"en": "<p data-HoCid=\"1028532\" data-originallang=\"en\">Mr. Speaker, I am pleased to speak on Bill <a data-HoCid=\"3085474\" href=\"/bills/39-2/C-13/\" title=\"An Act to amend the Criminal Code (criminal procedure, language of the accused, sentencing and other amendments)\">C-13</a> today. Again, it is another piece of legislation that I think is important when we look at trying to modernize the justice system in Canada and make various changes. It is also good to have time in our ridings to discuss these issues and get the support of our constituents in advance of being able to speak to them. </p>\n<p data-HoCid=\"1028533\" data-originallang=\"en\">Bill <a data-HoCid=\"3085474\" href=\"/bills/39-2/C-13/\" title=\"An Act to amend the Criminal Code (criminal procedure, language of the accused, sentencing and other amendments)\">C-13, An Act to amend the Criminal Code (criminal procedure, language of the accused, sentencing and other amendments)</a>, will clearly take us in another direction to ensure that our justice system in Canada is as modern as can be. Hopefully, the bill will modernize the system to make it also more efficient and more effective, something that we also hear complaints about in our judicial system. Lawyers, crown attorneys and so on talk about how slow the system is and how there is a need to update a variety of areas in our judicial system.</p>\n<p data-HoCid=\"1028534\" data-originallang=\"en\">Some of these amendments make certain processes more effective through greater use of technology and by consolidating and rationalizing existing provisions. The amendments relating to criminal procedure in Canada provide for, among other things, the use of a means of telecommunication to forward warrants for the purpose of endorsement and execution in the jurisdiction other than the jurisdiction where the search warrant was obtained. This clearly will save time and will be far more efficient. It is a logical step that needed to be taken.</p>\n<p data-HoCid=\"1028535\" data-originallang=\"en\">The amendments also provide for changes to the process with respect to the challenge of jurors to, among other things, assist in preserving their impartiality, which again is very important; summary dismissal by a single judge of the court of appeal when an appeal has erroneously been filed with that court; an appeal of a superior court order with respect to things seized lying with the court of appeal; a summary conviction trial with respect to the co-accused that can proceed where one of the co-accused does not appear; and the reclassification of the offence of possession of break and enter instruments into a dual procedure offence to allow the Crown to determine whether this offence should be prosecuted by way of indictment or by the more expeditious procedure of summary conviction, which again could save hours of court time and allow for much faster determinations.</p>\n<p data-HoCid=\"1028536\" data-originallang=\"en\">Amendments related to sentencing provide for, among other things: the power to order an offender not to communicate with identified persons while in custody, and the creation of an offence for failing to comply with the order, thereby enhancing protection of victims, which for some time has been called for; clarifications with respect to the application of impaired driving penalties; an increase of the maximum fine that can be imposed for a summary conviction offence from the current $2,000 to $10,000, which is a significant increase and hopefully would work to some degree as a deterrent; the suspension of a conditional sentence order or a probation order during an appeal; and the power to delay sentencing proceedings so that an offender can participate in a provincially approved treatment program.</p>\n<p data-HoCid=\"1028537\" data-originallang=\"en\"> We often have heard about the lack or insufficient number of treatment programs for people who find themselves with a serious drug problem. There are just not enough programs. There was an article in yesterday's paper and a symposium held yesterday in Toronto which talked about the very issue of there not being sufficient drug treatment programs for many people. That also results in many people are finding themselves in the judicial system.</p>\n<p data-HoCid=\"1028538\" data-originallang=\"en\">Further amendments include: in the case of a person serving a youth sentence who receives an adult sentence, to clarify that the remaining portion of the youth sentence is converted to an adult sentence; and the power of a court to order, on application by the Attorney General and after convicting a person of the offence of luring a child by means of a computer system, the forfeiture of things used in relation to that offence.</p>\n<p data-HoCid=\"1028539\" data-originallang=\"en\"> Clearly this legislation is reflecting the ongoing concerns of Canadians and parliamentarians with regard to many of the things that are going on through the Internet and the luring of young children, an issue that has been discussed at length here in the House. Again, it is all part of the modernization of our justice system's ability to reflect these kinds of things that did not happen many years ago.</p>\n<p data-HoCid=\"1028540\" data-originallang=\"en\">Other amendments will allow for better implementation of the language right provisions in the Criminal Code. These amendments will improve the means through which an accused is informed of the right to be heard by a judge or a judge and jury who speak the official language of Canada that is the language of the accused, or both official languages of Canada. The amendments also codify the right of the accused to obtain a translation of the information or indictment on request. Other provisions clarify the application of the language provisions of the Criminal Code in the context of bilingual trials. </p>\n<p data-HoCid=\"1028541\" data-originallang=\"en\">Although this bill may not seem as exciting as some that we have been debating lately, I think it is nice to get something that is not charging each and every one of us up but goes on to modernize the system. These justice bills are important. As the responsible Liberal official opposition that we are, we will be supporting this legislation.</p>\n<p data-HoCid=\"1028542\" data-originallang=\"en\"> The legislation might seem familiar to all the people watching at home. There is good reason for that. This bill was originally introduced as Bill <a data-HoCid=\"2304866\" href=\"/bills/39-2/C-23/\" title=\"An Act to amend the Criminal Code (criminal procedure, language of the accused, sentencing and other amendments)\">C-23</a> in the first session of the 39th Parliament. It passed all stages of approval in the House of Commons and had been sent to the Senate, so if anyone thinks this is familiar legislation, clearly it is. It died on the order paper, unfortunately, when the minority Conservative government decided to prorogue the House and start fresh with a Speech from the Throne. This is catch-up time on good legislation.</p>\n<p data-HoCid=\"1028543\" data-originallang=\"en\">That Speech from the Throne was another ploy by the government to try to raise its poll numbers, not unusual for the Conservatives, nor was it unusual for other people who had assumed the same role in government, but sadly for them Canadians saw through the strategy and were not fooled. Canadians know how much good work the Liberal government did to protect our cities and our communities and how much progress we made on our justice agenda.</p>\n<p data-HoCid=\"1028544\" data-originallang=\"en\">Notable achievements by my government included the creation of a national sex offender registry to protect Canadians from violent sex offenders, and we introduced legislation to restrict the use of conditional sentences for serious and violent offences. We also introduced a package of measures to crack down on violent gun crime and gang violence to assist communities at risk.</p>\n<p data-HoCid=\"1028545\" data-originallang=\"en\"> Much of that legislation is currently being used in cities across Canada, in particular my city of Toronto, which continues to work on areas of crime prevention, enforcement of the sentences that are there and reaching out to at risk youth and at risk communities. Some of the initiatives included a new $50 million gun violence and gang prevention fund, legislative reform for stricter sentencing for gun crimes, and social investments to prevent those at risk from following a life of crime and to provide them with hope and opportunity for tomorrow.</p>\n<p data-HoCid=\"1028546\" data-originallang=\"en\">Canadians know that the Liberal Party continues to be committed to protecting our homes and our rights, as they have always known. It is a priority for us. That is why we have committed to appointing more judges, and it is why we are supporting that legislation, and to putting more police officers on our streets and more prosecutors in the courts, as I mentioned earlier today. We also have worked very hard to toughen laws on Internet luring and identity theft to protect Canada's most vulnerable citizens, including children and seniors.</p>\n<p data-HoCid=\"1028547\" data-originallang=\"en\">In his many comments, our leader has also committed to establishing a new fund that will help preserve the safety of ethnic and cultural at risk communities across Canada. This safety being put at risk is something that unfortunately continues to happen more and more in many of our communities across Canada. This fund would, for example, cover the costs of security in their places of worship and gathering places.</p>\n<p data-HoCid=\"1028548\" data-originallang=\"en\">I am pleased to support Bill <a data-HoCid=\"3085474\" href=\"/bills/39-2/C-13/\" title=\"An Act to amend the Criminal Code (criminal procedure, language of the accused, sentencing and other amendments)\">C-13</a>. I encourage my colleagues to do the same. I also encourage my colleagues to exercise their privileges as members to be on the record as speaking out on behalf of their constituents on important pieces of legislation before the House. I am glad to have had the opportunity to get my points of view on the record today. I look forward to questions.</p>",

J'esp\u00e8re que le projet de loi modernisera le syst\u00e8me de mani\u00e8re \u00e0 le rendre plus efficace, car son inefficacit\u00e9 fait l'objet de plaintes. Des avocats, des procureurs de la Couronne et d'autres nous disent que le syst\u00e8me est lent et qu'il y a de nombreux points \u00e0 am\u00e9liorer.</p>\n<p data-HoCid=\"1028534\" data-originallang=\"en\">Certaines des am\u00e9liorations propos\u00e9es am\u00e9liorent l'efficacit\u00e9 de certains processus en faisant une meilleure utilisation de la technologie et en regroupant et en rationalisant certaines dispositions actuelles. Les modifications qui touchent la proc\u00e9dure criminelle pr\u00e9voient, entre autres, l'utilisation d'un moyen de t\u00e9l\u00e9communication pour la transmission des mandats afin de les faire viser et de les mettre en oeuvre dans un territoire autre que celui o\u00f9 le mandat a \u00e9t\u00e9 obtenu. Ce proc\u00e9d\u00e9 est nettement plus efficace et permettra de gagner du temps. C'est une mesure logique qui se devait d'\u00eatre prise.</p>\n<p data-HoCid=\"1028535\" data-originallang=\"en\">Les modifications pr\u00e9voient \u00e9galement des changements \u00e0 la proc\u00e9dure de r\u00e9cusation des jur\u00e9s afin de favoriser, entre autres, le maintien de leur impartialit\u00e9, ce qui est tr\u00e8s important; le rejet sommaire, par un juge, de l\u2019appel interjet\u00e9 par erreur devant la cour d\u2019appel; l\u2019appel d\u2019une ordonnance de la cour sup\u00e9rieure quant aux choses saisies devant la cour d\u2019appel; l\u2019instruction d\u2019un proc\u00e8s pour une infraction sommaire \u00e0 l\u2019\u00e9gard de coaccus\u00e9s dont l\u2019un ne compara\u00eet pas; et finalement afin de faire de l\u2019infraction de possession d\u2019outils de cambriolage une infraction mixte afin de permettre \u00e0 la Couronne de d\u00e9terminer si cette infraction doit faire l'objet d'une poursuite par acte d'accusation ou par voie sommaire, ce qui est plus rapide. Cette derni\u00e8re mesure permettrait de lib\u00e9rer grandement les tribunaux et d'en arriver \u00e0 des r\u00e8glements plus rapidement.</p>\n<p data-HoCid=\"1028536\" data-originallang=\"en\">Les modifications concernant la d\u00e9termination des peines pr\u00e9voient, entre autres: le pouvoir d'ordonner \u00e0 un contrevenant sous garde de ne pas communiquer avec des personnes identifi\u00e9es et la cr\u00e9ation d'une infraction de violation de l'ordonnance, ce qui rehausse la protection des victimes \u2014 il faut dire qu'on demandait cela depuis un certain temps; des clarifications concernant l'application des peines pour conduite avec facult\u00e9s affaiblies; l'augmentation de l'amende maximale, qui passe de 2 000 $ \u00e0 10 000 $, pouvant \u00eatre inflig\u00e9e pour une condamnation \u00e0 l'\u00e9gard d'une infraction sommaire, une hausse consid\u00e9rable qui, nous l'esp\u00e9rons, aura un certain effet dissuasif; la suspension d'une ordonnance d'emprisonnement avec sursis ou d'une ordonnance de probation durant l'appel; le pouvoir de reporter le processus de d\u00e9termination de la peine pour que le d\u00e9linquant puisse participer \u00e0 un programme de traitement approuv\u00e9 par une province.</p>\n<p data-HoCid=\"1028537\" data-originallang=\"en\">Nous avons souvent entendu parler de l'absence ou du manque de programmes de traitement \u00e0 l'intention des toxicomanes. Il n'y a tout simplement pas assez de programmes. Un article a d'ailleurs paru \u00e0 ce sujet hier dans le journal. En outre, il a \u00e9t\u00e9 question hier dans un symposium qui a eu lieu \u00e0 Toronto du fait qu'il n'y avait pas assez de programmes de traitement pour les nombreux toxicomanes. Beaucoup de personnes se retrouvent dans le syst\u00e8me judiciaire pour cette raison. </p>\n<p data-HoCid=\"1028538\" data-originallang=\"en\">Il y a aussi d'autres modifications qui pr\u00e9voient ce qui suit: dans le cas d\u2019une personne qui purge une peine pour adolescent et qui re\u00e7oit une peine pour adulte, clarifier que la portion restante de la peine pour adolescent est convertie en peine pour adulte; ainsi que le pouvoir d\u2019un tribunal d\u2019ordonner, sur demande du procureur g\u00e9n\u00e9ral et apr\u00e8s condamnation d\u2019une personne pour avoir commis une infraction de leurre d\u2019un enfant au moyen d\u2019un syst\u00e8me informatique, la confiscation de tout produit reli\u00e9 \u00e0 cette infraction.</p>\n<p data-HoCid=\"1028539\" data-originallang=\"en\">Cette mesure l\u00e9gislative refl\u00e8te clairement les pr\u00e9occupations des Canadiens et des parlementaires concernant ce qui se passe sur Internet et le leurre d'enfants, un dossier dont la Chambre a abondamment parl\u00e9. Encore une fois, la modernisation du syst\u00e8me de justice doit tenir compte de la capacit\u00e9 de traiter ce genre de choses qui ne se produisaient pas dans le pass\u00e9.</p>\n<p data-HoCid=\"1028540\" data-originallang=\"en\">D'autres modifications am\u00e9lioreront la mise en oeuvre des dispositions du Code criminel relatives aux droits linguistiques, notamment les moyens permettant d'informer un accus\u00e9 de son droit \u00e0 un proc\u00e8s devant un juge seul ou devant un juge et un jury parlant la langue officielle de l'accus\u00e9 ou encore les deux langues officielles du Canada. Ces modifications officialisent \u00e9galement le droit, pour l'accus\u00e9, de demander une traduction de la d\u00e9nonciation ou de l'acte d'accusation. D'autres dispositions pr\u00e9cisent l'application des dispositions linguistiques du Code criminel relativement aux proc\u00e8s bilingues. </p>\n<p data-HoCid=\"1028541\" data-originallang=\"en\">M\u00eame si ce projet de loi ne suscite pas autant les passions que d'autres mesures dont nous avons \u00e9t\u00e9 saisis r\u00e9cemment, je crois qu'il est bien de d\u00e9battre pos\u00e9ment d'une mesure l\u00e9gislative qui permet de moderniser le syst\u00e8me. Ces projets de loi sur la justice sont importants. En tant que d\u00e9put\u00e9s d'une opposition lib\u00e9rale officielle responsable, nous appuierons cette mesure l\u00e9gislative. </p>\n<p data-HoCid=\"1028542\" data-originallang=\"en\">Ce projet de loi peut sembler familier, avec raison, \u00e0 ceux qui nous regardent \u00e0 la maison. Il avait \u00e9t\u00e9 pr\u00e9sent\u00e9 \u00e0 l'origine sous le num\u00e9ro <a data-HoCid=\"2304866\" href=\"/bills/39-2/C-23/\" title=\"An Act to amend the Criminal Code (criminal procedure, language of the accused, sentencing and other amendments)\">C-23</a> pendant la premi\u00e8re session de la 39<sup>e</sup> l\u00e9gislature. Comme il avait franchi toutes les \u00e9tapes \u00e0 la Chambre des communes et qu'il avait \u00e9t\u00e9 renvoy\u00e9 au S\u00e9nat, il est possible, \u00e0 juste titre, qu'il paraisse familier \u00e0 certains. Il est malheureusement mort au <em>Feuilleton</em> lorsque le gouvernement conservateur minoritaire a d\u00e9cid\u00e9 de proroger le Parlement, puis de repartir \u00e0 neuf avec un discours du Tr\u00f4ne. Nous reprenons ici le temps perdu au sujet d'une bonne mesure l\u00e9gislative. </p>\n<p data-HoCid=\"1028543\" data-originallang=\"en\">Ce discours du Tr\u00f4ne fut une autre manigance du gouvernement pour essayer d'am\u00e9liorer sa popularit\u00e9 dans les sondages, ce qui n'est pas nouveau de la part des conservateurs, ni d'autres qui ont occup\u00e9 la m\u00eame place au gouvernement, mais malheureusement pour les conservateurs, les Canadiens ont vu clair dans leur jeu et n'ont pas \u00e9t\u00e9 dupes. Les Canadiens savent bien que les lib\u00e9raux ont fait du bon travail pour prot\u00e9ger nos villes et nos collectivit\u00e9s et quels progr\u00e8s nous avons r\u00e9alis\u00e9s en mati\u00e8re de justice. </p>\n<p data-HoCid=\"1028544\" data-originallang=\"en\">Parmi les r\u00e9alisations particuli\u00e8rement remarquables de mon gouvernement figuraient la cr\u00e9ation du Registre national des d\u00e9linquants sexuels, dont l'objet \u00e9tait de prot\u00e9ger les Canadiens des d\u00e9linquants sexuels violents, de m\u00eame que la pr\u00e9sentation d'un projet de loi visant \u00e0 restreindre le recours aux peines d'emprisonnement avec sursis pour les infractions graves et violentes. Nous avons \u00e9galement pr\u00e9sent\u00e9 un train de mesures permettant de s\u00e9vir contre les crimes violents commis avec des armes \u00e0 feu et la violence li\u00e9e aux gangs de rue, dans le but d'aider les collectivit\u00e9s \u00e0 risque. </p>\n<p data-HoCid=\"1028545\" data-originallang=\"en\">La plupart de ces dispositions l\u00e9gislatives sont actuellement appliqu\u00e9es dans des villes d'un bout \u00e0 l'autre du Canada, en particulier dans la mienne, Toronto, qui poursuit ses efforts dans les domaines de la pr\u00e9vention de la criminalit\u00e9, de l'ex\u00e9cution des peines existantes et de la sensibilisation des jeunes et des collectivit\u00e9s \u00e0 risque. Ces initiatives comprenaient notamment un nouveau fonds de 50 millions de dollars pour la lutte contre la violence commise avec une arme \u00e0 feu et pour la pr\u00e9vention visant les gangs de rue, une r\u00e9forme concernant l'imposition de peines plus s\u00e9v\u00e8res aux auteurs de crimes commis au moyen d'armes \u00e0 feu, ainsi que des investissements sociaux visant \u00e0 emp\u00eacher que des personnes \u00e0 risque ne s'engagent dans une vie criminelle en leur redonnant espoir et en leur offrant de nouvelles possibilit\u00e9s d'avenir.</p>\n<p data-HoCid=\"1028546\" data-originallang=\"en\">Les Canadiens savent depuis toujours que le Parti lib\u00e9ral est engag\u00e9 \u00e0 prot\u00e9ger nos foyers et nos droits. C'est notre priorit\u00e9. C'est pourquoi nous nous \u00e9tions engag\u00e9s \u00e0 nommer davantage de juges. C'est pourquoi nous appuyons ce projet de loi, de m\u00eame que l'augmentation du nombre d'agents de police dans nos rues et de procureurs dans nos tribunaux, comme je l'ai mentionn\u00e9 plus t\u00f4t aujourd'hui. Nous avons \u00e9galement travaill\u00e9 tr\u00e8s fort pour durcir les lois sur le leurre par Internet et le vol d'identit\u00e9 afin de prot\u00e9ger les citoyens les plus vuln\u00e9rables de notre pays, notamment les enfants et les a\u00een\u00e9s.</p>\n<p data-HoCid=\"1028547\" data-originallang=\"en\">Dans ses nombreuses interventions, notre chef s'est \u00e9galement engag\u00e9 \u00e0 cr\u00e9er un nouveau fonds qui contribuera \u00e0 assurer la s\u00e9curit\u00e9 des communaut\u00e9s ethniques et culturelles \u00e0 risque d'un bout \u00e0 l'autre du Canada. Leur s\u00e9curit\u00e9 est malheureusement de plus en plus menac\u00e9e dans un grand nombre de collectivit\u00e9s d'un oc\u00e9an \u00e0 l'autre.
