        "en": "<p data-HoCid=\"2170253\" data-originallang=\"en\">Mr. Speaker, I am pleased to speak on the report stage motion of the bill. The subject matter of Bill <a data-HoCid=\"4491489\" href=\"/bills/40-3/C-22/\" title=\"An Act respecting the mandatory reporting of Internet child pornography by persons who provide an Internet service\">C-22</a> was before Parliament shortly before the 2006 election when the current government took over.</p>\n<p data-HoCid=\"2170254\" data-originallang=\"en\">It is important to note that since January 2006 when the Conservative government took over, the subject matter of the bill and the importance of a bill dealing with the sexual exploitation of children has been before Parliament, and four years later we still have not passed a bill that could have dealt with this very linear approach to a very serious problem but important enough that all the parties are supporting the substance of the bill. It speaks volumes about the commitment of the government to be honest with Canadians about what its priorities are. </p>\n<p data-HoCid=\"2170255\" data-originallang=\"en\">I wish the media would do an analysis and look at how the various justice bills have come forward and have died due to prorogation or due to the 2008 election and what happened to them when they came back. We note first that the government has one member speak on a bill and then nobody else speaks on the government side. Government members are muzzled, handcuffed, and have no authorization to even speak in Parliament about legislation that the government has brought forward unless it is approved by the <a data-HoCid=\"78738\" href=\"/politicians/stephen-harper/\" title=\"Stephen Harper\">Prime Minister</a>'s office or by the Privy Council office. That is the level of participation in legislative debate that we can expect from government members. They cannot speak. They will not speak. They do not ask questions. They do not care to get involved because they cannot. They have been told not to. </p>\n<p data-HoCid=\"2170256\" data-originallang=\"en\">We should look at the facts. For a number of bills, the Conservatives have had an election platform of getting tough on crime and they continue to repeat the theme that they are tough on crime. Then they have all these bills, instead of saying there are a number of areas they would like to deal with in terms of the Criminal Code and then put them together in an omnibus bill, which is normally the case, the four, five or six different areas in which they want to toughen up sentencing, identify new offences, or whatever. The Conservatives put them out there, they table them, but we never hear about them again. They just languish there, and then we go along on other business. What happens? As soon as there is a crisis on some other business, the Conservatives come back with crime awareness week. They get their bills back out there to see if they can distract Canadians from the problem they have somewhere else in legislation so that Canadians will say, \u201cYes, the government is tough on crime; we like that\u201d. However, it never finishes. </p>\n<p data-HoCid=\"2170257\" data-originallang=\"en\">When we had the last election and the prorogation, the options of the government were to be able to bring back a bill that would be repositioned at the stage it was left at when prorogation occurred. Did the government do that? No. As a matter of fact, the Conservatives decided the bills would all start again, or they took two or three of them and put them in one bill. That changed the mechanism with which they were working and they had to start at the beginning. Therefore, all the debate, all the work that was done, all the prep work, all the printing, and all the consultations with all the stakeholder groups was basically set aside and we started again.</p>\n<p data-HoCid=\"2170258\" data-originallang=\"en\">Here we are, four years later. What was Bill <a data-HoCid=\"4243051\" href=\"/bills/40-3/C-58/\" title=\"An Act respecting the mandatory reporting of Internet child pornography by persons who provide an Internet service\">C-58</a> last time is now Bill <a data-HoCid=\"4491489\" href=\"/bills/40-3/C-22/\" title=\"An Act respecting the mandatory reporting of Internet child pornography by persons who provide an Internet service\">C-22</a>, and what is hanging the bill up is the government. </p>\n<p data-HoCid=\"2170259\" data-originallang=\"en\">I would like to read into the record what Bill C-22 would do. Every bill, on the inside cover, states in very distinct terms the purpose of the bill. </p>\n<p data-HoCid=\"2170260\" data-originallang=\"en\">It says:</p>\n<blockquote><p data-HoCid=\"2170261\" data-originallang=\"en\"> This enactment imposes reporting duties on persons who provide an Internet service to the public if they are advised of an Internet address where child pornography may be available to the public or if they have reasonable grounds to believe that their Internet service is being or has been used to commit a child pornography offence. This enactment makes it an offence to fail to comply with the reporting duties. </p>\n</blockquote><p data-HoCid=\"2170262\" data-originallang=\"en\">It is pretty straightforward. Internet service providers, whether they be individuals or businesses, must report if they become aware, and there are some penalties. For individuals, it could be up to $10,000 in penalties. For corporations, it could be $100,000.</p>\n<p data-HoCid=\"2170263\" data-originallang=\"en\">It is not a big deal, but why we are here today and what we are debating is a report stage motion to reinstate clause 1. Clause 1 is a short title. If the media were watching, they would say, and a lot of the members have mentioned, that the short title would be used; the courts would often refer to the short title rather than the long title. </p>\n<p data-HoCid=\"2170264\" data-originallang=\"en\">The short title that the government put in Bill <a data-HoCid=\"4491489\" href=\"/bills/40-3/C-22/\" title=\"An Act respecting the mandatory reporting of Internet child pornography by persons who provide an Internet service\">C-22</a> is the Protecting Children from Online Sexual Exploitation Act, compared to Bill <a data-HoCid=\"4243051\" href=\"/bills/40-3/C-58/\" title=\"An Act respecting the mandatory reporting of Internet child pornography by persons who provide an Internet service\">C-58</a>, the last iteration of this bill, which stated in clause 1:</p>\n<blockquote><p data-HoCid=\"2170265\" data-originallang=\"en\"> This Act may be cited as the Child Protection Act (Online Sexual Exploitation). </p>\n</blockquote><p data-HoCid=\"2170266\" data-originallang=\"en\">As a number of hon. members have said already, this bill does not do that, in terms of being the piece of legislation that is going to deal with sexual exploitation online. It is one aspect, one small aspect of activity that one would expect in a comprehensive, serious strategy to address exploitation of children.</p>\n<p data-HoCid=\"2170267\" data-originallang=\"en\">Why would the government do that? It goes back to probably the reason underlying virtually everything the government does. It has not been governing since 2006, it has been campaigning. To the government, everything in this place is slogans: \u201cWe are getting tough on crime\u201d; \u201cWe are going to deal with protecting children from online sexual exploitation\u201d. But the bill does not do it, because there are other jurisdictions. If the Conservatives were serious about it, they would not trivialize it like this. They would not make us go through another debate on this bill about a clause that supports that the bill would do something that in fact it does not.</p>\n<p data-HoCid=\"2170268\" data-originallang=\"en\">How is it that the <a data-HoCid=\"105824\" href=\"/politicians/rob-nicholson/\" title=\"Rob Nicholson\">Minister of Justice</a> gave the opinion to cabinet that the bill is in good form? It is not. It is misleading. It is false. It is deliberately misleading. The government has deliberately misled the House, deliberately misled Canadians. The government seems to lie so naturally. It really does. It looks so very natural. It does not even flinch anymore. It is too comfortable, because it knows it can get away with it. It is time to call the government on misleading Canadians and misleading Parliament, and to take legislation seriously. </p>\n<p data-HoCid=\"2170269\" data-originallang=\"en\">The member for <a data-HoCid=\"128527\" href=\"/politicians/joe-comartin/\" title=\"Joe Comartin\">Windsor\u2014Tecumseh</a> has given some very eloquent speeches over the years about the need to do a comprehensive review and amendment of the Criminal Code. We did not need 10 bills to adjust the sentencing provisions related to 10 different offences. We could have had one bill dealing with everything the government wanted to do on sentencing, on house arrest, on parole, on the faint hope clause, everything. If we wanted to deal with it, it could have been in one bill.</p>\n<p data-HoCid=\"2170270\" data-originallang=\"en\"> It is going to be the same committee, and in fact, by and large, the same witnesses who would come for that omnibus bill as it would be for each and every one of those individual bills. But it does not serve the political, partisan reasons that the government is here today. It is not governing, it is campaigning, and we have to call a spade a shovel. The government is campaigning. It is sloganeering. It thinks people are stupid. It thinks Canadians are stupid. Well, Canadians are not stupid. They deserve respect and we should deal with legislation in a responsible fashion. </p>\n<p data-HoCid=\"2170271\" data-originallang=\"en\">Maybe the hon. members would like to participate in the debate and defend the change to something that is so misleading. The government members had better start doing their job, or maybe it is time to look for another job.</p>",

On leur a dit de ne rien dire.</p>\n<p data-HoCid=\"2170256\" data-originallang=\"en\">Il faudrait s'en tenir aux faits. \u00c0 l'\u00e9gard d'un certain nombre de projets de loi, les conservateurs ont fait ce qu'ils avaient promis de faire dans leur programme de r\u00e9pression de la criminalit\u00e9 et ils continuent de le faire. Mais, \u00e0 l'\u00e9gard de plusieurs autres projets de loi, au lieu de s'attaquer \u00e0 un certain nombre d'aspects du Code criminel et de r\u00e9unir, dans un projet de loi omnibus les quatre, cinq ou six aspects diff\u00e9rents au sujet desquels ils veulent alourdir les peines et cr\u00e9er de nouvelles infractions, comme on le fait normalement, les conservateurs pr\u00e9sentent des projets de loi dont nous n'entendons plus jamais parler. Nous passons \u00e0 autre chose, et ces projets de loi sont simplement rel\u00e9gu\u00e9s aux oubliettes. Qu'arrive-t-il? D\u00e8s qu'une crise survient dans un autre dossier, les conservateurs reviennent \u00e0 la charge avec leur programme de r\u00e9pression de la criminalit\u00e9. Ils ressortent leurs projets de loi dans l'espoir de d\u00e9tourner l'attention des Canadiens du probl\u00e8me que pose une autre mesure l\u00e9gislative afin de leur faire croire que le gouvernement r\u00e9prime la criminalit\u00e9. Mais, cela ne s'arr\u00eate jamais.</p>\n<p data-HoCid=\"2170257\" data-originallang=\"en\">Lors des derni\u00e8res \u00e9lections et de la prorogation, le gouvernement aurait pu r\u00e9tablir un projet de loi \u00e0 l'\u00e9tape o\u00f9 il \u00e9tait rendu au moment de la prorogation. Est-ce ce que le gouvernement a fait? Non. En fait, les conservateurs ont d\u00e9cid\u00e9 que les projets de loi repartiraient tous \u00e0 z\u00e9ro ou qu'ils regrouperaient deux ou trois d'entre eux en un projet de loi. Ils ont ainsi modifi\u00e9 le m\u00e9canisme qu'ils utilisaient et ont d\u00fb repartir \u00e0 z\u00e9ro. Par cons\u00e9quent, les d\u00e9bats, les travaux, le travail pr\u00e9paratoire, l'impression et les consultations avec tous les groupes concern\u00e9s qui avaient d\u00e9j\u00e0 eu lieu au sujet de ces projets de loi ont \u00e9t\u00e9, pour ainsi dire, mis de c\u00f4t\u00e9, et nous avons d\u00fb tout recommencer du d\u00e9but.</p>\n<p data-HoCid=\"2170258\" data-originallang=\"en\">Nous voici, quatre ans plus tard. Il \u00e9rige en infraction le fait pour ces personnes de contrevenir \u00e0 ces obligations. </p>\n</blockquote><p data-HoCid=\"2170262\" data-originallang=\"en\">C'est assez clair. Qu'il s'agisse de particuliers ou d'entreprises, les fournisseurs de services Internet doivent faire rapport d\u00e8s qu'elles sont au courant qu'une chose doit \u00eatre signal\u00e9e, \u00e0 d\u00e9faut de quoi ils s'exposent \u00e0 des p\u00e9nalit\u00e9s. Pour un particulier, ces p\u00e9nalit\u00e9s peuvent atteindre 10 000 $, alors qu'elles peuvent atteindre 100 000 $ pour les entreprises.</p>\n<p data-HoCid=\"2170263\" data-originallang=\"en\">Ce n'est pas grand chose, mais si nous sommes ici aujourd'hui, c'est pour d\u00e9battre de la motion \u00e0 l'\u00e9tape du rapport proposant de r\u00e9tablir l'article 1, c'est-\u00e0-dire le titre abr\u00e9g\u00e9. Il s'agit en fait d'un aspect, d'un tout petit aspect d'une activit\u00e9 qu'on s'attendrait au contraire \u00e0 trouver dans une strat\u00e9gie globale et exhaustive de lutte contre l'exploitation des enfants.</p>\n<p data-HoCid=\"2170267\" data-originallang=\"en\">Pourquoi le gouvernement agit-il de la sorte? Probablement pour les m\u00eames raisons derri\u00e8re \u00e0 peu pr\u00e8s tout ce qu'il fait. En r\u00e9alit\u00e9, le gouvernement n'a pas gouvern\u00e9 une seule journ\u00e9e depuis 2006; il a fait campagne. Pour le gouvernement, tout est pr\u00e9texte \u00e0 cr\u00e9er un slogan: \u00ab Nous serons impitoyables avec les criminels \u00bb; \u00ab Nous allons prot\u00e9ger les enfants contre l'exploitation sexuelle en ligne \u00bb. Or, ce projet de loi ne prot\u00e9gera personne, parce que le gouvernement f\u00e9d\u00e9ral n'est pas le seul \u00e0 avoir son mot \u00e0 dire l\u00e0-dedans. Si les conservateurs \u00e9taient s\u00e9rieux, ils n'agiraient pas comme ils le font. Ils ne nous contraindraient pas tenir un nouveau d\u00e9bat sur un article qui nous laisse entendre que le projet de loi r\u00e9ussira \u00e0 faire quelque chose, alors que c'est faux.</p>\n<p data-HoCid=\"2170268\" data-originallang=\"en\">Pourquoi le <a data-HoCid=\"105824\" href=\"/politicians/rob-nicholson/\" title=\"Rob Nicholson\">ministre de la Justice</a> a-t-il affirm\u00e9 au Cabinet que la forme du projet de loi \u00e9tait acceptable? Ce n'est pas du tout le cas. C'est trompeur et faux. Le gouvernement a d\u00e9lib\u00e9r\u00e9ment tromp\u00e9 la Chambre et d\u00e9lib\u00e9r\u00e9ment tromp\u00e9 les Canadiens. Le gouvernement semble mentir de fa\u00e7on tellement naturelle. C'est vraiment le cas. Cela lui semble tellement naturel. Il n'h\u00e9site m\u00eame plus. Il se sent tr\u00e8s \u00e0 l'aise parce qu'il sait bien qu'il pourra s'en tirer facilement. Il est temps que nous exigions du gouvernement qu'il cesse de tromper les Canadiens et le Parlement et qu'il prenne les mesures l\u00e9gislatives au s\u00e9rieux. </p>\n<p data-HoCid=\"2170269\" data-originallang=\"en\">Le d\u00e9put\u00e9 de <a data-HoCid=\"128527\" href=\"/politicians/joe-comartin/\" title=\"Joe Comartin\">Windsor\u2014Tecumseh</a> a fait des discours tr\u00e8s \u00e9loquents au fil des ans sur la n\u00e9cessit\u00e9 de mener une \u00e9tude approfondie sur le Code criminel et d'y apporter des modifications. Nous n'avions pas besoin de 10 projets de loi pour rajuster les dispositions en mati\u00e8re de d\u00e9termination de la peine dans le cas de dix infractions diff\u00e9rentes. Nous aurions pu pr\u00e9parer un seul projet de loi et y inclure tout ce que le gouvernement voulait faire au chapitre de la d\u00e9termination de la peine, de la d\u00e9tention \u00e0 domicile, de la lib\u00e9ration conditionnelle, de la disposition de la derni\u00e8re chance, et ainsi de suite. Si nous voulions trouver des solutions, nous aurions pu le faire dans le cadre d'un seul projet de loi. </p>\n<p data-HoCid=\"2170270\" data-originallang=\"en\">Ce serait le m\u00eame comit\u00e9 et sensiblement les m\u00eames t\u00e9moins qui auraient \u00e9t\u00e9 appel\u00e9s \u00e0 se pencher sur ce projet de loi omnibus que ceux qui le seraient pour chacun de ces projets de loi distincts. Mais cela ne ferait rien pour appuyer les motifs politiques partisans du gouvernement actuel. Ce n'est pas une fa\u00e7on de gouverner. C'est plut\u00f4t une fa\u00e7on de mener une campagne. Nous devons reconna\u00eetre les choses pour ce qu'elles sont. Le gouvernement est en campagne \u00e9lectorale. Il lance des slogans. Le gouvernement croit que les gens sont stupides. Et bien, ce n'est pas le cas. Les Canadiens m\u00e9ritent qu'on les respecte et nous devons nous occuper des mesures l\u00e9gislatives de fa\u00e7on responsable. </p>\n<p data-HoCid=\"2170271\" data-originallang=\"en\">Les d\u00e9put\u00e9s aimeraient peut-\u00eatre participer au d\u00e9bat et d\u00e9fendre la modification tendancieuse. Les minist\u00e9riels feraient beaucoup mieux de commencer \u00e0 faire leur travail, ou peut-\u00eatre commencer \u00e0 se chercher un autre emploi. </p>"
