"en": "<p data-HoCid=\"1171880\" data-originallang=\"en\">Mr. Speaker, I have listened with great interest to my friend and he has repeatedly talked about the fact that all three opposition parties would like to have Mr. Khadr brought back to the Canadian justice system and I totally agree with him. </p>\n<p data-HoCid=\"1171881\" data-originallang=\"en\">He also mentioned about the government having courage. I do not think it is a lack of courage. I think that it is a fundamental ideologically driven decision by the government. It is sadly ironic in my view that we have Canadian men and women dying on Afghanistan soil, protecting the rights of the Afghanistan people, yet we have a government here that is not moving on the rights of a Canadian citizen.</p>\n<p data-HoCid=\"1171882\" data-originallang=\"en\">I would make this caveat and this disclaimer that I am not a lawyer. I know my hon. friend is and I have served on many committees with him. I am wondering if he would speak a minute about the fact that the judge has been replaced in Mr. Khadr's case.</p>\n<p data-HoCid=\"1171883\" data-originallang=\"en\">I think that is highly unusual and almost unprecedented in most judicial hearings in the absence of the fact that a judge became ill or something like that. There is also the fact that notes have been destroyed, which I think are very pertinent to the fair and due process that should be due Mr. Khadr who is facing these kinds of criminal charges.</p>\n<p data-HoCid=\"1171884\" data-originallang=\"en\">We purport around the world that we have an independent judiciary. I would say the United States is probably second to none. As my hon. colleague pointed out in his speech, this has been deemed by the supreme court of the United States to be outside of the law.</p>\n<p data-HoCid=\"1171885\" data-originallang=\"en\">I really do agree and wonder how the government can continue to be so entrenched in a position that is a departure from anything that we have done on the international stage, when indeed there are other democracies that have asked for their citizens to be repatriated. I too agree with the hon. member, and say I find this a very appalling situation and a new low for us as a country.</p>",

Je sais qu'il est avocat parce que nous avons si\u00e9g\u00e9 ensemble \u00e0 de nombreux comit\u00e9s. Je me demande s'il pourrait prendre une minute pour expliquer pourquoi, dans le cas de M. Khadr, le juge a \u00e9t\u00e9 remplac\u00e9.</p>\n<p data-HoCid=\"1171883\" data-originallang=\"en\">Je pense que cela est tout \u00e0 fait inhabituel et pratiquement sans pr\u00e9c\u00e9dent dans les audiences judiciaires. Cela n'arrive g\u00e9n\u00e9ralement que lorsqu'un juge tombe malade par exemple. Des notes ont \u00e9galement \u00e9t\u00e9 d\u00e9truites, m\u00eame si elles \u00e9taient tr\u00e8s pertinentes du point de vue du traitement juste et \u00e9quitable auquel aurait droit M. Khadr, sur qui p\u00e8sent de telles accusations criminelles.</p>\n<p data-HoCid=\"1171884\" data-originallang=\"en\">Nous nous targuons dans le monde entier de l'ind\u00e9pendance de notre appareil judiciaire. Je dirais plut\u00f4t qu'\u00e0 ce chapitre, les \u00c9tats-Unis sont probablement sans pareils. Comme le d\u00e9put\u00e9 l'a mentionn\u00e9 dans son expos\u00e9, la Cour supr\u00eame des \u00c9tats-Unis a statu\u00e9 que tout cela \u00e9tait ill\u00e9gal.</p>\n<p data-HoCid=\"1171885\" data-originallang=\"en\">Je suis tout \u00e0 fait d'accord. Toutefois, je me demande comment le gouvernement peut ainsi continuer \u00e0 se retrancher dans une position qui va \u00e0 l'encontre de tout ce que nous avons fait dans le pass\u00e9 sur la sc\u00e8ne internationale. Pourtant, d'autres d\u00e9mocraties ont demand\u00e9 le rapatriement de leurs citoyens. Je suis \u00e9galement d'accord avec le d\u00e9put\u00e9. Il s'agit en effet d'une situation \u00e9pouvantable. En tant que pays, nous venons encore de r\u00e9gresser d'un cran.</p>"
