        "en": "<p data-HoCid=\"807268\" data-originallang=\"en\">Mr. Speaker, today the House is debating the contents of Bill <a data-HoCid=\"3073355\" href=\"/bills/39-2/C-415/\" title=\"An Act to amend the Canada Labour Code (replacement workers)\">C-415</a>, legislation that would bar the ability of employers governed by federal regulation to use replacement workers during a labour stoppage.</p>\n<p data-HoCid=\"807269\" data-originallang=\"en\">Earlier this year we debated a similar legislative effort, Bill <a data-HoCid=\"2169666\" href=\"/bills/39-2/C-257/\" title=\"An Act to amend the Canada Labour Code (replacement workers)\">C-257</a>, which sought to achieve the same goal. I cannot help but think of Yogi Berra's famous line, \u201cIt's d\u00e9j\u00e0 vu all over again\u201d.</p>\n<p data-HoCid=\"807270\" data-originallang=\"en\">With Bill <a data-HoCid=\"2169666\" href=\"/bills/39-2/C-257/\" title=\"An Act to amend the Canada Labour Code (replacement workers)\">C-257</a>, I think there have been 11 previous attempts, and this would be the 12th attempt, to try to move the yardstick in this labour negotiation effort. The previous 11 attempts have all been defeated in Parliament.</p>\n<p data-HoCid=\"807271\" data-originallang=\"en\">There are some serious shortcomings to Bill <a data-HoCid=\"3073355\" href=\"/bills/39-2/C-415/\" title=\"An Act to amend the Canada Labour Code (replacement workers)\">C-415</a>. It is really no different from its predecessor, both in substance and in the threat it poses to the good health of Canada's economy and to labour relations. Both the current and previous bills call for an amendment to the Canada Labour Code. They contain identical summary paragraphs. Despite assurances by supporters of the bill, I see nothing in what has been proposed that could be considered an improvement on what we debated earlier this year, a bill which we opposed vigorously and which was defeated in Parliament.</p>\n<p data-HoCid=\"807272\" data-originallang=\"en\">Drafters of this bill have added a provision that would have us believe the issue of essential services has been resolved. However, it is a very complicated issue when we deal with essential services. We are talking about services in the transportation sector, particularly, interprovincial transportation, communications, banking and emergency services that are federally regulated. </p>\n<p data-HoCid=\"807273\" data-originallang=\"en\">However, would Bill <a data-HoCid=\"3073355\" href=\"/bills/39-2/C-415/\" title=\"An Act to amend the Canada Labour Code (replacement workers)\">C-415</a> define what is meant by \u201cessential workers\u201d? My answer is it would not.</p>\n<p data-HoCid=\"807274\" data-originallang=\"en\">Bill <a data-HoCid=\"3073355\" href=\"/bills/39-2/C-415/\" title=\"An Act to amend the Canada Labour Code (replacement workers)\">C-415</a> would not create a new category of essential services. Nor would it designate a group of workers to perform the essential work. There would be no material change at all to the existing requirements in the Canada Labour Code to maintain services or activities that are necessary to prevent an immediate and serious danger to the safety or the health of the public. In other words, the bill would not make any new services essential.</p>\n<p data-HoCid=\"807275\" data-originallang=\"en\">Under the current provision on essential services, questions have to be answered by the Canada Industrial Relations Board when the parties cannot agree on what services have to be maintained. The board is then required to make a determination on what is essential to ensure the health and safety of the public.</p>\n<p data-HoCid=\"807276\" data-originallang=\"en\">I will wrap up with this statement. It took the board seven years to make that determination with respect to a case involving NAV CANADA and its unions.</p>",

Comme son pr\u00e9d\u00e9cesseur, le projet de loi actuel pr\u00e9voit une modification du Code canadien du travail. Leur sommaire est identique. Malgr\u00e9 ce qu'en disent les partisans de ce projet de loi, je ne vois rien dans ce qui a \u00e9t\u00e9 propos\u00e9 qui puisse \u00eatre consid\u00e9r\u00e9 comme une am\u00e9lioration de la mesure dont nous avons discut\u00e9 au d\u00e9but de l'ann\u00e9e, un projet de loi auquel nous nous \u00e9tions oppos\u00e9s avec fermet\u00e9 et qui avait \u00e9t\u00e9 rejet\u00e9 \u00e0 la Chambre.</p>\n<p data-HoCid=\"807272\" data-originallang=\"en\">Les r\u00e9dacteurs de ce projet de loi ont ajout\u00e9 une disposition en vue de nous faire croire que la question des services essentiels est r\u00e9gl\u00e9e. C'est toutefois une question tr\u00e8s compliqu\u00e9e que d'assurer les services essentiels. Nous parlons de services dans le secteur des transports, et notamment de transports interprovinciaux, ainsi que dans les secteurs des communications, des banques et de tous les services d'urgence qui rel\u00e8vent du gouvernement f\u00e9d\u00e9ral.</p>\n<p data-HoCid=\"807273\" data-originallang=\"en\">Le projet de loi <a data-HoCid=\"3073355\" href=\"/bills/39-2/C-415/\" title=\"An Act to amend the Canada Labour Code (replacement workers)\">C-415</a> d\u00e9finit-il ce qu'est un travailleur essentiel? Selon moi, non.</p>\n<p data-HoCid=\"807274\" data-originallang=\"en\">Le projet de loi <a data-HoCid=\"3073355\" href=\"/bills/39-2/C-415/\" title=\"An Act to amend the Canada Labour Code (replacement workers)\">C-415</a> ne cr\u00e9erait pas une nouvelle cat\u00e9gorie de services essentiels. Il ne d\u00e9signerait pas non plus le groupe de travailleurs charg\u00e9s d'accomplir le travail essentiel. Le conseil a alors la responsabilit\u00e9 de d\u00e9terminer ce qui est essentiel pour assurer la sant\u00e9 et la s\u00e9curit\u00e9 de la population.</p>\n<p data-HoCid=\"807276\" data-originallang=\"en\">Je termine en rappelant un fait: il a fallu sept ans au conseil pour arriver \u00e0 le d\u00e9terminer, dans une affaire relative \u00e0 NAV CANADA et \u00e0 ses syndicats.</p>"
