"en": "<p data-HoCid=\"2619343\" data-originallang=\"en\">Mr. Speaker, I am pleased to rise in the House today to engage and speak to Bill <a data-HoCid=\"5254650\" href=\"/bills/41-1/C-26/\" title=\"An Act to amend the Criminal Code (citizen's arrest and the defences of property and persons)\">C-26, An Act to amend the Criminal Code (citizen's arrest and the defences of property and persons)</a>, commonly referred to as the Lucky Moose bill.</p>\n<p data-HoCid=\"2619344\" data-originallang=\"en\">Let me begin my statements by highlighting the incidents that have led to the introduction of legislation of this kind by both the government and by the member for <a data-HoCid=\"170633\" href=\"/politicians/olivia-chow/\" title=\"Olivia Chow\">Trinity\u2014Spadina</a>.</p>\n<p data-HoCid=\"2619345\" data-originallang=\"en\">On May 23, 2009, David Chen, owner of the Lucky Moose Food Mart in Toronto apprehended a man, Anthony Bennett, who had stolen from his store. After Bennett was initially caught on security footage stealing from the store, he returned an hour later. At that time, Chen, who was 36 and had two employees, tied up the man and locked him in the back of a delivery van.</p>\n<p data-HoCid=\"2619346\" data-originallang=\"en\">When police arrived, they charged Chen with kidnapping, carrying a dangerous weapon--a box cutter, which most grocery store workers would normally have on their person--assault and forcible confinement. Crown prosecutors later dropped the kidnapping and weapons charges but proceeded with the charges of forcible confinement and assault.</p>\n<p data-HoCid=\"2619347\" data-originallang=\"en\">Although Anthony Bennett, the suspect in question, ultimately pleaded guilty in August 2009 to stealing from the store and was sentenced to 30 days in jail, the crown moved ahead with the charges against Mr. Chen and his employees, since the Criminal Code, as it is currently written, stipulates that a property owner can only make a citizen's arrest if the alleged wrongdoer is caught in the act.</p>\n<p data-HoCid=\"2619348\" data-originallang=\"en\">Obviously in this case the circumstances of the suspect's returning to the scene shortly after the offence was committed exposed a fatal flaw in the legislation, and this flaw has led us to this point.</p>\n<p data-HoCid=\"2619349\" data-originallang=\"en\">It is also important to note that the suspect in question had stolen repeatedly from the same store, so this was certainly not a case of mistaken identity. We can be assured of that.</p>\n<p data-HoCid=\"2619350\" data-originallang=\"en\">Eventually, after a court ordeal lasting a year and a half, Chen and his two co-accused were found not guilty of the charges of forcible confinement and assault on October 29, 2010. Obviously the process of a lengthy trial was distressing for Mr. Chen and his family, while also tallying significant administrative costs borne by taxpayers and tying up the valuable time of police, prosecutors and the courts.</p>\n<p data-HoCid=\"2619351\" data-originallang=\"en\">In response to the ongoing concerns New Democrats heard from individuals across the country regarding a citizen's ability to make a lawful citizen's arrest, in September 2010 the New Democratic MP for <a data-HoCid=\"170633\" href=\"/politicians/olivia-chow/\" title=\"Olivia Chow\">Trinity\u2014Spadina</a> introduced a private member's bill to amend the Criminal Code in order to protect individuals like David Chen from facing criminal charges.</p>\n<p data-HoCid=\"2619352\" data-originallang=\"en\">New Democrats have consistently welcomed the government's decision to incorporate the member for <a data-HoCid=\"170633\" href=\"/politicians/olivia-chow/\" title=\"Olivia Chow\">Trinity\u2014Spadina</a>'s proposals into its legislation, first tabled in February 2011 during the 40th Parliament and now again in the 41st Parliament.</p>\n<p data-HoCid=\"2619353\" data-originallang=\"en\">Let me now move to the specifics of the bill in order to parse out what is actually being proposed by the government at this juncture. Let me begin with the sections dealing specifically with citizen's arrest.</p>\n<p data-HoCid=\"2619354\" data-originallang=\"en\">Currently, under subsection 494(1) of the Criminal Code, any individual can make an arrest without a warrant of a person he or she finds committing an indictable offence or who he or she believes on reasonable grounds has committed a criminal offence and is escaping from and freshly pursued by those with lawful authority to arrest the suspect in question.</p>\n<p data-HoCid=\"2619355\" data-originallang=\"en\">Under Bill <a data-HoCid=\"5254650\" href=\"/bills/41-1/C-26/\" title=\"An Act to amend the Criminal Code (citizen's arrest and the defences of property and persons)\">C-26</a>, this section of the Criminal Code relating to citizen's arrest would remain unaltered.</p>\n<p data-HoCid=\"2619356\" data-originallang=\"en\">Therefore the amendments being proposed apply solely to section 494(2), which applies to the owner or other persons in lawful possession of property or a person authorized by the owner or lawful possessor.</p>\n<p data-HoCid=\"2619357\" data-originallang=\"en\">Currently such a person may make a warrantless arrest of a person whom he or she finds committing a criminal offence on or in relation to that property. The proposed amendments would subsequently allow such a person to make an arrest within a reasonable time after the offence is committed.</p>\n<p data-HoCid=\"2619358\" data-originallang=\"en\">Under the amendment, business owners or persons under their delegated authority would be rightfully allowed to make an arrest if they believed, on reasonable grounds, that it was not feasible in the circumstances for a police officer to make that arrest.</p>\n<p data-HoCid=\"2619359\" data-originallang=\"en\">The final piece of Bill <a data-HoCid=\"5254650\" href=\"/bills/41-1/C-26/\" title=\"An Act to amend the Criminal Code (citizen's arrest and the defences of property and persons)\">C-26</a> as it relates to citizen's arrest is the proposed new subsection 494(4). This section specifically clarifies that a person who makes an arrest under section 494 is a person who is authorized by law to do so for the purposes of section 25 of the code. Essentially, the purpose of this amendment seems to be to denote that although the use of force is authorized in a citizen's arrest, there remain limits on how much force can be used.</p>\n<p data-HoCid=\"2619360\" data-originallang=\"en\">For those who are not fluent in legal jargon, essentially these amendments would permit citizen's arrests without a warrant within a reasonable period of time after a criminal offence is observed. This means that in the case of Mr. Chen, he would have been acting within his rights as a business owner to protect his property by detaining Mr. Bennett. By removing the onerous provision that requires the citizen's arrest to occur while the offence is being committed, we are moving in the right direction to ensure that business and property owners can properly assert their rights in defending their property.</p>\n<p data-HoCid=\"2619361\" data-originallang=\"en\">I have heard from many small business owners in my great riding of <a data-HoCid=\"170117\" href=\"/politicians/glenn-thibeault/\" title=\"Glenn Thibeault\">Sudbury</a> who were shocked at the prosecution of Mr. Chen. They support these changes, which I must again reiterate have been proposed from parties from all sides of the House. It is vital that we provide citizens with the lawful power to detain offenders when the situation warrants, and these amendments to the citizen's arrest sections of the Criminal Code strike an appropriate balance.</p>\n<p data-HoCid=\"2619362\" data-originallang=\"en\">In addition to amending section 494(2) of the Criminal Code, this bill and its predecessor, Bill <a data-HoCid=\"4963242\" href=\"/bills/41-1/C-60/\" title=\"An Act to amend the Criminal Code (citizen's arrest and the defences of property and persons)\">C-60</a>, also propose amendments to the sections in the Criminal Code dealing with self-defence and defence of property. The bill proposes a substantive overhaul of the statutory language pursuant to sections 34 to 42 of the Criminal Code. Five of these sections are from the original Criminal Code of 1892, and the courts have indicated that there are problems with clarity in regard to these sections.</p>\n<p data-HoCid=\"2619363\" data-originallang=\"en\">For example, the self-defence provisions in the Criminal Code have been described as confusing and have been much criticized as a result. In the case of R. v. McIntosh, Chief Justice Lamer stated that sections 35 and 34 are </p>\n<blockquote><p data-HoCid=\"2619364\" data-originallang=\"en\"> highly technical, excessively detailed provisions deserving of much criticism. These provisions overlap, and are internally inconsistent in certain respects. </p>\n</blockquote><p data-HoCid=\"2619365\" data-originallang=\"en\"> The judgment of the majority in McIntosh, however, has itself been called \u201chighly unfortunate\u201d for further muddying of the waters around the self-defence provisions.</p>\n<p data-HoCid=\"2619366\" data-originallang=\"en\">The majority in R. v. McIntosh held that subsection 34(2) of the code was available as a defence when the accused was the initial aggressor. The argument was that Parliament must have intended for subsection 34(2) to be limited to unprovoked assaults, because it enacted section 35 to deal specifically with situations where the accused was the initial aggressor. This argument failed. The ruling seemed to go against the history of self-defence law, which pointed to a sharp distinction between unprovoked and provoked attacks.</p>\n<p data-HoCid=\"2619367\" data-originallang=\"en\">The bill would remove current sections 34 through 37 and replace them with a new self-defence provision that would apply to all offences. The new provision would ensure that a person would not be guilty of an offence if they believed on reasonable grounds that force or a threat of force was to be used against them or another person, that any acts committed were for the purpose of defending or protecting themselves or that other person, and that the act committed was reasonable in the circumstances.</p>\n<p data-HoCid=\"2619368\" data-originallang=\"en\">The bill also lists a number of factors that might, among others, be considered when determining whether or not the act committed was reasonable in the circumstances. This list includes, among others, imminence of a threat; the use of a weapon by the aggressor; the size, age and gender of the aggressor; and the history of the relationship between the actors.</p>\n<p data-HoCid=\"2619369\" data-originallang=\"en\">Furthermore, the bill specifically states that the defence would not be available when responding to threats from people acting in their official capacity to enforce the law--for example, police officers--unless the accused had reasonable grounds to believe that the person was acting unlawfully. </p>\n<p data-HoCid=\"2619370\" data-originallang=\"en\">As they stand, sections 38 through 42 of the Criminal Code refer to the legal rights of people to use force legally in protection of their property against theft or damage. The first two sections refer to the defence of movable property and the latter three sections to real property and dwellings, as the code permits the use of more force to defend real property than movable property.</p>\n<p data-HoCid=\"2619371\" data-originallang=\"en\">The Criminal Code also recognizes that it is often difficult to distinguish where defence of property ends and self-defence begins. As a father and husband, I know that if someone were to break into my home, my first concern would be for my daughters and wife, not for my home and belongings. Fortunately, the Criminal Code recognizes this fact, and because of this, it explicitly outlines situations in which self-defence can be evoked, such as when a trespasser refuses to leave a property.</p>\n<p data-HoCid=\"2619372\" data-originallang=\"en\">It is important at this point to give a brief outline of what the five sections of the code authorize as they stand. Section 38 provides that a person can take back possessions from a trespasser provided that he or she does not strike the person or cause bodily harm, unless the trespasser continues to attempt to retain or take the items. At this point, the trespasser is deemed to have committed an unprovoked assault, and the provisions regarding self-defence come into play.</p>\n<p data-HoCid=\"2619373\" data-originallang=\"en\">Section 39 provides a defence to an individual using force to defend property being taken by someone else with a legal right to it. Subsection 39(1) of the provision refers to someone defending property to which they also have legal right; subsection 39(2) refers to someone defending property to which they have no legal right. It appears that the aim of this section is to encourage people to reclaim property through legal means rather than through force.</p>\n<p data-HoCid=\"2619374\" data-originallang=\"en\">Section 40 allows an individual to use as much force as necessary to prevent someone from breaking into his or her legally owned home. Section 41 sets out the amount of force an individual can defensibly use to prevent or remove a trespasser. Like section 38, this provision deems trespassers to be committing an unprovoked assault if they resist attempts to prevent or remove them, and therefore brings into play the provisions applying to self-defence.</p>\n<p data-HoCid=\"2619375\" data-originallang=\"en\">The final provision on this issue, section 42, provides information regarding the force that can be used when taking back possession of real property from trespassers and the effect of a trespasser assaulting someone who is attempting to take back legal possession of their real property.</p>\n<p data-HoCid=\"2619376\" data-originallang=\"en\">Under the bill being considered by the House today, these five sections would be repealed and replaced with a new single provision for the defence of property. Under this provision, individuals would not be considered guilty of an offence if they believed on reasonable grounds that they were peaceably possessing property or assisting an individual who they believed was in peaceable possession of the property; believed on reasonable grounds that another person was about to enter, was entering, or had entered the property unlawfully, and was taking the property or was about to do so or had done so, and was about to damage or was in the process of damaging the property; were acting to prevent or end such action; and the act committed was reasonable in such circumstances.</p>\n<p data-HoCid=\"2619377\" data-originallang=\"en\">These provisions would not apply if a person who did not have legal right to property used force against someone with a legal right to it or, as in the self-defence provisions, if the person committed any acts against people with the authority to enforce the law, unless the person believed that they were acting unlawfully. </p>\n<p data-HoCid=\"2619378\" data-originallang=\"en\">Having considered what this bill would do to the Criminal Code regarding self-defence and protection of property, it is now important to consider whether these changes are desirable and constitute good public policy. </p>\n<p data-HoCid=\"2619379\" data-originallang=\"en\">Whenever looking at changes to the Criminal Code, a good place to look is to the organizations that represent the organizations that enforce the law. The courts have already indicated that the language in these sections of the Criminal Code require some clarification, so it is important that we work to clear up such problems. However, we must ensure that any change has a positive effect. For that reason, I am looking forward to following this bill at committee stage where I am hopeful that the legal experts will be on hand to shed more light on the ramifications of these changes. </p>\n<p data-HoCid=\"2619380\" data-originallang=\"en\">Both the Canadian Association of Chiefs of Police and the Canadian Police Association, which represents 41,000 front line police personnel across Canada, have been generally supportive of the changes brought forward in this bill in terms of self-defence and protection of property. However, they have also stated that they have some reservations and some concerns. Again, I look forward to these organizations speaking to this bill at committee to hear if there is any way that we can address the concerns that they have brought forward.</p>\n<p data-HoCid=\"2619381\" data-originallang=\"en\">I am sure that both the police chiefs and the front line officers share my concerns that we do not want to make changes to the Criminal Code that would encourage people to participate in vigilante justice or to put their own safety at risk. While I know this is not the intention of the bill, I also look forward to hearing from people with a background in sociology and in criminology to ensure that this will not be the case and to strengthen the bill in this regard, if it is required. </p>\n<p data-HoCid=\"2619382\" data-originallang=\"en\"> I am happy that the government has brought forward this bill and I am happy to support it at second reading. The issues of citizen's arrest, self-defence and defence of property are all issues that need to be clarified in the Criminal Code and I am happy that we have this opportunity to do so. </p>\n<p data-HoCid=\"2619383\" data-originallang=\"en\">I will be following this bill very closely through the committee stage and I hope that the government will be willing to work with the NDP to ensure that we are able to have the strongest legislation possible ready for debate at third reading.</p>\n<p data-HoCid=\"2619384\" data-originallang=\"en\">I will take that acknowledgement from my colleague on the other side of the House as something that we all look forward to and is making Parliament work. </p>",

Cette disposition apporte la pr\u00e9cision suivante: Il est entendu que toute personne autoris\u00e9e \u00e0 proc\u00e9der \u00e0 une arrestation en vertu de l'article 494 est une personne autoris\u00e9e par la loi \u00e0 le faire pour l'application de l'article 25 du Code criminel. Essentiellement, l'objectif de cette modification semble \u00eatre de pr\u00e9ciser que m\u00eame si l'emploi de la force est autoris\u00e9 lors d'une arrestation par un citoyen, il y a une limite \u00e0 la force qui peut \u00eatre employ\u00e9e.</p>\n<p data-HoCid=\"2619360\" data-originallang=\"en\">Pour ceux qui ne sont pas vers\u00e9s en jargon juridique, essentiellement ces modifications permettraient des arrestations sans mandat par des citoyens, dans une p\u00e9riode de temps raisonnable apr\u00e8s la perp\u00e9tration de l'infraction. Cela signifie que dans le cas de M. Chen, en tant que propri\u00e9taire, il aurait agi en toute l\u00e9gitimit\u00e9 pour prot\u00e9ger son bien en d\u00e9tenant M. Bennett. En supprimant la disposition, lourde de cons\u00e9quences, qui exigeait que l'arrestation par le citoyen se produise au moment de l'infraction, nous faisons un pas dans la bonne direction pour s'assurer que les propri\u00e9taires de commerces et de biens peuvent ad\u00e9quatement exercer leurs droits de d\u00e9fendre leur propri\u00e9t\u00e9. biens.</p>\n<p data-HoCid=\"2619361\" data-originallang=\"en\">Plusieurs propri\u00e9taires de petites entreprises de ma belle circonscription, <a data-HoCid=\"170117\" href=\"/politicians/glenn-thibeault/\" title=\"Glenn Thibeault\">Sudbury</a>, \u00e9taient scandalis\u00e9s d'apprendre que M. Chen faisait l'objet d'une poursuite. Ils sont en faveur de ces modifications qui, je le r\u00e9p\u00e8te, ont \u00e9t\u00e9 propos\u00e9es par tous les partis de la Chambre. Nous devons absolument donner aux citoyens le pouvoir l\u00e9gal de d\u00e9tenir un d\u00e9linquant lorsque la situation le justifie. Ces modifications apport\u00e9es aux articles du Code criminel portant sur l'arrestation par des citoyens \u00e9tablissent un juste \u00e9quilibre.</p>\n<p data-HoCid=\"2619362\" data-originallang=\"en\">En plus de modifier le paragraphe 494(2) du Code criminel, ce projet de loi et son pr\u00e9d\u00e9cesseur, le projet de loi <a data-HoCid=\"4963242\" href=\"/bills/41-1/C-60/\" title=\"An Act to amend the Criminal Code (citizen's arrest and the defences of property and persons)\">C-60</a>, proposent \u00e9galement des modifications aux articles du Code criminel concernant la l\u00e9gitime d\u00e9fense et la d\u00e9fense des biens. Le projet de loi propose une r\u00e9vision substantielle du libell\u00e9 des articles 34 \u00e0 42 du Code criminel. En effet, cinq de ces articles datent de 1892, soit de la premi\u00e8re \u00e9dition du Code criminel, et les tribunaux ont soulign\u00e9 que leur clart\u00e9 laisse \u00e0 d\u00e9sirer.</p>\n<p data-HoCid=\"2619363\" data-originallang=\"en\">Par exemple, on a dit des dispositions du Code criminel touchant la l\u00e9gitime d\u00e9fense qu'elles portent \u00e0 confusion, ce qui leur a valu de faire l'objet de bien des critiques. Dans l'affaire R. c. McIntosh, le juge en chef Lamer a indiqu\u00e9 que les articles 34 et 35 sont </p>\n<blockquote><p data-HoCid=\"2619364\" data-originallang=\"en\"> fort techniques, et sont des dispositions excessivement d\u00e9taill\u00e9es qui m\u00e9ritent d'\u00eatre fortement critiqu\u00e9es. Ces dispositions se chevauchent et sont en soi incompatibles \u00e0 certains \u00e9gards. </p>\n</blockquote><p data-HoCid=\"2619365\" data-originallang=\"en\">Cependant, le jugement majoritaire de la Cour dans l'affaire McIntosh est consid\u00e9r\u00e9 comme \u00ab pour le moins f\u00e2cheux \u00bb parce qu'il brouille davantage les dispositions concernant la l\u00e9gitime d\u00e9fense. </p>\n<p data-HoCid=\"2619366\" data-originallang=\"en\">Dans l\u2019affaire R. c. McIntosh, la majorit\u00e9 des juges a soutenu que le paragraphe 34(2) du Code pr\u00e9voyait un moyen de d\u00e9fense dans les cas o\u00f9 l\u2019accus\u00e9 \u00e9tait l\u2019agresseur initial. L\u2019argument \u00e9tait que le Parlement devait avoir eu l\u2019intention de limiter l\u2019application du paragraphe 34(2) aux attaques non provoqu\u00e9es parce qu\u2019il a adopt\u00e9 le paragraphe 35, lequel porte sp\u00e9cifiquement sur les situations o\u00f9 l\u2019accus\u00e9 est l\u2019agresseur initial. Cet argument a \u00e9t\u00e9 rejet\u00e9. La d\u00e9cision semble aller \u00e0 l\u2019encontre de la r\u00e8gle de droit r\u00e9gissant la l\u00e9gitime d\u00e9fense, r\u00e8gle qui \u00e9tablit une nette distinction entre attaques provoqu\u00e9es et non provoqu\u00e9es. </p>\n<p data-HoCid=\"2619367\" data-originallang=\"en\">Le projet de loi abrogerait les articles 34 \u00e0 37 et les remplacerait par une seule disposition portant sur la l\u00e9gitime d\u00e9fense qui s\u2019applique \u00e0 toute infraction. Aux termes de cette nouvelle disposition, ne pourra \u00eatre d\u00e9clar\u00e9e coupable d\u2019une infraction la personne qui, \u00e0 la fois: croit, pour des motifs raisonnables, que la force est employ\u00e9e contre elle ou une autre personne ou qu\u2019on menace de l\u2019employer contre elle ou une autre personne; commet l\u2019acte constituant l\u2019infraction dans le but de se d\u00e9fendre ou de se prot\u00e9ger \u2014 ou de d\u00e9fendre ou de prot\u00e9ger une autre personne \u2014; agit de fa\u00e7on raisonnable dans les circonstances. </p>\n<p data-HoCid=\"2619368\" data-originallang=\"en\">Le projet de loi \u00e9num\u00e8re \u00e9galement plusieurs facteurs qui pourraient, entre autres, \u00eatre pris en consid\u00e9ration pour d\u00e9terminer si l'action commise est raisonnable dans les circonstances. Parmi les facteurs \u00e9num\u00e9r\u00e9s, il y a: l'imminence d'une menace; l'utilisation d'une arme par l'agresseur; la taille, l'\u00e2ge et le sexe de l'agresseur et l'historique des rapports entre les parties en cause. </p>\n<p data-HoCid=\"2619369\" data-originallang=\"en\">De plus, le projet de loi pr\u00e9cise clairement que l'accus\u00e9 ne pourra avoir recours \u00e0 ce moyen de d\u00e9fense dans le cas de menaces venant d'une personne qui, dans le cadre de ses fonctions officielles, applique la loi, par exemple un policier, \u00e0 moins que l'accus\u00e9 n'ait des motifs raisonnables de croire que la personne en question n'agissait pas de fa\u00e7on l\u00e9gitime.</p>\n<p data-HoCid=\"2619370\" data-originallang=\"en\">Sous leur forme actuelle, les articles 38 \u00e0 42 du Code criminel portent sur les droits juridiques des gens d'avoir recours \u00e0 la force l\u00e9galement pour prot\u00e9ger leurs biens contre le vol ou des dommages. Les deux premiers articles portent sur la d\u00e9fense de biens meubles et les trois derniers, sur la protection d'une maison ou d'un bien immeuble, le Code criminel permettant un recours plus important \u00e0 la force pour d\u00e9fendre des biens immeubles que des biens meubles. </p>\n<p data-HoCid=\"2619371\" data-originallang=\"en\">Dans le Code criminel, le l\u00e9gislateur reconna\u00eet \u00e9galement qu'il est souvent difficile de faire une distinction claire entre la d\u00e9fense d'un bien et la l\u00e9gitime d\u00e9fense. En tant que p\u00e8re et mari, je sais que si un individu entrait par effraction dans ma maison, je me pr\u00e9occuperais d'abord de mes filles et de ma femme, et non pas de ma maison et de mes biens. Heureusement, le Code criminel reconna\u00eet ce fait et ainsi, il d\u00e9crit de fa\u00e7on explicite des situations dans lesquelles une personne peut invoquer la l\u00e9gitime d\u00e9fense, notamment lorsqu'un intrus refuse de quitter une maison.</p>\n<p data-HoCid=\"2619372\" data-originallang=\"en\">Il est important \u00e0 ce stade-ci de pr\u00e9ciser bri\u00e8vement ce que les cinq articles du Code criminel autorisent sous leur forme actuelle. L'article 38 pr\u00e9voit qu'une personne peut reprendre \u00e0 un intrus des biens meubles pourvu qu'elle ne le frappe pas ou ne lui inflige aucune l\u00e9sion corporelle, \u00e0 moins que l'intrus persiste \u00e0 vouloir le garder ou \u00e0 le lui enlever. \u00c0 ce moment-l\u00e0, l'intrus est r\u00e9put\u00e9 commettre une attaque sans justification ni provocation et les dispositions sur la l\u00e9gitime d\u00e9fense s'appliquent. </p>\n<p data-HoCid=\"2619373\" data-originallang=\"en\">L'article 39 offre un moyen de d\u00e9fense \u00e0 un individu qui a recours \u00e0 la force pour d\u00e9fendre un bien dont s'empare une personne qui a l\u00e9galement droit \u00e0 la possession de ce bien. Le paragraphe 39(1) porte sur la d\u00e9fense d'un bien par une personne qui a aussi l\u00e9galement droit \u00e0 la possession du bien. Le paragraphe 39(2) parle d'une personne qui d\u00e9fend un bien auquel elle n'a pas l\u00e9galement droit. Il semble que cette disposition ait pour objectif d'encourager les gens \u00e0 r\u00e9cup\u00e9rer leur bien par des moyens juridiques plut\u00f4t que par la force.</p>\n<p data-HoCid=\"2619374\" data-originallang=\"en\">L'article 40 permet \u00e0 une personne d'avoir recours \u00e0 toute la force n\u00e9cessaire pour emp\u00eacher un individu d'entrer par effraction dans la maison qu'elle poss\u00e8de l\u00e9galement. L'article 41 \u00e9tablit la force qu'une personne peut utiliser pour emp\u00eacher une intrusion ou pour \u00e9loigner un intrus. Tout comme dans le cas de l'article 38, aux termes de cette disposition, les intrus sont r\u00e9put\u00e9s commettre une attaque sans justification ni provocation s'ils r\u00e9sistent aux tentatives faites pour les emp\u00eacher d'entrer ou les faire sortir et les dispositions sur la l\u00e9gitime d\u00e9fense s'appliquent alors.</p>\n<p data-HoCid=\"2619375\" data-originallang=\"en\">La derni\u00e8re disposition sur cette question, l'article 42, pr\u00e9cise la force qui peut \u00eatre utilis\u00e9e pour reprendre des biens immeubles d'intrus et les cons\u00e9quences si un intrus agresse une personne qui cherche \u00e0 reprendre possession de ses biens immeubles.</p>\n<p data-HoCid=\"2619376\" data-originallang=\"en\">Aux termes du projet de loi \u00e0 l'\u00e9tude aujourd'hui, ces cinq articles seraient abrog\u00e9s et remplac\u00e9s par une seule disposition sur la d\u00e9fense des biens. En vertu de cette disposition, une personne ne serait pas coupable d'une infraction si elle croit, pour des motifs raisonnables, qu'elle a la possession paisible de biens ou pr\u00eate l\u00e9galement main forte \u00e0 une autre personne dont elle croit qu'elle a la possession paisible d'un bien, si elle croit pour des motifs raisonnables qu'un autre individu, sans en avoir l\u00e9galement le droit, est sur le point ou est en train d'entrer dans ou sur ce bien ou y est entr\u00e9, est sur le point, est en train ou vient de le prendre, est sur le point ou est en train de l\u2019endommager, et si elle agit de fa\u00e7on raisonnable dans les circonstances pour pr\u00e9venir et faire cesser ces actes.</p>\n<p data-HoCid=\"2619377\" data-originallang=\"en\">Ces dispositions ne s'appliqueraient pas si une personne qui n'a pas l\u00e9galement droit \u00e0 un bien utilise la force contre une personne qui y a l\u00e9galement droit, ou comme dans le cas des dispositions sur la l\u00e9gitime d\u00e9fense, si la personne s'en prend \u00e0 des gens ayant l'autorit\u00e9 d'appliquer la loi \u00e0 moins qu'elle n'ait des raisons de croire qu'ils n'agissaient pas de fa\u00e7on l\u00e9gitime.</p>\n<p data-HoCid=\"2619378\" data-originallang=\"en\">Apr\u00e8s avoir pris connaissance des changements que le projet de loi apporterait au Code criminel en mati\u00e8re de l\u00e9gitime d\u00e9fense et de protection des biens, il importe maintenant de voir si ces changements sont souhaitables et s'ils constituent une bonne politique gouvernementale.</p>\n<p data-HoCid=\"2619379\" data-originallang=\"en\">Chaque fois que nous envisageons d'apporter des changements au Code criminel, il est utile de consulter les organismes charg\u00e9s de l'application de la loi. Les tribunaux ont d\u00e9j\u00e0 dit que le libell\u00e9 de ces articles du Code criminel doit \u00eatre clarifi\u00e9. Par cons\u00e9quent, il importe que nous prenions des mesures en ce sens. Cela dit, nous devons aussi nous assurer que tout changement apport\u00e9 aura un effet positif. C'est pourquoi je serai heureux de suivre le projet de loi \u00e0 l'\u00e9tape de l'\u00e9tude en comit\u00e9 o\u00f9, je l'esp\u00e8re, des juristes pourront nous \u00e9clairer davantage sur les r\u00e9percussions des changements propos\u00e9s. </p>\n<p data-HoCid=\"2619380\" data-originallang=\"en\">D'une fa\u00e7on g\u00e9n\u00e9rale, tant l'Association canadienne des chefs de police que l'Association canadienne des policiers, qui repr\u00e9sente 41 000 policiers de premi\u00e8re ligne au Canada, appuient les changements propos\u00e9s dans le projet de loi en mati\u00e8re de l\u00e9gitime d\u00e9fense et de protection des biens. Cela dit, les deux associations ont quant m\u00eame des r\u00e9serves et des pr\u00e9occupations. Encore une fois, j'ai h\u00e2te que ces groupes viennent faire part de leurs points de vue au comit\u00e9 et nous dire comment nous pourrions r\u00e9pondre \u00e0 leurs pr\u00e9occupations.</p>\n<p data-HoCid=\"2619381\" data-originallang=\"en\">Je suis convaincu que tant les chefs de police que les policiers de premi\u00e8re ligne partagent ma pr\u00e9occupation, \u00e0 savoir que nous ne voulons pas apporter des changements au Code criminel qui inciteraient les gens \u00e0 devenir des justiciers ou \u00e0 compromettre leur propre s\u00e9curit\u00e9. M\u00eame si je sais que tel n'est pas le but du projet de loi, j'ai h\u00e2te d'entendre le point de vue de gens qui ont une formation en sociologie et en criminologie, afin d'obtenir la confirmation que ce ne sera pas le cas et, au besoin, d'am\u00e9liorer la mesure l\u00e9gislative \u00e0 cet \u00e9gard. </p>\n<p data-HoCid=\"2619382\" data-originallang=\"en\">Je suis heureux que le gouvernement ait pr\u00e9sent\u00e9 ce projet de loi,et je suis heureux de l'appuyer \u00e0 l'\u00e9tape de la deuxi\u00e8me lecture. L'arrestation par des citoyens, la l\u00e9gitime d\u00e9fense et la protection des biens sont des questions qui doivent \u00eatre clarifi\u00e9es dans le Code criminel, et je suis heureux que nous ayons l'occasion de le faire.</p>\n<p data-HoCid=\"2619383\" data-originallang=\"en\">Je vais suivre le projet de loi de tr\u00e8s pr\u00e8s \u00e0 l'\u00e9tape de l'\u00e9tude en comit\u00e9 et j'esp\u00e8re que le gouvernement sera dispos\u00e9 \u00e0 collaborer avec le NPD, afin de pr\u00e9senter la meilleure mesure l\u00e9gislative possible pour le d\u00e9bat \u00e0 l'\u00e9tape de la troisi\u00e8me lecture.</p>\n<p data-HoCid=\"2619384\" data-originallang=\"en\">Je prends les propos du d\u00e9put\u00e9 d'en face comme une d\u00e9claration portant que nous avons tous la volont\u00e9 de faire en sorte que le Parlement fonctionne bien.</p>"
