        "en": "<p data-HoCid=\"754430\" data-originallang=\"fr\">Mr. Speaker, I would like to take this opportunity to wish you and your team a good session, and to welcome the new pages as they start their new jobs.</p>\n<p data-HoCid=\"754431\" data-originallang=\"fr\">No one will be surprised if I speak specifically about justice. Overall, the Bloc Qu\u00e9b\u00e9cois was disappointed in the throne speech. Our leader, the member for <a data-HoCid=\"78493\" href=\"/politicians/gilles-duceppe/\" title=\"Gilles Duceppe\">Laurier\u2014Sainte-Marie</a>, clearly indicated our conditions and expectations.</p>\n<p data-HoCid=\"754432\" data-originallang=\"fr\">We also spoke about the Kyoto protocol. We clearly wanted the government to confirm that it would follow through with the commitment we made when Kyoto was signed: to bring greenhouse gases down to their 1990 levels and then reduce them further still. We do not have a green government\u2014this we know. This government is very irresponsible when it comes to the environment, and the member for <a data-HoCid=\"78641\" href=\"/politicians/bernard-bigras/\" title=\"Bernard Bigras\">Rosemont\u2014La Petite-Patrie</a> has had many opportunities to speak about this.</p>\n<p data-HoCid=\"754433\" data-originallang=\"fr\">We would also have liked the government to agree with the views of many important representatives of civil society and our fellow citizens, that Canada's mission in Afghanistan must end in 2009. Since the beginning of the mission we have been critical of the fact that there has not been a satisfactory balance of development assistance, international cooperation and military objectives. </p>\n<p data-HoCid=\"754434\" data-originallang=\"fr\"> Obviously we hope that attention will be focused on the entire question of forestry and the manufacturing sector. We know what hard times those sectors have experienced. Certainly we hope that supply management will also be discussed, for it is an extremely important issue in rural communities. And we hope that the government will eliminate the spending power in relation to matters under provincial jurisdiction. There have been calls for this for 50 years, and the Bloc Qu\u00e9b\u00e9cois is certainly not going to be satisfied with the government\u2019s dishonest subterfuge.</p>\n<p data-HoCid=\"754435\" data-originallang=\"fr\"> With that introduction, we must now talk about the justice system. First, what an exercise in cosmetics this is, what an exercise in stage management! Watching the press conference given by the <a data-HoCid=\"105824\" href=\"/politicians/rob-nicholson/\" title=\"Rob Nicholson\">Minister of Justice</a>, his colleague the <a data-HoCid=\"78755\" href=\"/politicians/stockwell-day/\" title=\"Stockwell Day\">Minister of Public Safety</a>, and the <a data-HoCid=\"78745\" href=\"/politicians/jean-pierre-blackburn/\" title=\"Jean-Pierre Blackburn\">Minister of the Economic Development Agency of Canada for the Regions of Quebec</a>, we had the impression that we were attending a play by Moli\u00e8re, starring Tartuffe. We were given to think that since the Conservatives took power in 2006 the House of Commons has been the victim of obstruction when it comes to the justice system. We were also given to think that the government has been prevented from having its justice initiative passed.</p>\n<p data-HoCid=\"754436\" data-originallang=\"fr\"> And yet when we look a little closer, we see that since January 2006 the Conservative government has tabled 12 bills relating to the justice system. As we speak, six of those bills have received royal assent and have thus become law. Of those six bills that have become law, three were passed using what is called the fast-track procedure, with the unanimous consent of all leaders in the House of Commons.</p>\n<p data-HoCid=\"754437\" data-originallang=\"fr\"> So out of 12 bills, six have become law, and three of those were passed with the consent of all parties using the fast-track procedure; four reached the Senate, at first, second and third reading, while both in the House and in committee there were only two bills remaining. It has to be said that in parliamentary history there have been more vigorous examples of obstruction. When six bills receive royal assent, four are being considered in the Senate and only two are left, you cannot, in all honesty, appear at a press conference and say that you have been unable to get your bills passed.</p>\n<p data-HoCid=\"754438\" data-originallang=\"fr\"> For the benefit of our constituents, I will mention the bills that were passed. </p>\n<p data-HoCid=\"754439\" data-originallang=\"fr\"> First, there was Bill <a data-HoCid=\"2172003\" href=\"/bills/39-2/C-9/\" title=\"An Act to amend the Criminal Code (conditional sentence of imprisonment)\">C-9</a>, on conditional sentences. It is true that we did propose some amendments. It is our job to do that. We are a responsible opposition. What is the role of the opposition? It is to ensure that bill are improved and made as perfect as possible. We would be completely irresponsible if we did not do our work. As far as the bill on conditional sentences is concerned, the government ultimately wanted to do away with that option for judges and we highlighted that.</p>\n<p data-HoCid=\"754440\" data-originallang=\"fr\">Bill <a data-HoCid=\"2222191\" href=\"/bills/39-2/C-17/\" title=\"An Act to amend the Judges Act and certain other Acts in relation to courts\">C-17</a>, which dealt with judges\u2019 salaries, was also passed, followed by Bill <a data-HoCid=\"2250003\" href=\"/bills/39-2/C-18/\" title=\"An Act to amend certain Acts in relation to DNA identification\">C-18</a>, a rather technical bill on DNA data banks. Moreover, in tribute to our unfortunately deceased colleague, Bill <a data-HoCid=\"2277339\" href=\"/bills/39-2/C-19/\" title=\"An Act to amend the Criminal Code (street racing) and to make a consequential amendment to the Corrections and Conditional Release Act\">C-19</a>, which creates a new offence under the Criminal Code with regard to street racing, was passed unanimously.</p>\n<p data-HoCid=\"754441\" data-originallang=\"fr\"> Two other bills were passed within 48 hours, which is an indication of the cooperation among opposition parties. One of those two was introduced by the Bloc Qu\u00e9b\u00e9cois, because of incidents of piracy, the unauthorized use of camcorders to record movies in theatres, particularly in Montreal. The other bill dealt with the signing by Canada of an international convention to fight organized crime.</p>\n<p data-HoCid=\"754442\" data-originallang=\"fr\"> Four other bills were being dealt with in the Senate, or I should say, \u201cthe other place.\u201d There was, first, Bill <a data-HoCid=\"2172019\" href=\"/bills/39-2/C-10/\" title=\"An Act to amend the Criminal Code (minimum penalties for offences involving firearms) and to make a consequential amendment to another Act\">C-10</a>, concerning minimum penalties for offences involving firearms.</p>\n<p data-HoCid=\"754443\" data-originallang=\"fr\"> Next, there was Bill <a data-HoCid=\"2304794\" href=\"/bills/39-2/C-22/\" title=\"An Act to amend the Criminal Code (age of protection) and to make consequential amendments to the Criminal Records Act\">C-22</a>, which dealt with the age of protection under the Criminal Code. Some of my colleagues followed that subject with a great deal of interest. The Bloc Qu\u00e9b\u00e9cois had asked for a five-year proximity clause. The Bill was before the Senate. In spite of some questions, our position was relatively favourable. The bill had been amended in committee.</p>\n<p data-HoCid=\"754444\" data-originallang=\"fr\"> Then there was Bill <a data-HoCid=\"2304866\" href=\"/bills/39-2/C-23/\" title=\"An Act to amend the Criminal Code (criminal procedure, language of the accused, sentencing and other amendments)\">C-23</a>, somewhat technical, on the language of juries and the accused.</p>\n<p data-HoCid=\"754445\" data-originallang=\"fr\"> I do not want to forget to say, Mr. Speaker, that I am sharing the time allotted to me with the likeable and charming member for <a data-HoCid=\"78644\" href=\"/politicians/serge-cardin/\" title=\"Serge Cardin\">Sherbrooke</a>.</p>\n<p data-HoCid=\"754446\" data-originallang=\"fr\"> Finally, Bill <a data-HoCid=\"2519653\" href=\"/bills/39-2/C-35/\" title=\"An Act to amend the Criminal Code (reverse onus in bail hearings for firearm-related offences)\">C-35</a> on reversing the onus of proof was also passed. Some television journalists described this bill as reversing the onus of proof for parole. However, the bill was not about parole but about pre-trial bail hearings. </p>\n<p data-HoCid=\"754447\" data-originallang=\"fr\"> There were two bills remaining about which we had and still have questions and amendments to propose. </p>\n<p data-HoCid=\"754448\" data-originallang=\"fr\"> The first deals with drug-impaired driving. We are in favour of the new provision in the bill requiring individuals to take sobriety tests. Peace officers and police could stop people who are driving erratically under the influence of drugs. We were in favour of certain provisions to require people to submit to sobriety tests. </p>\n<p data-HoCid=\"754449\" data-originallang=\"fr\"> We amended the bill however because, as unlikely as it might seem, it would have been irresponsible to pass this Conservative bill without any amendments. Imagine someone driving along in his car together with a friend. They drive down the road\u2014let us say the Trans-Canada highway, for example, to please some of my colleagues here\u2014and it turns out that the friend, who is driving, has marijuana in his pockets or his luggage. If we had passed this bill, the car owner would have been held liable. That did not seem responsible to us or legally sound. </p>\n<p data-HoCid=\"754450\" data-originallang=\"fr\"> There was also another bill about which we had a lot of questions. Unfortunately though, I have only a minute left and so I am going to proceed to my conclusion and allow the hon. member for <a data-HoCid=\"78644\" href=\"/politicians/serge-cardin/\" title=\"Serge Cardin\">Sherbrooke</a> to take over. </p>\n<p data-HoCid=\"754451\" data-originallang=\"fr\"> We are going to take our work in committee very seriously. We will not allow ourselves to be dictated to by the government which, in a fit of authoritarianism, might demand that the opposition propose no amendments to Bill <a data-HoCid=\"3076458\" href=\"/bills/39-2/C-2/\" title=\"An Act to amend the Criminal Code and to make consequential amendments to other Acts\">C-2</a>. </p>\n<p data-HoCid=\"754452\" data-originallang=\"fr\"> We will amend Bill <a data-HoCid=\"3076458\" href=\"/bills/39-2/C-2/\" title=\"An Act to amend the Criminal Code and to make consequential amendments to other Acts\">C-2</a> if we think that is the direction in which the testimony we hear is taking us. As always, I can assure the House that the Bloc Qu\u00e9b\u00e9cois will act in a serious, responsible, reasoned way. We would also like to remind the House of the justice proposals we made last June. </p>",

Nous avions indiqu\u00e9 tr\u00e8s clairement nos conditions et nos attentes par la voix de notre chef le d\u00e9put\u00e9 de <a data-HoCid=\"78493\" href=\"/politicians/gilles-duceppe/\" title=\"Gilles Duceppe\">Laurier\u2014Sainte-Marie</a>.</p>\n<p data-HoCid=\"754432\" data-originallang=\"fr\">Nous avions \u00e9galement parl\u00e9 du Protocole de Kyoto. Nous souhaitions clairement que le gouvernement affirme qu'il respecterait l'engagement conclu lors de la signature du Protocole de Kyoto, soit de ramener les gaz \u00e0 effet de serre \u00e0 leur niveau de 1990 et de les r\u00e9duire depuis ce plafond. Nous ne sommes pas en pr\u00e9sence d'un gouvernement vert \u2014 nous le savons. Nous sommes en pr\u00e9sence d'un des gouvernements les plus irresponsables en mati\u00e8re d'environnement, et le d\u00e9put\u00e9 de <a data-HoCid=\"78641\" href=\"/politicians/bernard-bigras/\" title=\"Bernard Bigras\">Rosemont\u2014La Petite-Patrie</a> a eu l'occasion \u00e0 plusieurs reprises d'intervenir sur cette question. </p>\n<p data-HoCid=\"754433\" data-originallang=\"fr\">Nous souhaitions \u00e9galement que le gouvernement se rende \u00e0 l'analyse partag\u00e9e par plusieurs \u00e9l\u00e9ments importants de la soci\u00e9t\u00e9 civile et par nos concitoyens, soit qu'il faut mettre fin en 2009 \u00e0 la mission canadienne en Afghanistan. Du d\u00e9but de la mission jusqu'\u00e0 ce jour, nous d\u00e9plorons qu'il n'y ait pas eu un \u00e9quilibre satisfaisant s'agissant de l'aide au d\u00e9veloppement, de la coop\u00e9ration internationale et des objectifs militaires.</p>\n<p data-HoCid=\"754434\" data-originallang=\"fr\">Nous souhaitons \u00e9videmment qu'on se pr\u00e9occupe de toute la question de la foresterie et du secteur manufacturier. Nous savons combien ces secteurs sont mis \u00e0 rude \u00e9preuve. Nous souhaitons bien s\u00fbr qu'on se pr\u00e9occupe \u00e9galement de la gestion de l'offre, un dossier extr\u00eamement important dans les communaut\u00e9s rurales. De plus, nous souhaitons que le gouvernement \u00e9limine le pouvoir de d\u00e9penser lorsqu'il est question de sph\u00e8res de comp\u00e9tence provinciale. Il s'agit d'une revendication vieille de 50 ans, et ce ne sont certainement pas les subterfuges malhonn\u00eates du gouvernement qui donneront satisfaction au Bloc qu\u00e9b\u00e9cois.</p>\n<p data-HoCid=\"754435\" data-originallang=\"fr\">Cette introduction \u00e9tant faite, il faut maintenant parler du dossier de la justice. D'abord, quelle esp\u00e8ce d'op\u00e9ration de maquillage, quelle esp\u00e8ce de mise en sc\u00e8ne! Lors de la conf\u00e9rence de presse donn\u00e9e par le <a data-HoCid=\"105824\" href=\"/politicians/rob-nicholson/\" title=\"Rob Nicholson\">ministre de la Justice</a>, par son coll\u00e8gue le <a data-HoCid=\"78755\" href=\"/politicians/stockwell-day/\" title=\"Stockwell Day\">ministre de la S\u00e9curit\u00e9 publique</a> et par le <a data-HoCid=\"78745\" href=\"/politicians/jean-pierre-blackburn/\" title=\"Jean-Pierre Blackburn\">ministre de l\u2019Agence de d\u00e9veloppement \u00e9conomique du Canada pour les r\u00e9gions du Qu\u00e9bec</a>, on avait l'impression d'assister \u00e0 une pi\u00e8ce de Moli\u00e8re qui mettait en vedette Tartuffe. On nous donne \u00e0 penser que, depuis que les conservateurs ont pris le pouvoir en 2006, la Chambre des communes a fait l'objet d'obstruction en mati\u00e8re de justice. On donne \u00e9galement \u00e0 penser qu'on a emp\u00each\u00e9 le gouvernement de faire adopter son initiative en mati\u00e8re de justice. </p>\n<p data-HoCid=\"754436\" data-originallang=\"fr\">Pourtant, lorsqu'on regarde de plus pr\u00e8s, on se rend compte que depuis janvier 2006, le gouvernement conservateur a d\u00e9pos\u00e9 douze projets de loi en mati\u00e8re de justice. \u00c0 l'instant o\u00f9 l'on se parle, six de ces projets de loi ont re\u00e7u la sanction royale et sont donc devenus des lois. Or, parmi ces six projets de loi devenus lois, trois ont \u00e9t\u00e9 adopt\u00e9s gr\u00e2ce \u00e0 une proc\u00e9dure acc\u00e9l\u00e9r\u00e9e, dite <em>fast-track</em>, avec le consentement unanime de tous les leaders \u00e0 la Chambre des communes.</p>\n<p data-HoCid=\"754437\" data-originallang=\"fr\">Ainsi, sur douze projets de loi, six sont devenus lois, dont trois ont \u00e9t\u00e9 adopt\u00e9s avec le consentement de tous les partis gr\u00e2ce \u00e0 une proc\u00e9dure acc\u00e9l\u00e9r\u00e9e; quatre se sont rendus au S\u00e9nat en premi\u00e8re, en deuxi\u00e8me et en troisi\u00e8me lecture, tant et si bien qu'\u00e0 la Chambre et en comit\u00e9, il ne restait que deux projets de loi. On conviendra donc que, sur le plan de l'histoire du parlementarisme, on a d\u00e9j\u00e0 vu plus viril en mati\u00e8re d'obstruction. \u00c0 partir du moment o\u00f9 six projets de loi re\u00e7oivent la sanction royale, que quatre soient \u00e0 l'\u00e9tude au S\u00e9nat et qu'il n'en reste que deux, vous ne pouvez pas, en toute honn\u00eatet\u00e9, vous pr\u00e9senter \u00e0 une conf\u00e9rence de presse et dire que vous n'avez pas pu faire adopter vos projets de loi. </p>\n<p data-HoCid=\"754438\" data-originallang=\"fr\">\u00c0 l'intention de nos concitoyens, je rappelle quels projets de loi ont \u00e9t\u00e9 adopt\u00e9s.</p>\n<p data-HoCid=\"754439\" data-originallang=\"fr\">Il y a tout d'abord eu le projet de loi <a data-HoCid=\"2172003\" href=\"/bills/39-2/C-9/\" title=\"An Act to amend the Criminal Code (conditional sentence of imprisonment)\">C-9</a>, sur l'emprisonnement avec sursis. Il est vrai que nous y avons propos\u00e9 des amendements, et c'est notre travail de le faire. Nous sommes une opposition responsable. Quel est le r\u00f4le de l'opposition? C'est de s'assurer que les projets de loi sont sans cesse perfectibles et qu'ils sont am\u00e9lior\u00e9s. Nous serions compl\u00e8tement irresponsables de ne pas faire notre travail. En ce qui concerne le projet de loi sur l'emprisonnement avec sursis, le gouvernement voulait, en d\u00e9finitive, \u00e9liminer cette option pour la magistrature, et nous l'avons balis\u00e9.</p>\n<p data-HoCid=\"754440\" data-originallang=\"fr\">Le projet de loi <a data-HoCid=\"2222191\" href=\"/bills/39-2/C-17/\" title=\"An Act to amend the Judges Act and certain other Acts in relation to courts\">C-17</a>, qui traitait du salaire des juges, a \u00e9galement \u00e9t\u00e9 adopt\u00e9, suivi du projet de loi <a data-HoCid=\"2250003\" href=\"/bills/39-2/C-18/\" title=\"An Act to amend certain Acts in relation to DNA identification\">C-18</a>, un projet de loi plut\u00f4t technique sur les banques d'empreintes g\u00e9n\u00e9tiques. De plus, en hommage \u00e0 notre coll\u00e8gue malheureusement d\u00e9c\u00e9d\u00e9, le projet de loi <a data-HoCid=\"2277339\" href=\"/bills/39-2/C-19/\" title=\"An Act to amend the Criminal Code (street racing) and to make a consequential amendment to the Corrections and Conditional Release Act\">C-19</a>, qui cr\u00e9e une nouvelle infraction au regard du Code criminel \u00e0 propos des courses de voitures sur la voie publique, a \u00e9t\u00e9 adopt\u00e9 \u00e0 l'unanimit\u00e9.</p>\n<p data-HoCid=\"754441\" data-originallang=\"fr\">Deux autres projets de loi ont \u00e9t\u00e9 adopt\u00e9s en 48 heures, ce qui est un signe de collaboration entre les partis d'opposition. L'un d'entre eux avait \u00e9t\u00e9 pr\u00e9sent\u00e9 par le Bloc qu\u00e9b\u00e9cois, \u00e9tant donn\u00e9 le ph\u00e9nom\u00e8ne de piratage et l'utilisation non autoris\u00e9e de cam\u00e9scopes pour enregistrer des films dans les salles de cin\u00e9ma, particuli\u00e8rement \u00e0 Montr\u00e9al. L'autre projet de loi concerne la criminalit\u00e9, \u00e0 la suite de la signature d'une convention internationale par le Canada.</p>\n<p data-HoCid=\"754442\" data-originallang=\"fr\">Quatre autres projets de loi \u00e9taient devant le S\u00e9nat, bien que je doive plut\u00f4t dire \u00ab l'autre Chambre \u00bb. Il s'agissait tout d'abord du projet de loi <a data-HoCid=\"2172019\" href=\"/bills/39-2/C-10/\" title=\"An Act to amend the Criminal Code (minimum penalties for offences involving firearms) and to make a consequential amendment to another Act\">C-10</a>, \u00e0 propos des peines minimales pour les infractions mettant en jeu des armes \u00e0 feu.</p>\n<p data-HoCid=\"754443\" data-originallang=\"fr\">Il y avait ensuite le projet de loi <a data-HoCid=\"2304794\" href=\"/bills/39-2/C-22/\" title=\"An Act to amend the Criminal Code (age of protection) and to make consequential amendments to the Criminal Records Act\">C-22</a>, qui traitait de l'\u00e2ge de protection dans le Code criminel. Certains de mes coll\u00e8gues ont suivi ce dossier avec beaucoup d'int\u00e9r\u00eat. Le Bloc qu\u00e9b\u00e9cois avait demand\u00e9 une clause de proximit\u00e9 de cinq ans. Ce projet de loi \u00e9tait devant le S\u00e9nat. Nous avions un parti pris relativement favorable, malgr\u00e9 certaines interrogations. Ce projet de loi avait \u00e9t\u00e9 amend\u00e9 en comit\u00e9.</p>\n<p data-HoCid=\"754444\" data-originallang=\"fr\">Puis il y a eu le projet de loi <a data-HoCid=\"2304866\" href=\"/bills/39-2/C-23/\" title=\"An Act to amend the Criminal Code (criminal procedure, language of the accused, sentencing and other amendments)\">C-23</a>, plut\u00f4t technique, sur la langue des jurys.</p>\n<p data-HoCid=\"754445\" data-originallang=\"fr\">Je n'oublie pas de dire, monsieur le Pr\u00e9sident, que je partage le temps qui m'est imparti avec le sympathique et s\u00e9duisant d\u00e9put\u00e9 de <a data-HoCid=\"78644\" href=\"/politicians/serge-cardin/\" title=\"Serge Cardin\">Sherbrooke</a>.</p>\n<p data-HoCid=\"754446\" data-originallang=\"fr\">Enfin, le projet de loi <a data-HoCid=\"2519653\" href=\"/bills/39-2/C-35/\" title=\"An Act to amend the Criminal Code (reverse onus in bail hearings for firearm-related offences)\">C-35</a>, qui concerne le renversement du fardeau de la preuve, a aussi \u00e9t\u00e9 adopt\u00e9. Certains journalistes \u00e0 la t\u00e9l\u00e9vision ont d\u00e9crit ce projet de loi comme \u00e9tant le renversement du fardeau de la preuve en mati\u00e8re de lib\u00e9rations conditionnelles. Toutefois, ce projet de loi ne concerne pas les lib\u00e9rations conditionnelles, mais bien l'\u00e9tape de la comparution avant proc\u00e8s lors de laquelle on veut \u00eatre remis en libert\u00e9.</p>\n<p data-HoCid=\"754447\" data-originallang=\"fr\">On comprend qu'il restait deux projets de loi, au sujet desquels nous avions et nous avons toujours des amendements \u00e0 proposer et des questions \u00e0 poser.</p>\n<p data-HoCid=\"754448\" data-originallang=\"fr\">Le premier projet de loi concerne la conduite avec les facult\u00e9s affaiblies par la drogue. Nous sommes favorables \u00e0 la nouvelle disposition du projet de loi qui veut permettre de soumettre des individus \u00e0 des tests de sobri\u00e9t\u00e9. Ainsi, les agents de la paix et les policiers pourront intercepter sur la route les individus \u00e0 la conduite erratique ayant les facult\u00e9s affaiblies par la drogue. Qu'on s'imagine \u00eatre avec un ami \u00e0 bord d'une voiture dont on est propri\u00e9taire. On roule sur la voie \u2014 prenons l'exemple de la transcanadienne, pour faire plaisir \u00e0 certains de mes coll\u00e8gues \u2014 et on apprend que l'ami qui conduit a de la marijuana dans ses poches ou dans ses bagages. Si l'on avait vot\u00e9 le projet de loi, le propri\u00e9taire de la voiture en aurait lui-m\u00eame \u00e9t\u00e9 tenu responsable.
