"en": "<p data-HoCid=\"792409\" data-originallang=\"en\">Mr. Speaker, it is a pleasure to make some comments about the bill that is before us and to thank the hon. member for <a data-HoCid=\"78397\" href=\"/politicians/joe-comartin/\" title=\"Joe Comartin\">Windsor\u2014Tecumseh</a> who, as we know, was recently voted the most knowledgeable member of Parliament. Therefore, I take his comments on the bill very seriously and I want to congratulate him on that distinct honour.</p>\n<p data-HoCid=\"792410\" data-originallang=\"en\">I notice that the <a data-HoCid=\"105835\" href=\"/politicians/john-baird/\" title=\"John Baird\">Minister of the Environment</a> is applauding the member and I really appreciate that.</p>\n<p data-HoCid=\"792411\" data-originallang=\"en\">I know the member for <a data-HoCid=\"78397\" href=\"/politicians/joe-comartin/\" title=\"Joe Comartin\">Windsor\u2014Tecumseh</a> is one of the hardest working members. If we look at the number of crime bills that have gone through the House since the last election, the number is absolutely phenomenal. It is because of the member's diligence that we have been able to make some of the amendments that have made some of the crime bills palatable to those of us in the NDP caucus.</p>\n<p data-HoCid=\"792412\" data-originallang=\"en\">When I think about the kinds of issues that are raised with me by my constituents, yes, they are concerned about crime but they are not really looking for a law and order response to those. What they are looking for is a response that is based on some fundamental principles of justice.</p>\n<p data-HoCid=\"792413\" data-originallang=\"en\">As the member for <a data-HoCid=\"78397\" href=\"/politicians/joe-comartin/\" title=\"Joe Comartin\">Windsor\u2014Tecumseh</a> just said, four out of the five bills that are part of the omnibus bill, after his tremendous work and the amendments that he has brought forward, I was comfortable supporting on behalf of the constituents of Hamilton Mountain.</p>\n<p data-HoCid=\"792414\" data-originallang=\"en\">However, the reverse onus provision is really troubling for me. I think it offends the fundamental sense of justice. It is a law and order approach. It does not really speak to the way that my constituents of Hamilton Mountain would want us to deal with these very serious crime bills.</p>\n<p data-HoCid=\"792415\" data-originallang=\"en\">I am wondering if the member for <a data-HoCid=\"78397\" href=\"/politicians/joe-comartin/\" title=\"Joe Comartin\">Windsor\u2014Tecumseh</a> could tell me whether my concerns are right. I am hoping that the reverse onus provision will be struck down by the courts and that it will actually not meet a charter challenge and therefore I can feel just a little better about having supported Bill <a data-HoCid=\"3076458\" href=\"/bills/39-2/C-2/\" title=\"An Act to amend the Criminal Code and to make consequential amendments to other Acts\">C-2</a> yesterday at second reading. I did that because I agreed with four out of the five bills, but the fifth bill is troubling to me. I would like the member's assurances, as the most knowledgeable member, that that provision will be struck down. </p>",

Un nombre absolument incroyable de projets de loi sur la criminalit\u00e9 ont \u00e9t\u00e9 \u00e9tudi\u00e9s \u00e0 la Chambre des communes depuis les derni\u00e8res \u00e9lections. C'est gr\u00e2ce \u00e0 la diligence du d\u00e9put\u00e9 que nous avons pu proposer des amendements qui ont rendu certains de ces projets de loi plus acceptables aux yeux des n\u00e9o-d\u00e9mocrates.</p>\n<p data-HoCid=\"792412\" data-originallang=\"en\">Quand je pense au genre de questions que soul\u00e8vent mes \u00e9lecteurs, je constate que, effectivement, la criminalit\u00e9 les pr\u00e9occupe; toutefois, ils ne veulent pas de r\u00e9ponse r\u00e9pressive \u00e0 ces probl\u00e8mes. Ils veulent une r\u00e9ponse fond\u00e9e sur les principes fondamentaux de la justice.</p>\n<p data-HoCid=\"792413\" data-originallang=\"en\">Comme vient de le dire le d\u00e9put\u00e9 de <a data-HoCid=\"78397\" href=\"/politicians/joe-comartin/\" title=\"Joe Comartin\">Windsor\u2014Tecumseh</a>, j'\u00e9tais dispos\u00e9e \u00e0 appuyer, au nom des \u00e9lecteurs de Hamilton Mountain, quatre des cinq projets de loi qui font partie du projet de loi omnibus, gr\u00e2ce au travail impressionnant qu'a fait le d\u00e9put\u00e9 et aux amendements qu'il a propos\u00e9s.</p>\n<p data-HoCid=\"792414\" data-originallang=\"en\">Cependant, la disposition relative \u00e0 l'inversion du fardeau de la preuve m'inqui\u00e8te beaucoup. Je pense qu'elle va \u00e0 l'encontre du sens fondamental de la justice. C'est une approche r\u00e9pressive. Elle ne cadre pas avec la fa\u00e7on dont les \u00e9lecteurs de Hamilton Mountain aimeraient que nous traitions ces projets de loi tr\u00e8s importants de lutte contre la criminalit\u00e9.</p>\n<p data-HoCid=\"792415\" data-originallang=\"en\">Je me demande si le d\u00e9put\u00e9 de <a data-HoCid=\"78397\" href=\"/politicians/joe-comartin/\" title=\"Joe Comartin\">Windsor\u2014Tecumseh</a> peut me dire si mes pr\u00e9occupations sont fond\u00e9es. J'esp\u00e8re que la disposition relative \u00e0 l'inversion du fardeau de la preuve sera invalid\u00e9e par les tribunaux et qu'elle ne r\u00e9sistera pas \u00e0 une contestation fond\u00e9e sur la Charte.
