It's a real pleasure to be with you today to discuss my private member's bill, Bill <a data-HoCid=\"13596532\" href=\"/bills/45-1/C-244/\" title=\"An Act to amend the Canadian Environmental Protection Act, 1999 and the Wrecked, Abandoned or Hazardous Vessels Act\">C-244</a>, the clean coasts act.</p>\n<p data-HoCid=\"9458451\" data-originallang=\"en\">I see some familiar faces, including from the fisheries and oceans committee. I see Mr. Arnold.</p>\n<p data-HoCid=\"9458452\" data-originallang=\"en\"> These issues we're going to be talking about today are issues felt by many coastal communities, including my own in the riding of West Vancouver\u2014Sunshine Coast\u2014Sea to Sky Country, where we know the marine environment is inseparable from our communities, our local economies and our way of life.</p>\n<p data-HoCid=\"9458453\" data-originallang=\"en\">Over the years, I've heard consistently from local governments, first nations, harbour authorities, commercial operators, search and rescue personnel, the Coast Guard and, particularly, residents about the growing challenges posed by abandoned vessels and marine pollution. The <a data-HoCid=\"13596532\" href=\"/bills/45-1/C-244/\" title=\"An Act to amend the Canadian Environmental Protection Act, 1999 and the Wrecked, Abandoned or Hazardous Vessels Act\">clean coasts act</a> would respond to this by addressing two specific gaps in federal legislation that coastal communities continue to encounter in dealing with these long-standing frustrations.</p>\n<p data-HoCid=\"9458454\" data-originallang=\"en\">The first relates to abandoned vessels. In 2019, Parliament adopted the Wrecked, Abandoned or Hazardous Vessels Act. In so doing, it established new protections, making it illegal, for the first time, to abandon a vessel. Crazily, you could actually abandon a vessel before that without committing an offence.</p>\n<p data-HoCid=\"9458455\" data-originallang=\"en\">Experience has shown that since then, vessel owners have found ways to avoid their responsibilities under the act. Rather than properly disposing of vessels at the end of their useful life, I've encountered countless examples of unscrupulous boat owners transferring them, usually for nominal amounts, to individuals who lack the means, capacity or intent to operate, maintain or dispose of them responsibly. These are oftentimes vulnerable individuals who are simply looking for a roof over their heads.</p>\n<p data-HoCid=\"9458456\" data-originallang=\"en\">In many cases, these vessels continue to deteriorate, creating risks to human safety, navigation and the marine environment. I've seen examples of loss of life, even in my own riding, when these vessels sink. There are many cases of communities and taxpayers bearing the cost of cleaning up toxic waste and other pollutants that come out of these vessels when they sink. At major expense, the taxpayer then pays to clean those vessels up off the bottom of the ocean.</p>\n<p data-HoCid=\"9458457\" data-originallang=\"en\">The <a data-HoCid=\"13596532\" href=\"/bills/45-1/C-244/\" title=\"An Act to amend the Canadian Environmental Protection Act, 1999 and the Wrecked, Abandoned or Hazardous Vessels Act\">clean coasts act</a> seeks to close this loophole by strengthening accountability at the point of transfer. It would prohibit vessel owners from transferring ownership when they know or are reckless as to whether the recipient lacks the ability, resources or intent to prevent the vessel from becoming wrecked, abandoned or hazardous. One way of doing this is by creating a system whereby the boat seller will disclose the condition of the boat before selling it, and the boat purchaser will disclose how they intend to maintain and operate it. This would build on the existing system we have for vessel registration. This proposal complements the recent improvements that were made to that very system by Transport Canada and the pleasure craft licence system to strengthen ownership records and vessel traceability. Together, these measures will help improve accountability throughout the life cycle of the vessel.</p>\n<p data-HoCid=\"9458458\" data-originallang=\"en\">The second issue in the bill relates to marine pollution. At its core, it's guided by the principle that Canada's marine environment should not become a dumping ground, and coastal communities should not be bearing the costs of pollution caused by others. We see the impacts of deteriorating marine infrastructure when it breaks apart and enters marine ecosystems. We see them when aging docks and other structures release debris into our waterways. Most visibly, we see them when oil and other pollutants are released into the marine environment.</p>\n<p data-HoCid=\"9458459\" data-originallang=\"en\"> A well-known example occurred in English Bay in 2015, when a bunker oil fuel spill caused significant environmental and economic damage. Despite the consequences, establishing the liability proved very challenging, because the existing provisions focus heavily on proving intent. The court found that there was a <em>mens rea</em> requirement involved in that, so the proposed amendment to the Canadian Environmental Protection Act seeks to clarify marine dumping provisions so that accountability doesn't depend solely on proving that intent to pollute when harmful substances are entering the marine environment. It would allow someone who is spilling to still establish due diligence and that they took all reasonable measures.</p>\n<p data-HoCid=\"9458460\" data-originallang=\"en\">In closing, Bill <a data-HoCid=\"13596532\" href=\"/bills/45-1/C-244/\" title=\"An Act to amend the Canadian Environmental Protection Act, 1999 and the Wrecked, Abandoned or Hazardous Vessels Act\">C-244</a>, the clean coasts act, is not a complete solution. Preventing abandonment and strengthening accountability are important steps, but they must be accompanied by other practical measures that support responsible vessel disposal, recycling and cleanup efforts. For that, the long-awaited vessel remediation fund is needed.</p>\n<p data-HoCid=\"9458461\" data-originallang=\"en\"> This is a practical and targeted bill. It builds on existing federal legislation, addresses gaps that have emerged through experience and focuses on preventing environmental harm before communities are left to deal with the consequences when they are much more expensive.</p>\n<p data-HoCid=\"9458462\" data-originallang=\"en\">With that, I look forward to the committee's study and would be pleased to answer any questions that members have.</p>\n<p data-HoCid=\"9458463\" data-originallang=\"en\"> Thank you.</p>",

Arnold est l\u00e0.</p>\n<p data-HoCid=\"9458452\" data-originallang=\"en\"> Les enjeux dont nous allons parler aujourd'hui sont des enjeux auxquels sont confront\u00e9es de nombreuses collectivit\u00e9s c\u00f4ti\u00e8res, dont la mienne, dans la circonscription de West Vancouver\u2014Sunshine Coast\u2014Sea to Sky Country, o\u00f9 l'on sait que le milieu marin est indissociable de nos collectivit\u00e9s, de nos \u00e9conomies locales et de notre mode de vie.</p>\n<p data-HoCid=\"9458453\" data-originallang=\"en\">Au fil des ans, j'ai r\u00e9guli\u00e8rement entendu des administrations locales, des Premi\u00e8res Nations, des administrations portuaires, des exploitants commerciaux, du personnel de recherche et de sauvetage, des membres de la Garde c\u00f4ti\u00e8re et, notamment, des riverains \u00e9voquer les probl\u00e8mes croissants que posent les navires abandonn\u00e9s et la pollution marine. La <a data-HoCid=\"13596532\" href=\"/bills/45-1/C-244/\" title=\"An Act to amend the Canadian Environmental Protection Act, 1999 and the Wrecked, Abandoned or Hazardous Vessels Act\">loi sur la lutte contre la pollution des c\u00f4tes</a> y apporterait une r\u00e9ponse en comblant deux lacunes pr\u00e9cises dans les lois f\u00e9d\u00e9rales auxquelles les collectivit\u00e9s c\u00f4ti\u00e8res continuent d'\u00eatre confront\u00e9es quand elles tentent de rem\u00e9dier \u00e0 ces frustrations de longue date.</p>\n<p data-HoCid=\"9458454\" data-originallang=\"en\">La premi\u00e8re concerne les navires abandonn\u00e9s. En 2019, le Parlement a adopt\u00e9 la Loi sur les \u00e9paves et les b\u00e2timents abandonn\u00e9s ou dangereux. Ce faisant, il a pris de nouvelles mesures de protection en rendant ill\u00e9gal, pour la premi\u00e8re fois, l'abandon d'un bateau. C'est fou, mais il \u00e9tait en effet possible auparavant d'abandonner un bateau sans que ce soit une infraction.</p>\n<p data-HoCid=\"9458455\" data-originallang=\"en\">L'exp\u00e9rience a montr\u00e9 que, depuis, les propri\u00e9taires de bateaux ont trouv\u00e9 des moyens de se soustraire aux responsabilit\u00e9s que leur impose cette loi. J'ai pu constater que, au lieu de se d\u00e9barrasser correctement de leurs bateaux en fin de vie utile, beaucoup de propri\u00e9taires peu scrupuleux les c\u00e8dent, g\u00e9n\u00e9ralement pour des sommes symboliques, \u00e0 des personnes qui n'ont ni les moyens, ni la capacit\u00e9, ni l'intention de les exploiter, de les entretenir ou de s'en d\u00e9barrasser de mani\u00e8re responsable. Ce sont souvent des personnes vuln\u00e9rables qui cherchent simplement un toit pour vivre.</p>\n<p data-HoCid=\"9458456\" data-originallang=\"en\">Beaucoup de ces bateaux continuent de se d\u00e9t\u00e9riorer, et cela entra\u00eene des risques pour la s\u00e9curit\u00e9 des personnes, la navigation, et l'environnement marin. Dans ma propre circonscription, des bateaux ont coul\u00e9, entra\u00eenant des pertes humaines. Tr\u00e8s souvent, ce sont les collectivit\u00e9s locales et les contribuables qui doivent assumer le co\u00fbt du nettoyage des d\u00e9chets toxiques et autres polluants qui s'\u00e9chappent de ces bateaux coul\u00e9s. C'est ensuite le contribuable qui, \u00e0 grands frais, finance le rep\u00eachage de ces bateaux au fond de l'oc\u00e9an.</p>\n<p data-HoCid=\"9458457\" data-originallang=\"en\">La <a data-HoCid=\"13596532\" href=\"/bills/45-1/C-244/\" title=\"An Act to amend the Canadian Environmental Protection Act, 1999 and the Wrecked, Abandoned or Hazardous Vessels Act\">Loi sur la lutte contre la pollution des c\u00f4tes</a> vise \u00e0 combler cette lacune en renfor\u00e7ant la responsabilit\u00e9 au moment de la cession. Elle interdirait aux propri\u00e9taires de bateaux d'en c\u00e9der la propri\u00e9t\u00e9 quand ils savent ou ne se pr\u00e9occupent pas de v\u00e9rifier que le receveur n'a pas la capacit\u00e9, les ressources ou l'intention d'emp\u00eacher que le bateau coule, soit abandonn\u00e9 ou devienne dangereux. Pour ce faire, on pourrait notamment mettre en place un syst\u00e8me selon lequel le vendeur divulguerait l'\u00e9tat du bateau avant la vente, et l'acheteur indiquerait comment il compte l'entretenir et l'exploiter. Ce syst\u00e8me s'appuierait sur le syst\u00e8me actuel d'immatriculation des bateaux. Cette proposition vient compl\u00e9ter les r\u00e9centes am\u00e9liorations apport\u00e9es \u00e0 ce m\u00eame syst\u00e8me par Transports Canada, ainsi qu'au syst\u00e8me de permis pour les bateaux de plaisance, afin de renforcer les registres de propri\u00e9t\u00e9 et la tra\u00e7abilit\u00e9 des bateaux. Ensemble, ces mesures contribueront \u00e0 am\u00e9liorer la responsabilit\u00e9 tout au long du cycle de vie du bateau.</p>\n<p data-HoCid=\"9458458\" data-originallang=\"en\">Le deuxi\u00e8me volet du projet de loi concerne la pollution marine. Le principe essentiel en est que l'environnement marin du Canada ne doit pas devenir une d\u00e9charge et que les collectivit\u00e9s c\u00f4ti\u00e8res n'ont pas \u00e0 assumer les co\u00fbts de la pollution caus\u00e9e par d'autres. On voit bien les cons\u00e9quences de la d\u00e9t\u00e9rioration des infrastructures maritimes quand celles\u2011ci se d\u00e9sagr\u00e8gent et p\u00e9n\u00e8trent dans les \u00e9cosyst\u00e8mes marins. On les voit aussi quand des quais v\u00e9tustes et d'autres structures lib\u00e8rent des d\u00e9bris dans nos voies navigables. Et on les voit surtout quand du p\u00e9trole et d'autres polluants sont lib\u00e9r\u00e9s dans les milieux marins.</p>\n<p data-HoCid=\"9458459\" data-originallang=\"en\"> On se rappellera ce qui s'est produit dans la Baie des Anglais en 2015, quand du p\u00e9trole \u00e9chapp\u00e9 d'une soute de navire a caus\u00e9 d'importants dommages environnementaux et \u00e9conomiques. Malgr\u00e9 ces cons\u00e9quences, il a \u00e9t\u00e9 tr\u00e8s difficile d'en attribuer la responsabilit\u00e9, parce que les dispositions en vigueur mettent beaucoup l'accent sur la preuve de l'intention. Le tribunal a estim\u00e9 qu'il y fallait une <em> \u00ab mens rea \u00bb</em> \u2014 intention criminelle \u2014. C'est pourquoi l'amendement propos\u00e9 \u00e0 la Loi canadienne sur la protection de l'environnement vise \u00e0 clarifier les dispositions relatives aux rejets en mer, pour que la responsabilit\u00e9 ne repose pas uniquement sur la preuve de l'intention de polluer quand des substances nocives p\u00e9n\u00e8trent dans les milieux marins. Cela permettrait aussi \u00e0 la personne responsable du d\u00e9versement de d\u00e9montrer qu'elle a fait preuve de diligence raisonnable et qu'elle a pris toutes les mesures raisonnables.</p>\n<p data-HoCid=\"9458460\" data-originallang=\"en\">En conclusion, le projet de loi <a data-HoCid=\"13596532\" href=\"/bills/45-1/C-244/\" title=\"An Act to amend the Canadian Environmental Protection Act, 1999 and the Wrecked, Abandoned or Hazardous Vessels Act\">C-244</a> ou loi sur la lutte contre la pollution des c\u00f4tes, n'est pas une solution compl\u00e8te. La pr\u00e9vention de l'abandon des navires et le renforcement de la responsabilit\u00e9 sont des mesures importantes, mais elles doivent s'accompagner d'autres mesures concr\u00e8tes visant \u00e0 soutenir les initiatives responsables de mise au rebut, de recyclage et de nettoyage des bateaux. Pour cela, on a absolument besoin du tr\u00e8s attendu fonds pour l'assainissement des b\u00e2timents.</p>\n<p data-HoCid=\"9458461\" data-originallang=\"en\"> Ce projet de loi est concret et cibl\u00e9. Il s'appuie sur des lois f\u00e9d\u00e9rales en vigueur, comble des lacunes r\u00e9v\u00e9l\u00e9es par l'exp\u00e9rience et met l'accent sur la pr\u00e9vention des dommages environnementaux avant que les collectivit\u00e9s ne se retrouvent contraintes d'en assumer les cons\u00e9quences, qui sont alors bien plus co\u00fbteuses.</p>\n<p data-HoCid=\"9458462\" data-originallang=\"en\">Sur ce, j'attends avec impatience les conclusions de l'\u00e9tude du Comit\u00e9 et je me ferai un plaisir de r\u00e9pondre \u00e0 toutes vos questions.</p>\n<p data-HoCid=\"9458463\" data-originallang=\"en\"> Merci.</p>"
