        "en": "<p data-HoCid=\"720553\" data-originallang=\"en\">Mr. Speaker, it is with pleasure that I speak to Bill <a data-HoCid=\"2164190\" href=\"/bills/39-1/C-307/\" title=\"An Act respecting bis(2-ethylhexyl)phthalate, benzyl butyl phthalate and dibutyl phthalate\">C-307</a>, the phthalate control act. The bill seeks to regulate the use of certain phthalates in products that Canadians may be exposed to.</p>\n<p data-HoCid=\"720554\" data-originallang=\"en\">I want to take this opportunity to thank all the members of the Standing Committee on the Environment and Sustainable Development for their hard work in reviewing this bill.</p>\n<p data-HoCid=\"720555\" data-originallang=\"en\">Bill<a data-HoCid=\"2164190\" href=\"/bills/39-1/C-307/\" title=\"An Act respecting bis(2-ethylhexyl)phthalate, benzyl butyl phthalate and dibutyl phthalate\">C-307</a>, as amended by the committee, will ensure that the government takes the appropriate evidenced based approach to protect Canadians from exposures to levels of phthalates that can cause them harm.</p>\n<p data-HoCid=\"720556\" data-originallang=\"en\">The amended bill restricts the use of DEHP in children's toys, cosmetics and medical devices using the appropriate existing federal statutes and regulations.</p>\n<p data-HoCid=\"720557\" data-originallang=\"en\">Under the current regulatory regimes and in keeping with the federal constitutional jurisdiction, Health Canada has legislative authorities in place to regulate the safety and effectiveness of medical devices and their manufacturers under the Food and Drugs Act and the medical devices regulations.</p>\n<p data-HoCid=\"720558\" data-originallang=\"en\">One phthalate known as DEHP is used as a softening agent for many medical grade plastic materials made from polyvinylchloride, PVC.</p>\n<p data-HoCid=\"720559\" data-originallang=\"en\">Without a softening agent life saving medical devices such as medical tubing and blood bags would be brittle and crack during use, or could not be sterilized as effectively.</p>\n<p data-HoCid=\"720560\" data-originallang=\"en\">Alternative materials have been developed for use in some medical devices for certain medical applications. In other cases non-DEHP containing devices are not available or do not perform as well as devices made with DEHP.</p>\n<p data-HoCid=\"720561\" data-originallang=\"en\">In these cases an individual risk evaluation must be undertaken to fully understand the implications of alternate treatments or no treatment compared with the use of a medical device containing small quantities of DEHP.</p>\n<p data-HoCid=\"720562\" data-originallang=\"en\">Only a physician in consultation with the patient can make the final decision as to what is an appropriate medical treatment. No medical device or drug is 100% safe and effective. This is an important consideration in any decision when seeking medical treatment.</p>\n<p data-HoCid=\"720563\" data-originallang=\"en\">It follows then that the government's response to the phthalates in medical devices must differ from its approach taken with other consumer products.</p>\n<p data-HoCid=\"720564\" data-originallang=\"en\">Concerns have been raised about the safety of DEHP in medical devices since the 1980s. These concerns are based on studies showing that DEHP administered at high doses to rodents caused certain adverse effects, particularly effects on the developing reproductive system in young males.</p>\n<p data-HoCid=\"720565\" data-originallang=\"en\">There is concern that DEHP has the potential to produce similar adverse reproductive effects on humans, although there are no reliable data demonstrating that it does. </p>\n<p data-HoCid=\"720566\" data-originallang=\"en\">Health Canada has extensively studied the safety of DEHP in medical devices. In 2001 Health Canada completed a review of the scientific and medical literature and in the fall of 2001 convened an expert advisory panel to review the report and provide specific advice on managing the risk associated with the use of DEHP in medical devices. The recommendations of the advisory panel were made public in January 2002 and implemented. </p>\n<p data-HoCid=\"720567\" data-originallang=\"en\">In 2003 Health Canada published a draft position paper regarding the use of DEHP in medical devices. Health Canada has committed to finalize this position paper within the next few months.</p>\n<p data-HoCid=\"720568\" data-originallang=\"en\">Bill <a data-HoCid=\"2164190\" href=\"/bills/39-1/C-307/\" title=\"An Act respecting bis(2-ethylhexyl)phthalate, benzyl butyl phthalate and dibutyl phthalate\">C-307</a>, as amended in committee, recognizes that it is not in the best interests of Canadians to ban all medical devices containing DEHP in Canada at this time because alternate treatment options may not exist; and secondly, alternate treatment options may present higher risks to the patients.</p>\n<p data-HoCid=\"720569\" data-originallang=\"en\">Bill <a data-HoCid=\"2164190\" href=\"/bills/39-1/C-307/\" title=\"An Act respecting bis(2-ethylhexyl)phthalate, benzyl butyl phthalate and dibutyl phthalate\">C-307</a> will aim to provide Canadians with continued access to needed medical devices, such as blood bags and intravenous tubing, when DEHP-free devices are not available or appropriate.</p>\n<p data-HoCid=\"720570\" data-originallang=\"en\">Under this bill the Government of Canada will work with the health care community, hospital associations, industry and other stakeholders to facilitate the development and promotion of clinical practice guidelines for the use of DEHP-containing medical devices. It will finalize and release a position paper on the use of medical devices containing DEHP and develop a guidance document on labelling requirements for these products.</p>\n<p data-HoCid=\"720571\" data-originallang=\"en\">The government will also give priority to the review of phthalate-free medical devices intended to be used on vulnerable patient groups. These actions will lead to a phase-out of the use of DEHP in medical devices starting with those used on vulnerable populations such as children, pregnant women and newborns.</p>\n<p data-HoCid=\"720572\" data-originallang=\"en\">This approach will aim to provide Canadians with continued access to the best available medical devices and treatment options. Health Canada continues to monitor and review the approaches of other global regulatory agencies with regard to the potential risks associated with DEHP and other phthalates used in medical devices.</p>\n<p data-HoCid=\"720573\" data-originallang=\"en\">Since the 1980s' Canada's risk management approach to this subject has been evidence based, recognizing the balance between potential exposure to DEHP with the need for medically necessary treatments.</p>\n<p data-HoCid=\"720574\" data-originallang=\"en\">I can assure members that Canada's approach to minimize the risk associated with medical devices containing DEHP is one of the most stringent in the world. I would also urge members to support Bill <a data-HoCid=\"2164190\" href=\"/bills/39-1/C-307/\" title=\"An Act respecting bis(2-ethylhexyl)phthalate, benzyl butyl phthalate and dibutyl phthalate\">C-307</a> as amended by the committee and proposed actions by Health Canada and Environment Canada aimed to ensure the health and well-being of Canadians.</p>\n<p data-HoCid=\"720575\" data-originallang=\"en\">I would like to take a moment to reflect on the hard work of the <a data-HoCid=\"78966\" href=\"/politicians/mark-warawa/\" title=\"Mark Warawa\">Parliamentary Secretary to the Minister of the Environment</a>, the member for Langley, and his lead at the environment committee. We all know that can be a very challenging position. The member for Langley has demonstrated that the committee process is active and well through the cooperation of the mover of the bill and others to demonstrate that this Parliament is in fact working. </p>\n<p data-HoCid=\"720576\" data-originallang=\"en\">As I mentioned previously, Bill <a data-HoCid=\"2164190\" href=\"/bills/39-1/C-307/\" title=\"An Act respecting bis(2-ethylhexyl)phthalate, benzyl butyl phthalate and dibutyl phthalate\">C-307</a> was amended at committee to make sure that we clearly reflect the realities in the medical community. Medical devices are very important. On one hand we want them to be available; however, as I said, there are always risks with some devices. I think the committee has struck a balance. The <a data-HoCid=\"78966\" href=\"/politicians/mark-warawa/\" title=\"Mark Warawa\">Parliamentary Secretary to the Minister of the Environment</a> should be congratulated for navigating this bill through the committee.</p>\n<p data-HoCid=\"720577\" data-originallang=\"en\">I think Canadians, in particular vulnerable Canadians such as children, pregnant women and newborns, will be better off for the hard work of the committee, and particularly the member for Langley, the <a data-HoCid=\"78966\" href=\"/politicians/mark-warawa/\" title=\"Mark Warawa\">Parliamentary Secretary to the Minister of the Environment</a>.</p>",

L'objet du projet de loi est de r\u00e9glementer l'utilisation de certains phtalates dans la fabrication de produits auxquels les Canadiens risquent d'\u00eatre expos\u00e9s.</p>\n<p data-HoCid=\"720554\" data-originallang=\"en\">Je saisis cette occasion pour remercier tous les membres du Comit\u00e9 permanent de l'environnement et du d\u00e9veloppement durable pour leur travail acharn\u00e9 tout au long de l'examen de ce projet de loi.</p>\n<p data-HoCid=\"720555\" data-originallang=\"en\">Le projet de loi <a data-HoCid=\"2164190\" href=\"/bills/39-1/C-307/\" title=\"An Act respecting bis(2-ethylhexyl)phthalate, benzyl butyl phthalate and dibutyl phthalate\">C-307</a>, tel qu'amend\u00e9 par le comit\u00e9, permettra au gouvernement de prendre les mesures appropri\u00e9es, fond\u00e9es sur les donn\u00e9es pertinentes, pour prot\u00e9ger les Canadiens contre l'exposition \u00e0 des concentrations de phtalates susceptibles de nuire \u00e0 leur sant\u00e9.</p>\n<p data-HoCid=\"720556\" data-originallang=\"en\">Le projet amend\u00e9 limite l'utilisation du DEHP dans les jouets d'enfants, dans les cosm\u00e9tiques et dans les instruments m\u00e9dicaux gr\u00e2ce aux lois et r\u00e8glements appropri\u00e9s qui existent d\u00e9j\u00e0.</p>\n<p data-HoCid=\"720557\" data-originallang=\"en\">En vertu des r\u00e9gimes de r\u00e9glementation actuels et dans le cadre des comp\u00e9tences conf\u00e9r\u00e9es au gouvernement f\u00e9d\u00e9ral par la Constitution, Sant\u00e9 Canada est d\u00e9j\u00e0 investi de l'autorit\u00e9 l\u00e9gislative n\u00e9cessaire pour r\u00e9glementer la s\u00e9curit\u00e9 et l'efficacit\u00e9 des instruments m\u00e9dicaux et leurs fabricants en vertu de la Loi sur les aliments et drogues et des r\u00e8glements relatifs aux instruments m\u00e9dicaux.</p>\n<p data-HoCid=\"720558\" data-originallang=\"en\">Un phtalate connu sous l'acronyme DEHP est utilis\u00e9 comme plastifiant dans de nombreux plastiques de qualit\u00e9 m\u00e9dicale \u00e0 base de polychlorure de vinyle ou PVC.</p>\n<p data-HoCid=\"720559\" data-originallang=\"en\">Sans plastifiant, les instruments m\u00e9dicaux pouvant sauver des vies, notamment les tubulures m\u00e9dicales et les sacs de sang, serait friables et se fissureraient en cours d'utilisation. Ils ne pourraient pas non plus \u00eatre st\u00e9rilis\u00e9s aussi efficacement. </p>\n<p data-HoCid=\"720560\" data-originallang=\"en\">Des mat\u00e9riaux de remplacement ont \u00e9t\u00e9 mis au point pour \u00eatre utilis\u00e9s dans certains instruments m\u00e9dicaux dans le cadre de certaines applications m\u00e9dicales. Dans d'autres cas, des instruments exempts de DEHP ne sont pas disponibles ni aussi efficaces que ceux qui contiennent du DEHP.</p>\n<p data-HoCid=\"720561\" data-originallang=\"en\">Dans ces cas, une \u00e9valuation individuelle des risques doit \u00eatre effectu\u00e9e afin de comprendre toutes les implications de traitements de remplacement ou de l'absence de traitements en comparaison \u00e0 l'utilisation d'un instrument m\u00e9dical contenant des quantit\u00e9s minimales de DEHP.</p>\n<p data-HoCid=\"720562\" data-originallang=\"en\">Seul un m\u00e9decin, en consultation avec son patient, peut prendre la d\u00e9cision finale pour d\u00e9terminer le traitement m\u00e9dical appropri\u00e9. Aucun instrument m\u00e9dical ou aucun m\u00e9dicament n'est s\u00fbr et efficace \u00e0 100 p. 100. C'est un facteur important dont il faut tenir compte avant de recevoir un traitement m\u00e9dical.</p>\n<p data-HoCid=\"720563\" data-originallang=\"en\">Par cons\u00e9quent, l'approche du gouvernement dans le dossier des phtalates pr\u00e9sents dans les instruments m\u00e9dicaux doit \u00eatre diff\u00e9rente de celle qu'il adopte pour les autres produits de consommation. </p>\n<p data-HoCid=\"720564\" data-originallang=\"en\">Des r\u00e9serves ont \u00e9t\u00e9 soulev\u00e9es au sujet de l'innocuit\u00e9 du DEHP dans les instruments m\u00e9dicaux depuis les ann\u00e9es 1980. Ces r\u00e9serves sont fond\u00e9es sur des \u00e9tudes d\u00e9montrant que le DEHP administr\u00e9 \u00e0 fortes doses aux rongeurs a eu des effets pervers, en particulier en ce qui concerne le d\u00e9veloppement de l'appareil reproducteur des jeunes m\u00e2les.</p>\n<p data-HoCid=\"720565\" data-originallang=\"en\">On craint que le DEHP ait le potentiel de causer les m\u00eames effets pervers chez les humains, bien qu'il n'y ait aucune donn\u00e9e cr\u00e9dible \u00e0 l'appui.</p>\n<p data-HoCid=\"720566\" data-originallang=\"en\">Sant\u00e9 Canada a fait \u00e9norm\u00e9ment d'\u00e9tudes sur la s\u00e9curit\u00e9 du DEHP dans les instruments m\u00e9dicaux. Sant\u00e9 Canada s'est alors engag\u00e9 \u00e0 publier un expos\u00e9 de position d\u00e9finitif au cours des mois suivants. </p>\n<p data-HoCid=\"720568\" data-originallang=\"en\">Le projet de loi <a data-HoCid=\"2164190\" href=\"/bills/39-1/C-307/\" title=\"An Act respecting bis(2-ethylhexyl)phthalate, benzyl butyl phthalate and dibutyl phthalate\">C-307</a>, tel qu'amend\u00e9 lors de l'\u00e9tude en comit\u00e9, reconna\u00eet qu'il n'est pas dans l'int\u00e9r\u00eat des Canadiens d'interdire pour le moment l'utilisation au Canada de tous les instruments m\u00e9dicaux renfermant du DEHP, premi\u00e8rement, parce qu'il n'y a peut-\u00eatre pas \u00e0 l'heure actuelle d'autres possibilit\u00e9s de traitement et, deuxi\u00e8mement, parce que les autres traitements peuvent comporter des risques plus importants pour les patients.</p>\n<p data-HoCid=\"720569\" data-originallang=\"en\">Le projet de loi <a data-HoCid=\"2164190\" href=\"/bills/39-1/C-307/\" title=\"An Act respecting bis(2-ethylhexyl)phthalate, benzyl butyl phthalate and dibutyl phthalate\">C-307</a> vise \u00e0 assurer aux Canadiens un acc\u00e8s continu aux instruments m\u00e9dicaux dont ils ont besoin, notamment les sacs de sang et les tubes \u00e0 perfusion intraveineuse, lorsque des instruments sans DEHP ne sont pas disponibles ou ne conviennent pas. </p>\n<p data-HoCid=\"720570\" data-originallang=\"en\">Cette mesure l\u00e9gislative pr\u00e9voit que le gouvernement du Canada collaborera avec le secteur des soins de sant\u00e9, les associations d'h\u00f4pitaux, l'industrie et d'autres intervenants pour faciliter l'\u00e9laboration et la promotion de lignes directrices en mati\u00e8re de pratique clinique pour l'utilisation d'instruments m\u00e9dicaux renfermant du DEHP. Le gouvernement publiera un expos\u00e9 de position d\u00e9finitif sur l'utilisation d'instruments m\u00e9dicaux renfermant cette substance et il pr\u00e9parera un document d'orientation sur les exigences d'\u00e9tiquetage visant ces produits. </p>\n<p data-HoCid=\"720571\" data-originallang=\"en\">Le gouvernement accordera \u00e9galement la priorit\u00e9 \u00e0 l'examen des instruments m\u00e9dicaux sans DEHP qui sont destin\u00e9s aux groupes de patients vuln\u00e9rables. Ces mesures m\u00e8neront \u00e0 la diminution graduelle de l'utilisation de DEHP dans les instruments m\u00e9dicaux, en commen\u00e7ant par ceux qui sont destin\u00e9s aux populations vuln\u00e9rables comme les enfants, les femmes enceintes et les nouveau-n\u00e9s. </p>\n<p data-HoCid=\"720572\" data-originallang=\"en\">Cette approche a pour but d'assurer aux Canadiens un acc\u00e8s constant aux meilleurs instruments m\u00e9dicaux et aux meilleurs traitements. Sant\u00e9 Canada continue de surveiller et d'examiner les approches des autres organismes r\u00e9glementaires sur la sc\u00e8ne internationale en ce qui concerne les risques li\u00e9s \u00e0 l'utilisation du DEHP et d'autres phtalates dans les instruments m\u00e9dicaux.</p>\n<p data-HoCid=\"720573\" data-originallang=\"en\">Depuis les ann\u00e9es 1980, l'approche du Canada en mati\u00e8re de gestion du risque \u00e0 cet \u00e9gard repose sur des donn\u00e9es probantes et elle tient compte de l'\u00e9quilibre entre l'exposition potentielle au DEHP et la n\u00e9cessit\u00e9 de traitements m\u00e9dicaux essentiels. </p>\n<p data-HoCid=\"720574\" data-originallang=\"en\">Je peux assurer aux d\u00e9put\u00e9s que l'approche du Canada pour r\u00e9duire au minimum les risques associ\u00e9s aux instruments m\u00e9dicaux contenant du DEHP est l'une des plus rigoureuses au monde. Les instruments m\u00e9dicaux sont tr\u00e8s importants.
