait son neveu et \u00e0 qui elle a dit que son avocat \u00e9tait extraordinaire. Mais \u00e7a n'a rien \u00e0 avoir avec l'application de la loi, sinon qu'une loi difficile \u00e0 comprendre peut amener un verdict de sympathie. Le pr\u00e9sent projet de loi est dix fois plus difficile \u00e0 comprendre.</p>\n<p data-HoCid=\"2370156\" data-originallang=\"fr\"> Je crois avoir le temps de parler d'un autre cas, mais l\u00e0, il s'agit de la simple arrestation d'un simple citoyen apr\u00e8s le fait. C'est un peu comme le cas de M. Chen, sauf que c'est un agent de s\u00e9curit\u00e9 qui est impliqu\u00e9. \u00c7a fait 17 ans que je n'ai pas pratiqu\u00e9 le droit criminel. \u00c0 cette \u00e9poque, la mode des cr\u00e2nes ras\u00e9s chez les hommes n'existait pas, sauf chez certains hurluberlus. La personne que je vois n'a ni cheveux ni cils, rien. Elle souffre de ce qu'on appelle la pelade aig\u00fce. Elle m'a bien dit n'avoir de poils nulle part, y compris l\u00e0 o\u00f9 l'on pense. C'est bizarre de voir une personne sans cheveux ni cils. Cette personne me dit qu'ils sont quelques milliers \u00e0 Montr\u00e9al et que le batteur de Corbeau, entre autres, \u00e9tait atteint de cette maladie. Il dit qu'on prend toujours les uns pour les autres.</p>\n<p data-HoCid=\"2370157\" data-originallang=\"fr\"> Il venait de d\u00e9m\u00e9nager et il va au Steinberg acheter un pain et du caf\u00e9 pour d\u00e9jeuner. Alors qu'il allait payer \u00e0 la caisse, il se fait arr\u00eater par l'agent de s\u00e9curit\u00e9, qui lui dit qu'il avait vol\u00e9 quelque chose la veille. Il lui r\u00e9pond qu'il n'est pas venu au magasin hier et qu'il s'agit probablement d'une personne lui ressemblant. Il lui dit qu'il se fait souvent prendre pour le batteur de Corbeau, qui a la m\u00eame maladie. </p>\n<p data-HoCid=\"2370158\" data-originallang=\"fr\">On a expliqu\u00e9 sa maladie et les cons\u00e9quences de celle-ci, mais quand j'ai plaid\u00e9 le proc\u00e8s, le gardien de s\u00e9curit\u00e9 \u00e0 la porte de la cour avait la m\u00eame maladie. Alors, on n'a pas eu besoin d'obtenir un acquittement, mais on a lanc\u00e9 une poursuite en dommages-int\u00e9r\u00eats. Steinberg a fait faillite et l'agent de s\u00e9curit\u00e9 s'est suicid\u00e9. Il avait fait une erreur en l'arr\u00eatant le lendemain. Il n'avait pas le droit de l'arr\u00eater, car il ne l'avait pas pris sur le fait. </p>"
